Revised Federal Ethics and Anti-Corruption Commission Proclamation No. 1236/2021

1. Short Title ይህ አዋጅ “የፌዴራል የስነ-ምግባርና የፀረ ሙስና This Proclamation may be cited as the ኮሚሽን ማቋቋሚያ አዋጅን ለማሻሻል የወጣ አዋጅ “Revised Federal Ethics and Anti-Corruption ቁጥር ፩ሺ፪፻፴፮/፪ሺ፲፫’’ ተብሎ ሊጠቀስ ይችላል፡፡ Commission Proclamation No. 1236/2021” ፪. ትርጓሜ 2. Definition የቃሉ አግባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ Unless the context requires otherwise in this በስተቀር በዚህ አዋጅ ውስጥ፡- Proclamation: 1/ "Commission" means The Federal Ethics ፩/ “ኮሚሽን’’ ማለት የፌዴራል የሥነ-ምግባርና and Anti-Corruption Commission; የፀረ ሙስና ኮሚሽን ነው፣ ፪/ “ኮሚሽነር ወይም ምክትል ኮሚሽነር’’ ማለት 2/ "Commissioner or Deputy commissioner" እንደ ቅደም ተከተሉ የኮሚሽኑ ኮሚሽነር ወይም means the Commissioner or the ምክትል ኮሚሽነር ነው፣ DeputyCommissioner of the Commission respectively; gA ፲፪ሺ፱፻፹፮ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12986 ፫/ “የመንግስት መስሪያ ቤት’’ ማለት ሙሉ በሙሉ 3/ "Public Office" means any office the ወይም በከፊል በመንግስት በጀት የሚተዳደር budget of which is fully or partially እና የፌዴራል መንግስቱ ስራዎች allocated by the Government and in which any Federal Government activity የሚከናወኑበት ማናቸውም መስሪያ ቤት ነው፣ is performed; ፬/ “የመንግስት የልማት ድርጅት’’ ማለት 4/ "Public Enterprise" means any Public የመንግስት ባለቤትነት ድርሻ በሙሉ ወይም Enterprise or Share Company the በከፊል ያለበት ማንኛውም የፌዴራል ownership of which is fully or partly መንግስት የልማት ድርጅት ወይም የአክሲዮን owned by the Federal Government; ኩባንያ ነው፣ ፭/ “ህዝባዊ ድርጅት’’ ማለት በማንኛውም አግባብ 5/ “Public Organization” means a body that ከአባላት ወይም ከህዝብ የተሰበሰበ ወይም administers money, property or other ለህዝባዊ አገልግሎት ታስቦ የተሰበሰበ ገንዘብ፣ resources collected in any form from ንብረት ወይም ሌላ ሃብትን የሚያስተዳደር members or the public or collected for public service and includes the private አካልንና አግባብነት ያለው ኩባንያን sector company or organization; it may የሚያካትት የግል ዘርፍ ሲሆን የሚከተሉትን not however include the following: አያካትትም፡- a) Religious organization; ሀ) የሃይማኖት ድርጅትን፣ b) Political organization/parties; ለ) የፖለቲካ ድርጅትን(ፓርቲን)፣ c) International organizations; and ሐ) የዓለም አቀፍ ድርጅትን፣ እና d) Edir or other traditional or religious መ)ዕድርንና ተመሳሳይ ባህላዊ ወይም association; ሃይማኖታዊ ይዘት ያለው ማህበርን፡፡ ፮/ “የመንግስት ባለስልጣን’’ ማለት ለዚህ አዋጅ 6/ "Public Official" for the purpose of this አፈጻጸም ሲባል የህዝብ ተወካዮች ምክር ቤት Proclamation, means Members, Speakers አባላት፣ አፈጉባኤና ምክትል አፈጉባኤ፣ and Deputy Speakers of the House of People's Representatives, Speakers and የፌዴሬሽን ምክር ቤት አፈጉባኤና ምክትል Deputy Speakers of the House of the አፈጉባኤ፣ የሪፐብሊኩን ፕሬዚዳንት፣ ጠቅላይ Federation, the President of the ሚኒስቴርና ምክትል ጠቅላይ ሚኒስቴር፣ Republic, the Prime Minister, Deputy ሚኒስቴሮች፣ ሚኒስቴርዴኤታዎች፣ ኮሚሽነሮች፣ Prime Minister, Ministers, State ምክትል ኮሚሽነሮች፣ ዳይሬክተሮች፣ ምክትል Ministers, Commissioners, Vice ዳይሬክተሮች፣ ስራአስኪያጆች፣ ምክትል ስራ Commissioners, Directors, Deputy አስኪያጆች፣ የፌዴራል ፍርድ ቤቶች Directors, General Managers, Deputy ፕሬዚዳንት፣ ምክትል ፕሬዚዳንት እና ዳኞች፣ General Managers , Presidents, Vice ዋና ጠቅላይ አቃቤ ህግ፣ ምክትል ጠቅላይ Presidents and Judges of Federal Courts, አቃቤ ህግ እና አቃቢያን ህጎች፣ የዩኒቨርስቲ the Attorney General, Deputy Attorney gA ፲፪ሺ፱፻፹፯ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12987 ፕሬዚዳንቶችና ምክትል ፕሬዚዳንቶች፣ የኮሌጅ General and Public Prosecutors, ዲኖችንና ምክትል ዲኖች፣ የሆስፒታል ስራ አኪያጆች Presidents and Deputy Presidents of እና ሌሎች በተመሳሳይ በሁሉም ደረጃ የሚገኙትን Universities; Deans and Deputy Deans of Colleges; Directors of Hospitals and የስራ ኃፊዎችን ያካትታል፣ other officials with similar rank at all levels; ፯/ “የመንግስት ሰራተኛ’’ ማለት በዚህ አንቀፅ 7/ "Public Employee" means any person, ንዑስ አንቀፅ ፮ ውስጥ ከተጠቀሱት ውጭ other than those referred to under Sub- በማንኛውም የመንግስት መስሪያ ቤት ውስጥ Article (6) of this Article, employed or assigned, and working in any public ተቀጥሮ ወይም ተመድቦ በቋሚነት ወይም office permanently or temporarily for a በጊዜዊነት ከ፫ ወር በላይ ለተራዘመ ጊዜ period of time longer than three months; የሚሰራ ሰው ነው፣ ፰/ “የመንግስት የልማት ድርጅት ባለስልጣን” 8/ “Official of a Public Enterprise” for the ማለት ለዚህ አዋጅ አፈፃፀም ሲባል የድርጅቱ purpose of this proclamation shall include የዳይሬክተሮችና የስራ አመራር ቦርድ Chairman and Members of the Board of ሰብሳቢና አባላትን፣ የድርጅቱ ኃላፊ እና directors or Boards of Management of the Enterprise, the Head and Deputy Heads of ምክትል ኃላፊዎችን፣ በቦርዱ ወይም በስራ the enterprise as well as any management አመራሩ ወይም በሌላ ስልጣን በአለው አካል member appointed or assigned by the የተሾመ ወይም የተመደበ የስራ ኃላፊን Board, Board of Management or any other ያካትታል፣ competent body; ፱/ “የህዝባዊ ድርጅት ባለስልጣን” ማለት ለዚህ 9/ “Official of a Public Organization” for the purpose of this proclamation shall include አዋጅ አፈፃፀም ሲባል የድርጅቱ Chairman and Members of the Board of የዳይሬክተሮችና የስራ አመራር ቦርድ Directors or Board of Management of the ሰብሳቢና አባላትን፣ የድርጅቱ ኃላፊ እና organization, the Head and Deputy Heads ምክትል ኃላፊዎችን፣ በቦርዱ ወይም በድርጅቱ of the organization as well as any የበላይ ኃላፊ ወይም በሌላ ስልጣን በአለው management member appointed or አካል የተሾመ ወይም የተመደበ የስራ ኃላፊን assigned by the Board, head of the ያካትታል፣ Organization or any other competent body; ፲/ “የመንግስት የልማት ድርጅት ወይም የህዝባዊ 10/ "Employee of a public enterprise or ድርጅት ሰራተኛ” ማለት በድርጅቱ ውስጥ public organization" means any person ተቀጥሮ ወይም ተመድቦ በቋሚነት ወይም employed or assigned and working in በጊዜዊነት ከ፫ወር በላይ ለተራዘመ ጊዜ any public enterprise or organization የሚሰራ ሰው ነው፣ permanently or temporarily for a period of time longer than three months; gA ፲፪ሺ፱፻፹፰ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12988 ፲፩/ “የስነምግባር መከታታያ ክፍሎች” ማለት 11/ “Ethics Liaison Units” are organizations በመንግስት መስሪያ ቤት ወይም በመንግስት that the ethics and anticorruption ልማት ድርጅቶች ወይም በህዝባዊ ድርጅቶች commission creates under public offices, public enterprises or public organizations ውስጥ የስነምግባርና የፀረ ሙስና ኮሚሽን for it to accomplish its tasks in the ስራውንበየተቋማቱ ለማስራት የሚያደራጀቸው respective institutions; አደረጃጀቶች ናቸው፣ ፲፪/ “የስነምግባር መከታታያ ክፍል ኃላፊ ወይም 12/ “Ethics officer or employee of ethics ሰራተኛ” ማለት በመንግስት መስሪያ ቤት liaison unit” means any person assigned ወይም በመንግስት ልማት ድርጅት ወይም or employed and working in public በህዝባዊ ድርጅት ውስጥ ተመድቦ ወይም offices, public enterprises or public ተቀጥሮ የሚሰራ ማለት ነው፣ organizations; ፲፫/ “አደረጃጀቶች” ማለት ኮሚሽኑ በመንግስት ወይም 13/ “Mass Organizations” means students’ በግል የትምህርት ተቋማት ዉስጥ መልካም ethics and anticorruption clubs the ስነምግባርን ለመገንባት እና ሙስናን commission creates in public or private educational institutions, or other various ለመከላከል እንዲያስችለው የሚያደራጀቸው organizations created in public offices, የተማሪዎች የስነ-ምግባርና የፀረ ሙስና ክበባት public enterprises and public ወይም በመንግስት መስሪያ ቤት፣ የመንግስት organizations so as to enable it to ልማት ድርጅት እና ህዝባዊ ድርጅት ውስጥ enhance good ethical values and prevent የሚፈጠሩ ሌሎች ልዩ ልዩ አደረጃጀቶች corruption; ናቸው፣ ፲፬/ “ለህዝባዊ አገልግሎት የተሰበሰበ ሃብት” ማለት 14/ “Resource collected for public purpose” የተወሰነ የህብረተሰብ ክፍልን ወይም means money, property or resource that ህብረተሰቡን በአጠቃላይ ለመርዳት ወይም is collected with the intent to support, ለመደገፍ ወይም ለማበረታተት ወይም assist, encourage or develop the whole ለማልማት ታስቦ የተሰበሰበ ወይም ለዚሁ or a section of the community or ዓላማ እንዲውል በማንኛውም መንገድ የተገኘ obtained in any way with such intent እና በበጎ አድራጎት ድርጅት ወይም ማህበር and administered or utilized by a charity ወይም ይህን ዓላማ ለማሳካት ተብሎ በተደራጀ or association or a committee organized ወይም በተቋቋመ ኮሚቴ የሚተዳደር ወይም or formed for such purpose; የሚንቀሳቀስ ገንዘብ፣ ንብረት ወይም ሃብት ነው፣ gA ፲፪ሺ፱፻፹፱ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12989 ፲፭/ “የባንክ ሂሳብ” ማለት በባንክ የተቀመጠ 15/ “Bank Account” means money, gold and ገንዘብ፣ ወርቅ እና የመሳሰሉት ውድ እቃዎች other similar precious items deposited እንዲሁም አንድ ደንበኛ ከባንኩ ጋር in a bank and includes any transaction a customer has with a bank; የሚያደርጋቸውን ማናቸውንም ግንኙነቶች /ትራንዛክሽኖች/ የሚያጠቃልል ነው፣ ፲፮. “ጠቋሚ” ማለት ሊፈፀም ነው ብሎ ያመነውን 16/ “Whistle blower” means any person who የሙስና ወንጀል ወይም የሃብት ምዝገባ reports to the commission or ethics ትክክለኛ አለመሆንን የሚመለከት መረጃ liaison units a corruption offense ለኮሚሽኑ ወይም ለስነ-ምግባር መከታታያ intended to be committed or inaccurate ክፍሎች የሚያቀርብ ማንኛውም ሰው ነው፣ asset registration; ፲፯/ “ሀገራዊ የፀረ ሙስና ፖሊሲ እና ስትራቴጂ” 17/ “National Anticorruption Policy and Strategy” means a national document ማለት መልካም ስነምግባርን በመገንባት፣ that indicates the level the country ሙስናን በመከላከል እና በመዋጋት ረገድ envisages of achieving in the short and በአጭር እና በረጅም ጊዜ ሀገሪቱ long term in building good ethical ልትደርስበትየምታስበውን ደረጃ የሚያመላክት conduct, preventing and combating ሀገራዊ ሰነድ ነው፣ corruption; ፲፰/ “ሰው’’ ማለት የተፈጥሮ ሰው ወይም በህግ 18/ "Person" means natural or juridical የሰውነት መብት የተሰጠው አካል ነው፣ person; ፲፱/ በወንድ ፆታ የተገለጸዉ ሴትንም ይጨምራል፡ 19/ Any expression in the masculine gender includes the feminine. ክፍል ሁለት PART TWO ስለኮሚሽኑ መቋቋም፣ ስልጣንና ተግባር ESTABLISHMENT AND POWERS AND DUTIES OF THE COMMISSION ፫. የኮሚሽኑ መቋቋም 3. Establishment of the Commission ፩/ የፌዴራል የሥነ-ምግባርና የፀረ ሙስና ኮሚሽን 1/ The Federal Ethics and Anti-Corruption Commission (hereinafter referred to as ከዚህ በኋላ ኮሚሽን እየተባለ የሚጠራ "the Commission") is hereby established የፌዴራል መንግስት መስሪያ ቤት ሆኖ as the Federal Government office. በአዋጅ ተቋቁሟል፣ ፪/ ኮሚሽኑ ተጠሪነቱ ለህዝብ ተወካዮች ምክር ቤት 2/ The Commission shall be accountable to ይሆናል፣ the House of Peoples Representatives. ፫/ የአዲስ አበባ እና የድሬደዋ ከተማ አስተዳደሮች 3/ The Addis Ababa and Dire Dawa City የራሳቸውን ኮሚሽን ያቋቁማሉ፡፡ Administrations shall establish their own ethics and Anticorruption commission. gA ፲፪ሺ፱፻፺ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12990 ፬. ስለ ኮሚሽኑ የአሰራር ነፃነት 4. Independence of the Commission ኮሚሽኑ ሙስና ለመከላከል በሚያደርገው The Commission shall be free from any እንቅስቃሴ ከማንኛውም ሰው ወይም አካል ጣልቃ interference from any person or organ with ገብነት ነፃ ነው፡፡ regard to activities undertaken to prevent corruption. ፭. ዋና መስሪያ ቤት 5. Head Office The Commission shall have its Head Office የኮሚሽኑ ዋና መስሪያ ቤት አዲስ አበባ ይሆናል፣ in Addis Ababa. ፮. የኮሚሽኑ ዓላማዎች 6. Objectives of the Commission ኮሚሽኑ የሚከተሉት ዓላማዎች ይኖሩታል፡- The Commission shall have the following objectives to: ፩/ የትውልድ ስነምግባር እና የሞራል እሴቶችን 1/ Effectively enhance ethical and moral በብቃት መገንባት፣ values of the generation; ፪/ የሙስና ወንጀልን እና ብልሹ አሰራርን 2/ Prevent corruption offences and other መከላከል፣ improprieties; ፫/ ለፀረ ሙስና ትግሉ አጋዥ የሆነ የህዝብ ንቅናቄ 3/ Make the public become owner of the anti- በመፍጠር ህዝቡ የፀረ ሙስና ትግሉ ባለቤት corruption struggle by creating a popular እንዲሆን ማስቻል፣ movement helpful in the fight against corruption; ፬/ በህግ የተሰጡትን ስልጣን እና ተግባር 4/ Create institutional capacity that would ለመፈጸም የሚያስችል ተቋማዊ አቅም enable to carry out powers and duties መገንባት፣ given to it by law; ፭/ በመንግስት መ/ቤቶች፣ በመንግስት የልማት 5/ Ensure transparency and accountability in ድርጅቶች እና በህዝባዊ ድርጅቶች ውስጥ public offices, public enterprises and የሚገኙ የህዝብ ተመራጮች፣ የመንግስት public organizations by having the asset ተሿሚዎች፣ የመንግስት ሰራተኞች የመንግስት and financial interests of their officials ልማት ድርጅቶችና የህዝባዊ ድርጅቶች የስራ and employees declared, registered and made accessible and verified as to its ኃላፊዎች እና ሰራተኞች ሃብት እና የገቢ accuracy; ምንጮቻቸውን በማሳወቅ፣ በመመዘገብ፣ ተደራሽ በማድረግ፣ ትክክለኛነቱን በማረጋገጥ የግልፅነት እና የተጠያቂነትን ስርዓት መፍጠር ነው፡፡ gA ፲፪ሺ፱፻፺፩ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12991 ፯. የኮሚሽኑ ስልጣንና ተግባር 7. Powers and Duties of the Commission ኮሚሽኑ የሚከተሉት ስልጣንና ተግባራት The Commission shall have the following ይኖሩታል፡- powers and duties to: ፩/ ሀገራዊ የፀረ ሙስና ፖሊሲ እና ስትራቴጂ 1/ Prepare National Anti-Corruption Policy ያዘጋጃል፣ያስፀድቃል፣አፈፃጸሙን ይከታተላል፣ and Strategy; have it approved and follow up its implementation; ፪/ በመንግስት መስሪያ ቤቶች፣ በመንግስት 2/ Provide or cause the provision of training የልማት ድርጅቶች እና በህዝባዊ ድርጅቶች on ethics and corruption prevention to የሚሾሙ ወይም የሚመደቡ ወይም የሚቀጠሩ officials, heads and employees የስራ ኃላፊዎች እና ሰራተኞች ስራ appointed, assigned or employed in ከመጀመራቸው በፊት የስ-ነምግባር እና public offices, enterprises and የሙስና መከላከል ስልጠና እንዲወስዱ organization before engaged to the work; ያደርጋል፣ ፫/ በመንግስት መስሪያ ቤቶች፣ በመንግስት 3/ Study or cause to be studied practices and የልማት ድርጅቶች እና በህዝባዊ ድርጅቶች work procedures in Public Offices, ውሰጥ ለሙስናና ብልሹ አሰራር የተጋለጡ Public Enterprises and public እና ሊጋለጡ የሚችሉ የአሰራር ስርዓቶችን organizations prone or conducive to corruption and improprieties in order to በማጥናት ወይም እንዲጠኑ በማድረግ give recommendations and follow up የተሰጡ የመፍትሄ /የማሻሻያ/ ሃሳቦችን their implementation, report for an organ ያቀርባል፣ተግባራዊ መሆናቸውን ይከታተላል፣ which has the power to investigate and በማይፈፅሙት ላይ ተገቢ የሆነ እርምጃ prosecute to take the proper measures on እንዲወሰድ በህግ የመመርመርና የመክሰስ those failing to implement; ስልጣን ላለዉ አካል ያቀርባል፣ ፬/ ኮሚሽኑ ሙስና ለመፈፀም የሚያስችል ዝግጅት 4/ Where the Commission suspects or እየተደረገ መሆኑን ሲጠረጥር ወይም ጥቆማ receive information a preparation for the commission of corruption is underway, ሲደርሰዉ ድርጊቱ ከመፈፀሙ በፊት by undertaking a rapid corruption አስቸኳይ የሙስና መከላከል ስራ በመስራት prevention activity, suspend the ሂደቱ እንዲቋረጥ ወይም አስፈላጊውን operation or cause the taking of the ማስተካከያ የማድረግ ስልጣን አለው፡፡ ሆኖም necessary correction. Where it has, ግን በተደረገው ክትትል ሙስና ስለመፈፀሙ however, suspicion about the ጥርጣሬ ሲኖረው በህግ የመመርመርና commission of corruption in the process የመክሰስ ስልጣን ላለዉ አካል ያቀርባል፣ it shall report same to the relevant organ which has the power to investigate and prosecute ; gA ፲፪ሺ፱፻፺፪ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12992 ፭/ የህዝብ ተመራጮችን፣የመንግስት ተሿሚዎችን 5/ Cause the declaration and registration of እና የመንግስት ሰራተኞችን፣ የመንግስት the assets and financial interests of የልማት ድርጅቶች እና የህዝባዊ ድርጅቶች elected public officials, public appointees and employees of public offices, heads የስራ ኃላፊዎችና ሰራተኞች ሃብታቸውን and employees of public enterprises and እንዲያሳውቁ፣ እንዲያስመዘግቡ፣ ትክክለኛነቱ public organizations; verify its accuracy, እንዲረጋገጥ፣ መረጃው በአግባቡ ተደራጅቶ organize such data and make it እንዲያዝና ተደራሽ እንዲሆን ያደርጋል፣ accessible; ፮/ የሃብት ምዝገባ፣ ትክክለኛነትን ለማረጋገጥ እና 6/ Develop, put to use, and administer ተደራሽ ለማድረግ የሚያስችል ሶፍት ዌር software database that would enable an ያለበለፅጋል፣ ጥቅም ላይ ያውላል፣ effective asset and financial interest ያስተዳድራል:: አግባብነት ያላቸዉ አካላት declaration, registration and access. Powers and Duties of the Commissioner ፩/ ኮሚሽነሩ የኮሚሽኑ የበላይ ሃላፊ በመሆን 1/ The Commissioner shall be the top official የኮሚሽኑን ሥራዎች ያደራጃል፣ ይመራል፣ of the Commission and, as such, shall organize, direct and manage ያስተዳድራል፡፡ the activities of the Commission. [ ፪/ የዚህ አንቀፅ ንዑስ አንቀጽ (፩) የተደነገገው 2/ Without prejudice to the provisions of Sub-Article (1) of this Article, the እንደተጠበቀ ሆኖ ኮሚሽነሩ፦ Commissioner shall have powers and duties to: ሀ) በዚህ አዋጅ አንቀጽ ፯ የተዘረዘሩትን a) Exercise the powers and duties of the የኮሚሽኑን ሥልጣንና ተግባራት በሥራ Commission specified under ላይ ያውላል፣ Article 7 of this Proclamation; ለ) የኮሚሽኑን መዋቅር፣ የደመወዝ ስኬል እና b) Prepare and submit to the House of ጥቅማጥቅሞቻቸውን በማዘጋጀት ለህዝብ Peoples Representative for approval ተወካዮች ምክር ቤት አቅርቦ በማፀደቅ the organizational structure , salary ክፍያ ይፈፅማል፣ ዝርዝር አፈጻጸሙ scale and benefit schemes of the employees of the Commission and በተመለከተ ምክር ቤቱ በሚያወጣው implement same upon approval; ደንብ መሰረት ይወሰናል፣ particulars shall be specified in Regulations to be issued by the House; ሐ) በዚህ አዋጅ የተመለከቱትን ድንጋጌዎች c) Prepare regulations in line with እና የፌዴራል የመንግስት ሰራተኞች provisions specified in this አዋጅ አጠቃላይ መርሆዎችን ጠብቆ Proclamation and the basic principles of Federal public servants ደንብ አዘጋጅቶ ለህዝብ ተወካዮች ምክር Proclamation and submit to the ቤት ያቀርባል፣ ሲፀድቅም ተግባራዊ House of Peoples Representatives and ያደርጋል፣ implement same upon approval; መ) ለስራው አስፈላጊ የሆኑ ሰራተኞችን d) To appoint, assign, employ, ይሾማል፣ ይመድባል፣ ይቀጥራል፣ administer and dismiss the necessary ያስተዳደራል፣ ያሰናብታል፡፡ ዝርዝር staffs. 11. Term of Office and Removal from Office ከስራ ስለመነሳት of the Commissioner and the Deputy Commissioners ፩/ የኮሚሽነሩ እና የምክትል ኮሚሽነሩ የሥራ 1/ The term of office of the Commissioner ዘመን ለስድስት ዓመት ይሆናል፣ ሆኖም ግን and the Deputy Commissioner shall be for አስፈላጊ ሆኖ ሲገኝ እንደገና ለአንድ የስራ six years; he may, however, be reappointed for only one term where ዘመን ብቻ ሊሾም ይችላል፣ necessary. 2/ Once appointed, the Commissioner or the ፪/ ኮሚሽነሩ ወይም ምክትል ኮሚሽነሩ ከዚህ Deputy Commissioner may not be በታች በተመለከቱት ሁኔታዎች ካልሆነ removed, except on his own will, from his በስተቀር የተሾመበት የሥራ ዘመን ከማለቁ office unless: በፊት ከፈቃዱ ውጭ ከሥራው አይነሳም:- ሀ) አግባብነት ባለው የሥነ ምግባር ደንብ a) He has violated the provisions of የተመለከቱትን ድንጋጌዎች ተላልፎ the relevant code of conduct; ሲገኝ፣ gA Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12998 ፲፪ሺ፱፻፺፰ b) He has shown manifest ለ) ጉልህ የሆነ የሥራ ችሎታና የቅልጥፍና incompetence and inefficiency; [[[[[{‹‹ ጉድለትኣሳይቷልተብሎ ሲታመን፣ c) He can no longer carry out his ሐ) በጤና ችግር ምክንያት ተግባሩን responsibilities on account of በተገቢው ሁኔታ ማከናወን የማይችል illness; ሆኖ ሲገኝ፣ d) On attaining retirement age. መ) የጡረታ እድሜ ላይ ሲደርስ ይሆናል፣ 3/ The provisions in Sub Article (2) (a) and ፫/ በንዑስ አንቀፅ (፪) በፊደል ተራ (ሀ) እና (ለ) (b) of this Article shall apply where it ያሉት ድንጋጌዎች ተፈፃሚ የሚሆኑት በህዝብ has been verified by the House and ተወካዮች ምክር ቤት ተጣርቶ በአብላጫ voted on by majority vote. ድምጽ ሲደገፍ ነዉ፡፡ [

12. 13. Taking of an Oath ፲፫. ቃለመሀላ ስለመፈፀም Any person shall upon Assigned or employed in the Commission take oath that በኮሚሽኑ የተቀጠረ ማንኛውም ሠራተኛ ለፌደራሉ he will be faithful to the Federal Constitution ህገ መንግስት ታማኝ በመሆን የተጣለበትን ህዝባዊ and fulfill the demands of public trust and አደራና ሙያዊ ሀላፊነት ለመወጣት ቃለመሀላ professional responsibility bestowed on him. ይፈጽማል፡፡ የቃለመሀላው ዝርዝር ይዘት በደንቡ Details regarding the oath shall be specified ይወሰናል፡፡ in the administrative regulation

14. Rights of Employees ፲፬. የኮሚሽኑ ሠራተኞች መብት 1/ Any officials and employees of the Commission is entitled to a salary and ፩/ ማንኛውም የኮሚሽኑ የስራ ሃላፊዎችና benefits in accordance with a special salary ሠራተኞች ደሞዝና ጥቅማጥቅም ከስራቸዉ scale and benefit scheme approved by the ልዩ ባህሪ ጋር በተያያዘ የህዝብ ተወካዮች House of Peoples Representatives In view of ምክር ቤት በሚያፀድቀው የደመወዝ ስኬል the special nature of their work. Details shall እና ጥቅማጥቅም ዉሳኔ መሰረት ተግባራዊ be specified in regulation to be issued as per ይሆናል፡፡ ዝርዝሩ ይህን አዋጅ ለማስፈፀም this proclamation. በሚወጣ ደንብ የሚወሰን ይሆናል:: gA ፲፪ሺ፱፻፺፱ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 12999 ፪/ የማንኛውም ሠራተኛ ደመወዝ፡- 2/ The salary of any employee may not be attached or deducted except in accordance with, ሀ) በሠራተኛው ስምምነት፣ a) A written consent of the employee; ለ) በፍርድ ቤት ትእዛዝ፣ b) A court order; or ሐ) በህግ በተደነገገው መሠረት፤ ካልሆነ በስተቀር ሊያዝ ወይም ሊቆረጥ c) Provisions of the law. አይችልም፡፡ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪)(ለ) ወይም(ሐ) 3/ The amount deductible in accordance with መሠረት ከሠራተኛ ደመወዝ በየወሩ Sub Article (2) (b) or (c) of this Article የሚቆረጠው ከደመወዙ አንድ ሶስተኛ may not exceed one third of the salary of አይበልጥም:: the employee. 4/ Any permanent employee of the ፬/ ማንኛውም የኮሚሽኑ ቋሚ ሠራተኛ በጡረታ Commission is entitled to a pension in ሕግ መሠረት የጡረታ መብት ይኖረዋል፣ accordance with the Pension law. ፭/ የኮሚሽኑ ሠራተኛ፡- 5/ Any employee of the Commission shall: ሀ) ሥራውን በተገቢው መንገድ በመወጣት a) Be provided with attorney service at ላይ እያለ ለሚደርስበት ተጠያቂነት the expense of the Commission for በኮሚሽኑ ወጪ ድጋፍና የጥብቅና any liability incurred while አገልግሎት ያገኛል፡፡ ዝርዝር አፈፀፃሙ executing his duties properly. በደንብ ይወሰናል፤ Particulars shall be determined by the Regulations; ለ) በማንኛውም አጋጣሚ የበላይ ሀላፊዎችን b) Have the right to appropriately በአግባቡ የመጠየቅ፣ ስህተት ሲያይ question superiors under any የመጠቆም፣ በውይይት ችግሮችን circumstances, inform mistakes, የመፍታት እንዲሁም የስልጣን resolve problems through discussion ተዋረድን ጠብቆ አቤቱታ ማቅረብ as well as lodge complaints ይችላል፣ following the chains of command; ሐ) የሰራተኞች ቅሬታንና የዲስፒሊን c) Have the right to appeal for relevant ጉዳዮችን በተመለከተ በኮሚሽኑ ዉስጥ organ with regard to the decision በኮሚሽነሩ ዉሳኔ ቅር የተሰኘ ወይም passed by the Commission in ያልተስማማ ሰራተኛ ቅሬታዉን relation to any grievances and አግባብነት ላለዉ አካል የማቅረብ discipiline issues; Particulars shall መብት ይኖረዋል፣ ዝርዝር አፈጻጸሙ be determined by the regulations; በሚወጣዉ ደንብ ይወሰናል፤ gA ፲፫ሺ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 13000 መ) ከሥራው ጋር በተያያዘ ሁኔታ d) Be entitled to benefits provided in በሚደርስበት ጉዳት ዘላቂ ወይም ሙሉ the relevant pension law for ወይም ከፊል የመሥራት ችሎታውን permanent, total, or partial disability sustained in relation to his duties. ያጣ የኮሚሽኑ ሠራተኛ አግባብ ባለው particulars shall be specified in the ህግ መሰረት የጉዳት ካሳ ይከፈለዋል፣ Regulations to be issued; በጡረታ ህግ መሰረት የተሰጠው መብት ይከበርለታል፡፡ ዝርዝር አፈፃፀሙ በሚወጣው ደንብ ይወሰናል፣ ሠ) የኮሚሽኑ የስራ ኃላፊዎች እና ሰራተኞች e) In view of the special nature of their ከስራቸው ልዩ ባህሪ ጋር በተያየዘ work, the Commission shall have ደመወዝ እና ልዩ ልዩ ጥቅማጥቅሞችን the salary and various benefits of አስጠንቶ በማቅረብ እና በተወካዮች officials and employees of the ምክር ቤት በማፀደቅ ተግባራዊ Commission studied and implement it upon approval by the House of ይደረጋል፣ Peoples Representatives; f) After informing the Commission ረ) በትርፍ ጊዜው ከሥራው ጋር የጥቅም engages in any other activity which ግጭት በማይፈጥር ሥራ ላይ ለመስራት may not have a conflict of interest መሥሪያ ቤቱን በማሳወቅ ለመስራት with his duty, during his leisure ይችላል፡፡ ዝርዝሩ ኮሚሽኑ በሚያወጣው time. Exemption from Tax በዚህ አዋጅ በአንቀፅ ፲፬ በንዑስ አንቀፅ Any compensation to be made pursuant to (፭)(መ) መሠረት የሚከፈል የጉዳት ካሳ ከፍያ Article 14 Sub-Article (5)(d) of this ከግብር ነፃ ይሆናል፡፡ እንዲሁም በእዳ ሊከበር Proclamation shall be exempt from taxation ወይም በማቻቻያነት ሊቀነስ ወይም ባለመብቱ and may not be attached, deducted by way of ሊያስተላልፈው አይችልም፡፡ setoff or assigned by the beneficiary. ፲፮. ሰራተኛን ከሥራ አግዶ ስለማቆየት 16. Suspension from Duty 1/ An employee of the Commission may be ፩/ የኮሚሽኑ ሠራተኛ ከሥራ ታግዶ መቆየት suspended from duty by withholding his ለሥራው አፈፃፀም ጠቃሚ ሆኖ ከተገኘ salary for a period not exceeding one ሠራተኛውን ከአንድ ወር ለማይበልጥ ጊዜ month if that course of action is necessary ከሥራና ደመወዝ አግዶ ለማቆየት ይቻላል፣ for the smooth execution of the work; gA ፲፫ሺ፩ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 13001 ፪/ በዚህ አንቀፅ ንዑስ አንቀፅ (፩) የተደነገገው 2/ Notwithstanding the provisions of Sub ቢኖርም የኮሚሽኑ ሠራተኛ በወንጀል ወይም Article (1) of this Article an employee በዲሲኘሊን ጥፋት በህግ የተከሰሰ እንደሆነ shall be suspended for an additional one month if he is formally charged with a እና ተመስክሮ ጥፋቱ ከሥራው የሚያስወጣው criminal or disciplinary offence for መሆኑ ሲገመት ለተጨማሪ አንድ ወር ከሥራ which his dismissal is to be expected if it ታግዶ ሊቆይ ይችላል፡፡ ዝርዝሩ ይህን አዋጅ is proved against him. Details shall be ተከትሎ በሚወጣው ደንብ ይወሰናል፡፡ specified in regulations to be issued as per this Proclamation. ፲፯. ስለይርጋ ጊዜ 17. Period of Limitation ፩/ ቀላል የዲሲኘሊን ቅጣት የሚያስከትል ጥፋት 1/ Disciplinary measure may not be taken የፈፀመ የኮሚሽኑ ሠራተኛ የምርመራውን against an employee of the Commission who has committed an offense entailing ጊዜ ሳይጨምር የፈፀመው ጥፋት ከታወቀበት simple disciplinary penalty unless such ቀን ጀምሮ እስከ ስድስት ወር እርምጃ measure is taken within six months, ካልተወሰደበትበዲሲኘሊን ተጠያቂ አይሆንም፣ excluding the time required for investigation, from the time the breach of discipline is known; ፪/ ከባድ የዲሲኘሊን ቅጣት የሚያስከትል ጥፋት 2/ No disciplinary charge shall be brought የፈፀመ የኮሚሽኑ ሠራተኛ የፈጸመው ጥፋት against an employee who has committed an offense entailing rigorous disciplinary ከታወቀበት ቀን ጀምሮ በአንድ አመት ጊዜ penalty unless such disciplinary charge is ውስጥ በጥፋቱ ካልተከሰሰ በዲሲኘሊን brought within a year from the time the ተጠያቂ አይሆንም፣ commission of the offense is known; ፫/ በዚህ አንቀፅ ንዑስ አንቀጽ (፩) ወይም (፪) 3/ The Official who has failed to take the በተመለከተው የጊዜ ገደብ ውስጥ መወሰድ measures specified under Sub-Articles (1) የሚገባውን የዲሲኘሊን እርምጃ ሳይወስድ or (2) of this Article shall be held የቀረው ኃላፊ ተጠያቂ ይሆናል፡፡ responsible. ፲፰. በጀት 18. Budget ኮሚሽኑ ለስራ የሚያስፈልገውን በጀት The Commission prepare its budget and በማዘጋጀት ለተወካዮች ምክር ቤት አቅርቦ submit for approval to the House. ያፀድቃል፡፡ ፲፱. የሂሣብ መዛግብት 19. Books of Accounts ፩/ ኮሚሽኑ የተሟሉ እና ትክክለኛ የሂሳብ 1/ The Commission shall keep complete and መዛግብት ይይዛል፡፡ accurate books of accounts; gA ፲፫ሺ፪ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 13002 ፪/ የኮሚሽኑ የሂሳብ መዛግብት እና ገንዘብ ነክ 2/ The Commission's books of accounts and ሰነዶች በፌዴራሉ ዋና ኦዲተር በየዓመቱ financial documents shall be Audited annually by ይመረመራል፡፡ the Federal Auditor-General. PART THREE ክፍል ሶስት ESTABLISHMENT OF ETHICS LIAISON የስነ-ምግባርና መከታታያ ክፍሎችን OFFICES AND RELATIONSHIP OF THE ስለማደራጀት እና ኮሚሽኑ ከክልል የስነ- COMMISSION WITH REGIONAL ETHICS ምግባርና የፀረ ሙስና ኮሚሽኖች ጋር AND ANTI-CORRUPION COMMISSION ስለሚኖረዉ ግንኙነት ፳. የስነ-ምግባር መከታታያ የስራ ክፍል ስለማደራጀት 20. Establishment of Ethics and Anti- Corruption Liaison Offices ፩/ ኮሚሽኑ በየደረጃው በሚገኙ በመንግሥት 1/ The Commission shall establish Ethics and መሥሪያ ቤቶች እና በመንግስት የልማት Anti-corruption Liaison offices at every ድርጅቶች ውስጥ የሥነ-ምግባር ተግባራትን level of Public Offices and Public እና የሙስና መከላከል ስራን የሚያስተባብር Enterprises the duty of which shall be to እና የሚፈፅም የሥነ-ምግባር መከታተያ የስራ coordinate and carry out ethical issues and ክፍል ያደራጃል፣ corruption prevention activities in their respective office or enterprise; 2/The Commission shall cause the ፪/ ኮሚሽኑ በየደረጃው በሚገኙ ህዝባዊ ድርጅቶች establishment of Ethics and Anti- ውስጥ የሥነ-ምግባር ተግባራትን እና የሙስና corruption Liaison offices at every level መከላከል ስራን የሚያስተባብር እና የሚፈፅም of Public Organizations the duty of which የሥነ-ምግባር መከታተያ የስራ ክፍል shall be to coordinate and carry out ethical እንዲደራጅ ያደርጋል፣ issues and corruption prevention activities in their respective organization; 3/ The ethics and anticorruption Liaison ፫/ የሥነ-ምግባር መከታተያ ክፍል ተጠሪነቱ office shall be accountable to the ለኮሚሽኑ ይሆናል፣ Commission; ፬/ በመንግሥት መሥሪያ ቤቶች እና በመንግስት 4/ It shall be the duty of the Commission to assign, employ, transfer and dismiss the ልማት ድርጅቶች ውስጥ የሥነ-ምግባር head or employee of the ethics and መከታተያ ክፍል ኃላፊ ወይም ሠራተኛ anticorruption liaison offices of public የመመደብ፣ የመቅጠር፣ የማዛወር እና offices and enterprises. The ethics liaison የስራ ደረጃ በህዝባዊ ድርጅቶች በሚገኙ offices to be established shall be ዓላማ ፈጻሚዎች የስራ ደረጃ ጋር ትያዩ organized in parallel with the line staff of ያሆናል፣ the public organization; ፮/ በመንግሥት መሥሪያ ቤቶች፣ በልማት 6/ Particulars regarding the ethics and ድርጅቶች እና በህዝባዊ ድርጅቶች ውሰጥ anticorruption Liaison office's work የሚደራጁት የሥነ-ምግባር መከታታያ relation with the Commission, their ክፍሎች ከኮሚሽኑ ጋር የሚኖራቸውን የሥራ organization and operation shall be ግንኙነት፣ አደረጃጀት እና አሰራር ኮሚሽኑ specified by directives to be issued by the በሚያዘጋጀው መመሪያ ይወሰናል፣ Commission; ፯/ የሥነምግባርመከታታያክፍሎች ከሚደራጁበት 7/ The work relation of the ethics Liaison የመንግሥት መሥሪያ ቤት፣ የልማት ድርጅት offices with their respective public office, እና የህዝባዊ ድርጅቶች ጋር የሚኖራቸውን public enterprise or public organization shall be determined by directives to be የሥራ ግንኙነት ኮሚሽኑ በሚያዘጋጀው issued by the commission. መመሪያ ይወሰናል፡፡ ፳፩. ኮሚሽኑ ከክልል የስነ-ምግባርና የፀረ ሙስና 21. Work Relations of the Commission with ኮሚሽኖች ጋር ስለሚኖረው የሥራ ግንኙነት the Regional Ethics and Anti-Corruption Commissions ፩/ ኮሚሽኑ በሀገር ደረጃ የስነ-ምግባር እና የፀረ 1/ The Commission being an organ ሙስና ተግባራትን የመምራት እና responsible for leading and coordinating የማስተባበር ተግባራትን የሚያከናውን ስለሆነ Ethics and Anti-corruption activities at የክልል እና የከተማ አስተዳደሮች National level shall coordinate Ethics and የሥነምግባር የፀረ ሙስና ኮሚሽኖችን Anti-corruption commissions of regional ያስተባብራል፣ የቴክኒክ ድጋፍ ያደርጋል፣ and city administrations and give technical support; ፪/ ኮሚሽኑ ከክልል እና ከከተማ አስተዳደር 2/ The Commission shall establish a የሥነ-ምግባርና የፀረ ሙስና ኮሚሽኖች ጋር planning, reporting and relation system የእቅድ፣ የሪፖርት እና የግንኙነት ስርዓት with the Ethics and Anti-corruption ይፈጥራል፣ commissions of the regional and city administrations; gA ፲፫ሺ፬ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 13004 ፫/ የክልል እና የከተማ አስተዳደር የስነምግባርና 3/ The City and Regional Ethics and Anti- የፀረ ሙስና ኮሚሽኖች በየአካባቢያቸው corruption commissions shall submit ስላለው የፀረ ሙስና እንቅስቃሴ የሚመለከቱ statistical data and periodic report regarding the state of anti-corruption ሪፖርቶችን እና ስታስቲካዊ መረጃዎችን activities in their respective City or በየጊዜው ለኮሚሽኑ ይሰጣሉ፡፡ Region to the Commission. ክፍል አራት PART FOUR ልዩ ልዩ ድንጋጌዎች MISCELLANEOUS PROVISIONS ፳፪. የመተባበበር ግዴታ 22. Duty to Cooperate Any person is duty bound to cooperate ማንኛዉም ሰዉ ወይም አካል ኮሚሽኑ በዚህ whenever cooperation and assistance is አዋጅ መሰረት የተሰጠዉን ስልጣን እና required by the Commission in connection ተግባሩን ለመወጣት በሚያርገዉ እንቅስቃሴ with its powers and duties. የመተባበር ግዴታ አለበት፡፡ ፳፫. ደንብና መመሪያ የማውጣት ሥልጣን 23. Powers to Issue Regulations and Directives ፩/ የህዝብ ተወካዮች ምክር ቤት ለዚህ አዋጅ 1/ The House of Peoples Representatives አፈጻጸም ደንብ ሊያወጣ ይችላል፡፡ may issue Regulations for the implementation of this Proclamation; ፪/ ኮሚሽኑ ይህንን አዋጅና በዚህ አዋጅ መሠረት 2/ The Commission may issue Directives for የሚወጣውን ደንብ ለማስፈጸም መመሪያ the implementation of this Proclamation ሊያወጣ ይችላል፡፡ and the Regulations issued under this Proclamation. ፳፬. የተሻሩና ተፈጻሚነት ስለማይኖራቸው ህጐች 24. Repealed and Inapplicable Laws 1/ Provisions provided under The Revised ፩/ በፌዴራል የሥነ-ምግባርና የፀረ ሙስና Federal Ethics and Anti-Corruption ኮሚሽን ማቋቋሚያ አዋጅ ቁጥር ፬፻፴፫/፪ሺ፭ Commission Establishment Proclamation እና በማሻሻያ አዋጅ ቁጥር ፰፻፹፫/፪ሺ፯ ላይ No.433/2005 and Amendment ተደንግገዉ የነበሩና በዚህ አዋጅ የተሸፈኑ Proclamation No. 883/2015 covered by ድንጋጌዎች በዚህ አዋጅ ተሽረዋል፡፡ this Proclamation are hereby repealed; ፪/ ከዚህ አዋጅ ጋር የሚቃረኑ ማናቸውም ሌሎች 2/ All laws which are inconsistent with this ህጐች በዚህ አዋጅ ውስጥ በተሸፈኑ ጉዳዮች Proclamation shall not apply on matters ላይ ተፈፃሚነት አይኖራቸውም፡፡ covered under this Proclamation. gA ፲፫ሺ፭ Ød‰L ነ U¶T Uz¤È qÜ_R ፲፭ የካቲት ፲፪ ቀን ፪ሺ፲፫ ›.M Federal Negarit Gazette No. 15, 19th , February 2021 ….page 13005 ፳፭. አዋጁ የሚፀናበት ጊዜ 25.
