Page 5679 COUNCIL OF MINISTERS REGULA TlON No. 192 /2010 COUNCIL OF MINISTERS REGULATION TO PROVIDE FOR THE ESTABLISHMENT OF THE SUGAR CORPORA TION This Regulation is issued by the Council of Ministers pursuant to Article 5 of the Definition of Powers and Duties of the Executive Organs of the FederaI Democratic Republic of Ethiopia Proclamation No. 691/20 I O and Article 4 7( I )(a) of the Public Enterprises Proclamation No. 25/1992. l. Sbort Title 2. 3. This Regulation may be cited as the "Sugar Corporation Establishment Council of Ministers Regulation No. 192 / 20 I O". Establishment 1/ The Sugar Corporation (hereinafter the "Corporation") is hereby established as a public enterprise. 21 The Corporation shan be governed by the Public Enterprises Proclamation No. 25/1992 . Purposes The purposes for which the Corporation IS established are: I I 2/ 31 41 5/ 61 71 .81 91 to grow sugarcane and other sugar yielding crops; to process and produce sugar, sugar products, sugar by-products and products of sugar by-products; to sell its products and by-products in the domestic and export markets; to cause the undertaking of feasibility studies, design preparation, technology selection and negotiation, erection and comrmsslOnmg of new sugar development and expansion projects; in cooperation with the relevant organs, to undertake studies and research in the field of sugar cane plantation and sugar production technologies and implement useful results thereof; in cooperation with capable domestic enterprises, to cause the designing and fabrication of machineries and spare parts required by public sugar factories; to possess, in accordance with the law, and develop lands required for its operations; to encourage and support sugar cane growers who are supplying their cane products to public sugar factories; to cooperate with the concemed educational institutions in producing the required type, number and quality of trained manpower for the sugar industry; 1lt ?;;l~hì-n t.Y./--1:\ ~:>t·)· :>Ib"l "''l'C ii UP,C i'ìE .~ ') ~i'i.i' '1.9". The authorized capitai of the Corporation is Birr 41 ,999,731,264 (forty one billion nine hundred ninety nine million seven hundred thirty one thousand two hundred sixty four Birr) of which Birr 6,042,512,614 (s ix billion forty two million five hundred twelve thousand six hundred fourteen Birr) is paid up in cash and in kind. Liability Thé Corporation shall not be held liable beyond its total assets. 8. PuratjoD 9. The Corporation is established for an indefinite duration. 'z. fl +C Dissolution of the Ethiopian Sugar Developrnent Agency The Ethiopian Sugar Development Agency established under Proclamation No. 504/2006 is hereby disso lved pursuant to Article 34 of the Definition of Powers and Duties of the Executive Organs of the Federai Democratic Republic of Ethiop ia Proc lamation No. 691120 I O. Transfer of Rjgbts and Obligatjons The rights and obligations of the Metahara Sugar Factory establ ished under the Council of Ministers Regu lation No. 88/1992, the Wonji/Sheoa Sugar Factory established under the Council of Ministers Regulation No. 89/1992, the Finchaa Sugar Factory established under tbe Council of Ministers Regulation No. 199/1994, the Tendaho Sugar Factory established under the Council of Ministers Regulation No. 122/2006 and the Ethiopian Sugar Development Agency established under Proclamation No. 504/2006 are hereby transferred to the Corporation. Effectjve Date This Regulation shall come into force as of the 29th day of October, 20 I O. Done at Addis Ababa, this 2nd day of December, 2010.
