PRODUCT SAFETY ACT (CAP. 427) Dangerous Substances and Preparations (Amendment) Regulations, 2009 IN exercise of the powers conferred by articles 38 to 40 of the Product Safety Act, the Minister of Finance, the Economy and Investment, on the advice of the Malta Standards Authority, has made the following regulations: Citation. S.L. 427.28 1. The title of these regulations is the Dangerous Substances and Preparations (Amendment) Regulations, 2009, and they shall be read and construed as one with the Dangerous Substances and Preparations Regulations, hereinafter referred to as "the principal regulations". Scope.2. These regulations implement the provisions of Article 56 of Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006. Amends regulation 6 of the principal regulations. 3. (1) In the first indent of regulation 6.2 of the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No. 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (2) In regulation 6.3 of the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". Amends regulation 13 of the principal regulations. 4. In the first indent of regulations 13.2.3 and 13.2.4 of the principal regulations, for the words "Annex I to Directive 67/548/ EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (1) In points (a) and (b) and the last paragraph starting with the words "Where they are not given" in the Second Schedule to the principal regulations, for the words "Annex I to Directive 67/548/ EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". Amends the Third Schedule to the principal regulations. 6. (1) In points (a) and (b) of the Introduction of the Third Schedule to the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (2) In the following points of Part A, section (a) Aquatic environment, of the Third Schedule to the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures": point 1.1 (a) and (b); point 2.1 (a) and (b); point 3.1 (a) and (b); point 4.1 (a) and (b); point 5.1 (a) and (b); point 6.1 (a) and (b). (3) In points 1.1 (a) and (b) of Part A, section (b) Non-aquatic B 3072 environment, of the Third Schedule to the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". Amends the Fifth Schedule to the principal regulations. 7. (1) In points 3 and 4 of section A of the Fifth Schedule to the principal regulations, for the words "Annex I to Directive 67/ 548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (2) In point 9 of section B of the Fifth Schedule to the principal regulations, for the words "Annex I to Directive 67/548/ EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". Amends the Sixth Schedule to the principal regulations. 8. (1) In the third column of the table under point 2 of Part A of the Sixth Schedule to the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (2) In point 1, first paragraph, and in the first column of the table under point 3 of Part B of the Sixth Schedule to the principal regulations, for the words "Annex I to Directive 67/548/EEC" there shall be substituted the words by "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (3) In point 1, paragraph 3, first indent and paragraph 5 of Part B of the Sixth Schedule to the principal regulations, for the words "Annex I" there shall be substituted the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures". (4) In point 4.2, in the final paragraph of Part B of the Sixth Schedule to the principal regulations, for the words "Annex I to Directive 67/548/EEC (19th adaptation)" there shall be substituted B 3073 the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures".
