(1) इन िनयम) का संि�E त नाम ओजोन अव�यकारी पदाथ� (िविनयमन और िनयं5ण) संशोधन िनयम, 2019 ह।ै (2) ये राजप5 म7 इनके अंितम $काशन क! तारीख को $वृ% त ह)गे। 2. उH त िनयम) के, िनयम 5 म7, उप-िनयम 2क के पI चात् िन निलिखत उप-िनयम अंत:Y थािपत �कया जाएगा अथा�त्:- ‘‘(2ख) तारीख 01 जनवरी, 2020 से एचसीएफसी-141ख के आयात के िलए अनु[िQ का जारी �कया जाना $ितिषC �कया जाएगा ।’’ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. उH त िनयम क! अनूसूची-4 म7, Fम सं. 10 के सामने मद (ग) और उससे संबंिधत $िवि\य) के Y थान पर िन निलिखत रखा जाएगा, अथा�त्: F.सं. काय�कलाप) के नाम ओजोन अव�यकारी पदाथ� के समूह का नाम चरणबC समािQ क! तारीख (1) (2) (3) (4) (ग) पूव�-िमि]त पोिलयोल का िविनमा�ण समूह-VI 1-1-2020 4. उH त िनयम क! अनुसूची-7 के अधीन KटE पण म7 खंड 2 के पI चात् िन निलिखत खंड अंत:Y थािपत �कया जाएगा, अथा�त्:- ‘‘$ी-पॉलीमर) िजनम7 समूह-6 पदाथB को अंतRव^ ट करने वाले पूव� िमि]त पोिलयोल भी हO।’’ [फा. सं. 16/1/96-ओसी-पाट�-III] गीता मेनन, संयुH त सिचव �ट� प�ट� प�ट� प�ट� पणणणण :::: मूल अिधसूचना तारीख 19 जुलाई, 2000 क! अिधसूचना सं. का.आ. 670 (अ) #ारा भारत के राजप5, असाधारण, भाग II खंड 3, उप-खंड (ii) म7 $कािशत क! गई थी और त% पI चात् िन निलिखत अिधसूचनाa #ारा संशोिधत क! गई थी: 1. का.आ. 1283 (अ), तारीख 31 �दस बर, 2001; 2. का.आ. 966 (अ), तारीख 27 अगY त, 2003; 3. का.आ. 929 (अ), तारीख 16 अगY त, 2004; 4. का.आ. 1391 (अ), तारीख 26 िसत बर, 2005; 5. का.आ. 1561 (अ), तारीख 18 िसत बर, 2007; और 6. का.आ. 1033 (अ), तारीख 13 माच�, 2014 । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 31st December, 2019 S.O. 4724(E).—Whereas the Central Government, in exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), made the Ozone Depleting Substances (Regulations and Control) Rules, 2000 (hereinafter referred to as the said rules) vide notification number S.O. 670(E), dated the 19th July, 2000; And whereas, the said rules as amended need to be further amended to align with the accelerated phase-out of Ozone Depleting Substances (ODSs) as per the adjustment of the Montreal Protocol as decided at the 77th meeting of the Executive-Committee (Ex-Com) of the Multilateral Fund for implementation of the Montreal Protocol held in 2016; Now, therefore, in exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, after having dispensed with the requirement of notice under clause (a) of sub-rule (3) of the rule 5 of the said rules in public interest, to enforce the phase out of Group VI substances used in manufacture of all other foam products including discontinuous sandwich panels, as stated in the said rules as amended by the Ozone Depleting Substances (Regulation and Control) Amendment Rules, 2014, the Central Government hereby makes the following rules further to amend the Ozone Depleting Substances (Regulation and Control) Rules, 2000, namely: ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 1. (1) These rules may be called the Ozone Depleting Substances (Regulation and Control) Amendment Rules, 2019. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the said rules, in rule 5, after sub-rule 2A, the following sub-rule shall be inserted namely: “(2B) Issuance of license for import of HCFC-141b shall be prohibited from 1 st January 2020.”. 3. In the said rules, in Schedule-IV, against serial number 10 for item (c) and the entries relating thereto, the following shall be substituted, namely: Sl.No. Name of Activities Name of Group of ozone depleting substance Phase-out date (1) (2) (3) (4) “(c) Manufacture of pre-blended polyols Group VI 1-1-2020”. 4. In the said rules, in the Note under Schedule-VII, after clause 2, the following clause shall be inserted, namely: “3. Pre-polymers include pre-blended polyols containing Group VI substances.”. [F.
