THE FISHERIES AND AQUATIC RESOURCES ACT, No.2 01<' 1996 REGULAnONS made by the Minister of fisheries and Aquatic Resources Development under Section 61, read with sections 6, 28 and 29 of the Fisheries and Aquatic Resources Act, No. 2 of 1996. These regulations may be cited as Fishing Operations Regulations of 1996 and shall come into operation on the first day of December, 1996. 2. (a) No person shall catch, land, transport, sell, buy, receive or have in his possession any marine mammals or turtles. (b) The following fishing operations are hereby prohibited : (i) Push Net fishing operations; (ii) Harpooning for marine mammals; (iii) Moxi Net fishing operations; (iv) Gill Net or Trammel Net fishing operations on coral reefs or rocks. 3. No person shall engage in, or cause any other person to engage in, any fishing operation specified in Part I of the Schedule'hereto, in the sea, estuaries or coastal lagoons ofSri Lanka except under the authority of a licence issued under these regulations and otherwise than in accordance with the termsand conditions attached to such licence. 4. Every application for a licence referred to in Regulation 3 shall be substantially in Form "A" in Part 1Iof the Schedule hereto, and shall be sent by registered post to the Licensing Officerofthe Administrative District in which the relevant fishing operation is to be carried out, and shall be accompanied by the relevant licence fee specified in Part III of the Schedule hereto, Application shall be made by the owner of the boat (if such boat is used in the fishing operation) or by the owner of the fishing equipment, as the case may be. Where a Licensing Officer has not been appointed for any Administrative District, such application may be addressed to the Director of Fisheries and Aquatic Resources (hereinafterreferred to as "the Director"). 5. Every licence granted under these regulations shall be in Fonn "B" in Part II of the Schedule hereto and shall be in force for a period ofone year from the date of the licence unless it is cancelled earlier under Section 10 of the Fisheries and Aquatic Resources Act. 6. It shall be the duty ofevery licensee to surrender his licence immediately after its expiry or cancellation or when applying for renewal of such licence. otWO~ cr61 ~. A licence granted under these regulations may be renewed upon application made to the Licensing Officer or the Director as the case may be not less than 30 days before the expiry of the licence. Such application shall be substantially in Form "A" in Part II of the Schedule hereto and shall be accompanied by the fee for renewal of licence specified in Pan ill of the Schedule hereto. 8. A licence may be renewed by the issue of a licence on Form "B" in Part II of the Schedule hereto with an endorsement by the Licensing Officer or the Director as the case may be, that it is a renewal of licence. SCHEDULE [Regulation ?! Part I FISHING OPERATIONS REQUIRING LICENCE Prescribedfishing operation Interpretation I. Fishing operations carried out by Seine Nets including fishing operations carried out using beach seine "Madel" or Danish seine nets "Seine Net" means a net with or without a cod end (madrya) at the centre which covers a certain water mass and has two ropes tied at the two ends of the net which is pulled towards the land or into a vessel with the help of the ropes 2. Fishing operations carried out by Trawl Nets including those using nets without two wings but using vertical poles at the two free ends of the net "Trawl Net" means towing nets having a cone shaped body and a bag or cod end (madiya) connected to the apex with or without two wings connected to the other end. (These nets are towed in sea, lagoon or in other water bodies or in reservoirs by one or two craft for harvesting of fish) 3. Fishing operations carried out by surrounding net "Surrounding Net" means a net set in water covering all sides except the surface of the water 4. Fishing operations carried out by Trammel Nets "Trammel Net" means a net which is made out of three nets placed one avec the other the middle one having the smallest mesh net and the other two nets having relatively larger sized mesh 5. Fishing operations carried out by Gill Nets "Gill Net" means a net set at any depth, surface, midwater or at the bottom layers of water 6. Fishing operations carried out by Drift Gill Nets "Drift Gill Net" means a net set at the surface layers of water 7. Fishing operations carried out by Long Lines "Lpng Line" means a fishing gear having a main line and number of branch line, fixed at regular intervals, with each branch line having a hook with or without a bait. When a long line is allowed to float freely at the surface, mid-wateror close to the bottom, it is known as a Floating Long Line and when the line is anchored close to the bottom or at the bottom it is called the Bottom Long Line 8. Fishing operations carried out by Cast Nets "Cast net" means a cone shaped net, one end of which is kept free and the other end cast on to the surface of water 9. Fishing operations carried out by Fish Traps "C:.~; Trap" means device of various shapes made out of various materials into which fish enters through an opening and gets trapped 10. These regulations may be cited as the Inland Fisheries Management Regulations of 1996and shall come into operation on the rust day of December, 1996. 2. These regulations shallapply to and in relationto all parts of inland watersof Sri Lanka. 3. No personshall,exceptunder the authorityof a licence issuedby the Directoror by a litensing officer specially authorized in writing by theDirector in that behalf, use or operate any type of fishing gear other than a rod and line for the purpose of taking fish in anypart of the InlandWatersdescribed in the Schedule hereto. 4. A licence shall not be issuedunder these regulations for the followingtypesof fishing gearor boats: (i) Any net of meshsize 85 mm or below; (ii) Any surrounding or towingnet (suchas madel, purse seine, trawl net); (iii) Any tnurlJIlel net; (iv) Any net made of monofilament nettingmaterial, (v) Any mechanised boat. 5. Every licence issued under these regulations shall be valid for one year from the dale of issue. 8. Every licence may be renewed by the Director or the licensing officer as the case may be. for a further period of one year on payment of a renewal fee (a) of Rupees Fifty (Rs. 50.(0) in the case of a set of gill nets; (b) of Rupees Twenty-five (Rs. 25.(0) in the case of other fishing gear. 9. The Director may from time to time limit the number of licences that may be issued in any area forming part of inland waters brought under these regulations in respect of each type of fishing gear or suspend licences for a specified period having regard to the sustainability of the resources in any area or a particular water body. 10. A licence may be cancelled by the Director (i) where the licensee has contravened any of the provisions of the Fisheries and Aquatic Resrouces Act, No.2 of 1996 or any regulations made there under or any condition contained in such licence; or (ii) where the Director wishes to act under regulation 9 (in which case the licence fee shall be refunded). Notice of cancellation shall be sent by registered post to the last known address of the licensee. II. Where the Director or a licensing officer refuses to issue or renew a licence or cancels a licence under these Regulations such decision shall be communicated to the applicant by registered post. The applicant may appeal against such decision in writing to the Secretary within thirty days from the date of communication of the decision. The appeal shall set out the grounds upon which it is made. 12. The decision of the Secretary on any such appeal under regulation 11 shall be final and conclusive. 13. In these regulations, unless the context otherwise requires "Director" means the Director ofFisheries and Aquatic Resources; "Inland Waters" means any public river,lake, estuary, lagoon, stream. tank. pond, channel and any other public area of fresh or brackish water in Sri Lanka; "gill net" means a net set at any depth, surface, mid water or at the bottom layers of waters; "Secretary" means the Secretary to the Ministry of the Minister appointed under Article 44 of the Constitution to be in charge of the subject of Fisheries and Aquatic Resources Development; "set of gill nets" means a unit consisting of not more than six gill nets; "Surrounding net" means a net set in water covering all sides except the surface of the water. No person shall set up or operate an aquaculture enterprise except under the authority of a licence issued to him by the Director or any officer authorized by him. 4. An application for a licence under regulation 3 shall be in form A set out in Part II of the Schedule hereto. and shall be accompanied with (a) the licensing fee specified in Part I of the Schedule hereto; (b) copies of permits/approval obtained under any other applicable law; and (c) such particulars of the proposed enterprise as may be requested by the Director or the Licensing Officer. 5. Upon receipt ofan application under these regulations. the Director or the Licensing Officer may after making such inquiry as he may deem necessary. issue to the applicant a receipt in form General 172. The Director may having regard to interests of national economy and environment, limit the number of licences that may be issued in any area. 9 On receipt of an application for a licence the Director or the Licensing Officer may after such inquiry as bemay deem necessary, grant a licence for aquaculture enterprises in Category .. On receipt of an application for a hcence to set up or operate an aquatic enterprise of Category "B" 10 Part I of the Schedule hereto. the Director or the Licensing Officer may where necessary consult the Technical Committee within 30 days. and if the advice of theTechnical Committee is not in favour of the applicant, the advice should be conveyed to the applicant for his response. The Director may after considering the recommendations of the Technical Committee and the response of the applicant, either grant a licence within 60 days, if he is satisfied on the matter referred to in paragraphs (a). (b) and (c) of regulation 9 or, refuse to grant a licence and inform the applicant the reasons for refusal within 14 days of the receipt of the applicnat's response. II. On receipt of an apphcation for a hcence to set up or operate an aquaculture enterprise in Category "C" set out in Pan I of the Schedule hereto the Director may if he is satisfied on the matters referred to in paragraphs (a), (b) and (c) of regulation 9 refer the application to a Technical Committee appointed by the Director for evaluation and recommendation. The Technical Committee shall take not more than 30 days for the evaluation and report. If the report of the Technical Committee is not in favour of Ibe applicant. Ibe report shall be referred to the applicant for his response. The Director shall, after considering the report and the response of the applicant where necessary either grant a licence within 60 days. or, refuse to grant a licence and inform Ibeapplicant. wilb the reasons for refusal within 14daysofthe receipt of the report or Ibe applicant's response. 12. On receipt of an application for a licence to set up or operate an aquatic enterprise of Category "0" set out in Pan I of the Schedule hereto. the Director may. if he is satisfied on Ibe matter referred to in paragraphs (a). (b) and (c) of regulation 9. call for approval under the provisions of the National Environment Act. if applicable or, Environmental Impact Assessment Report. on terms of reference given by the Director. The Director may refer the said documents to a Technical Committee appointed by him for its report. The said Technical Committee shall make its repot to the Director within 30 days of the reference. 13. If the repon of the Technical Committee is not in favour of the applicant, the report should be referred to the applicant for his response. The Director may. after considering the recommendations of the Technical Committee and the response of the applicant. either grant a licence within 60 days. if he is satisfied on the matters referred to in paragraphs (a), (b) and (c) ofregulation 9 or. refuse to grant a licence and inform the applicant with the reasons for refusal within 14 days of the receipt of the report or the applicant's response. In the event of a change of the ownership of an enterprise. the new owner may apply for a renewal of the licence in his name. Such application shall be in Form "C" of Pan nofthe Schedule hereto and be accompanied with the relevant fee specified in Pan I of the Schedule hereto IS. Any application for renewal of the licence may be made to the Director or the Licensing Officer as the case may be. not less than 30 days prior to the expiry of the licence. in the manner referred to in regulation 14. 16. On receipt of an application for renewal of licence under regulation 14or 15. the Director or the Licensing Officer may either (a) renew the licence; or (b) refuse the renewal of licence if he has reason to believe that (i) the licensee has not observed the terms and conditions of the licence: or (ii) the continuation of the aquaculture enterprise could harm the environment; or (iii) the ownership of the enterprise is not sufficiently proved. Such decision shall be communicated to the applicant by registered post before the expiry of the current licence 17. Any licence issued to any person may be cancelled by the Director where (a) the licensee has contravened any of the provisions of the Fisheries and Aquatic Resources Act or the regulations or any conditions of the licence; (b) that the continuation of the enterprise would be harmful to the industry or, may cause any health hazard to the public; (c) that the continuation of the enterprise would harm the environment. Notice of such cancellation shall be sent by registered post to the licence holder. 18. Before issuing an Order for the suspension of the licence or cancellation to the holder of the licence, the licensee may be given an opportunity, except in the case of 17b and c above, to show cause why such order should not be issued. 19. The Director may issue specific directions to licence holders where he considers it necessary to do so under epizootic conditions. It shall be theduty of the licensee to give effect to such directions. 20. An applicant shall not be entitled to a refund or transfer of the licence fee for any reason whatsoever. 21. Any person who is aggrieved by any decision of the Director or a Licensing Officer under these regulations may appeal to the Secretary of the Ministry of the Minister in charge of the subject of Fisheries and Aquatic Resources, within 30 days from thedate of receiving such decision. The Secretary after making such inquiries as he may deem necessary either (a) allow the appeal and direct the Director or the Licensing Officer as the case may be. to grant, renew or revoke the suspension or cancellation of the licence; or (b) disallow the appeal and confirm such decision.
