Decree of the Minister of Agriculture No. 60/Kpts/Ik.120/2/97 re the Granting of Licences for the Import of Fishing Vessels

1 DECREE OF THE MINISTER OF AGRICULTURE NUMBER: 60/Kpts/IK.120/2/97; DATED: FEBRUARY 4, 1997 RE THE GRANTING OF LICENCES FOR THE IMPORT OF FISHING VESSELS THE MINISTER OF AGRICULTURE, Considering: a. that by the Decree of the Minister of Agriculture No. 508/1996 on the Procurement of Fishing Vessels and Abolition of the Foreign Flag Fishing Vessel Leasing System, the domestic purchase of fishing vessels as well as the import of fishing vessels and or fish carriers, new and used ones are allowed; b. that fishery companies meeting relevant requirements need to be granted licences for the import of fishing vessels and or fish carriers. Bearing in mind: 1. Law No. 5/1983 on the Indonesian exclusive economic zone (State Gazette of 1983 No. 44 Supplement to State Gazette No. 3299); 2. Law No. 9/1985 on Fishery (State Gazette of 1985 No. 46, Supplement to State Gazette No. 3299); 3. Government Regulation No. 15/1984 on the Management of Biological Natural Resources in the Indonesian exclusive economic zone (State Gazette of 1984 No. 23, Supplement to State Gazette No. 3378); 4. Government Regulation No. 15/1990 jo. No. 46/1993 on Fishery Business Operation (State Gazette of 1990 No. 19, Supplement to State Gazette No. 3408 and State Gazette of 1993 No. 73, Supplement to State Gazette No. 3536): 5. Presidential Decree No. 44/ 1974 on the organisational principles of ministries; 6. Presidential Decree No. 15/1984 on the organisational structures of ministries jo. Presidential Decree No. 83/1993 on the amendment of Presidential Decree No. 15/1984 on the organisational structures of ministries; 7. Presidential Decree No. 96/M/1993 on the establishment of the sixth Development cabinet. 8. The Joint Decree of the Minister of Trade the Minister of Communications and the Minister of Finance No. 885/Kpb/VII/1985, No. KM.139/HK.205/PHB-85 and No. 677/KMK.05/1985 as already amended and supplemented the latest by the Joint Decree of the Minister of Trade, the Minister of Communication and the Minister of Finance No. 297/Kpb/X/86, No. KM.146/HK.101 /PHB-86 and No. 836/KMK.01/1986; 9. The Decree of the Minister of Agriculture No. 815/Kpts/IK.120/11/90 on the fishery business licensing; 10. The Decree of the Minister of Agriculture No. 816/Kpts/IK.120/90 on the use of foreign flag fishing vessels by leasing four fishing operation in the Indonesian exclusive economic zone; 11. The Decree of the Minister of Agriculture No. 96/Kpts/OT.210/2/1994 on the organisation and operational procedure of the Ministry of Agriculture; 12. The Decree of the Minister of Agriculture No. 508/Kpts/PL.810/7/1996 on the procurement of fishing vessels and abolition of the foreign flag fishing vessel leasing system. HAS DECIDED: To stipulate: FIRSTLY: To grant licences for the import of fishing vessels and or fish carriers to fishery companies, effective through December 31, 1997, with the number of vessels to be imported as contained in Attachment 1 and Attachment 2 to this decree. SECONDLY: The fishery companies obtaining import licences as meant in the First dictum shall be given the opportunity to realise their licensed imports with the following provisions: (1) Used vessels purchased from abroad can sail to one of the ports in Indonesia for preliminary inspection. (2) If desired by owners/buyers of vessels, preliminary inspection can be conducted abroad. (3) New vessels purchased from abroad and directly flying Indonesian flags shall be subject to preliminary inspection in the countries where the vessels have been built. 2 (4) Results of the inspection as meant in paragraph (1), paragraph (2) and paragraph (3) shall be reported to the Director General of Fishery as Chairman of the Development and Control Team along with suggestions and considerations. (5) After the procurement has been approved, replacement with Indonesian flags shall be realised and provisional certificates shall be issued by the Directorate General of Sea Communications, effective for 6 (six) months. (6) Before the expiration of provisional certificates as meant paragraph (5), vessels shall be docked for first inspection and measurement by marine inspectors and measuring experts from the Directorate General of Sea Communication for certification and registration. (7) After the arrival of vessels in Indonesia and their transfer, owners shall report all accessories/equipment of vessels being carried. (8) In the case of new vessels built domestically or overseas, before construction is realised their pictures, calculations, stability details all others shall be examined and validated by the Directorate General of Sea Communications.
