THE AGRARIAN SERVICES ACT, No. 58 OF 1979 Regulations made by the Minister of Agricultural Development and Research under section 66 read with section 46 of the Agrarian Services Act, No. 58 of 1979. D· B. VhJETHUNGA, Minister of Agricultural Development and Research Colombo, 10th of March, 1988. REGULATIONS 1. These regulations may be cited as the Agrarian Services regulations, No.1 of 1988. 2. Every Agrarian Services Committee (hereinafter referred to as the " Committee "), may within its area of authority utilize the moneys of such Committee for the following purposes, subject to the prior written approval of the Commissioner of Agrarian Services: (a) publicity programmes for the promotion of agrarian service activities; (b) setting up of demonstration plots, nurseries or provision of other amenities in the pursuit of agrarian service activities, (c) provision of storage facilities; (d) granting of loans to eligible cultivators for their agricultural pursuits; (e) granting of loans or advances to any person who is an agent of the Committee to construct any building for the purpose of. storage of any agricultural commodity or inputs on such con­ ditions determined by the Committee; (f) payment of advances to employees of the Committee during any festival or any distress situation; (g) training of members, servants or agents of such Committee in agrarian service matters; (h) granting of scholarships to persons in the field of agrarian services to enable such persons to improve their capabilities to work for the improvement of agrarian services in tbearea ; IA 2 A I ~:::llJDc" : (I) Gr§~",-§ (30z:;)J 9~J::;))J::>i~z:;) CJeJ~DJ~ eSZi'l60G~ <t~ €lG(''1f1e C)1.c"D <::l~"'-1988.03.16 y>ART I: SEC. (I)-GAZE'J.'TE EXTRAORDINARY OF THE DEi\lOCHATIC SOCIALIST REPUBLIC OF SRI LANKA 1088.03:16 (i) making of donations for common causes relevant to the Department of Agrarian Services; (j) religious observances, rituals, customary practices and offerings relating to agrarian services; (Jc) development of agricultural roads and common threshing grounds: (I) for the purposes provided in section 55 (3) of the Act, wherever expenditure is incurred to prevent damage being caused on account of an omission of an established custom or rule relseing to irrigation or cultivation; (m) legal action as contemplated by the Committee or for such action as may be necessary in conducting its defence in legal matters preferred against the Committee. :3-713 = PRINTED AT. P.C'gulation The Agrarian Services Regulations, No. I of 1979 published in Gazeue Extraordinary No. 66/14 of December 14, 1979 are hereby "mended as follows : (a) By the insertion, immediately after Regulation 5 in Part I, of tho following Regulation ; 1'5A. Every Agrarian Services Com mit tee shall, in respect. of its area of authority, keep, maintain and from t imo to timo revise a register of tenant eult.i\·ator8.- The register shall be substantially in Form B set out. in the Schedule hereto" (b) In Regulation 8 (i) by the insert.ion, immediately after the words, "paddy land" iu paragraph (a) of the word. "in eaoh eultive tion officer's area" ; and (ii) by the addition of the following paragraph immediately after paragraph (d) ; "(e) The boundaries of oach lot of paddy land." ; (c) In Regulation ll. by the substitution, for paragraph (a), of the following paragraph; "(a) Tbe name, extent and boundaries of the land;" ; (d) By the repeal of Regulation 10 and the subst it.ut.ion therefor, of the following Regulation : (I) It shall be the duty of the Agrarian Services Committee to prepare the register of agriculturallancU in its area in accordance with the directions given by the Commissioner. . (2) The register of agricultural lands shell be certified by the Commissioner. (3) The Secretary of each Agrarian Services Committee :ha1l transmit the regi,ter of agricultural lands to the Commissioner with an endorsement that such register has been duly prepared. Every alteration in the register shall be countersigned by the Secretary. (4) The Commissioner shall send each ccpy of the register of agricultural lands certined by him to the Cultivation Officer in whose area of authority the lands are situated and the Secretary of the Agrarian Servie•• Committee." The remuneration payable to a yaya representative under section 42(10)(c) of the Act by each owner cultivator or occupier-: (i) in an area covered by .. tank shall be a sum equal to the' al ue of one bushel of pa dd y per acre per person; and (ii) in an area fed by an anicutshall bo a sum equal to tbe value of one bushel of paddy per acre. For the purposea of this Regulation the value of a bushel of paddy shall be the minimum price currently paid by Government therefor, Tho remuneration shall be paid within fifteen days of tho removal of the harvest", (m) By the substitution for Form.
