23A TECHNICAL PROCEDURES FOR ENDORSEMENT BY THE FORESTRY INDUSTRY REVITALIZATION BOARD (B'RIK) (Regulation of the Director General of Foreign Trade No. Ol/DAGLUjPER/2.j2007 dated February 14, 2007) THE DIRECTOR GENERAL OF FOREIGN TRADE, Conslderlnq: a. that in the framework of implementing the provi sion in Article 8 paragraph (4) of Regulation of the Minister ofTrade No. 09jM-DAG/PER/2/2007 dated February 14,2007 concerning Provisions on the Ex port of Forestry Industry Products, it is necessary to stipulate Technical Procedures for Endorsement by the Forestry Industry Revitalization Board (BRIK); b. that based on the consideration as meant in letter a, it is necessary to stipulate a regulation of the Direc tor General of Foreign Trade; In view of: 1. Presidential Regulation No. 10/2005 on First-echelon Organizational Units and Tasks of State Ministries as already amended several times and the latest by Presidential Regulation No. 63/2005; 2. Presidential Decree No. 34/M/200Son Appointment of First-Echelon Officials within the Ministry of Trade; 3. Regulation of the Minister of Trade No. Ol/M-DAG/ PER/3/200S on the Organization and Working Ar rangement of the Ministry of Trade as already amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/ 12/2005i 4. Joint Decree of the Minister of Industry and Trade and the Minister of Forestry No. 803/MPP/Kep/2002 and No. 10267/KPTS-I1 on the Establishment of the Forestry Industry Revitalization Board; 5. Regulation of the Minister of Trade No. 09/M-DAG/ PER/2/2007 dated February 14,2007 on Provisions on the Export of Forestry Industry Products; Business News 7501-7502/25~4-2007 DECIDES: To stipulate: THE REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON TECHNICAL PROCEDURES FOR ENDORSEMENT .BY THE FORESTRY INDUSTRY REVI TAUZATION BOARD (BRIK) Article 1 Forestry industry products regulated in this regu lation are those subsumed into HS. 4407, HSA408, HS. 4409, HS. 4410, HS. 4411, HS. 4412, HS. 4413, HSA415, HS,4418, Ex. MS. 4421.90.99.00 (especially for timber paving block) and HS. 9406.00.92.00. Article 2 Approved Exporters of Forestry Industry Prod ucts (ETPIK) planning to export the forestry-industry products as meant in paragraph (1) must secure prior Endorsement Ratification Document from the Forestry Industry Product Revitalization Board (BRIK). Article 3 In order to obtain the Endorsement Ratification Document, I:TPIK must submit application to BRIK by endoslnq: a. Export Plan; b. TImber Mutation Report (LMK); and c. Copy of certificate of legitimacy of foreign products, already decimated and legalized by the authorized ornoai. Article 4 Description of goods and tariff headings as well as technical criteria submitted in the document of Ex port Plan refer to Attachments I and II to Regulation of the Minister of Trade No. 09jM-DAGFjPER/2/2007 con cerning provisions on the export of forestry industry products. Article 5 . • . :. Article 5 (l)BRIK examines documents conveyed bv epphcants, (2)The examination as meant in paragraph (1) covers technical criteria for products, which would be ex ported, output rate as well as legality of raw materi als. Article 6 (l)BRIK is obliged to issue or deny application for en dorsement in writing in not later than 3 (three) days as from the date of receipt of the application. (2)ln the case of the result of examination as meant in paragraph (l) being suitable to the provisions in force, BRIKissues Endorsement Ratification Document. (3)Tl1e validity period of the endorsement ratification document is 30 (thirty) days as from the date of is suance. Article 7 Every Endorsement Ratification Doc:uI'Y1ent is only usable as customs complementary document required for registration of one number of Export Declaration (PEB) or Customs oeoaranonot Single Administrative Document (PP SAD) for Customs and Excise Service Offices already applying it. Article 8 Copy of Export Declaration or PPSAD and copy of Surveyor Report (lS), copy of Bill or lading (Bll), copy of Invoice and copy of packing list (P/l) must be conveyed by ETPIK to BRIK in not later than 14 (four teen) days after securing loading approval. Artide9 (1) BRIK is obliged to convey data about Endorsement Ratification Document electronically to the Director General of Foreign Trade} Ministry of Trade and sur veyors in not later than one day after the date of issuance of the document. (2)BRIK is obliged to convey report on results of the implementation of endorsement to the Director Ge Business News 7501~7502/25-4~2007 24A neral of Foreign Trade, Ministry of Trade with a copy made available to with a copy made available to the Director General of Agro and Chemical Indus tries, Ministry of Industry and Director General of Forestry Production Deyelopment, Ministry of Fo restry in the form of hard copy and electronic data by using the format as contained in Attachment I to lhis regulation in not later than the 15th of the en suing month. (3)BRIK is obliged to convey report on the realization of the export of ETPIK to the Director General of Fo reign Trade, Ministry ofTrade with Cl copy made avai'~ able to with a copy made av6llable to the Director General of Agro and Chemical Industries, Ministry of Industry and Director General of forestrY Production Development, Ministry of Forestry in the form ofhard copy and electronic data by using the format as con tained in Attachment II to this regulation in not later than the 15th of the ensuing month. Article 10 Viol~tion of the provision as meant in Article 9 is subjected to sanction in the form of written warning, Article 11 With the enforcement of this regulation, Regu~ latlon of the, Director General of Foreign Trade No. 01/ DAGlU/PER/3/2006 on Technical Procedures for En dorsement by the Forestry Industry ReVitaliZationBoard .(BRIK) is revoked and declared null and void. The regulation starts to come into force 2 (two) months as from the date of stipulation.
