3 22nd January, 2010 ( Legislative Supplement No. 2) LEGAL NOTICE No. 2 THE GOVERNMENT LANDS ACT (Cap. 280) IN EXERCISE of the powers conferred by section 148 of the Government Lands Act, the Mmister for Lands makes the following Rules: THE GOVERNMENT LANDS (FEES) (AMENDMENT) RULES, 2010 l. These Rules may be cited as the Government Lands (Fees) (Amendment) Rules, 2010. 2. The Government Lands (Fees) Rules, 1994 (in these Rules L.N 3071 1994 referred to as "the principal Rules") are amended by deleting rule 2 and suli~lituting ll11;:rdu1 the follvwing uew ruk "2. The following fees shall be levied under part X of the Act~ Pees KSh. (a) Fm every document presented for registration 500 (b) For every notice (excluding notice given on registration of a caveat) 500 (c) For acceptance of an affidavit under section 112 of the Act 500 (d) For correcting errors or supplying omissions in the register under section 120 of the Act (e) For every personal search (j) For every postal search (g) On appeal to the Principal Registrar from an order refusing to register a document under Sections 110 and 113 of the Act (h) For attendance by an officer of the registry at a place outside the registration office (per day or part thereof of the absence from the registry and the expenses incurred) (i) On resubmission for registration of any document previously rejected because of error thereon or for failure to comply with any prerequisite of registration 500 1,000 500 500 2,500 500 per document rejected 4 Kenya Subsidiary Legislation, 2010 (j) For every copy of a registered document or abstract of tit!e (i) Where the number of pages or folios does not exceed five (ii) Where the number of pages or folios exceeds five 200 per copy of such pages or folios 200 per copy of the first five pages or folios p!us Ksh. 10 per page or folios in excess of the said five pages or folios (Note.-ln (i) and (ii) above, 11 folio or 11 page or a register (title) shall be deemed to be two folios or pages). The principal Rules are amended by deleting rule 4 ancl substituting therefor the following new rule~ "4, The fees prescribed by these rules include the provision of photostatic copy prescribed by the AcL" 4. The principal Rules are amended by deleting rule 5 and substituting therefor the following new rule "5.
