L.S. 423.32 1. It-titolu ta’ dawn ir-regolamenti hu r-Regolamenti tal-2012 li jemendaw ir-Regolamenti dwar it-Tħaffir ta’ Boreholes u x-Xogħol ta’ Tħaffir f’Żona ta’ Saturazzjoni, u dawn ir-regolamenti għandhom jinqraw u jiftiehmu ħaġa waħda mar-Regolamenti dwar it-Tħaffir ta’ Boreholes u x-Xogħol ta’ Tħaffir f’Żona ta’ Saturazzjoni, hawn iżjed ’il quddiem imsejħa "ir-regolamenti prinċipali". Jemenda r regolament 6 tar-regolamenti prinċipali. 2. Is-subregolament (2) tar-regolament 6 tar-regolamenti prinċipali għandu jiġi emendat kif ġej: (a) il-paragrafu (d) tiegħu għandu jiġi sostitwit bil paragrafu ġdid li ġej: "(d) kull seawell; u"; u (b) minnufih wara l-paragrafu (d) tiegħu għandu jiżdied dan il-paragrafu ġdid li ġej: A.L. 120 tal-1997. L.S. 423.12 "(e) kull borehole li tiġi mħaffra b’sostituzzjoni ta’ borehole li tkun ikkollassat b’mod irrevokabbli u li kienet ġiet debitament notifikata jew irreġistrata mal-Awtorità bħala sors tal-ilma ta’ taħt l art użat għal finijiet agrikoli taħt ir Regolamenti tal-1997 dwar ir Reġistrazzjoni ta’ Sorsi tal-Ilma ta’ taħt l Art jew taħt ir-Regolamenti dwar in Notifika ta’ Sorsi tal-Ilma ta’ taħt l-Art. Suppliment tal-Gazzetta tal-Gvern ta’ Malta Nru. 18,912, 8 ta’ April, 2012 Taqsima B B 1188 LN VERŻJONI ELETTRONIKA B 1188 L.S. 146.07 Dik il-borehole b’sostituzzjoni tal borehole ta’ qabel għandha tiġi mħaffra fl istess "żona ta’ referenza" (kif imfisser taħt ir-Regolamenti dwar Skema ta’ Ħlas Uniku) tal-borehole li tkun ikkollassat b’mod irrevokabbli: Iżda dik il-borehole għanda tiġi ċertifikata bħala li "ikkollassat b’mod irrevokabbli" permezz ta’ dikjarazzjoni iffirmata minn Perit u tiġi ddikjarata bħala li "ikkollassat b’mod irrevokabbli" permezz ta’ dikjarazzjoni taħt ġurament mill-utent tas-sors tal-ilma ta’ taħt l-art li tkun ikkollassat b’mod irrevokabbli.". B 1189 LN VERŻJONI ELETTRONIKA B 1189 L.N. 147 of 2012 MALTA RESOURCES AUTHORITY ACT (CAP. 423) Borehole Drilling and Excavation Works within the Saturated Zone (Amendment) Regulations, 2012 IN exercise of the powers conferred by article 28(1) of the Malta Resources Authority Act, the Minister for Resources and Rural Affairs, after consultation with the Malta Resources Authority, has made the following regulations: Citation. S.L. 423.32 1. The title of these regulations is the Borehole Drilling and Excavation Works within the Saturated Zone (Amendment) Regulations, 2012 and these regulations shall be read and construed as one with the Borehole Drilling and Excavation Works within the Saturated Zone Regulations, hereinafter referred to as "the principal regulations". Amends regulation 6 of the principal regulations. 2. Sub-regulation (2) of regulation 6 of the principal regulations shall be amended as follows: (a) paragraph (d) thereof shall be substituted by the following new paragraph: "any seawell; and"; and (b) immediately after paragraph (d) thereof, there shall be added the following new paragraph: L.N. 120 of 1997. S.L. 423.12 "(e) any borehole to be drilled in replacement of an irretrievably collapsed borehole which was duly notified or registered with the Authority as a groundwater source used for agricultural purposes under the Registration of Groundwater Sources Regulations, 1997, or under the Notification of Groundwater Sources Regulations. S.L. 146.07 Such replacement borehole is to be drilled within the same "reference parcel" (as defined under the Single Payment Scheme Regulations) as the irretrievably collapsed borehole: B 1190 LN VERŻJONI ELETTRONIKA B 1190 Provided that such borehole shall be certified to be "irretrievably collapsed" by means of a signed declaration of a Perit and be declared to be so "irretrievably collapsed" by means of a declaration under oath of the user of the irretrievably collapsed groundwater source.".
