Page 62 PROCLAMATION No. 142 OF 1978 A PROCLAMATION '.I'O PROVIDE FOR THE ESTABLISHMENT OF THE STATE FARMS DEVELOPMENT AUTHORITY "ETfflOPIA TIKDEM" WHEREAS, it is believed that agriculture, the foundation for building up the national economy of the country and the progress and prosperity of the broad masses, can play its ap propriate role in the struggle to liberate the country's economy from imperialist dependency inherited from the defunct feudo capitalist economic order and, thereby, achieve self-reliance, only when it is exploited on a large scale by the State on a modern basis and when large scale production i~ achieved; WHEREAS, the problem of the short,ige of crops, highly demanded by the broad masses, arising from the failure of peasant associa.tions to produce them on a scale commensurate with their demand due to natural disasters or other causes, can be overcome on the basis of self-reliance only when the State establishes large scale farms and produces such crops; WHEREAS, the State can play its vanguard role in open ing up, vast development averiues only when it establishes large scale state farms and, through them, . conducts the study am;! exploiti1tion of areas having vast agricultural development po tential; WHEREAS, in order to achieve these obiectives and to expand the participation of State farms and make them more efficient and to regulate them on a uniform and comprehensive basis by coordinating their administrll/tion, it has been deemed necessary to establish an autonomous public Authority; f1.tL1'P. fJJ;J-~t-'P. Short Title This Proclamaiion may be cited as the · "State Farms Development Authority Proclamation No. 142/1978." 2 . Definitions In this Proclamation, unless the context otherwise requires: ( 1 ) "corporation" shall mean any agricultural development organization es~ablished by the Authority pursuant to this Proclamation and includes: (a) the Uppec Awash Valley Agricultural Develop ment Corporation established under Legal Notice No. 27/19'76; (b) the Middle Awash Valley Agricultural Develop ment Corporation established under Legal Notice No. 28:11976; ( c) the Rift Valley Agricultural Development Corpo ration established under Legal Notice No. 29/ 1976; ( d) :the Hararghe Agricultural Development Corpora tion established under Legal Notice No. 32/1976; (e) the Tendaho Agricultural Development CorJX>ra tion established under Legal Notice No. 33/1976; (f) the Gewane Agricu1tural Development Corpora tion established under Legal Notice No. 37/1976. (2) "Mini&ter" shall mean the Minister of Agriculture and Settlement. 3. Establishment There is hereby established the State Farms Development Authority (hereinaftec the "Authority") as an autonomous Public Authority having juridical personality. 4. Head Office The Authority shall have its head office in Addis Ababa and may establish 6ranch offices in places within the coun ~Y as it may deem necessary. 5. Purposes The purposes for which the Authority is established are: ( 1 ) to be respoosible for the overall direction, supervision and coordination of the management and operation of corporations; (2) to clraw up a coordinated common plan for all corpo rations in line with the Nation's overall plan; (3) .to ensure efficient functioning of all corporations; ( 4) to carry out studies needed to establish agro-industrial complexes. 6. Powers and Duties The Authority shall have all the powers necessary for tho , attainment of its objectives. (I) r+oo/ltl-tw-' 1''11.+m 11+ tr'f 'f''iro, P't- J\llh.f:f., f"'l.h+h-:r-1 11~ /1,l', f,1.1.'"'I A I ( 1) determine the area and location of land to be exploit ed by State fanns in consultation with concerned government offices; ( 2) with the approval of the Minister: (a) fix each corporation's ;annual budget including development budget; (b) decide on loan to be contracted by each corpo ration; ( c) recommend the appointment of the general managers and assistant general managers of cor porations; ( d) establish agricultural development corporations; confer juridical personality on, and define t)le powers and duties of such corporations; and ( e) borrow mooey a,!I may be ,decessary for its acti vities. ( 3) dissolve and liquidate any corpot'ation with the ap!. proval of the Council of Ministers and in accordancec with regulations 'issued hereunder; ( 4) establish agro-industrial complexes with the approval of the Minister and in consultation with the Ministry of Industry; (5) ensure national or international markets for the pro, duces of corponitions; ( 6) amalgamate two or more corporations when it finds it necessary for the impwvement of the operation of the corporations; (7) make the necessary study with respect to each corpo ration and implement its findings; ( 8) closely supervise and operate the activities of any oor poration whenever- it finds >t necessary; (9) follow up and supervise the implementation of the coordinated common plan it has drawn up in line with the Nation's ovemll plan. for all the corp~ratioils; ( 10) receiive annual budget pioposals from each corpora tion, including development budget; analyse said bud get proposals and prepare appropriate alternative bud get proposals for each corporation, iJ' it finds it neces sary; ( 11 ) own, possess and dispose of .any property as may be necessary; ( 12) open and operate bank accounts, 7. Organization The Authority shall have: ( 1) a General Manager; and ( 2) the necessary staff. 8. The General Manager ( 1) The General Manager of ,the Authority shall be ap pointed by the Government on the recommendation of the Minister. ( 2) The General Manager shall be the chief executive of the Authority an\i shall, under the overall supervision of the· Minister, be responsible for the proper admini stration and operation of .the Authority. " ( a J an ploy, dismiss or demote any personnel of the· Authority, fix their salarie& and allowances; (b) prepar~ plans 'and programmes in accordance with directives issued by the Minister; ( c) effect payment in accordance with 11:he aipproV!l(l annual bt1dget and the work programme of the Authority; (d) represent the Authority in any legal proceeding; ( e) submit annual reports to the Minister; ( f) prepare and submit annual budget proposals of the Authority to the Minister for approval. (4) The Gen.era! Manager may delegate part of hls powers and duties to the employees of the Authority to the extent necessary for the efficient operation of the activities of the Authority, 9. Fund The fund of the Authority shall consist of: ( 1) contributions made by the corporations; and (2) Government financial subsidies as may be required. 10. Contribution and Fiscal Year ( 1 ) The contributions of the corpora;tious to the budget of the Authority shall be proportiOillal to their annual expense budget. (2) Each corporation shal), unless a different time of pay ment is specified by the Authority, deposit in •the Authority's Bank Accounts its share of collltribution to the Authority's annual budget every three mooiths &tarting from the beginning of the Authority's fiscal year. ( 3 ) The fiscal year of the Authority shall end on the 30th day of Megabit and begin on ,the 1st day of Miazia. 11 . Auditors ( 1) The books of accounts and all financial matters of the Authority shall be audited annually by the Audiltor General or by auditors appointed by him. (2) The Auditor-General may, at any time, audit 1he · books of accounts and all financial matters of the Authority. ( 3) The report of the auditors in accordance with sub arti,cle (I) shall be submitted to the Authority and to the Auditor-General within six ( 6) months from the close of the fiscal year. 12.
