Decree of the Minister of Agriculture No. 646/KPTS/KP.150/7/1996 re establishment of a team for fostering and controlling the supply of fishing vessels

1 DECREE OF THE; MINISTER 01; AGRICULTURE NO. 646/KPTS/KP.150/7/1996; DATED JULY 31, 1996 RE THE ESTABLISHMENT OF THE TEAM FOR FOSTERING AND CONTROLLING THE SUPPLY OF FISHING VESSELS THE MINISTER OF AGRICULTURE. Considering: a. that by virtue of Decree of the Minister of Agriculture No. 508/Kpts/PL 810/7/1996 dated July 4, 1996, a stipulation has been laid down on the supply of Fishing Vessels and the 'Abolition of the System of Hiring Fishing Vessels Carrying Foreign Flags; b. that to assist the Minister of Agriculture in Fostering and Controlling the implementation of the said policy referred to in letter a above particularly as far as supply of fishing vessels are concerned, it is necessary to establish a team whose membership 'shall he comprised of relevant government agencies. Bearing in mind: 1. Act No. 5 of 1983 on the Indonesian Exclusive Economic Game (State Gazette No. 44 of 1983, Supplement to State Gazette No. 3299): 2. Act No. 9 of 1985 on Fishery (State Gazette No. 46 of 1985. Supplement to State Gazette No. 3299); 3. Government Regulation No. 15 of 1984 on the Management of Biological Natural Resources in the Indonesian Exclusive Economic Zone (State Gazette No 23 of 1984, Supplement to State Gazette No. 3378): 4. Government Regulation No. 15 of 1990 jo. No. 46 of 1993 on Fishery Undertakings State Gazette No. 19 of 1990, Supplement to State Gazette No. 3408 and State Gazette No. 73 of 1993, Supplement to State Gazette No. 3536); 5. Presidential Decree No. 44 of 1974 on the Organizational Structure of Ministries; 6. Presidential Decree No. 15 of 1984 jo. Presidential Decree No. 83 of 1993 on the Amendment to Presidential Decree No. IS of 1984 on the Organization of Ministries: 7. Presidential Decree No. 96/M/1993 on the establishment of Development Cabinet VI; 8. Joint Decree of the Minister of Trade, the Minister of Finance and the Minister Communications No. 885/1985, No. KM. 139 of 1985 and No. 677 of 1985, which has been amended and supplemented with No. 297 of 1986, No. KM. 146 of 1986 and No. 836 of 1986: 9. Decree of the Minister of Agriculture No. 815/Kpts/IK.120/11/1990 on Licensing for Fishery Undertakings; 10. Decree of the Minister of Agriculture No. 816/Kpts/IK.120/11/1990 on the use of fishing vessels carrying foreign flags by means of hiring for the purpose of fishing in the Indonesia Exclusive Economic Zone; 11. Decree of the Minister of Agriculture No. 96/Kpts/OT.210/2/1994 on the organization and the working system of the Ministry of Agriculture; 12. Decree of the Minister of Agriculture No. 508/Kpts/PL.810/7/1996 on the Supply of Fishing Vessels and the Abolition of the system of hiring fishing vessels carrying foreign flags. HAS DECIDED To Stipulate: FIRSTLY To establish a Team for Fostering and Controlling the Implementation of the supply of Fishing Vessels, hereinafter referred to in this decree as the Team four Fostering and Controlling the supply of Vessels with the membership structure being as follows: Chairman concurrently member: Director General of Fisheries Ministry of Agriculture; Members: 1. Director General of Sea Communications, Ministry of Communications 2. Director General of Metal, Machinery and Chemical Industries, Ministry of Industry and Trade; 3. Deputy Chairman in charge of the Assessment and Basic and Applied Sciences, Agency for the Assessment and Application of Technology; 2 4. 2nd Assistant to the Coordinator Minister, Office of State Minister for the Coordination of Production and Distribution Areas. SECONDLY The Team for Fostering and Controlling supply of Vessels shall he assigned to assist the Minister of Agriculture in implementing the supply of fishing vessel and or fish-transporting vessels in relation to Decree of the Minister of Agriculture No. 508/Kpts/PL.810/7/1996 dated July 4, 1996, encompassing: (1) Drawing up the criteria which shall he used in selection in the framework of determining fishery companies which shall be eligible for licences to supply fishing vessels and or fish-transporting vessels. (2) Conducting surveys and assessment in the framework (d selecting applications for the supply of fishing vessels and or fish-transporting vessels, concerning the business operation, technical and administrative aspects. (3) Conveying results of the surveys and assessment mentioned in figure (2) along with suggestions and considerations regarding applications which have fulfilled the requirements for being granted a licence. (4) Drawing up the procedure for the supply of fishing vessels and or fish-transporting vessels domestically and or from abroad. THIRDLY The Team for Fostering and Controlling the supply of Vessels shall conduct surveys and assessment as meant in figure (2) of the second dictum at least once a month or at any time if deemed necessary. FOURTHLY To help expedite the implementation of his duties, the chairman of the Team for Fostering and Controlling the supply of Vessels may set up a secretariat and appoint a number of assistants in accordance with the necessity. FIFTHLY In implementing its duties, the Team for Fostering and Controlling shall he accountable to the Minister of Agriculture. SIXTHLY Expenses arising owing to the performance of the duties of the Team for Fostering and Controlling the supply of Vessels shall he borne by the budget of the Directorate General of Fisheries.
