2.6A GUIDANCE FOR THE PREPARATION OF ENVIRONMENTAL IMPACT ANALYSIS (Regulation of the State Minister for Environmental Affairs Number 08 of 2006 dated August 30, 2006) THE STATE MINISTER FOR ENVIRONMENTAL AFFAIRS Considering: a. that to implement the provision of Article 14 para­ graph (2.) and Article 17 paragraph (2.) of Govern­ ment Regulation Number 2.7 of 1999regarding Envi­ ronmental Impact Analysis, Decree of StateMinister No. KEP-14/MENLH/3/1994 regarding General Guid­ an~e for the Preparation of Environmental Impact Analysis and Decision of the Head of the Environ­ mentImpactControl BodyNumber9 of 2000 regard­ ing Guidance for PreparatIon of EnvIronmental Im­ pact Analysis were alreadystipulated. b. that Decree of the State Minister for Environmental AffaIrs Number KEP-14/MENLH/3/1994 regarding General GUIdance for preparation of Environmental Impact Analysis and Decision of the Head of Envi­ ronmentImpact Control BodyNumber 9 of 2.000 re­ garding Guidance for Preparation of Environmental ImpactAnalysis areno longersuitable to the progress thereby requiring renewal; c. that based on the consideration asreferred to in let­ ters a andb, it isnecessary to stipulatea Regulation of the State Minister for Environmental Affairs re­ garding Guidance for the Preparation of Environmen­ tal Impact Analysisi In view of: 1. Presidential Regulation Number 9 of 2.005 (BN No. 7182 pages 2A-23A) regarding Position, Tasks, Functions, Organizational Structures and Work Pro­ cedures of State Ministries of the Republic of Indo­ nesia; DECIDES: To Stipulate; THE REGULATION OF THE STATE MINISTER FOR EN­ VIRONMENTAL AFFAIRS REGARDING GUIDANCE FOR THE PREPARATION OF ENVIRONMENTAL IMPACT ANALYSIS. Article 1 The scope of this Regulation of Minister shall comprise Guidance on Preparation of Terms of Refer­ ence on Environment Impact Analysis, Guidance on Preparation of Environment Impact Analysis, Guidance on Preparation of Environment Management Plan, Guld­ anl"e on Pr~paration of Environment Monitoring Plan and Guidance of Preparation of Executive Summary. Article2. , . . , . 27A Article 2 (l)Terms of Reference of Environment Impact Analysis shall be prepared on the basis of GUidance for the Prepara­ tion of Terms of Reference of Environmental Impact Analysis as contained in Appendix I to this Regulation of Minister. (2)Environment Impact Analysis shall be prepared on the basis of Guidance for Preparation of EnVironmental Impact Analysis as contained in Appendix II to this Regulation of Minister. (3) Environment Management Plan shall be prepared on the basis of Guidance for the Preparation of Environment Management Plan as contained in Appendix III to this Regulation of Minister. ('I) EnVironment Monitoring Plan shall be prepared on the baSIS of GUidancefor Preparation of Environment MOnitor­ ing Plan as contained in Appendix IV to this RegUlation of Minister. (5) Executive Summary shall be prepared on the basis of Guidance for Preparation of Executive Summary as con­ tained in Appendix V to this Regulation of Minister. (6)The appendices as referred to in paragraphs (1), (2), (3), (4) and (5) shall be an integral part of this Regulation of Minister. Article 3 Document of Envlronmantal Impar-t An~ly"i" hping the in process and/or already submitted prior to the stipulation of this Regulation of Minister shall refer to the previous Guidance for the Preparation of Environmental Impact Analysis. Article 4 By the enforcement of this Regulation: a. Decree of the 5tate Minister for Environmental Affairs Number KEP-14/MENLEH/3/1994 regarding General Guid­ ance for the Preparation of Environmental Impact Analysis shall be revoked and declared null and void. b. Decision of the Head of the Environment Impact Control Body Number 9 of 2000 regarding Guidance for the Preparation of Environmental Impact Analysis shall be revoked and declared null and void.
