SOLD WASTE MANAGEMENT PROCLAMATION WHEREAS, it is essential to promote community participation in order to prevent the adverse effects and to enhance the benefits resulting from solid wastes; WHEREAS, solid waste management action plans designed by, and implemented at, the lowest administrative units of urban administrations can ensure community participation; NOW, THEREFORE, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows” PART ONE GENERAL 1. Short Title This Proclamation maybe cited as “Solid Waste Management Proclamation No.513 /2007.” 2. Definition In this Proclamation: 1/ “Environmental Protection Agency” means the Authority or the environmental protection organ of a Regional State; xo‰ሦስተኛ ›mT qÜ R 03 xÄþS xbÆ የካቲት 5 qN 09)(9 13th Year No. 13 Addis Ababa 12th February, 2007 gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3525 ץጥּׁש በአዋጅ ֳُד ''ጣንָםֳֹו'' /2 2)(5/09)(5 የאּהּהـው የአካּתֹו ጥበቃ ጣን ነው፤ָםֳֹו 3/ ''ጉድፍ'' ֳُד የጠבץስ ስעֹוን፣ የብُנ፣ የתጋף፣ ወይו የወץּׁש ׂُשנጥףጭን፣ የጨץቅ እףፊን፣ የוግብ ُףፊን እና የዕፅዋُ ቅُעን ጨצו የـጣֳበُን ቦٍ ውበُ ወይו ንፅሕና የגያሳጣ የגጠቅוו ይሁን የדይጠቅו ነው፤ ץነገ וንኛውד በֱግ וው ወይר צፈጥـየ ''ֳُד ውר'' /4 የרውነُ אብُ የרـጠው አካָ ነው፤ 5/ ''ክָָ'' ֳُד በኤُዮጵያ ፌዴֶףዊ ዲזክ ፅׂשበአን ُםንግא-ፐብֵክ ֱገע ያዊתף $7/1/ የֳאـከًُ ክֲָֹת ֳُד ٤ን በዚֱ አዋጅ አፈፃፀו የአዲר አበֹו እና የድפዳዋ አስـዳደ٤ץን ይጨָףו፤ 6/ ''ደנቅ ֳُד ''ָךָךּב የדይፈֳግ ـብֹ የـጣֳ דንኛውו ፈሳֹּל ወይו ነፋֹּל ያֲָነ ነገץ ነው፤ 7/ ''የደנቅ ָךָךּב አያያዝ'' ֳُד ደץቅ ָךָךּבን ሶָא ፣ُْדከד ጓጓዝ፣ד ብ፣רብרא አገָግֹُ וስወገድ፣ ወይד ፣וׂשጠא ስወገጃ ቦٍד ָךָךּבጥِ ያበቃֳُን የר ግ ነው፡፡נድד እንዲውָ ץֹוግـ ֳֶַ 3. የአዋጁ ዓֶד የአዋጁ ዓֶד ከአያያዙ ֵከָـ የ٤ָג አִٍዊ ዊֹורנበֱד ያዊናגከֶከִ ኢኮኖـፅዕኖን እየـ ፋይዳ ከደנቅ ָךָךּב እንዲገኝ የגያስ٤ָ አቅוን በሁִו ደנጃ דጐָበُ ነው፡፡ ክፍָ ሁֳُ የደנቅ ָךָךּב አያያዝ 4. የከדـ አስـዳደ٤צ አጠቃֶይ ግዴٍ 1/ የከדـ አስـዳደ٤צ በደנቅ ָךָךּב አገָግֹُ אስክ ኢን‌ስُאንُ እንዲ ስፋፋ የגያግዝ ٠ו ሁኔٍ אፍጠץ አֳֹْוው፡፡ 2/ ደנቅ ָךָךּבን በראብרብ፣ በדጓጓዝ፣ በጥቅו ֶይ በדዋָ ወይו በדስወገድ ውר וንኛውד ףדרגይ የֶ ץֹוግـ ከֳאגከـው የከדـው አስـዳደץ አካָ በቅድגያ ፈቃድ דግኘُ አֳበُ፡፡ 2/ “Authority” means the Environmental Protection Authority established pursuant to Proclamation No. 295/2002; 3/ “Litter” means anything that may or may not have any value, including glass, metal, cigarette butts, paper fabric, food, garden remnants or other materials that in any way spoil the aesthetics of the place or make it unhygienic; 4/ “person” means any natural or juridical person; 5/ “State” means regions states enumerated under Article 47(1) of the constitution of the Federal Democratic Republic of Ethiopia; for the application of this proclamation State includes Addis Ababa and Diredawa Administrations; 6/ “Solid Waste” means any thing that is neither liquid not gas and is discarded as unwanted; 7/ “Solid Waste Management” means the collection, transportation, storage, recycling or disposal of solid waste, or the subsequent use of a disposal site that is no longer operational. 3. Objective of the Proclamation The objective of this Proclamation is to enhance at all levels capacities to prevent the possible adverse impacts while creating economically and socially beneficial assets out of solid waste. PART TWO SOLID WASTE MANAGEMENT 4. General Obligations of Urban Administrations 1/ Urban administrations shall create enabling conditions to promote investment on the provision of solid waste management services. 2/ Any person shall obtain a permit from the concerned body of an urban administration prior to his engagement in the collection, transportation, use or disposal of solid waste. 3¹þ5)@5 gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3526 5. የደנቅ ָךָךּב አያያዝ ዕቅድ ዝግጅُ 1/ የከדـ አስـዳደ٤צ ዝቅـኛውን የአስـዳ ደץ እץከናْውንና የአካּתֹוያْውን ٧דበ ዘዴ ץףרገ አሳٍፊ የአנደֹו ָךነא ብרנ የደנቅ ָךָךּב አያያዝ ዕቅድ ـዘጋጅِ እንዲـገበד ץድנግ አֳֹْוው፡፡ 2/ እያንዳንዱ ክָָ ወይו የከדـ አስـዳ ደשף ץ በגወስነው የጊዜ ַרዳ ُנטא የደנቅ ָךָךּב አያያዝ ዕቅድና የዕቅድ አፈፃፀו ዘገד ֹוዘጋጀُ አֳበُ፡፡ 3/ በዚֱ አንׂשጽ ንዑስ አንׂשጽ /2/ የֳאـ ከـው ዕቅድና ዘገֹו በዝቅـኛው የአስـ ዳደץ እץከን በגዘጋጅ የደנቅ ָךָךּב አያያዝ ዕቅድና በዕቅድ አፈፃፀו ዘገֹו ֶይ አֳበُ፡፡ ץׂשጠናא ِץስאـ 4/ የከדـ አስـዳደ٤צ፣ ሀ/ የደנቅ ָךָךּב አያያዝ ዕቅድ የדዘጋ ጀُና የـאግበץ፣ ׂשףጠד ው የጉድፍֹْוገנደـክُ የָו /ֳ የሕ ና በַֹ٤ץበየጎዳናው ዳ ያዎ٤ג ዝብ דዘውעـያ םፍףዎאׂשא ٤ጣ ْውን የנדጋገጥ፣ ּ/ የጉድፍ דጠגׂשףያ ָِז ሳይዝנ ከנክ ָךָךּבው በየወቅً אነሳًን የנדጋገጥ፣ ףֹוግـ ስፋፊያד ግንዛቤ ּתֹוየአካ /א ُን የׂשדድና የדከናወን፣ ስץአያያዝ ጉድֳُ ֵደ ָךָךּב ቅנከደ /ט የ٤ָג ብክֳُን የאከֶከያ እוץጃ ጋገጥ፣נד ዱንרወא ٪ֶፊነِ٤ን ֳዝቅـኛው የአስـዳደץ እץከ ናْው ֵያስֶָـፉ ይ٤ִֶ፡፡ 6. በክָֹא ٤ካከָ የגደנግ የደנቅ ָךָךּב ዝውውץ 1/ እያንዳንዱ ክָָ ወደ ֶַ ክָָ በֶאክ የגያስወግደውን ደנቅ ָךָךּב በ٢ֳـ ሳነስ አֳበُ፡፡ד ጠንא 2/ ክָֹ٤ በክֶָْው አָፎ የגጓጓዝ ደנቅ םא ጥበቃ ּתֹוው የአካـከֳאגበ ָךָךּב ُנטא ጃנያና ደעאא ያ ቤُ በወጣע ጎ እንዲጓጓዝ ֵያስገድዱ ይ٤ִֶ፡፡ֹּלٍ 5. Solid Waste Management Planning 1/ Urban Administrations shall ensure the participation of the lowest administrative levels and their respective local communities in designing and implementing their respective solid waste management plans. 2/ Each Region or urban administration shall set its own schedule and, based on that, prepare its solid waste management plan and report of implementation. 3/ The plan and report referred to under Sub Article (2) of this Article shall be consolidated based on the solid waste management plans and implementation reports of the lowest administrative units. 4/ Urban administrations may transfer the following responsibilities to their lowest administrative units: a) the formulation and implementation of action plans on solid waste management; b) ensuring the installation of marked waste bins by streets and in other public places; c) ensuring the collection of solid wastes from waste bins with sufficient frequency to prevent overflow; d) planning and carrying out public awareness raising activities; e) ensuring that measures are taken to prevent pollution arising from the mishandling of solid wastes. 6/ Inter-Regional Movement of Solid Wastes 1/ Each Regional State shall keep the shipment of solid waste to other regions for final disposal at the minimum possible. 2/ Regional States may require any transit of solid waste through their region to be packaged and transported in conformity with the directives and standards issued by the concerned environmental agency. 3¹þ5)@6 gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3527 3/ ደנቅ ָךָךּבን ከአንድ ክָָ ወይו የከדـ አስـዳደץ ወደ ֶַ ክָָ ወይו የከדـ አስـዳደץ ָኮ דስወገድ የ٢ֳגው נـካּתው ክָָ ወይו የከדـ አስـዳደץ በָךָךּבው ይነֹُוׂשـ ያዊּתֹוአካ וወይ וׂשጠאֳ ሶָא እንዳֳው וስወገድ አቅדֳ ንገድא ውֳֹו ֳֶኪው በፅሁፍ תያሳውቅ ብ٢ ነው፡፡ ክፍָ מስُ 7. ጠבץስና ጣሳ 1/ የጠבץስ ወይו የצּבץּב ጣሳ አ٤ףו ወይו አስאጪ ጠשבץ ወይו የצּבץּב ጣሳው የአገָግֹُ ዘאኑ እንዳበቃ ָאሶ የגወስድበُን ወይו እንዲወרድ የגያስ ደץግበُንና ָאሶ በጥቅו ֶይ የגውָ በُን ዘዴ אዘץጋُና ـאግበץ አֳበُ፡፡ 2/ ֳዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ አـገ ץጠ ֹּלֶאـ ٤צዳደـአስ דـ፣ የከץበֹו ጣሳ በጊዜያዊነُ צּבץּבየ וስ ወይב የגከ٤דበُ ቦٍ אאደּשንና ክו٤ًו በየወቅً אነሳًን נדጋገጥ አֳֹْוው፡፡ 8. ስֳፕֶስٌክ ከנጢِ٤ 1/ በָםֳֹוጣኑ በגወጣ עאאያ ከגወ ץበስብሶ ወደ አፈ ִֶׂשበ צוን ጀׂש ነውר የגደֳֹוቅ ֲאን አֲֳאኑን የגያሳይ נገበُን የፕֶስٌክ ከנደـክُ ያָָו ጢُ ֳገበያ דቅנብ የـከֳከֳ ነው፡፡ 2/ ውፍץُה ֵג 0.03 ًנ እና ከ0.03 ץኖ በስብሶ ከአፈֲ וበٍ٤ ץُה ֵג ጋץ የדይዋሃድ የፕֶስٌክ ከנጢُ የُנוד ወይו ወደ ሃገץ ውስጥ የדስገֹُו ፈቃድ אስጠُ የـከֳከֳ ነው፡፡ 3/ የዚֱ አንׂשጽ ንዑስ አንׂשጽ /2/ ድንጋጌ እንደـ ጠበׂש ֲኖ ָםֳֹוጣኑ ውፍֵג 0.03 ًנ ያንስ ֲኖגየ ץُה ֵג እና ከ0.03 ץُה በስብሶ ከአፈץ ጋץ የדይዋሃድ የፕֶስٌክ ከנጢُን ֳـይِ ֳـገֳፀ አገָግֹُ ብ٢ ወደ አገץ ውስጥ እንዲገֹו ወይו በአገץ ውስጥ እንዲُנא የגወስን עאאያ ያወጣָ ፡፡ 9. የአገֳገֳ የֹּלـከץካע ጐד 1/ የአገֳገֳ የֹּלـከץካע ጎדን ֳדስወገድ ወደ ኢُዮጵያ ግዛُ ውስጥ דስገֹُו የـከֳከֳ ነው፡፡ 3/ Solid waste may be transported from one Regional State or urban administration to another Regional State or urban administration only if the recipient Regional State or urban administration has notified the sender in writing of its capacity to recycle or dispose of it in an environmentally sound manner. PART THREE 7. Glass Containers and Tin Cans 1/ The manufacturer or importer of glass containers or tin cans shall develop and implement a system that enables it, on its own or through other persons, to collect and recycle used glass containers or tin cans. 2/ For the implementation of Sub-Article (1) of this Article urban administrations shall ensure that pre-collection sites are designated to collect used glass containers and tin cans, and emptied periodically. 8. Plastic Bags 1/ As of the date fixed under a directive to be issued by the Authority, it shall be unlawful to put on the market any plastic bag that is not labeled to how whether it is biodegradable or not. 2/ It is prohibited to grant permit for the manufacture or importation of any non biodegradable plastic bags with a wall thickness of 0.03 millimeters and less than 0.03 millimeters. 3/ Without prejudice to Sub-Article (2) of this Article, the Authority shall, through the issuance of a directive, determine the conditions under which plastic bags with wall thickness of 0.03 millimeters and less than 0.03 millimeters may be imported or manufactured locally for specified purposes. 9. Used Tires 1/ The importation of used tires into Ethiopian territory for the purpose of disposal is prohibited. 3¹þ5)@7 gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3528 2/ የአገֳገֳ የֹּלـከץካע ጎד አካּתֹוያዊ ץይነُ ֳֶው አገָግֹُ ወደ አገֹוׂשـ ውስጥ ֵገֹו የ٤ָגበُ ሁኔٍ ָםֳֹוጣኑ በגያወጣው עאאያ ይወרናָ፡፡ 0. ከוግብ ጋץ የـያያዙ ደנቅ ָךָךּבዎ٤ 1/ የוግብ ኢንዳስُעዎ٤ና የוግብ ቤِ٤ የגያאነጩُን ከוግብ ጋץ የـያያዘ ደנቅ ָךָךּב አካּתֹוያዊ ֹוׂשـይነُ ֳֹוው ሁኔٍ ראብרብና דስወገድ አֳֹْוው፡፡ አያያዝ ָךָךּב ቅנየደ ግብ ቤِ٤ו /2 ּתֹוው የአካـከֳאגዓٍْውን የץם ጥበቃ עםאያ ቤُ በגያወጣው עאאያ ው፡፡ֹْוአֳ ץግበـא ዘጋጀُናד ُנטא 3/ ነו ץֹוግብ ቤِ٤ የגያאነጩُን ደנቅ ָךָךּב የֳאגከُ የአካּתֹו ኦዲُ דካְድና የደנቅ ץግበـא ዘጋጀُናד አያያዝ ዕቅድ ָךָךּב አֳֹْוው፡፡ 01. የאኖעያ ቤُ ደנቅ ָךָךּב አያያዝ 1/ የእያንዳንዱ אኖעያ ቤُ ٪ֶፊ ֳዳግו አገָግֹُ የגውֳውን ከናካَው ከגጣָ ደנቅ ָךָךּב ֳይِ ֳד ָךָךּבስወገጃ ወደ ግ አֳበُ፡፡נድד ስץነው ቦٍ እንዲደרወـ 2/ የከדـ አስـዳደ٤צ በዚֱ አንׂשጽ ንዑስ አን ֹוያ አካעኖאኑُ የרወـበ ُנטא /ጽ /4ׂש ብרብראֳ ָךָךּב ቅנያ ቤُ ደעኖאየ ዎ٤ּת የגያስ٤ִ በּׂש የአገָግֹُ אስጪያ ፡፡ֹْוጋገጥ አֳנד ውንֶٍْחא ያዎ٤עכא 3/ ֳዚሁ ـግـ ץֹוብֹ የـዘጋጀ דጠגׂשףያ በአቅּתףያው እያֳ ጉድፍን በאንገድ፣ በጎץፍ ץּשֹוበ וስ ወይּשክ፣ በአውِץጃ ቦይ፣ በፓְא ጣּתያ፣ በስፖה ُץዳ፣ በከדـ ውስጥ በגገኝ የውሃ አካָ ወይו በֶַ የሕዝብ אጠגׂשያ ቦٍ אጣָ የـከֳከֳ ነው፡፡ 4/ እያንዳንዱ የከדـ አስـዳደץ የዚֱ አን ኑֲגየ גፈጻـ በግዴٍ ጽ ድንጋጌዎ٤ׂש ከֳָא ዎ٤ּתֹוያ አካעኖאውን የֹْו አֳበُ፡፡ 02. የግንֹٍוና የፍץስֹּלף ደנቅ ָךָךּב 1/ የከדـ አስـዳደ٤צ በףሳْው ወይו ከግን ָךָךּב ቅנዋዋָ የደאበ ץጋ ጅِ٤ץድ ֹٍו ጉድጓዶ٤ን ֹוየካ וስወገጃ ቦٍዎ٤ን ወይד ከሕንፃ ፍץስֹּלף በגገኝ ጠጠץ ወይו አ₪ዋ ወይּבـ וፍצ በወጣ አፈץ እንዲד ִזድנግ ይ٤ִֶ፡፡ 2/ The importation of used tires for environmentally acceptable use shall be determined by directives issued by the Authority. 10. Food Related Solid Wastes 1/ Food industries and restaurants shall collect, store and dispose of the food related solid wastes they generate in an environmentally sound manner. 2/ Restaurants shall design and implement solid waste management systems in accordance with directives issued by the concerned environmental agency. 3/ Existing restaurants shall undertake environmental audit and prepare and implement solid waste management plans. 11. Management of Household Solid Wastes 1/ The head of each household shall ensure that recyclable solid wastes are segregated from those that are destined for final disposal and are taken to the collection site designated for such wastes. 2/ Urban administrations shall, in the residential areas designated pursuant to Sub-Article (4) of this Article, ensure that adequate household solid waste collection facilities are in place. 3/ It is prohibited to dispose of litter on streets, waterways, parks, bus stops, train stations, sport fields, water bodies in urban areas or in other public places while litter bins are available. 4/ Each urban administration shall delineate residential areas wherein the provisions of this Article shall have compulsory application. 12. Construction Debris and Demolition Wastes 1/ Urban administrations may themselves undertake or enter into agreements with construction enterprises to refill solid waste disposal sites or quarry pits with pebbles or gravel from demolished buildings or with excavated earth. 3¹þ5)@8 gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3529 2/ የግንֹٍו ፈቃድ የרגጠው የግንֹٍו ፍץስ ውּתገـበ ץየወጣ አፈ צፍּבـ וወይ ֹּלף ጩףּהـ ףםያስወግድ የגንገድ እንደא የףם አፈፃፀו ወይאـ ֶַ וሳሳይ ሕጋዊ ዋስُና תያץׂשብ ብ٢ ነው፡፡ ֹٍוያ ቤُ ግንץኖא דـየከ וንኛውד /3 ከאጀסא በፊُ የከדـ አስـዳደ٤צ አካּתֹוያዊ ֹוׂשـይነُ ֳֶው የደנቅ ָךָךּב አያያዝ በּׂש ዝግጅُ אኖסን נדጋገጥ አֳֹْוው፡፡ ክፍָ አُף 03. የደנቅ ד ָךָךּבጓጓዣ ֹּלـከץካעዎ٤ና עכאያዎ٤ ዊٍאዝገብ፣ ዓאאֳ ንעካץከֹּלـ ץـזֳֹו /1 וካְድ እንዲሁדֳ ףאץו ና የَክኒክֹוዝገו የאንጃ ፈቃድ ֳאስጠُ የሕግ ָםጣን ያֳው አካָ ـግץֹוና ሃֶፊነُ እንደـጠበׂש ֲኖ፣ የደנቅ ד ָךָךּבጓጓዣ ֹּלـከץካע ወይכא ו አገָግֹُ זድׂשዋִ አስאይ ከֶ ףםያ በע የאስጠُ ብቃً የֳאגከـው የአካּתֹו ጥበቃ ስגየ ץጋ ُץስፈא ያ ቤُ ካወጣውעםא ጋገጥנא סዳደـአስ דـኑ በከֲאስֳ דד አֳበُ፡፡ 2/ አግֹוብ ֳֹוው ሕግ የـወרነው የֹּלـከץካע ክብ ደُና אጠን እንደـጠበׂש ֲኖ፣ እያንዳንዱ የከדـ አስـዳደץ የደץቅ ד ָךָךּבጓጓዣ ሳቃሾ٤ንׂשያ አንעכא٤ንና የצሾፌ עካץከֹּלـ ክֱֹُ ֳאወרን እንዲሁו ከָክ ያֳፈ የደנቅ ץስፈא ያስፈָጉגከֶከָ የאֳ ጭነُን ָךָךּב ِ٤ን דውጣُ አֳበُ፡፡ 04. የደנቅ ד ָךָךּבስወገጃ ቦٍዎ٤ ግንֹٍו 1/ እያንዳንዱ የከדـ አስـዳደץ አግֹוብነُ ያֳውን የፌዴָף የአካּתֹו ደנጃ በאከָـ የደנቅ ד ָךָךּבስወገጃ ቦٍ እንዲገነֹוና አገָግֹُ እንዲרጥ דድנግ አֳበُ፡፡ 2/ የከדـ አስـዳደ٤צ ይֱ አዋጅ ከאውጣً በፊُ ግንֹٍוው በـጀנא ወይו በـከና ወነ የደנቅ ד ָךָךּבስወገጃ ቦٍ ֶይ አግֹוብ ኦዲُ ּתֹוየአካ ُנטא ው ሕግֳֹו ው፡፡ֹْוጋገጥ አֳנד ካְዱንא 3/ የከדـ አስـዳደ٤צ አዲስ የደנቅ ָךָךּב ቅנየደ ץֹוነ וወይ ֹוገነת ስወገጃ ቦٍד ብነֹُוአግ ָָךָךת ስወገጃ ቦٍד ָךָךּב ጽዕኖـ ּתֹוየአካ ُנטא ው ሕግֳֹו ግוገד የـካְደበُ ֲאኑን נדጋገጥ አֳֹْוው፡፡ 2/ Construction permits shall be issued only when the building contractor deposits a legally valid bond or any other instrument to ensure the environmentally sound disposal of construction debris or excavated earth. 3/ Urban administrations shall, before the commencement of any construction of residential houses, ensure the availability of adequate facility for an environmentally sound solid waste management. PART FOUR 13. Transportation of solid waste 1/ Without prejudice to the mandate of the appropriate agency to register, undertake annual registration and technical inspection of motor vehicles as well as to issue a driving license, the conformity of any vehicle or equipment with the specification set by the concerned environmental agency shall be ascertained by the relevant urban administration prior to its use for solid waste management. 2/ Each urban administration shall, without prejudice to the weight and size of vehicles determined under the relevant law, set standards to determine the skills of drivers and equipment operators and to prevent overloads of solid wastes. 14. Construction of Solid Waste Disposal Sites 1/ Each urban administration shall, in conformity with the relevant federal environmental standard, ensure that solid waste disposal sites are constructed and properly used. 2/ Urban administrations shall ensure that a solid waste disposal site that was under construction or was constructed prior to the coming into force of this Proclamation is subjected to environmental auditing as per the relevant law. 3/ Urban administrations shall ensure that any new solid waste disposal site being constructed or an existing solid waste disposal site undergoing any modification has had an environmental impact assessment according to the relevant law. 3¹þ5)@9 gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3530 05. በነץֹו የደנቅ ד ָךָךּבስወገጃ ቦٍዎ٤ ֶይ የአካּתֹו ኦዲُ ስֳדካְድ 1/ በነץֹו የደנቅ ד ָךָךּבስወገጃ ቦٍዎ٤ ֶይ የአካּתֹו ኦዲُ אካְዱን የנדጋገጥ ٪ֶፊነُ የየከדـው አስـዳደץ ይֲናָ፡፡ 2/ በዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ ُנטא በـካְደው የአካּתֹו ኦዲُ ُנטא የደנቅ ስጠُא ስወገጃው ቦٍ አገָግֹُד ָךָךּב ውּתֹוበአካ וጠָ በሕዝብ ጤና ወይׂשא ֶይ ጉዳُ ֵያስከָُ እንደ٤ָג ከـጠ ግנድד ያָךָךד ቤً አስፈֶጊውንֳֹו נጠנ አֳበُ፡፡ ָךָךּב ቅנወ የደــየ וወይ אּבያ ףם /3 ስወገጃ ቦٍ ֳֶַ አገָግֹُ እንዲውָד የגወרንበُን የአካא ּתֹוስፈָםֳֹו ُץ ጣኑ በעאאያ ֵያወጣ ይ٤ֶָ፡፡ ክፍָ አוስُ ָዩ ָዩ ድንጋጌዎ٤ 06. የፍּُ ብሔץ ٪ֶፊነُ 1/ የደנቅ ד ָךָךּבስወገጃ ቦٍ በףם ֶይ እያֳ ወይו ከـዘጋ በኋֶ በአካּתֹו፣ በרው ጤና ወይו በንብُנ ֶይ ጉዳُ ካደרנ ጥፋـኝነُ נדጋገጥ ሳያስፈָግ ֳֹוቤً ٪ֶፊ ይֲናָ፡፡ 2/ የዚֱ አንׂשፅ ንዑስ አንׂשፅ /1/ ድንጋጌ እንደـጠበׂש ֲኖ፣ ከ٪ֶፊነُ ነፃ ֲאን የ٢ֳגው ጉዳً በـጎጂው በשף ወይו ደግז የደנቅ ד ָךָךּבስወገጂያው ֳֹוቤُ ٪ֶፊነُ በֳַበُ በמስـኛ ወገን אድשנ ነው፡፡ ጋገጥ ብ٢נת 3/ በዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ ُנטא ٤ֳውגብ የנቅא የካሳ ጥያቄ וንኛውד ጉዳُ אድשנ ከٍወׂשበُ ׂשን ጀצו በሁֳُ አُא ውስጥ ይֲናָ፡፡ 07. ቅ ጣ ُ 1/ በֳאגከـው የአካּתֹו ጥበቃ עםאያ ቤُ በወጣ עאאያ ُנטא ָዩ ፈቃድ ከـገኘ በኋֶ እንዲـገበץ የـወרነበُን የደנቅ ָךָךּב አያያዝ ፕצጀክُ ያֳፈቃድ የـገበר נው ጥፋُ ፈፅָחና አግֹוብ ያֳው የወንጀָ ሕግ ـፈፃג ይֲንበָٍ፡፡ 15. Auditing Existing Solid Waste Disposal Sites 1/ Each urban administration is responsible for ensuring that an environmental audit is carried out on every existing solid waste disposal site. 2/ The owner of any solid waste disposal site shall make the necessary modifications if the environmental audit made under Sub-Article (1) of this Article shows that its continued operation poses a risk to public health or the environment. 3/ The Authority may prescribe environmental criteria to determine the alternative use of a solid waste disposal site that has ceased operation or is abandoned. PART FIVE MISCELLANEOUS PROVISIONS 16. Civil Liability 1/ The owner of any solid waste disposal site shall, regardless of fault, be liable for any damage caused to the environment, human health or property in the course of its operation and after its closure. 2/ Without prejudice to Sub-Article (1) of this Article, exemption from liability shall be granted only when verified that it is the victim himself or a third party for whom the owner of the solid waste disposal sit is not responsible that has caused the damage. 3/ Any claim for damage under Sub-Article (1) of this Article shall be barred by a period of limitation unless brought within two years from the date on which the occurrence of the damage was known. 17. Penalty 1/ Without obtaining authorization, a person who implements a solid waste management project that requires special permit before its implementation as determined in a directive issued by the relevant environmental agency commits an offence and shall be liable according to the relevant provision of the Criminal Code. 3¹þ5)# gA ØÁ‰L U¶T Uz¤È qÜ R 03 የካቲት 5 qN 09)(9 ›.M Federal Negarit Gazeta No. .13 12th February, 2007… page 3531 2/ በዚֱ አንׂשፅ ንዑስ አንׂשፅ /1/ ُנטא ፈቃድ ראጠً፣ የፕצጀክًን ֳֹוቤُ አግֹוብ ֳֹוው የአካּתֹו ደנጃ የـዘנዘנ ָـከגፍ ከֳֶـאፈֶጊ ሁኔٍን በـ ሃֶፊነُ ነፃ አያደץገውו፡፡ 3/ የዚֱን አዋጅ ድንጋጌዎ٤ የֳֶـגፍ דን ኛውו አ٤ףו፣ አስאጪ ወይָך וጭ ጥፋُ ፈፅזአָና አግֹוብ ያֶْው የወን ጀָ ሕግ ድንጋጌዎـ ٤ፈጻג ይֲኑበָٍ፡ 4/ የዚֱ አንׂשጽ ንዑስ አንׂשጽ /2/ እና /3/ ድንጋጌዎ٤ እንደـጠበּׁש ֲኖ እያንዳንዱ የከדـ አስـዳደץ ስֳደנቅ ָךָךּב አያያዝ በዚֱ አዋጅ የـደነገጉ ግዴٍዎ٤ን אֳֹו ወጣُ ጥፋُ በגፈፅר וው ֶይ ـፈጻג የֲגኑ የገንዘብ ቅጣِ٤ን אወרንና ይ٤ֶָ፡፡ וስፈጸד 08. ደንብና עאאያ የדውጣُ ָםጣን 1/ የגኒስُו ٤צክץ ቤُ ይֱንን አዋጅ በגገـ ֹוግףֹוዊ ֳדድנግ የגያስፈָጉ ደንቦ٤ን ֵያወጣ ይ٤ֶָ፡፡ ጽׂשጣኑ ይֱን አዋጅና በዚֱ አንָםֳֹו /2 ንዑስ አንׂשጽ /1/ የגወጡ ደንቦ٤ን በגገـ ֹוግףֹוዊ ֳדድנግ የגያስፈָጉ ያዎ٤ን ֵያወጣ ይ٤ֶָ፡፡עאא 09. አዋጁ የגፀናበُ ጊዜ ይֱ አዋጅ በነጋُע ጋዜጣ ٍُז ከወጣበُ ׂשን ጀצו የፀና ይֲናָ፡፡ አዲስ አበֹו የካٌُ 5 ׂשን !9)(9 ዓ.ו ግדץ ወָደ ጊዮץጊስ የኢُዮጵֱየ ፌዴֶףዊ ዲזክתףያዊ ዚዳንُפፐብֵክፕע 2/ The granting of authorization pursuant to the above Sub-Article does not exonerate the proponent from liability that emanates due to contravention of the requirements specified under the relevant environmental standard. 3/ Any manufacturer, importer or seller who violates the provision of this Proclamation commits an offence and shall be liable according to the relevant provisions of the Criminal Code. 4/ Without prejudice to the provisions of Sub Articles (2) and (3) of this Article, each urban administration may prescribe and enforce fines to be imposed on a person failing to comply with the requirements of this Proclamation relating to solid waste management. 18. Power to Issue Regulations and Directives 1/ The Council of Ministers may issue regulations necessary for the proper implementation of this Proclamation. 2/ The Authority may issue directives for the proper implementation of this Proclamation and regulations issued under Sub-Article (1) of this Article. 19. Effective Date This Proclamation shall come in to force up on Publication in the Federal Negarit Gazeta.
