LF . 2004 and all other power enabling it in that behalf, the onrnin~ ouncil, ~ith the appro al of the Minister, makes the following egulation. - p RT 1 -APPLICATION AND 0BJl:.CTIVE ment ]. The Regulations provide regulatory framework for the labelling of Objective animal feed additives manufactured, imported, exported, advertised, sold, di tributed, and used in Nigeria. 2. These Regulations shall apply to the labelling of animal feed additives Application manufactured. imported, exported, advertised, sold, distributed, and used in 'igeria. PART II - LABELLING INFORMATION DETAILS 3.-( I) Information required to be indicated on the label of an animal Labelling feed additive shall be prominent, legible and distinct. information (2) Information on label shall appear in font size and style type, which are legible for clarity and on sufficient contrasting background without obscuring designs vignettes and crowding within written, printed or graphic matter. (3) The most prominent letters on the label shall be the brand name and the name of the animaJ feed additive product and the net content. ( 4) The information shall be in English Language and may include any other language. (5) Labelling shall be informative and accurate. (6) Labelling shall not be false or misleading. (7) The infonnation and statement required by these Regulations shall appear on the part or panel of the label, which is presented or displayed under customary condition of purchase. (8) The label pace shall not be used to present infom1ation, tatement r graphic not required by these ReguJations in such a manner that ma make th label pac insuffici nt for the placing of such information or statem nt requir d und r th e ReguJations. B 'arne and address ol manuf acturc:r (9) Labels shall not be described by words, pictorials or other devices, which refer to or are suggestive, either directly or indirectly of any other product with which such animal feed additives might be confused, or in such a manner as to lead the purchaser or consumer to suppose that the animal feed additives is connected with or derived from such other product. ( I 0) An animal feed additives label shall include - (a) brand name, where applicable; ( b) product name and statement of identity; (c) lot or batch number; (d) net content; (e) manufacturing date; (f) Expiry Date or Best Before Date, where appliable; (g) manufacturer's name and location address including country of origin~ (h) registration number assigned to it in a manner as prescribed by the agency; (i) storage conditions; and (i) any other information as may be prescribed by the agency. ( 11) Label on animal feed additive shall not bear words, pictorial or other means, which refer to any other product or falsely suggest either directly or indirectly, that the animal feed additive is connected with other product. ( 12) Claims on the animal feed additive shall be substantiated through field trial. ( I 3) Animal feed additive having a shelf life not exceeding I 8 months. shall carry the date of minimum durability using words such as "keep until. ... ". ( 14) The words ''Not for human consumption" or a statement ubstnntially similar to it shall appear in a prominent position on the label. ( 15) The pictorial and physiological status of the target animal shall b specified on the product label. 4.-( 1) The name and address of the manufacturer, pack~r, distributor. importer or vendor of the Animal feed additive shall be declared on th product label. (2) The label of an animal feed additive shall be con picuous, indicating the name, manufacturing address of the manufacturer, and the name ot the Holder of Certificate of Registration. (3) Where an animal feed additive is manufactured und r contmct manufacturing agreement. the name and manufacturing location add re • ·hnll be indicated by the words that reveals the connection with the entity, such n "Manufactured by ... for .... "., • Manufactured for ..... by .... ". ( 4) The manufacturing address on the label of the Animal feed additive shall be complete on the Primary, Secondary and Tertiary packaging components. (5) Where an animal feed additive undergoes processing in a country, which changes its chemical or physical nature, the country in which the processing is perfonned shall be considered to be the country of origin for the purposes oflabeling. 5.-{ I) The primary, secondary and tertiary package of an animal feed additives shall bear the name and indicate the accurate nature of the animal feed additives. (2) Where a common name or statement of identity has been established for the animal feed additives, it shall be used in conjunction with the brand name of such animal feed additives. (3) Where no common name or statement of identity exists for an animal feed additives, an appropriate descriptive name shall be affixed to it. (4) Where a coined or fanciful name is used for the animal feed additives the name shall be accompanied with an appropriate descriptive tenn and not be misleading. B 989 Product Identity 6.-{ I) A complete list of ingredients used in preparing the animal feed List of additives product shall be declared on the label in decreasing order of ingredients prominence. (2) The declaration of the ingredients shall be prominent, readable and understood under nonnal conditions of purchase. 7.-{ I) The accurate net content of an animal feed additives shall be Net content declared on the label in the metric system. (2) The declaration of the net content of an animal feed additives shall be required to be made in the case of- (a) powder or solid animal feed additives other than those sold in tablet form by weight; (h) liquid animal feed additives in volume; ( c) semi-solid or viscous animal feed additives by weight or volume; and (d) animal feed additives sold in tablet fonn by weight, together\! ith the number of tablets in the package. (3) The declaration referred to in subregulation (2) of this regulation shall accurately reveal the quantity of animal feed additives in a package exclusive of bags and other material packed with it. ()) The date markings shall be used in combination with subrcgulations ( t) and (2) of this regulation and be introduced with the words "Date of Manufacture" and "Date of Expiry" as appropriate. (4) Where several items are included in an outer package which during nonnal usage by the consumer may be discarded, the date marking shall appear on the packaging that is retained by the consumer until consumption. (5) The date markings and batch number shall - (a) be indicated on the label of animal feed additive. (b) not be pre-printed on the label. 9. The required storage conditions shall be specified on the product label. 10.-(l) The brand name ofan animal feed additives shall be indicated on the label of the animal feed additives in a manner as not to give wrong impression of the nature and quality, or substance of the animal feed additives. (2) Where animal feed additives is rebranded, the rebranded name shall be indicated on the label and not in conflict with any Regulations or requirements prescribed by the Agency. 11. The direction for use of animal feed additives, including reconstitution, where applicable, shall be included on the label to ensure correct utilisation of the animal feed additives. 12. Animal feed additive shall be clearly labelled conspicuously with the fol lowing precautionary statements - (a) for animal use only; (b) keep out of reach of children. 13. The label of an animal feed additives shall not refer or lay claim to an endorsement directly or indirectly, to a professional body or association, except as prescribed by the Agency 14. A person shall not manufacture, import, export, distribute, advertise. display for sale, offer for sale, sell, or use in Nigeria any animal feed additive except in accordance with the provisions of these Regulations. 8 991 P-\Rl 111 - 01 H NCI S /\ND PFNAI IIES 15.--{ I) per-on ,, ho contravenes any of the provisions of these Offences and R g.ulat i n commit' an offence nnd is liable on conviction, in the case of- penalties (a) an indh idual, to imprisonment for a term not exceeding one year or to a fine note ceeding N800,000 or both; and ( /,) a bod} corporate. to a fine not exceeding NS.000,000. (2) Where an offence under these Regulations is committed by a body corporate. finn or any other association of individuals, every- (a) director. manager, secretary or other similar officer of the body corporate; ( h) partner or officer of the firm; ( c) trustee of the body concerned; (d) person concerned in the management of the affairs of the association; or (e) person who purports to act in a capacity referred to in paragraphs (a) to (d) of this regulation, is liable to be proceeded against and be punished for the offence and in the same manner as if the person committed the offence, unless the person proves that the act or omission constituting the offence took place without his knowledge, consent or connivance. 16.-( 1) A person convicted of an offence under these Regulations shall forfeit to the Federal Government - (a) asset or property constituting proceeds derived from or obtained, directly or indirectly, as a result of the offence; and ( b) any of the person's property or instrument used in any manner to commit or to facilitate the commission of the offence. (2) In this regulation, "proceeds" means any property derived or obtained, directly or indirectly, through the commission of the offence. PART JV - MtSCl:LLANEOUS 17. The Agency shaJI be responsible for the enforcement of these Regulations. J 8. In these Regulations- 'Address" means a place where the business of manufacture, sale, distribution, storage and display of Animal feed additive is carried out which incJudes the house number, plot number, street name, town or city, state, country; ''Agency" means National Agency for Food and Drug Administration and Control; Forfeiture after conviction Enforcement of these Regulations Interpretation B 992 Citation ·'Animal Feed Additive" means any intentionally added ingredient not normally consumed as feed by itself,\: hether or not it has nutritional alue, which affects the characteristics of feed or animal product ; "Batch number or lot numher" mean the number or a combination of numbers and letters specifically given to animal feed additive product" hich is linked to the manufacturing histof) of the product. "Expiry date'' mean an)' date after which product i not recommended for use; "Laber' means any tag, brand, mark pictorial or other dcscripti matter, written, printed, tencilled, marked, embos cd, impressed on, or attached to the packaging or the container of animal feed dditivc; "Labelling" means all labd • and other, rittcn, printed, or graphic matter (I) upon any article or an) ot its cont 1incr-. or\: rnpp r •. or (2) accompanying the animal feed additive; "Ma1111/acturi11g date'' mean an) date that the product i formulated, mixed or produced. 19.
