CRL 18-112 EIGHTEENTH CONGRESS OF THE FEDERATED STATES OF MICRONESIA THIRD REGULAR SESSION, 2014 C.R. NO. 18-112 A RESOLUTION To ratify the Treaty between the Federated States of Micronesia and the Republic of Palau concerning the Maritime Boundaries and Cooperation on Related Matters, which was signed on behalf of both State Parties in 2006. WHEREAS, the jurisdiction over certain territory and waters 1 of the Federated States of Micronesia is set forth in Article I of 2 the Constitution of the Federated States of Micronesia and 3 elaborated upon in title 18 of the Code of the Federated Stats of 4 Micronesia, including assertion of an exclusive economic zone 5 extending up to 200 nautical miles outward from baselines; and 6 WHEREAS, the Constitution of the Federated States of 7 Micronesia permits limitation for jurisdiction over waters 8 pursuant to international treaty obligations; and 9 WHEREAS, the Exclusive Economic Zones of the Federated States 10 of Micronesia and the Republic of Palau overlap in some areas; and 11 WHEREAS, the international practice in this circumstance is 12 to negotiate a treaty establishing the boundaries of each nation’s 13 waters; and 14 WHEREAS, the Treaty between the Federated States of 15 Micronesia and the Republic of Palau Concerning Maritime 16 Boundaries and Cooperation on Related Matters establishes a line 17 of delimitation between the Exclusive Economic Zones over which 18 each nation respectively exercises sovereign rights and/or 19 jurisdiction; and 20 C.R. NO. 18-112 2 of 2 WHEREAS, the President of the Federated States of Micronesia 1 and the Republic of Palau have signed the Treaty between the 2 Federated States of Micronesia and the Republic of Palau 3 Concerning Maritime Boundaries and Cooperation on Related Matters 4 in 2006, and the Congress of the Federated States of Micronesia 5 now desires to ratify the treaty; now, therefore, 6 BE IT RESOLVED by the Eighteenth Congress of the Federated 7 States of Micronesia, Third Regular Session, 2014, that Congress 8 hereby ratifies the Treaty Between the Federated States of 9 Micronesia and the Republic of Palau Concerning Maritime 10 Boundaries and Cooperation on Related Matters, which signed on 11 behalf of both State Parties in 2006; and 12 BE IT FURTHER RESOLVED that certified copies of this 13 resolution be transmitted to the President of the Federated States 14 of Micronesia. 15 16 Date: 1/16/14 Introduced by: /s/ Florencio S.
