This Law ma�' be cited as the \\'ater Conntction Fee and Water Rate l.a\,. ln this La\\ - "Board"' means th(' Board fo� the 11me bei 1rn chan?ed w1th ihe responsibility for water suµpl� in the State� - .. domestic consumer .. mcam, a consumer of water for domestic purposes. '·oomcst1c purpose" means water supplied for drinking, washing. cooking and oiher sanitary purposes; "Head'" means the General :-S1anager or any other person for the time bcmg charged with thc responsibility of over seeing the Board: "'Governor .. means the Gove:no� of /\b12 State of):12ena '·no11-do111cs1ic purposes·• means any water from the-waterworks used for purpose of. or in carrying out trade, busmess, or manufacture, or for watering fields or gardens cultivated or occupied as a means of pecuniary profits, or for private fountains or for any ornamental purpose or fo, the suppl)' of ponds or tanks, or for laundries or public wash-houses or public baths, vessels, ships, boats or machinery; and includes the water used or consumed by any person resident in or occupying any premises where a non-domestic supply is given as well as any water taken or used for the water­ works for the use of any municipal or government establishment or department: 3. Schedule" means the Schedule to this Law which shall form pan of end be read and construed as one with this Law; '"State'· means Abia State of Nigeria. PART 2 - PROCEDURE FOR WATER CO�NECTJON AND FEES (I) Any person who wishes to have his premises connected to the public pipe-borne water supply scheme shall apply in writing 10 the nearest office ofihe Board. (2J The Board shall upon the receipt of such application survey the premises to the point where the c01mection shall be made and charge the applicant. (3) (4) (5) The applicant shall thereafter pay the survey and water connection fees as prescribed in the Schedule to the appropriate re\·cnue office of the Board and obta[n official receipts. The applicam shall thereafter presen1 the official receipt to the office of the Board responsible for water connection who shal! en sun.: that the applicant's premises is connected to the public pipe-borne water supply scheme with minimum dela). No applicant who is unable to present a receipt shall have his premises conne::ted to any public pipe-borne water supply scheme (6) In addition to paying the connection fee, the applicant shall supply all the finings required for the connection. PART 3. - WATER RJ\TES AND WATER RECOt\1''BCTlON 4. The Board shall charge water rates from every class of domestic, non-domestic or Local Government consumer as prescribed in the Schedule. 5. Every water consumer in the State shall pay within two weeks all water rates as sent 10 him by the Board. 7. Any consumer who fails lo pay his water rate as and when due shall without prior notice. have his water supply disconnected. 8. Every consumer whose water supply is disconnected shall pay a reconnection fee as prescribed in the Schedule before his water supply is reconnected. ln addition he shall supply the fittings and materials required for the reconnection. !I. Without prejudice to the gencralit) of the foregoing, wherever any water meter breaks down or is malfunctioning and is unable to record the \'Olume or !he correct volume of water consumed by any industrial, commercial and other non-domestic establishments, until such water meter is repaired, the consumer shall pay water rate equal to the volume of water recorded in the month prior 10 the break ciown or malfunctioning of the meter. l 0. The Board shall carry out regular and periodic inspection and sup7v1sion of watc� and water related prnjects and charge fees accordingly. 11. The Board shall on the request of individuals or organizations render water services and charge fees. 12. The Board shall on the receipt of ., request for the development of new water supply scheme chanre de,·elooment commitment fee as prescribed in the Schedule. - 13. The Board shall grant permit to qualified applicants to construct boreholes and shall charge fees as presciibed in the Schedule. 14. (I) An) person who connects water 10 his premises in any manner other than as prescribed under this Law shall be guilty of an offence and liable on conviction to a fine no! exceeding =N=I ,000 or three months imprisonment or to Abia Sw,e Water Co1111ectio11 Fee and Water Rate Law !CAI'. 43 705 both such fine and imprisonment L, addition, !he illegal water connection shall be disconnected at his own cost. (2) Any person who constructs borehole wi1holll the necessary permit shall be guilty of an offence and liable on conviction to a fine of =N==20,000.00 or to five years imprisonment or to both such fine and imprisonment. (3) Any person who fails, refuses or neglects to pay his water rate or any other fees payable by him under this Law shall in addition 10 .having his water supply disconnected without prior notice be guilty of an offence and shall on conviction be liable to six months imprisonment or to a fine 11ot exceeding 50% of the amount payable by him under 1he Principal Law or to both such line and imprisonment. Further the offender shall be ordered 10 pay forthwith the sum owed by him. (4) \\"here the offender under subsection (3J above is a corporate bod� or limited liabilit� company, organization or .firm such corporate body or limited liabilil) company. organiza11on or fim1 shall have its water supply disconnected without prior notice ancl 1he said corporate bodv or limited liabilit) compan). m1s1ec in case of an organization, principal panne� in case of a firm shall be guilty of an offence and shall on con\'iction be liable to a fine not exceeding twemy thousand naira. (5) Where the offender under subsection (3) above is a Government ins1i1u1ion or es1ablishmcm, such offender shall have its water supply disconnected without prior notice and shall have it reconnected on the payment of the sum due and after it has fully complied with !he provisions of section 8 of this I ,aw� "(6) In any prosecution or proceedings under this Law, the facts that the offender has before conviction paid the sum for which he is charged may serve as a mitigating factor.
