Non Poisonous and Dangerous Wastes, hereinafter referred to as Non B3Wastes is remaining of a busi nessand/or activities in the form of remalns.screps, or remnants which are not included in the classifica tion and/or category of poisonous and dangerous wastes. Poisonous andDangerous Wastes, hereinafter referred to as 63 Wastes namely every waste which contains poisonous and dangerous materials which due to its natureand/orconcentrate and/or amount, bothdirectly and indirectlymay damageand/or pollute lifeenviron mentand/or may endanger human health. 6. Noll 63 Wd~lt'PIOOUUllg IHlJJUller, tlt:rtlinant::r refern::d to as Non B3 Waste IP is the company which is en gaged in industrial business activitiesapprovedto im port itself Non B3 Wastes requlred solely for produc tion process of its industry and is not allowed to be traded and/or transferred to another party. 7. Non 83 Wastes Exporteris the companyin the country wherethe Non B3wcdes ore produced end/or shipped who delivers the Non 53 Wastes to Indonesia. 8. Surveyor isa surveycompany which carriesout verifi cation or technical tradng of Non B3Wastes Import. 9. Recommendation is a letter issuedby the competent authoritiesor related working unit who are authorized to give technicalconsideration as its basisin the issu "nee of Trtentification as Non B3 Wastes IP. 10. The Minister is the Minister ofirade. 11. Director General is the Director General for Foreign Tradeof the Department ofTrade. Article 2 (1) NonB3Wasteswhich may be imported are only in the form of Leftovers, Scraps or Remnants whichare used for industrial raw marertalsand/or aUXiliary materials. (2) NonB3Wasteswhich may be imported as specified in the paragraph (1) is specified in Attachment I which constitute5 tin insepereble pert of the Regulation or theMinister. Artide3 (1) Non 63 Wastesas specified in the Article 2 may only be imported by the company which isengaged in in dustrial businessactivities and hasobtained Identifi cation as Non B3 Wastes IP from the Director General. (2) Identification ..•.. (2) Identification asNon 'B3Wastes. IP as specifiedin the paragraph (1) at least contains number and type of Non 63 wastes IP which may be imported by Non 63 Wastes IP together with technical conditionsof its irn portation implementation. Article 4 (1) Requestto get Recognition as Non B3 WastesIP as specified in the Article 3 paragraph (1) must be sub mitted 10 wntmq to the Director GeneralWith the at tachrnentof the following documents: a. Photocopies of Industrial Business license/Indus trial Registration Certificatefrom technical agenD// department; b. Photocopies of Company Registration certificate (1DP); c. PhotocopIes of Taxpayer Registration Number (NPWP); d. Producing Importer Identification Number(API-P) or LimitedImporter Identification Number (API-n who is Non Limited - GeneralImporter Identifica tion Number(APIT-U); e. Customs Affairs Identity Number(NIK); f. Recommendation tram the Director General for Metal, Machine, Textile and Multifarjous Industry (ILMTA) or Dirednr General for Ayro and Chemical Industry (YAK),I1eparbnent of Industry; and g. Recommendation from Deputy State Minister for ute Environment in the Fieldof Poisonous andDan gerous Materials and Poisonous and Dangerous Wastes, State Ministry tor life environment, espe cially for the type of Non 83 Wastes with a serial numberfrom 1 up to 5 at the Attachment I of the Regulation of thp Ministpr. (2) The Director General issues Cl Recognition as Non 63 WastesIP as specified in the paragraph (1) not later than a period of five (5) working days effective from the request is received completely and correctly. Article 5 (1) Reoognition as Non B3 Wastes TP iC;C;IIM based on con dition as specified in the Article 4 paragraph (2) shall be valid for one (1) year and may be extended. (2) The extension for the Recognitionas Non 83 Wastes IP may be carried out prior to the termination of the validity period of the NonB3WastesIP as specified in the paragraph (1) in case the Non83 Wastes approved for import has been entirely realized Business News 7762/1-16-2009 (3) Request for the extension of Recognitionas Non 63 WastesIP asspecified in the para~raph(l) is submit ted in writing to the Director GeneralWiththe attach ment of the following documents: a. Recommendation from the Director General for MPh=ll, Mrlrhinp, Tfloxtilp and Multifariou<;. Tnrlu<;.try (ILMTA) or Director Generalfor Agroand Chemical Industry (IAK), Departmentof Industry; b. Recommendation from Deputy State Minister for LifeEnvironmentinthe Field of Poisonous andDan gerous Materials and Poisonous and Dangerous Wastes, State Ministry for Ufe Environment,espe cially for the type of Non B3 Wastes with a serial number from 1 up to 5 at the Attachment I of the Regulation of the Minister. c. Originalof Recognitionas Non 83 Wastes IP which hasexpired of its validity period; and d. Amendment to the documents as specified in the Artide 4 paragraph (1) letter a, b, d, d and e. (4) Recornmendotion es specified in the porugruph (3) let ter a and b is required if the type and/or volumeof the wastes to be imported exceeds that of the previous year. Article 6 (1) The implementationof the Non63 Wastes import shall De required to be provided with Sldlelllelll from the Exporter for Non B3Wasteswho states that: a. The wastes to be exported shall not constitute B3 Wastes; and b. To be prepared to accept Non B3 Wastes which hasbeen exported if the Non83 Wastes IP isproved as 83 Wastes. (2) In case the Non 83 Wastes imported isevidently as 63 Wastesas specified in the paragraph (1) letterb, the Non83 Wastesshall be required to be re-sentnot later than ninety (90) dayseffectivQ from thQ arrival ot thp goodsbased on the prevailing documents of the cus toms affairs. (3) Re-delivery of the Non B3 Wastes as specified it! the paragraph (2) shall become responsibility of the Sur vefor. Article? (6) The-verifk:ation and tedmical tracing results based on the scope as specified in the paragraph (3) are stated in the form of a Surveyor Report (LS) to be used as customs supplementary oocuments in the settlement of cusltms affairs In the field of import. (7) The surveyor shall be responslbte to the results of the verification and technical tradna as specified in the paragraph (6). (8) In case the Non 63 Wastesimported is evidenced as 63 Wastes as specifiedin the Artlde6 paragraph (1) letter 0 whidl is venfiecl or teennica,ly traced by tile Surveyor as spedfled in the paragraph (5), the re shipmentof the Wasl'E5 shallbecome responsibility of the Non 83 Wa§b:oco TPmncemet'L (9) After the tennlnation of the period~six (6) months as specified in the paragraph (5), the impJementation of the verificationand technicat tradng for the import of Non83 Wastes asspecified in the serialnumberfrom 6 upto 63 inthe Attac:hmentl oftheRegulaUon of the Minister is carried out by the Surveyor stipulated by the Minister as: spedt'ied in the paragraph (2). (10) Incase the Non B3 wastes In the form of bulk will be transshipped in a transit port, it shall be verifiedand technicaHy re-traced at the time the Non53 Wastes wUI be re-Ioaded to theship. (11) The Surveyor shallcoUect tees from an importer for the implementation of the verifICation and technical tracing as specified in the paragll2ph (1) and pera graph(10) of which the value is provided by observ ingthe prindples of benefit. (12) The Surveyor as specified In the paragraph (2) shall be required to submita reporton verification or tech nical tracing activities in writing every month to the Director General. AI'tiete 9 (1) Recognition as Non 83 Wastes IP shall be frozen if the Non B3 Wastes IPmncemed- fails tofufflIl its obIjgatjon to submit the report as spedFled in the Article7 para graph(l). (2) The freezingof theRecognition asNon 83 Wastes IP asspedfIeO In the paragraph (1) maybe re-aetivated within a period of one (1) month effective from the Non 63 Wastes IP concemed has implemented its ob ligation to submit' the report. (2) The revoc:ation of the ReoJgnition as the Non 63 Wastr.s IPasspecified inthe paragraph (1) is stipulated bythe DirectorGeneral. (3) ThP nwner of the' Non B3 wastes IP who .15 liable to sanction of revocation as specified in the paragraph (2) may only submit its request to obtain-again the Recognition as the Non 53 Wastes IP after one (1) year effectivefrom the revocation of the Rerognition asNon83 Wastes IP isstipulated. Artide 11 (1) Any infringementby the Surveyor with respect to the conditions in the Article8 paragraph (12) shall be li able to on odminisb"ative sanction in the form of rev0 cation of the appointment as Surveyor.
