Sindh Local Government (Third Amendment) Act, 2023 (Sindh Act No. XLVI of 2023)

1. H) This Act may be called the Sindh Local Government (Third Short title and ,.\mendment) Act, 2023. commencement. (2) It shall come into force at once. 2. ln the Sindh Local GoVl:mment Act.. 2013, hereinafter Amendment of referred to as the said Act, in section 132, in sub-section (3), after section 131 ofSindh the word "Court". the words ..or Inspector" sh.ailbe inserted. 3. In the said Act. in section 133, in Sllb-section (!), in the table Amendment or under the Proviso, after Sr.No.6, the following shall be added:- section IJJ or Sindh Act No.XLIJ of 2013. "7, Metropolitan One (ea.ch) for Town Corporation Municipal Corpora6on .·... in its iurisdiction.'' .

4. In the said Acl. the existing provisions of section 136 shall be Amcndm<"nt of numbered as 13/\(l ). and there:ifter lhe following new sub-sections section 136 of Siodh s'riatt be :i.ddcd:- Act No.XLH of2013. "(2) The Inspectors appointed tinder section 133 may t,ike cognizance of offences specified in Pan-I tif Schedule-VJ and may impose penalty of fine not exct.>edingfifty thou-'amJ rupees. and in case of repeated offence by the same offender. the Tnspector shall file a case before the Court for a pena.lt;• not exceeding five hundred thousand rupees or imprisonment fora lennwhichmayextendto threeyearsor withboth. (3) Notwithstanding anylhlng contained in sec,-tioo260 of the Code of Criminal Procedure, 1898, lhe offences punishable under this Acl shall be tried by a Special Magistrate appointed under section 14-A of the Code in a summRt)' maru1eras provided in section 262 to 265 of the Code: Provided lhal sub-section (2) of $CC:lion262 of lhe Code shall not apply to the Irie.ls of offences under Uus Act.
