B 3452 Ippubblikat mid-Dipartiment tal-Informazzjoni (doi.gov.mt) — Valletta — Published by the Department of Information (doi.gov.mt) — Valletta Mitbugħ fl-Istamperija tal-Gvern fuq karta riċiklata — Printed at the Government Printing Press on recycled paper Prezz/Price €0.09 B 3452 L.N. 325 of 2015 PESTICIDES CONTROL ACT (CAP. 430) Biocidal Products (Implementation of Regulation (EU) No 528/2012) (Amendment) Regulations, 2015 IN exercise of the powers conferred by articles 4 and 5 of the Pesticides Control Act, the Minister for Sustainable Development, the Environment and Climate Change, in consultation with the Parliamentary Secretary for Health, has made the following regulations: Citation, scope and commencement. 1. (1) The title of these regulations is the Biocidal Products (Implementation of Regulation (EU) No 528/2012) (Amendment) Regulations, 2015, and these regulations shall be read and constried as one with the Biocidal Products (Implementation of Regulation (EU) No 528/2012) Regulations, hereinafter referred to as "the principal regulations". (2) These regulations implement the provisions of Article 95 of Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market, and use, of biocidal products, hereinafter referred to as "Regulation (EU) No 528/2012". (3) These regulations shall apply as from the 1st of September 2015. Amends regulation 2 of the principal regulations. 2. In regulation 2 of the principal regulations, immediately afer the definition "DG" there shall be added the following new definition: " "supplier of the active substance or product" refers to the submitter of the dossier.". Amends regulation 5 of the principal regulations. 3. Immediately after paragraph (f) of sub-regulation (2) of regulation 5 of the principal regulations, there shall be added the following: "The applicant must moreover provide documented evidence that the supplier of the active substance or product is included in the latest version of the list referred to in Article 95 of Regulation (EU) No 528/2012, for the product type to which the product belongs.".
