MINISTRY OF TRADE OF THE REPUBLIC OF INDONESIA THE REGULATION OF THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA NUMBER 05/M-DAG/PER/1/2016 ON PROVISIONS FOR EXPORTATION AND IMPORTATION OF ANIMAL AND ANIMAL PRODUCTS WITH THE GRACE OF GOD THE ALMIGHTY THE MINISTER OF AGRICULTURE OF THE REPUBLIC OF INDONESIA, Considers : a. that in order to encoyrage the improvement of national competitiveness, it is required to simplify the licensing in the field of trade, particularly exportation and importation of animal and animal products; b. that the provisions of exportations and importations of animal and animal products as stipulated in the Regulation of the Minister of Trade No. 46/M-DAG/PER/8/2013 on the Provisions of Importations and Exportations of Animal and Animal Products as amended several times, the latest by the Regulation of the Minister of Trade No. 41/M-DAG/PER/6/2015 is deemed irrelevant; c. that based on the consideration as referred to in paragraph b, it is required to revoke the Regulation of the Minister of Trade No. 46/M DAG/PER/8/2013 on the Provisions of the Importation and Exportation of Animal and Animal Products as amended several times, the latest by the Regulation of the Minister of Trade No. 41/M-DAG/PER/6/2015 and re-arange the provisions of exportation and importation of animal and animal products; d. that based on the consideration as referred to in paragraphs a, b and c, it is required to stipulate the Regulation of the Minister of Trade on Provisions of Exportation and Importationn of Animal and Animal Products; In view of : 1. Law No. 16/1992 on Animal, Fish and Plant Quarantine (State Gazette of the Republic of Indonesia of 1992 No. 56, Additional State Gazette of the Republic of Indonesia No. 3482); 2. Law No. 7/1994 on the Stipulation of the Agreement Establishing World Trade Organization (State Gazette of the Republic of Indonesia of 1994 No. 57, Additional State Gazette of the Republic of Indonesia No. 3564); 3. Law No. 10/1995 on Customs (State Gazette of the Republic of Indonesia of 1995 No. 75, Additional State Gazette of the Republic of Indonesia No. 3612) as amended by the Law No. 17/2006 (State Gazette of the Republic of Indonesia of 2006 No. 93, Additional State Gazette of the Republic of Indonesia No. 4661); 4. Law No. 5/1999 on the Prohibition of Monopolistic Practices and Unfair Business competition (State Gazette of the Republic of Indonesia of 1999 No. 33, Additional State Gazette of the Republic of Indonesia No. 3817); 5. Law No. 8/1999 on Cunsumer Protection (State Gazette of the Republic of Indonesia of 1999 No. 42, Additional State Gazette of the Republic of Indonesia No. 3821); 6. Law No. 18/2009 on Livestock and Animal Health (State Gazette of the Republic of Indonesia of 2009 No. 84, Additional State Gazette of the Republic of Indonesia No. 5015) as amended by the Law No. 41/2014 (State Gazette of the Republic of Indonesia of 2014 No. 338, Additional State Gazette of the Republic of Indonesia No. 5619); 8. Government Regulation No. 14/2002 on Plant Quarantine (State Gazette of 2002 No. 35, Additional State Gazette No. 4196); 9. Law No. 7/2014 on Trade (State Gazette of the Republic of Indonesia of 2014 No. 45, Additional State Gazette of the Republic of Indonesia No. 5512); 10. Law No. 23/2014 on Local Government Administration (State Gazette of the Republic of Indonesia of 2014 No. 244, Additional State Gazette of the Republic of Indonesia No. 5587) as amended several times, the latest by the Law No. 9/2015 (State Gazette of the Republic of Indonesia of 2015 No. 58, Additional State Gazette of the Republic of Indonesia No. 5679); 11. Presidential Regulation No. 48/2015 on Ministry of Trade; 12. Presidential Regulation No. 71/2015 on Determination and Storage of Basic Goods and Essential Items; 13. Regulation of the Minister of Trade No. 31/M DAG/PER/7/2010 on Organization and Governance of the Ministry of Trade as amended by the Regulation of the Minister of Trade No. 57/M-DAG/PER/8/2012; 14. The Regulation of the Minister of Trade No. 13/M-DAG/PER/3/2012 on General Provisions in the Area of Export; 15. The Regulation of the Minister of Trade No. 53/M-DAG/PER/9/2014 on Integrated Services for Trade; 16. The Regulation of the Minister of Trade No. 48/M-DAG/PER/7/2015 on General Provisions in the Area of Import; 17. The Regulation of the Minister of Trade No. 70/M-DAG/PER/9/2015 on Importer Identification Number; DECIDES: To establish : THE REGULATION OF THE MINISTER OF TRADE ON PROVISIONS OF EXPORTATION AND IMPORTATION OF ANIMAL AND ANIMAL PRODUCTS. Article 1 1. Animal that all or parts of the life cycle are in the land, water and/or air, domesticated or in their habitats. 2. Breeding Animal hereinafter is referred to as Breeding, is animal that has prime nature and inheriting as well as fulfilling certain requirements for breeding. 3. Animal seed hereinafter is referred to as Seed, is animal reproductive material that may be in the forms of cement, sperm, ova, embryonated egg and embryo. 4. Prospective meat ruminant livestock hereinafter is referred to as Prospective is adult fattened ruminant that is raised for certain period of time to achieving maximum body weight of optimum age for slaughter. 5. Animal Products are all materials originated from fresh and/or managed or processed animals intended for consumptions, pharmaceutica, agriculture, and/or other utilization to meet the needs of human’s welfare. 6. Zoonosis is the disease that could transmit from animals to humans or vice versa. 7. Export is the activity of exiting goods from the area of custom. 8. Import is the activity of entering goods from the area of custom. 9. Importer Identification Number, hereinafter is referred to as API is the identification as importer. 10. Lable is every information on the goods in a form of picture, writing, combination of both, or other forms that contain information on product and information on the enterprise as well as other information, included in the goods, inserted inside, affixed or attached to the goods, printed on the goods, and or part of the packaging. 11. Food Grade Logo is the signage that shows that a food Package is safe to be used for food. 12. Recycle Code is the signage that shows that a food package may be recycled. 13. Package is the container used to pack and/or wrap Animal Products that may be directly as well as indirectly in touch with Animal Products. 14. Approval of Export is the approval used as license to perform Export of Animal and Animal Products. 15. Approval of Import is the approval used as license to perform Import of Animal and Animal Products, 16. Recommendation is the certificate issued by the officials of the authorized related technical institutions/units and is the requirement of the issuance of Approval of Export and Approval of Import. 17. Reference Price is the referred price for retail sales determined by the Team for Beef Monitoring Price. 18. State-Owned Enterprise, hereinafter is shortened to BUMN is the enterprise which all or most of the capital is owned by the State through direct investment that comes from separated State’s wealth. 19. Local Government-Owned Enterprise, hereinafter is shortened to BUMD is the enterprise which all or most of the capital is owned by Local Government through direct investment that comes from separated Local Government’s wealth. 20. Minister is the minister who performs the government’s administration in the field of trade. 21. Director General is the director general of Foreign Trade of the Ministry of Trade. 22. Trade Integrated Service Unit I, hereinafter is referred to as UPTP I is the unit that performs trade integrated services. 23. UPTP I Implementing Coordinator is the official assigned by the Minister to perform the licensing services in UPTP I. Article 2 Seed, Breed and/or Prospective in this Ministerial Regulation are grouped under the category of Animal. Article 3 (1) Export of Animal and Animal Products are limited. (2) Types of Animal and Animal Products which export are limited as referred to in Annex I which is an integral part of this Ministrial Regulation. (3) Animal Export as referred to in paragraph (2) may oly be performed if the domestic needs of Animal Seed, Breed and/or Prospective are fulfilled and local livestock preservation is guaranteed. Article 4 (1) The Export of Animal and/or Animal Products as referred to in the Article 3 paragraph (2) may only be performed by company that has received the Approval of Export from the Minister. (2) Minister gives mandate to issue Approval of Export as referred to in paragraph (1) to the UPTP I Implementing Coordinator. Article 5 (1) In order to receive the Approval of Export as referred to in Article 4, company must submit request electronically to the UPTP I Implementing Coordinator by attaching: a. Business License (SIUP) or the business license in the field of livestock and animal health; b. Certificate of Company Registration (TDP); and c. Recommendation from the Minister of Agriculture or official appointed by the Minister of Agriculture. (2) UPTP I Implementing Coordinator on behalf of the Minister issues the Approval of Export at the latest of 2 (two) working days since the received date of the completed and correct request as referred to in the paragraph (1). (3) In the event of the request as referred to in paragraph (1) is incomplete and/or incorrect, the UPTP I Implementing Coordinator on behalf of the Minister is rightfull to deny the issuance of Approval of Export. (4) Approval of Export as referred to in the paragraph (2) is delivered to the company with the copy to the related institutions. Article 6 Approval for Export as referred to in Article 5 paragraph (2) is applicable based on the expiration of the Recommendation. Article 7 (1) Animal and Animal Products may be imported. (2) Types of Animal and Animal Products that may be imported as referred to in Annex II, Annex III and Annex IV that are integral parts of this Ministrial Regulation. (3) Animal Import as referred to in paragraph (2) may be performed to: a. Improve the genetics quality and diversity; b. Develop science and technology; c. Overcome the deficiency of domestic needs of Seed, Breed and/or Prospective; and/or d. Fulfill the needs for research and development. Article 8 (1) Animal and Animal Product Import as referred to in Annex II of this Ministrial Regulation may only be performed in order to maintain the food security and price stability. (2) Animal and Animal Product Import as referred to in paragraph (1) may only be performed by BUMN and/or BUMD after receiving the assignment from the Government. (3) Assignment as referred to in paragraph (2) is given by the Minister of BUMN for BUMN and Governor to BUMD based on the suggestion from the Minister and the results of agreement in the economic ministerial coordination meeting by considering the Reference Price. Article 9 (1) Animal and Animal Product Import as referred to in Annex II of this Ministrial Regulation as referred to in Article 8 is performed by BUMN and/or BUMD after receiving the Approval of Import from the Minister. (2) Animal and Animal Product Import as stated in Annexes III and IV of this Ministrial Regulation may only be performed by companies with API, BUMN and BUMD after receiving Approval of Import from the Minister. (3) Minister gives mandate for the issuance of Approval of Import as referred to in paragraphs (1) and (2) to the UPTP I Implementing Coordinator. Article 10 (1) To obtain the Approval of Import as referred to in Artcle 9 paragraph (1), BUMN and/or BUMD must submit request electronically to the UPTP I Implementing Coordinator by attaching the Recommendation from the Minister of Agriculture or official appointed. (2) In order to obtain the Approval of Import as referred to in Article 9 paragraph (2), company must submit request electronically to the UPTP I Implementing Coordinator by attaching: a. Company Incorporation Legal Documents with the amendments, to Import Animal and Animal Products as stated in the Annex III of this Ministrial Regulation; b. API; c. Certificate of ownership of raising location and certificate of ownership of Slaughterhouse or working contract with Slaughterhouse that have met the standards based on the legislations, for Import of Prospective as stated in the Annex III of this Ministrial Regulation; d. Certificate of ownership of cold storage and certificate of ownership of cold transports, for Import of Animal Products as stated in Annex III of this Ministrial Regulation; and e. Recommendation from the Minister of Agriculture or official appointed by the Minister of Agriculture, for Import of Animal and Animal Products as stated in Annex III and Annex IV of this Ministerial Regulation; or f. Recommendation from the Head of the Food and Drug Supervisory Agency or official appointed by the Head of the Food and Drug Supervisory Agency for Import of Animal and Processed Animal Products that are still at risk of zoonosis transmission as stated in Annex IV of this Ministerial Regulation. (3) UPTP I Implementing Coordinator on behalf of the Minister issues the Approval for Import at the latest of 2 (two) working days since the date of request as referred to in paragraph (1) and paragraph (2) is received completely and correctly. (4) In the event the request as referred to in paragraphs (1) and (2) is incomplete and/or incorrect, the UPTP I Implementing Coordinator on behalf of the Minister denies issuing the Approval for Import. (5) Approval for Import as referred to in paragraph (3) is delivered to the company and is copied to the related institutions. Article 11 (1) Request for Approval for Import of Animal and Animal Products as referred to in Annex III of this Ministrial Regulation is set forth as follows: a. For the first quarter of the period of January-April may only be submitted in December of the previous year; b. For the second quarter of the period of May-August may only be submitted in April; and c. For the third quarter of the period of September-December may only be submitted in August. (2) Approval of Import as referred to in paragraph (1) is issued every beginning of the quarter. (3) Request for the Approval of Import of Animal and Animal Products as stated in the Annex IV of this Ministrial Regulation may be submitted anytime. Article 12 (1) The expiration of the Approval of Import of Animal and Animal Products as stated in Annexes II and IV of this Ministerial Regulation is in accordance to the expiration of the Recommendation starting from the date of issuance. (2) The expiration of the Approval of Import of Animal and Animal Products as stated in Annex II of this Ministerial Regulation is 4 (four) months starting from the date of issuance. Article 13 (1) The expiration of Approval of Import as referred to in Article 12 paragraph (2) may be extended by the UPTP I Implementing Coordinator on behalf of the Minister for the duration of the maximum of 30 (thirty) calendar days. (2) The extension of expiration of the Approval of Import as referred to in paragraph (1) is awarded after obtaining the agreement from the Minister through the Director General. (3) The extension of expiration of Approval of Import as referred to in paragraph (1) may only be awarded so long as the date of the Bill of Lading from the Country of Origin does not exceed the expiration of the Approval of Import and is submitted 1(one) time for every importation period. (4) The Expiration of the Approval of Import for the third quarter of the period of September-December may not be extended. (5) In order to obtain the extension of expiration of Approval of Import, the company must submit the request in writing to the UPTP I Implementing Coordinator by attaching: a. a photocopy of the still-valid Approval of Import; and b. a sufficiently-stamped statement letter from the importer on the reasons of request submission of the extension of the Approval of Import completed with sufficient supporting evidence documents. (6) UPTP I Implementing Coordinator on behalf of the Minister issues: a. The extension of expiration of the Approval of Import at the maximum of 2 (two) working days since the request is received completely and correctly; or b. The rejection of issuance of the expiration extension as referred to in paragraph (6) point a is delivered to the company with copies to the related institutions. Article 14 (1) The submission of the request to obtain: a. approval of Export as referred to in Article 5; and b. approval of Import as referred to in Article 10, may only be served electronically through http://inatrade.kemendag.go.id (2) in the event of force majeure that resulting the dysfunctioning of the electronic system, the submission of request as referred to in paragraph (1) may be performed manually. Article 15 (1) The Approval of Export as referred to in Article 5 and Approval of Import as referred to in Article 10 is forwarded electronically from the INTRADE portal to the Indonesia National Single Window (INSW) portal. (2) In the event that the Imports of Animal and Animal Products are conducted through ports that are not connected to the INSW, the copy of the Approval of Import is delivered manually to the related institutions. Article 16 (1) Reference Price as referred to in Article 8 paragraph (3) is determined by the Beef Price Monitoring Team formed by the Minister which membership consists of the elements of related institutions and it may evaluated at any time. (2) In the event that the price of secondary cuts beef in the market is below the Reference Price, the importation of carcasses and/or http://inatrade.kemendag.go.id/ secondary cuts beef as stated in the Annex II of this Ministerial Regulation is delayed until the secondary cuts beef is back to reach the Reference Price. Article 17 (1) Imported animal products are obliged to be labeled inside and/or on the packaging when traded/sold in the territory of the Republic of Indonesia. (2) The labeling as referred to in paragraph (1) must be done in writing or in print by using clear and easy-to-understand Indonesian Language, and includes at least the information of: a. the name of the product; b. the list of ingredients used; c. the nett weight; d. the name and address of the producer or importer; e. halal for those who require; f. the date and code of production; g. the espiration date, month and year; h. the marketing authorization number for processed food; and i. the origin of certain food/ingredient. (3) The language used, beside Indonesian, Arabic number; Latin letters are permitted if the synonyms are unavailable. (4) The labeling is done in such a way so that it will not be easily separated from the packaging, it will not be easily fade or damaged, and is easy to see and read. (5) The obligation to put label in Indonesian Language on every product and/or packaging as referred to in paragraph (1) is regulated in accordance to the legislations. Article 18 (1) Imported Animal Products must meet the requirements of packaging: a. The packaging that directly touches with food must use the permitted materials for food in accordance to the provisions of the legislations; b. Packaging that utilizes plastic must put Food Grade Logo and Recycle Code in accordance to the provisions of the legislations; or c. The packaging utilizing wood must be dried and given the signage in accordance to the provisions of legislations. (2) The fulfillment of the requirements on packaging as referred to in paragraph (1) must be proven by: a. certificate of test results issued by the competent and local government-recognized test laboratory; or b. statement letter from the importer stating that the Packaging used is in accordance to the provisions of the legislations by putting Fod Grade Logo and Recycle Code on the Packaging. Article 19 (1) Certificate of Health in the Animal and/or Animal Products’ country of origin that will be imported issued after the issuance of the Import Approval. (2) The Number of Approval of Import is put on the Certificate of Health as referred to in paragraph (1). Article 20 Animal Products as referred to in Annex III of this Ministerial Regulation may only be imported for the purpose of utilization and distribution for industry, hotelier, restaurants, catering and/or other specific needs. Article 21 In the event that in the country of origin of the Imported Animals and/or Animal Products occurs the risk of zoonosis [disease] spread and it is stated start import is prohibited based on the Decision of the Minister of Agriculture, the Approval of Import issued is declared void. Article 22 (1) The company that has obtained the Approval of Export and companies with ownership of API, BUMN, and BUMD that have obtained Approval of Import are obliged to submit reports electronically on the Export of Animals and/or Animal Products conducted, or the Import of Animals and/or Animal Products conducted by attaching the scanned copy of the initialed and stamped Export or Import Realization Control Card by officials of Tarriffs and Customs. (2) Reports as referred to in paragraph (1) are submitted through http://inatrade.kemendag.go.id every month at the latest on date 15 (fifteen) of the following month to the Director General with the copies sent to: a. The Director General of Domestic Trade, Ministry of Trade; b. The Head of the Food and Drug Supervisory Agency; and c. The Director General of Livestock and Animal Health, Ministry of Agriculture. (3) Companies with the ownership of API, BUMN and BUMD that have obtained the Approval of Imports for Animals and/or Animal Products as stated in Annex III of this Ministrial Regulation are obliged to submit the report on the distribution of cattles and beef. (4) The form of the report on the distribution of cattles and beef is as stated in Annex V and Annex VI which is an integral part of this Ministrial Regulation. http://inatrade.kemendag.go.id/ Article 23 Companies that do not perform the obligation to submit report as referred to in Article 22 for 2 (two) times, are sanctioned with the suspension of the application for Approval of Export or Approval of Import for the next period for 4 (four) months. Article 24 The Approval of Export and Approval of Import are revoked if the company: a. is proven of submitting incorrect data and/or information as part of the requirements to obtain the Approval of Export and the Approval for Import; b. is proven to have altered the information stated in the Approval of Export and Approval of Import; c. is found guilty by a court decision that has had permanent legal force for a criminal offense related to the abuse of the Approval of Export and the Approval of Import; and/or d. is proven to have had conducted violation based on the recommendation from the related technical institution(s) to revoke the Approval of Export and the Approval of Import. Article 25 The suspension of application for the Approval of Export and the Approval of Import as referred to in Article 23 and the revocation of the Approval of Export and the Approval of Import as referred to in Article 24 is determined by the UPTP I Implementing Coordinator on behalf of the Minister. Article 26 Companies which the Approval of Export or Approval of Import have been revoked may only re-submit their application for the Approval of Export or Approval of Import after 1 (one) year after the date of the revocation. Article 27 (1) Exporter or importer conducting Exportation or Importation of Animals and/or Animal Products that are not in accordance to the provisions in this Ministerial Regulation are sanctioned based on the provisions of the legislations. (2) Imported Animals and/or Animal Products which the number, types, enterprises and/or country of origins are not in accordance to the provisions of this Ministerial Regulations must be exported back. (3) The cost of exporting back as referred to in paragraph (2) is the responsibility of the importer. Article 28 (1) Export of Animals and/or Animal Products that are: a. personal belongings of passengers or crew members of a carrier that are in accordance to the provisions of legislations of customs; b. shipment that are in accordance to the provisions of legislation in the field of customs; c. goods belonging to the representatives of foreign countries and their officials assigned in Indonesia that are based on the principle of reciprocity; and/or d. goods belonging to people crossing borders that are in accordance to the provisions of the customs legislation with bilateral agreements, cross-border trade, are excluded from the provisions of this Ministrial Regulation. (2) The Export of Animals and/or Animal Products that are: a. Shipment of gift/grant for the purpose of public religious worship, charity, social, or for the natural disaster’s relief; b. goods for the purpose of international agencies with the officials assigned in Indonesia; c. goods for the purpose of research and science development; and/or d. example goods that are not for sale, must obtain Approval of Export from the Director of Exportation of Agricultural and Forestry Products. (3) To obtain the Approval of Export as referred to in paragraph (2), the applicant must submit the written application to the Director of Exportation of Agricultural and Forestry Products by attaching the Recommendation as referred to in Article 5 paragraph (1) point c. Article 29 (1) The Import of Animal and/or Animal Products that are: a. personal belongings of passengers and/or crew members of a carrier that are in accordance to the provisions of legislation of customs; b. shipments that are in accordance to the provisions of legislations of customs; c. exported goods and then re-imported with the maximum number the same as when exported and proven by the Notification of Exporting Goods; d. goods belonging to representatives of foreign countries and their officials assigned in Indonesia that are based on the principle of reciprocity; and/or e. goods belonging to people crossing borders that are in accordance to the provisions of the customs legislation with bilateral agreements, cross-border trade, are excluded from the provisions of this Ministerial Regulation. (2) Import of Animals and/or Animal Products that are: a. shipment of gift/grant for the purpose of public worship, charity, social or for the purpose of natural disaster relief; b. goods for the purpose of international agencies with the officials assigned in Indonesia; c. goods for the purpose of research and development of science; and/or d. example goods that are not for sale, must obtain the Approval of Import from the Director of Import. (3) To obtain the Approval of Import as referred to in paragraph (2), applicant must submit written application to the Director of Import by attaching the Recommendation as referred to in Article 10 paragraph (2) points e or f. Article 30 Every Export and Import of Animals and/or Animal Products must maintain to observe the provisions of the legislations. Article 31 (1) Monitoring of Import and distribution of Animals and Animal Products is performed in accordance to the provisions of the legislations. (2) Minister may establish an integrated team which consists of representatives from related institutions to perform: a. evaluation of the Policy Implementation of Exportation and Importation of Animals and Animal Products; and b. monitoring of the distribution of Animals and Animal Products. (3) Directorate General of Foreign Trade at anytime may conduct assessment of compliance (post-audit) against companies that have obtained Approval of Export and/or Approval of Import. Article 32 Technical instruction of the implementation of this Ministrial Regulation may be stipulated by the Director General. Article 33 Exclusion of the provisions regulated in this Ministerial Regulation must be by the approval from the Minister after coordinating with related institutions. Article 34 The stipulation as IT-Animals and Animal Products, Approval of Import and Approval of Export that have been issued based on the Regulation of the Minister of Trade No. 41/M-DAG/PER/6/2015 shall remain valid [and applicable] to the expiry date. Article 35 Approval of Import for Animals and Animal Products as stated in Annex III of this Ministerial Regulation that has been issued based on the Regulation of the Minister of Trade No. 46/M-DAG/PER/8/2013 on the Provisions of Importation and Exportation of Animals and Animal Products as amended several times, the lates by the Regulation of the Minister of Trade No. 41/M-DAG/PER/6/2015 must be conformed with this Ministerial Regulation no later than 1 (one) month after this Ministerial Regulation is entered into force. Article 36 (1) Import of Processed Animal Products that are included in the Tariff Post/HS 16.01 and 16.02 as regulated in the Regulation of the Minister of Trade No. 87/M-DAG/PER/10/2015on the Provisions of Imports of Certain Products as amended by the Regulation of the Minister of Trade No. 94/M-DAG/PER/10/2015 obeys the provisions in this Ministerial Regulation. (2) The implementation of the provisions as referred to in paragraph (1) starts to be put into force 1 (one) month after this Ministerial Regulation is entered into force.
