24A QUALITY STANDARD OF WASTE WATER OF BUSINESSES AND/OR ACTIVITIES OF UPSTREAM -PETROCHEMICAL INDUSTRY (Regulation of the State Minister for Environmental Affairs Number 8 Year 2007 dated July 4, 2007) THE STATE MINISTER FOR ENVIRONMENTAL AFFAIRS, Considering: a. that in order to conserve the environment functions, it is necessary to control businesses and/or activi ties potential to pollute the environment; b. that in order to prevent pollution from the businesses and/or activities of upstream petrochemical indus try, it is necessaryto control water pollution by Stipu lating quality standard of waste water for businesses and/or activities of upstream petrochemical indus try; c. that in according to the considerations as referred to in letters a and b as well as to execute the provision in Article 21 paragraph (1) of Government Regula tion Number 82 Year 2001 regarding the Manage ment of Water Quality and the Controlling of Water Pollution, it's necessary to stipulate a regulation of the State Minister for Environmental Affairs regard ing Quality Standard of Waste Water of Businesses and/or Activities of Upstream Petrochemical Indus try; In view of: 1. To stipulate: THE REGULATION OFTHE STATE MINISTER FOR ENVI RONMENTAlAFFAIRS REGARDING OF LIFE ENVIRON MENT REGARDING QUALI1Y STANDARD OF WASTE WATER OF BUSINESSES AND/OR ACTIVmES OF UP STREAM-PETROCHEMICAlINDUSTR~ Article 1 In this Regulation of Minister, the meaning of: 1. UpstreamPetrochemical Industry is the industry man aging processing resources in the forms of llquld hy drocarbon substancesor gases(natural hydrocarbon) into chemical substances, such as olefin, aromatic, and syngas, covering industry producing ethylene, propylene, butadiene, benzene, ethyl benzene, tolu ene, xylem, styrene and cumene. 2. Quality standard of waste water is the limit or stan dard of polluted substance and/or amount of pol luted substance in waste water to be dumped or re leased into water source from one business and/or activity. 3. Water source is water place which is on above and under the land surface, including aqUifer, spring, river, swamp, lake, situ, rumen, and estuary. 4. Waste water is the remains from a result of a busi ness and/or activity in liquid form. 5. Maximum Quantity of waste water is the highest vol ume of w,..te water which CM be thrown into water source each product unit. 6. Maximum standard is the size of the highest limit of one substance of polluted into the waste water. 7. Monitoring Point is one or more of locations which shall be become the reference for monitoring In or der of the management of standard quality of waste water. 8. Article 2 (l)The quality standard of waste water of businesses and/or activities of upstream petrochemical industry is as mentioned in the attachment to this regulation. (2)The attachment as referred to in paragraph (1) shall be inseparable from this regulation. Article 3 The quality standard of waste water of busi nesses and/or activities of upstream petrochemical in dustry as referred to in Article 2 paragraph (1) shall be stipulated according with the standard and the quantity of waste water. Article 4 The quality standard of waste water of busi nesses and/or activities of upstream petrochemical in dustry as referred to in the attachment may not be sur passed at anytime. Article 5 (l)Regions shall stipulate the quality standard of waste water of businessesand/or activities of upstream pet rochemical industry with the provision that the stan dard is equal or tighter than the provision as men tioned in the attachment to this regulation. (2)The quality standard of waste water as referred to in paragraph (1) shall be stipulated by provincial regu lation. Article 6 In case the result of Inspection of properness of Environmental Impact Analysis (AMDAL) or the recom mendation of the Environmental Management Efforts (UKl) and Environmental Monitoring Efforts (UPl) of businesses and/or actiVities of upstream petrochemical industry requiring the tighter quality standard of waste water than the quality standard of waste water as re water" . " rerred to in ArtIcle 2 paragraph (1) or Article 5 para graph (1), the quality standard of waste water as re quired by AMDAL or recommendation of UKL and UPL shall apply. Article 7 In case of the resultof analysis of waste water requiring the tighter quality standard than the quality standard of waste waterasreferred to in Article 2 para graph (1), Article 5 paragraph (1), or Article 6, the re quirement nf lie''I'lol' to rlioPMI' w"otl' w"tl'r shall mf>et the quality standard of waste water according to the analysis result. Article 8 Personnel in responsible of businesses and/or activities of upstream petrochemical industry is obliged to: a. Manage waste water so that the quality of waste water to bedisposed into water source does not ex ceed the quality standard of waste water already stipulated in the attachment to this regUlation. b. use water-proof networks of the release of waste watl'r to prl'vl'nt w"ste w"ter from infiltrating the environment; c. installdebit calculation or flow speed measuring in struments of waste water and record dailydebit of the waste water; d. avoid the thinning of waste water, including the mix ing of the disposed water into the flow of the dis posal of waste water; e. record monthly production; f. separate the networkof the disposal of waste water from the networkof rainwater; g. execute thedailymonitoring of the qualityof param eter of the qualitystandard of waste water, for pa rameter pH andCOD; h. stipulate monitoring point for taking sample; i. check the parameter standard of qualitystandard of waste waterasmentioned in the attachment to this regulation periodically at least1 (one)time in 1 (one) month to the accredited laboratory. j. submitthe reportof dailydebitof waste water, notes Business News 7596/12-7-2007 26A of monthly production, daily monitoring of the pa rameterstandard of waste water, and the result of laboratory analyzes on the qualitystandard of waste water as referred in letter c, e, g, and i as periodi callyat least1 (one) time in 3 (three) months to the Regent/Mayor, with carbon copy to the Governor or Minister, also another related institution according with the regulation and law; and k. report to the Regent/Mayor, with copy made avail ableto the Governor and Minister regarding the ex cess of the Quality standard because of the discon tinuation of operational activities partlyorwholly until the operational activities start againalongwith the nerans of outcomes of the actIVities. Artide 9 Regents/mayors are obligated to mention the qualitystandard of wastewateras referred to in Article 2 paragraph (1), Article 5 paragraph (1), Article 6 or Article 7 and the obligation as referred to in Article8 in license to dispose waste water of businesses ad/or ac tivities of upstream petrochemical indUstry. Article 10 Following the enforcement of this regulation, all regulations related to the qualitystandard of waste wa ter of businesses and/or activities of upstream petro chemical industryalready existing shallremain effective aslongastheydo not contravene the provisions in this regulation.
