THE REGISTRATION OF AND THE ISSUANCE OF PROVISIONAL LICENCES TO PESTICIDES (Decree of the Minister of Agriculture No. 227/Kpts/SR.140/4/2004 dated June 13, 2004) THE MINISTER OF AGRICULTURE, Considering: a. that additional information on the pesticides whose applications for registration have been evaluated and tested with the results of the evaluation and test fulfill ing the specified requirements will constantly be needed to meet requirements for permanent permits; b. that based on the above matters and pursuant to De· cree of the Minister of Agriculture No.434.1/Kpts/TP.270/ 7/2001 on the Requirements and Procedures for Regis tering Pesticides, it is deemed necessary to register and issue provisional permits to pesticides; In view of: 1. Decree of the Minister of Agriculture No. 517/Kpts/TP.270/9/2002 on Pesticide Control; By observing: The views of the Pesticide Commission in its letter No.01/Kompes/2004 dated January 8, 2004; DECIDES: To stipulate: DECRf~ OF THE MINISTER OF AGRICULTURE ON THE REGISTRATION OF AND THE ISSUANCE OF PROVISIONAL PERMITS TO PESTICIDES. Article 1 ( 1) The pesticides contained in column 2 of Attachments I and II to this Decree shall be registered and given provisional permits as meant in Article 10 of Decree of the Minister of Agriculture No. 434.l/Kpts/TP.270/7/2001 on the Require ments and Procedures for Registering Pesticides, in the name of registration holders as contained in column 7 of Attachments I and II to this Decree. (2)The registration holders referred to in paragraph (1) shall be given permits which will be valid for 1 (one) year after the stipulation date of this Decree, to circulate pesticides and issue information on pesticides referred to in paragraph ( 1) by observing this Decree and the legislation in force. (3)The status of registration holder referred to in paragraph (1) may be reviewed if the registration holder is no longer appointed by the relevant pesticide formulation owner to register the pesticide or does not m eet the legislation in force. ·( 4) Any application for reregistration of pesticide referred to in column 2 of Attachment II to this Decree shall be filed in writing before the expiry of the permit referred to in paragraph (2). (S)The reregistration of a provisional permit may be given 3 (three) times at the most for a period of 1 (one) year each. Article 2 ( 1) The pesticides referred to in Article 1 paragraph ( 1) shall contain active substances as meant in column 2 and have formulation form as meant in column 3 .of Attachments I and II to this Decree. (2) The formula composition, physical and chemical characteristics, stability, compatibility and other characteristics of active substances and formulations shall accord with the data and information given in the application for the registra tion of the active substances and formulations. Article 3 ( 1) The pesticides referred to in Article 1 paragraph ( 1) may only be: a. imported and/or produced by the registration holders and/or other parties securing approval from the registration holders by fulfilling the legislation in force; b. stored and circulated in the original containers using labels according to Decree of the Minister of Agriculture No. 434/Kpt/TP.270/7 /2001 on the Requirements and Procedures for Registering Pesticides and approved by the Directorate General of Agricultural Means Development before being printed and used; c. used according to provisions in column 5 of Attachments I and II to this Decree and directives contained in the label. (2)The pesticides referred to in Article 1 paragraph (1) shall not be used with a plane without a prior consent from the Minister of Agriculture or the appointed official. ( 3) The pesticides referred to in column 2 can only be circulated in quantities referred to in column 4 of Attachments I and II to this Decree. Article 4 ( 1) The registration holders referred to in Artide 1 paragraph ( 1) shall ensure that: a. the quality of the pesticides accord with provisions in Artide 2 at a time when they begin to circulate the pesticides; b. the pesticides are circulated in containers and packs which accord with those stated in the application for the registration of the pesticides and approved by the Directorate General of Agricultural Means Development as speci fied in Article 3 paragraph ( 1) letter b; c. each container or pack of pesticide is labelled according to Decree of the Minister of Agriculture No.434.1/Kpts/ TP.270/7/2001 on the Requirements and Procedures for Registering Pesticides; d. any piece of information circulated by the registration holders or other parties who have secured their approval accords with licencing provisions as well as data and information stated in the application for the registration of the pesticides. (2)The registration holders referred to in Article 1 paragraph {l) shall try to: a. prevent the quality of pesticides circulated from being damaged, making the pesticides ineffective and/or unsafe for circulating and using; b. withdraw the pest1c1des whose quality does not accord with the existing provisions from circulation; c. stop the circulation of pesticides whose containers, packs and labels do not accord with the existing provisions as specified in paragraph (1) letters band c, until the containers, packs and labels are replaced with those fulfilling the requirements. d. withdraw information in any form which does not accord with the existing provisions. ( 3) The registration holders referred to in Article 1 paragraph ( 1) shall send the Directorate General of Agricultural Means Development: a. pure active substances for a laboratory test on the pesticides referred to in Article 3 paragraph {l). b. specimen pesticide formulation referred to in Article 2 and container, pack and label referred to in paragraph ( 1) letters b and c. Article 5 The permits referred to in Article 1 paragraph ( 1) may be changed, replaced or revoked if the pesticides referred to in Article 1 paragraph ( 1) are found violating the leg;slation in force, causing an unexpected side-effect or having unprecedented potential danger.
