Food (Amendment) (No. 2) Regulations 2002

FOOD (AMENDMENT) (NO. 2) REGULATIONS 2002 PU(A) 125/2002 IN exercise of the powers conferred by section 34 of the Food Act 1983 [Act 281], the Minister makes the following regulations: 1. Citation. These regulations may be cited as the Food (Amendment) (No. 2) Regulations 2002. 2. Amendment of regulation 37. The Food Regulations 1985 [PU(A) 437/85], which in these Regulations are referred to as the "principal Regulations", are amended in subregulation 37(3) by inserting after the words "38," the words "38A,". 3. New regulation 38A. The principal Regulations are amended by inserting after regulation 38 the following regulation: " 38A. 3-monochloropropane-1,2-diol(3-MCPD). No person shall import, prepare or advertise for sale or sell any food specified in column (1) of the Fourteenth A Schedule which contains 3-monochloropropane-1,2-diol (3-MCPD) in a proportion greater than the maximum permitted proportion specified opposite that food in column (2) of the Schedule.". 4. New Fourteenth A Schedule. The principal Regulations are amended by inserting after the Fourteenth Schedule the following Schedule: " FOURTEENTH A SCHEDULE (Regulation 38A) MAXIMUM PERMITTED PROPORTION OF 3-MONOCHLOROPROPANE-1,2-DIOL (3-MCPD) IN SPECIFIED FOOD (1) (2) Food Maximum permitted proportion in food (mg/kg) All foods containing acid 0.02 hydrolysed vegetable protein (liquid foods) All foods containing acid 0.05 hydrolysed vegetable protein (solid foods) Acid hydrolysed vegetable 1.0 protein ".
