PrOOuet Certification Jnsitutes, hereinafterreferred to asLSPro, are institutesaccredited by the National Ac creditation Committeeand/or appointedby means of Regulation of theIndustryMinister toconduct Q:!rtifica tionactivities. 4. Notional Accreditation Committee, hereinafter referrQd to asKANI isa non'"5t:nJctural institute under the pre view Ofandresp:>nsJbJe to thePresident which has the authority to accredit laboratory institutesto conduct certification activities. 5. Article 2 (1) Indonesian National Standards(SNI)shall oompulsory be enforced to 7 (seven) types of fertilizers asfollows 1. Urea fertilizer SNI02-2801-1998 HS3102.10.00.00 2. Ammorium fertilizerSNI 02-1760-2005 HS3102.21.00.00 SUlphate (ZA) 3. NPK fertilizer SNI02-28Q3.2000 HS3105.20.00.00 4. Su~fertilizer SNI02-3769-2oo5 HS3103.10.90.00 Phosphate(SP-36) 5. Triplefertilizer SNI02-0086-2oo5 HS3103.10.00.oo Superphosphate (TSP) 6. Phosphate fertilizer SNI02-3n6-2OU!:l HS j 1Uj.9lI.\:lU.00 Nature forfann 7. Potassium fertilizer SNI02-2805-2005 HS 3104.20.00.00 01I0ride (KCI) (2) IfSNIfor fertilizers as referred to in paragraph (1) are revised, the last SNI for fertilizersshall apply. (3) The compulsory enforcement as referred to in para graph (1) shall apply to fertilizers in packs and/or bulks. Article 3 Theenforcement of SNI to fertilizersasreferred to in Artide 2 shall apply to fertilizers used for farm and plantation. (2) For fertiliZers In bulk, the label SNI as referred to in paragraph (1) letter b shall be replaced with SPPT SNI. ArtideS fertilizersasreferred to inArtide 2 ttIataretraded In the domestic market andoriginatefrom local products or lmports shall meet provisions on SNIas referred to in Article4. Article6 SPPT-SNI as referred to in Article 4 shall be is sued by LSPro accredited by KAN according to a proper scope of accreditation or thoseappointed by the Inclusby Minister. Article7 (1) The issuance of SPPT-SNI as referred to in Artide 6 shall be conducted according to : a. Guidance for National Standardization PSN 302 2006; Assessment ofAppropriateness-Fundamen tals of Product certification, System 5, namely: 1. the assessment of appropriatequalityof prod ucts shallaccord with SNIor its revision; and 2. the auditof the applied qualitymanagementsys tem SNI 19-9001-2001/ISO 9001:2000 or its: revision orother recognized quality management system; or b. Guidance ..... b. (2) Thetest as referred to in paragraph(1) lettera point 1 and letterb point1 can be subcontracted to : a. a test laboratory accredited by KAN ora test labo ratory appointed bythe IndustryMinister; or b. em oversees test IClboratory oceredited by KAN or anaccreditation board in other country signing a mutual rec<Xlnition agreement (MRA) with KAN and verified by lSPro. (3) The auditofapplied quality management systemas referredto in paragraph (1) letter a point2 shallJ:Je Business News 1813/5~22-2009 29A based onguarantee issued by theQualitySystem Cer tification Instituteacereditedby KAN or an acetedita· non board in othercounttysigning a mutualrecoqnt t:ItJn agreement (MRA) WIth KAN and vertned by lSPrO. ArticleS (1) Imported fertlJizers that do not meet provisions inAr tide 4andArtide 5are banned from entering the In donesian customs territory and must be re-exported or destroyed. (2) lOCally-mac1e fertt1lzersthat dO not meet provlSfOns In Attide4 and Article 5 arebanned frombeing drculated. (3) Imported and locally-made fertilizers that drculatein the marketbut do notmeetprovisions inArticle 4 and Article 5 shallbe withdrawn from circulation. Artide 9 (1) The nurturing and control of the appllcat\on of SNI· fertilirersas referred to in Artide 2, Article 3 and Ar ticle4 at factory shall be conducted bythe Directorate General ofIndustrial Development in this case Goods and Selvlces Standard ControllQrs: at Factory (PPSP) at leastonce everyyear. (2) In conducting the controlas referred to Inparagraph (1),the Director General ofIndustrial Developmentcan coordinate with Heads of ProvIncial Offices and/or Headsof Regency/Munidpal Offices. Decree of the Industry Minister No. 131/M/SK/3/1980 on the Use of sn labels for Ten Types of Industrial Products, provided they are related to urea fertili2ers; and z, Decree of the Industry and Trade Minister No. 140/ MPP/Kep/3/2002 onthe Compulsory Application of SNI Fertilizers; shall be declared nullandvoid. Artide 11 LSPro b5uing SPPT-SNIfor fertilizers shall be ra sponSible for controlling and monitoring the useof SNI labels fromSPPT-SNI issued. Article 12 The DIrectOr General of lnaUstrlal Development shall set technical guidance to implement this Ministerial ReQulation. Article 13 Businessmen violating provisions in thisMiniste rialRegulation shall be subject to sanction pursuant to the low and regulation. Article14 companies already holding SPPT-SNI fertilizers shall replace SPPT-SNI fertilizers based on this Ministerial Regulation. Artide 15 Withthe enforcement of this Ministerial Regula tion: Business News 7813/5-22-2009 Artide 16 Thls Ministerial RegUlation shall come into force 6 (six)months after the date ofstipulation.
