B 1975 B 1975 L.N. 310 of 2020 ENVIRONMENT PROTECTION ACT (CAP. 549) Waste Management (Packaging and Packaging Waste) (Amendment) Regulations, 2020 IN EXERCISE of the powers conferred by articles 54 and 55 of the Environment Protection Act, the Minister for the Environment, Climate Change and Planning, after consultation with the Environment and Resources Authority, has made the following regulations: Citation. S.L. 549.43. 1. The title of these regulations is the Waste Management (Packaging and Packaging Waste) (Amendment) Regulations, 2020 and these regulations shall be read and construed as one with the Waste Management (Packaging and Packaging Waste) Regulations, hereinafter referred to as "the principal regulations". Amends regulation 2 of the principal regulations. 2. In regulation 2 of the principal regulations, immediately after sub-regulation (5) there shall be added the following new sub regulation: L.N. 311 of 2020. "(6) The following shall be excluded from the scope of these regulations, to the extent that they are covered by the Beverage Containers Recycling Regulations, 2020: (a) beverages in beverage containers intended to be placed on the national market; and (b) any person importing, bottling, canning or otherwise filling beverages in beverage containers intended to be placed on the market within the territory of Malta, hereinafter referred to as a producer of beverages in beverage containers: L.N. 311 of 2020. Provided that this regulation does not exonerate such producers of beverages in beverage containers from the provisions of these Regulations with respect to other packaging or packaging material placed on the market other than the beverage containers referred to in the Beverage Containers Recycling Regulations, 2020: Provided further that regulations 4, 5, 6, 7, 11, 18 and Schedule 2 shall still apply.".
