Governmental Resolution No. 522 “On measures for further development of fishery, strengthening of protection of fish resources and improvement of fishery management”

THE GOVERNMENT OF THE KYRGHYZ REPUBIJJC House of Gevernment, Bishkek RESOLUTION September, 12 1997, # 522 On measures for further development of fishery, strengthening of protection of fish resources and improvement of management in flshery Government of the Kyrghyz Republic notes that Water Fund, which exists in the Republic is being used insufficiently for the development offishery. Out of numerous lakes, reservoirs and ponds catch offish is being done only in the Issyk Kul and Son-Kul lakes, Kara-Suu, Toktogul, Orto-Tokoi, Kirov and Bazar-Korgon reservoirs. Pond water Fund of the Kyrghyz Republic has more than 1 thousand hectares and in present time is used insufficiently. Result reached in 1988 - production of 1000 tons offish had been decreased 22 times or 95.6 % and made up 44 tons, since 1994 delivery offish from ponds has nearly been stopped. As a result of irrational fishing and absence of activities aimed at reproduction of fish stock of fish had been significantly decreased, catch in the Issyk-Kul and Son-leu! lakes and other reservoirs is being reduced. Total catch reduced from 1342 tons in 1988 to 141 tons in 1996. During last five years in fish reservoirs no measurements on acclimatisation had been done; works on reproduction has been reduced. Measures taken now on artificial reproduction of fish resources are not sufficient and do not lead to reproduction of losses of fish amount in the Issyk-Kul lake and other reservoirs. In 1988 Ton fish plant used to produce 3317 thousand units of young trout, in t993 this amount was only 1317 thousand units, in 1996 it was 645 thousand. Production capacities of'Kara-Kol fish plant are out of order and can't be used for further operation. Catches are not being registered, cases of stealing of fish had been registered, poaching has become widely spread. All above mentioned facts became possible because JSC "Kyrghyzbalygy" (state and corporation "Kyrgnyzbalygy" owe only 12 % of shares) has actually monopolised fishery in state reservoirs and uncontrolled implements policy in this branch. Main activities of JSC "Kyrghyzbalygy" and its subdivisions are removal of natural fish resources without implementation of necessary measures for reproduction and multiplication of fish resources. At the same time J~C "Kyrghyzbalygy" is financed from Republican budget, but use received profit for their own needs. Ministry of Finance of the Kyrghyz Republic, Ministry of Environment of the Kyrghyz Republic and State Property Fund of the Kyrghyz Republic didn't implement appropriate control for activities ofthe JSC "Kyrghyzbalygy". Ministry of Environment of the Kyrghyz Republic nearly doesn't take measures for elimination of poaching. Government ofthe Kyrghyz Republic decrees: 1. To declare all reservoirs ofgeneral use to be reservoirs of state significance. 2. To consider Ministry of Agriculture and Water Resources to be the main user of fish reservoirs. 3. In order to fulfil unified policy in development and maintenance offishery, organisation of catch and reproduction of fish resources to establish Fishery Department under the Ministry of Agriculture and Water Resources of the Kyrghyz Republic. Main aim of the Department - further increase of fish production in reservoirs and natural reservoirs, increase of productivity of existing capacities and construction of new fish farms, improvement of quality and widening of assortment of fish products, protection offish resources. 4. To oblige Ministry of Environment of the Kyrghyz Republic to organise and exercise control for protection offish resources and regulate use of resources. 5. State Property Fund of the Kyrghyz Republic shall solve the problem oftransference of state Ton fish plant and Uzgen fish plant with all their employees, fixed assets, transport and other property to the Ministry of Agriculture and Water Resources of the Kyrghyz Republic. 6. Ministry of Agriculture and Water Resources of the Kyrghyz Republic shall : within one month time together with the Ministry of Finance of the Kyrghyz Republic work out and approve Regulations on Fishery Department, define its structure, staff and forms of financing within approved costs. Financing of additional expenses should be done from other than budget funds; study situation of pond fishery of the republic and within one month within one month and submit proposals on further use to the Government of the Kyrghyz Republic; together with National Academy of Science of the Kyrghyz Republic within two months time work out measures for further development of fishery in the Kyrghyz Republic and submit them for approval of the Government of the Kyrghyz Republic. 7. To establish State Inspection for fish supervision under the Ministry of Environment of the Kyrghyz Republic. 8, Ministry of Environment of the Kyrghyz Republic shall: within one month examine situation of organisation of protection of fish resources of the Issyk-Kul lake and other reservoirs; determine measures for elimination of poaching and strengthening of protection of fish resources; work out and approve together with the Ministry of Finance of the Kyrghyz Republic within one month Regulations on State Inspection for fish supervision under the Ministry of Environment of the Kyrghyz Republic; to define its structure, staff and forms of financing within approved costs. Financing of additional expenses should be done from other than budget funds; work out Regulations together with the National Academy of Science of the Kyrghyz Republic proposals for effective regulation of fishery activities on the Issyk-Kul, Son-Kul lakes, Toktogul and other reservoirs, which ensure optimum catch of fish without damage for reproduction offish resources. 9, To give the right to the Ministry ofEnvironment of the Kyrghyz Republic to agree with the National Academy of Science of the Kyrghyz Republic to determine limits for catches and to issue permissions for amateur fishing and fishing with scientific and research purposes. 10. Ministry of Finance of the Kyrghyz Republic in agreed order to include to coefficients' of economic and social development and State budget for 1997 and following years amendments, which an: based on given Resolution. 11.To add the following passage to the Plan of preparation of legislative acts of the Government of the Kyrghyz Republic for 1997, which approved by the Government of the KyrghyzRepublic of June, 9,1997 # 343: 12. To invalidate Resolution of the Government of the Kyrghyz Republic of June, 30, 1994 # 465 "On Republican fish production amalgamation Kyrghyzbalygy under the Government ofthe Kyrghyz Republic".
