W E L S H S TAT U T O RY I N S T R U M E N T S 2010 No. 66 (W.16) WATER, WALES The Private Water Supplies (Wales) Regulations 2010 EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations implement Council Directive 98/83/EC on the quality of water intended for human consumption (OJ No. 330, 5.12.1998, p. 32) in relation to private water supplies. A "private supply" is defined in section 93(1) of the Water Industry Act 1991 as a supply that is provided otherwise than by a water undertaker or a licensed water supplier. Part 1 of the Regulations makes miscellaneous provision in relation to water standards for private supplies. It defines the circumstances in which water is to be regarded as "wholesome" (regulation 4 and Schedule 1). It also sets out the requirements which apply where water is disinfected (regulation 5) and imposes a duty on each local authority to carry out a risk assessment of every private supply in its area (regulation 6). Part 2 of the Regulations places a duty on local authorities to monitor private supplies (regulations 7 to 10 and Schedule 2) and to ensure that each sample taken is analysed in the ways set out in Schedule 3 (regulation 11). It also requires the local authority to make and maintain records for every water supply in its area (regulation 12 and Schedule 4) and to send a copy of the records to the Drinking Water Inspectorate and the Welsh Ministers (regulation 13). Part 3 of the Regulations sets out the procedures to be followed if the water is not wholesome. It requires local authorities to provide information to those people likely to consume the water (regulation 14) and to carry out an investigation (regulation 15). Maent yn dirymu ac yn disodli Rheoliadau Cyflenwadau Dŵr Preifat 1991 (O.S. 1991/2790). Diffinnir "cyflenwad preifat" yn adran 93(1) o Ddeddf y Diwydiant Dŵr 1991 fel cyflenwad a ddarperir yw fodd ac eithrio gan ymgymerwr dŵr neu gyflenwr dŵr trwyddedig. Mae Rhan 1 o'r Rheoliadau yn gwneud darpariaeth amrywiol mewn perthynas â safonau dŵ r ar gyfer cyflenwadau preifat. Diffinnir o dan ba amgylchiadau yr ystyrir dŵr yn "iachus". (rheoliad 4 ac Atodlen 1). Mae hefyd yn pennu'r gofynion sy'n gymwys pan ddiheintir dŵr (rheoliad 5) ac yn gosod dyletswydd ar bob awdurdod lleol i gynnal asesiad risg ynglŷn â phob cyflenwad preifat yn ei ardal (rheoliad 6). Mae Rhan 2 o'r Rheoliadau yn gosod dyletswydd ar awdurdodau lleol i fonitro cyflenwadau preifat (rheoliadau 7 i 10 ac Atodlen 2) ac i sicrhau bod pob sampl a gymerir yn cael ei dadansoddi yn y ffyrdd a bennir yn Atodlen 3 (rheoliad 11). Mae'n gwneud yn ofynnol hefyd bod yr awdurdod lleol yn paratoi ac yn cynnal cofnodion ar gyfer pob cyflenwad dŵr yn ei ardal (rheoliad 12 ac Atodlen 4) ac yn anfon copi o'r cofnodion at yr Arolygiaeth Dŵr Yfed ac at Weinidogion Cymru (rheoliad 13). Mae Rhan 3 o'r Rheoliadau yn pennu'r gweithdrefnau sydd i'w dilyn pan nad yw'r dŵr yn iachus. Gwneir yn ofynnol bod awdurdodau lleol yn darparu gwybodaeth i'r bobl sy'n debygol o ddefnyddio'r dŵr (rheoliad 14) ac yn cynnal ymchwiliad (rheoliad15). Os yw achos y dŵr afiachus yn y pibwaith o fewn annedd sengl, rhaid i awdurdodau lleol gynnig cyngor ar y mesurau sydd eu hangen i ddiogelu iechyd dynol. Fel arall, pan nad oes modd datrys y broblem yn anffurfiol, caiff awdurdodau lleol, mewn amgylchiadau diffiniedig, awdurdodi safonau gwahanol. Os na roddir awdurdodiad o'r fath, rhaid i awdurdodau lleol (neu yn achos annedd sengl, caiff awdurdodau lleol) gyflwyno hysbysiadau gwella i fynnu gwneud y cyflenwad yn iachus (rheoliadau 16 ac 17). Mae Rhan 4 o'r Rheoliadau yn gwneud yn ofynnol cyflwyno hysbysiad i'r "person perthnasol" (fel y'i diffinnir yn adran 80 o Ddeddf y Diwydiant Dŵr 1991) os yw unrhyw gyflenwad yn achosi perygl posibl i iechyd dynol (rheoliad 18) ac yn darparu ar gyfer apelau a chosbau mewn cysylltiad â hysbysiadau o'r fath (rheoliadau 19 a 20). Mae Rhan 5 o'r Rheoliadau yn gwneud darpariaeth ar gyfer talu ffioedd (rheoliad 21 ac Atodlen 5) ac yn dirymu Rheoliadau Cyflenwadau Dŵ r Preifat 1991 (O.S. 1991/2790) o ran Cymru (rheoliad 22). Otherwise, if it is not possible to solve the problem informally, local authorities may, in defined circumstances, grant an authorisation of different standards. If such an authorisation is not granted local authorities must (or, in the case of a supply to a single dwelling, may) serve improvement notices requiring the supply to be made wholesome (regulations 16 and 17). Part 4 of the Regulations requires a notice to be served on the "relevant person" (as defined in section 80 of the Water Industry Act 1991) if any supply constitutes a potential danger to human health (regulation 18) and makes provision for appeals and penalties in connection with such notices (regulations 19 and 20). Part 5 of the Regulations makes provision for the payment of fess (regulation 21 and Schedule 5) and revokes the Private Water Supplies Regulations 1991 (S.I. 1991/2790) in relation to Wales (regulation 22). (3) The local authority may set a higher frequency for any parameter if it considers it appropriate taking into account the findings of any risk assessment, and in addition may monitor anything else identified in the risk assessment. (4) Notwithstanding the provisions in sub-paragraph (2) above, there must be a minimum of 1 sample per year. 27 PART 2 Audit monitoring Sampling 3.–(1) A local authority must undertake audit monitoring in accordance with this Part. (2) Audit monitoring means sampling for each parameter listed in Schedule 1 (other than parameters already being sampled under check monitoring) in order to provide information necessary to determine whether or not the private supply satisfies each concentration, value or state specified in that Schedule and, if disinfection is used, to check that disinfection by-products are kept as low as possible without compromising the disinfection. (3) The local authority may, for such time as it may decide, exclude a parameter from the audit monitoring of a private supply– (a) if it considers that the parameter in question is unlikely to be present in the supply or system at a concentration or value that poses a risk of the private supply failing to meet the concentration, value or state specified in Schedule 1 in respect of that parameter; (b) taking into account the findings of any risk assessment; and (c) taking into account any guidance issued by the Welsh Ministers. (4) It may monitor anything else identified in the risk assessment. Frequency of sampling 4.–(1) Sampling must be carried out at the frequencies specified in Table 3. (2) It must ensure that the sample is analysed using a system of analytical quality control. (3) The system must be subjected to checking by a person who is– (a) not under the control of either the analyst or the local authority; and (b) approved by the Welsh Ministers for that purpose. Analysing samples 2.–(1) The local authority must ensure that each sample is analysed in accordance with this paragraph. (2) For each parameter specified in the first column of Table 1 in Part 2 of this Schedule the method of analysis is specified in the second column of that table. (3) For each parameter specified in the first column of Table 2 in Part 2 of this Schedule the method is one that is capable of– (a) measuring concentrations and values with the trueness and precision specified in the second and third columns of that table, and (b) detecting the parameter at the limit of detection specified in the fourth column of that table. (4) For hydrogen ion, the method of analysis must be capable of measuring a value with a trueness of 0.2 pH unit and a precision of 0.2 pH unit. (5)The method of analysis used for odour and taste parameters must be capable of measuring values equal to the parametric value with a precision of 1 dilution number at 25°C. (5) For these purposes– "limit of detection" is – (a) three times the relative within-batch standard deviation of a natural sample containing a low concentration of the parameter; or (b) five times the relative within-batch standard deviation of a blank sample; "precision" (the random error) is twice the standard deviation (within a batch and between batches) of the spread of results about the mean; "trueness" (the systematic error) is the difference between the mean value of the large number of repeated measurements and the true value. 34 Authorisation of alternative methods of analysis 3.–(1) The Welsh Ministers may authorise a method different from that set out in paragraph 2(2) if satisfied that it is at least as reliable. (2) An authorisation may be time-limited and may be revoked at any time. Sampling and analysis by persons other than local authorities 4.–(1) A local authority may enter into an arrangement for any person to take and analyse samples on its behalf. (2) A local authority must not enter into an arrangement under paragraph (1) unless– (a) it is satisfied that the task will be carried out promptly by a person competent to perform it, and (b) it has made arrangements that ensure that any breach of these Regulations is communicated to it immediately, and any other result is communicated to it within 28 days.
