Statute on the State Agency for Hydrometereology under the Government of the Kyrgyz Republic

Approved by the Decree of the Government of the Kyrghyz Republic of 2 August 1996 #354 Statute on the State Agency for Hydrometereology under the Government of the Kyrghyz Republic 1.General Provisions 1. The State Agency under for Hydrometereology under the Government of the Kyrghyz Republic (hereinafter referred to as Kyrghyzhydromet) is a body of state administration and management in hydrometereology and observance of the level of environmental pollution. 2. Kyrghyzhydromet shall take guidance in its activities in the Constitution of the Kyrghyz Republic, laws of the Kyrghyz Republic, decrees and resolutions of the President of the Kyrghyz Republic, decrees of the Legislative Assembly and Assembly of People’s Representatives of Jogorku Kenesh of the Kyrghyz Republic, decrees and resolutions of the Government of the Kyrghyz Republic and this Statute. 3. Kyrghyzhydromet of the Kyrghyz Republic shall act directly and through its dependent directorates of hydrometereological observations, forecasts and submission of information about radioactivity and pollution of environment, oblast centers of hydrometereology, directorates of communication and information, glasiological and mud stream hydrographic crews, operation and production network organisations. 4. Kyrghyzhydromet of the Kyrghyz Republic shall be a legal entity with its round seal with the emblem of the Kyrghyz Republic and its name both in Kyrghyz and Russian II Objectives and Functions of Kyrghyzhydromet of the Kyrghyz Republic 5. The main objectives of Kyrghyzhydromet are as follows: a) to meet the requirements of various economic sectors in information on the current situation of environment and climate, on actual and expected variations of hydrometereological conditions and environmental situation and reasons of these variations to reduce pollution-type damages/externality, on extreme levels of environmental pollution; b) to develop further and increase the efficiency of hydrometereological assistance to the economy by introducing new and improving the existing methods of observance and forecasts. 6. The main functions of Kyrghyzhydromet shall be as follows: conduct systematic observation of metereological and hydrological, agrcometereological conditions, situation of the air, agricultural crops and pasture vegetation, pollution of surface water, soil, air including radioactive situation, ensure collection, analysis, integration of data; develop and improve the national system of hydrometereological observation including observation of environmental pollution; prepare weather forecasts, water content in rivers, advance notices about accidental metrological occurences and extreme high levels of environmental; pollution; render hydrometereological assistance to the state administration bodies, enterprises and organisations and population of the Republic, development of special (target) methods of hydrometereological assistance on commercial basis; keep the state data fund containing information about situation and pollution of environment, preparation for publishing of scientific and applied, climatologic, agroclimatologic, aerologic and other reference-books regarding the territory of the Republic; equip the national observation system for monitoring of the status and pollution of the environment with the current technical means of measurement, communication as well as material and technical procurement of subdivisions for their fulfillment of tasks; provide current technical level of unity and comparability of the results of measurement in the national system of observation of the situation of environment as provided by the provisions of standardization, rules and norms of metrology, carrying out of metrological control over the measurement means; take decisions on establishment and liquidation of hydrometereological stations and points, units of observation of the environmental pollution; carry out control and issue authorisations for establishment and liquidation of hydrometereological stations and points of the ministries and administrative bodies, submission of information, keep, record and disseminate materials about hydrometereological observations and data on the level of the environmental pollution, monitor the observance of applicable normative documents about the procedures of hydrometereological observation and operations and status of the environment; ensure long-term and short-term planning of activity of the Agency and implementation of plans of economic and social development; cooperate in hydrometereology within the framework of the World Metereological Organisation (WMO) and the Interstate Council on Hydrometereology of the CIS. III. Rights of Kyrghyzhydromet 7. Kyrghyzhydromet shall enjoy the rights: to present in the established order the interests of the Kyrghyz Republic in the World Metereological Organisation (WMO) and the Interstate Council on Hydrometereology of the CIS; to transfer to non-state enterprises, organisations hydrometeoinformation at prices fixed in price lists of Kyrghyzhydromet and at negotiated prices as well. Receipts coming for special services rendered and other receipts shall be deposited to the account of Kyrghyzhydromet; to receive from the state administration bodies, enterprises, organisations materials on hydrometereology, environmental pollution, active affects on hydrometereological and other geophysical processes, required for fulfillment of its specified tasks; to set up, reorganise and liquidate Kyrghyzhydromet- dependent subdivisions; to authorise the ministries, enterprises and organisations using hydrometeoinformation to transfer it to other users. IV. Organisation of Work of Kyrghyzhydromet 8. Kyrghyzhydromet of the Kyrghyz Republic shall be headed by the Director appointed or dismissed by the President of the Kyrghyz Republic in consultation with the Prime-Minister. The Director of Kyrghyzhydromet shall have a Deputy to be appointed and dismissed by the Prime-Minister of the Kyrghyz Republic with presentation made by the Director of Kyrghyzhydromet 9. The Director of Kyrghyzhydromet of the Kyrghyz Republic shall bear personal responsibility for fulfillment of tasks and obligations imposed on hydrometereological services within the framework of his rights and obligations, determine responsibility of the Deputy Director and heads of subdivisions of the Agency for management of separate directions of the activity, approve the structure of the central apparatus of Kyrghyzhydromet and salaries within the funds allocated for this purpose. 10.The Director of Kyrghyzhydromet shall: issue within its authority and according to the applicable legislation of the Kyrghyz Republic orders, instructions binding for the directorates, departments and network subdivisions; introduce changes in the structure of Kyrghyzhydromet if required, with the aim of applying advanced management forms within the pay-roll funds and approve regulations on directorates and departments of Kyrghyzhydromet; carry out the selection and arrangement of personnel, organise training and re training of specialists and refreshment courses; control the observance of labor discipline and ensure taking the measures on further improvement of labor conditions; appoint and dismiss the employees and heads of the network subdivisions. 11. For collective decision-making in issues of state management in hydrometereology and discussion of the most important issues on activity and development of the branch a Collegium consisting of five people including Director, his Deputies and heads of subdivisions shall be set up. Members of the Collegium shall be approved by the Prime-Minister of the Kyrghyz Republic with their presentation made by the Directorate of Kyrghyzhydromet under the Government of the Kyrghyz Republic. The issue on dismiss of the members of the Collegium shall be coordinated with the Prime-Minister in advance. Meetings of the Collegium shall take place when required but not less than once a quarter. Decisions of the Collegium shall be accepted by a majority and put into practice by orders of the Director of Kyrghyzhydromet. Decisions shall be put into force with the casting vote of the Chairman when votes subdivided equally. Members of Collegium not agreeable to this decision can inform the Government of the Kyrghyz Republic about their views. 12.A Scientific and Technical Council under Kyrghyzhydromet shall be set up for consideration of the most important issues in hydrometereology. The composition of the Council can include the representatives of organisations concerned. Decisions of Kyrghyzhydromet in hydrometereology and issues of observation of the environment shall be binding for all consumers and organisations regardless of their subordination.
