Ordinance on Amendments to the Ordinance on the Management of Waste Electrical and Electronic Appliances and Equipment

THE MINISTRY OF ENVIRONMENTAL PROTECTION, PHYSICAL PLANNING AND CONSTRUCTION 681 Pursuant to Article 104 paragraph 1 item 3 indent 2 of the Waste Act (Official Gazette 178/04, 111/06 and 60/08), the Minister of Environmental Protection, Physical Planning and Construction hereby issues the ORDINANCE ON AMENDMENTS TO THE ORDINANCE ON THE MANAGEMENT OF WASTE ELECTRICAL AND ELECTRONIC APPLIANCES AND EQUIPMENT Article 1 In the Ordinance on the management of waste electrical and electronic appliances and equipment (Official Gazette 74/07 and 133/08), in Article 17 after paragraph 3, paragraphs 4 and 5 are added and read: “(4) The fee for dishwashers shall amount to 70% of the total net weight of a dishwasher multiplied by the unit rate referred to in paragraph 3 of this Article. (5) The fee for all the EE equipment referred to in Annex IB to this Ordinance exceeding the weight of 500 kg per unit of equipment shall amount to the weight of 500 kg multiplied by the unit rate referred to in paragraph 3 of this Article.” Article 2 In Article 19, paragraph 1 is amended to read: “(1) The producer must keep records on the quantities of the manufactured and imported EE equipment referred to in Annex IB (List of products by categories of EE equipment from Annex IA) together with the corresponding Tariff number of the EE equipment pursuant to a special regulation.” Article 3 Article 21 is amended to read: “(1) Compensation to the collection operator referred to in Article 20 paragraph 1 of this Ordinance shall amount to HRK 2.60 per kg of EE waste submitted to the treatment operator (VAT included). (2) Compensation to the treatment operator shall amount to HRK 1.60 per kg of EE waste taken over for treatment and recovery except for Category 1 of EE equipment listed in Annex IA to this Ordinance. (3) Compensation to the treatment operator (VAT included) for Category 1 of EE equipment listed in Annex IA to this Ordinance shall amount to HRK 1.40 per kg of EE waste taken over for treatment and recovery.” Article 4 The provisions of Article 3 of this Ordinance shall apply in the year 2009. Article 5 In Annex V referred to in Article 26 of the Ordinance, the form IU/PEEO is replaced by the form IU/PEEO which is printed along with this Ordinance and constitutes an integral part thereof.
