Box ባህር ዳር ሰኔ 1 ቀን 2004 ዓ.ም Bahir Dar 8 th June, 2012 17ኛ አመት ቁጥር 12 17 th Year No 12 16 th Year No 15 www.abyssinialaw.com ገጽ-2-ዝክረ-ህግ ጋዜጣ ቁጥር 12 ሰኔ 1 ቀን 2004 ዓ.ም Zikre-Hig Gazette No. 12 8th Day of June 2012, Page -2 የመንዝ-ጓሳ አካባቢ የተፈጥሮ ጓሳ፣ ዕፅዋትና የዱር እንስሳት ካለፉት መንግስታት ጀምሮ በአካባቢው ሕብረተሰብ ሲጠበቅ የቆየ ቢሆንም በአሁኑ ወቅት የህዝቡና የቤት እንስሳት ቁጥር እየጨመረ ከመምጣቱ የተነሳ የጓሳውና የዱር እንስሳቱ ህልውና ለአደጋ በመጋለጡ ምክንያት ህጋዊ ዕውቅና እንዲኖረውና ለዘለቄታው ለምቶና ተጠብቆ ለትውልድ በቅርስነት እንዲተላለፍ ማድረግ በማስፈለጉ፣ WHEREAS, although the natural guassa, plants and wildlife of the Menz Guassa area had been conserved as of the times of the previous regimes, as the very exixtence of the guassa and the wildlife is, now a days, exposed to danger due to the increment of the amount of people and tame animals, it is henceforth necessary to render it legal recognition and bequeath same to the posterity in the form of heritage by protecting and developing it in a sustainable way; ቦታው ከ 26 በላይ ለሆኑ ወንዞች መነሻና ለአፈር ክለትና ለተፈጥሮ ሀብት ውድመት ተጋላጭ የሆነውን የአፍሮ አልፓይን ሥርዓተ ምሕዳር በመንከባከብ ጤናማ ሥርዓተ ምህዳር እንዲኖር ማድረግ አስፈላጊ በመሆኑ፣ WHEREAS, it has been necessary to maintain the privalence of healthy ecosystem in the area by conserving the afro-alpine ecosystem which is a source of more than 26 rivers and prone for both soil erosion and degradation of natural resources thereto; ስፍራው በሀገራችን ብቻ የሚገኙና ለመጥፋት የተቃረቡ ብርቅዬ የዱር እንስሳት፣ እፅዋትና አዕዋፋት መጠለያ መሆኑን በመገንዘብ በሰሜን ሸዋ አስተዳደር ዞን በመንዝ ጌራ ምድር ወረዳ በህዝብ የወል መሬት ይዞታነት የሚገኘውንና አስፈላጊ መስፈርቶችን የሚያሟላውን የመንዝ ጓሳ የማህበረሰብ ጥብቅ ቦታ ወሰኖቹን ከልሎ ስልጣን ባለው የህዝብና የመንግስት አካል ባለቤትነት ሥር የሚተዳደርበትን ህጋዊ ሁኔታ መፍጠር ተገቢ ሆኖ በመገኘቱ፣ WHEREAS, it has, being aware of the fact that the place is a sanctuary for the endangered species of wild animals, plants and birds which are solely endemic to our country, been appropriate to create a legal setting for the Menz Guassa Community Conservation Area situated in the Menz Gera Meder Woreda of the North Shoa Zonal Administration, falling under the collective land holding of the community and thereby found to have fulfilled the essential requirements as well as get it administered under the authority of the community and the governmental body competent, by delimiting its boundaries thereof; የአማራ ብሄራዊ ክልላዊ መንግስት መስተዳድር ምክር ቤት በተሻሻለው የክልሉ ህገ መንግስት አንቀጽ 58 ንዑስ አንቀጽ 7 እና በአስፈፃሚ አካላት እንደገና ማቋቋሚያና ስልጣንና ተግባራት መወሰኛ አዋጅ ቁጥር 176/2003 ዓ.ም አንቀጽ 35 NOW, THEREFORE, the Council of the Amhara National Regional Government, pursuant to the powers vested in it under the provisions of Art. 58 Sub Art. 7 of the Revised Constitution of the Regional State and Art. 35 of the Executive Organ’s Reestablishment and Determination of their Powers and Duties www.abyssinialaw.com ገጽ-3-ዝክረ-ህግ ጋዜጣ ቁጥር 12 ሰኔ 1 ቀን 2004 ዓ.ም Zikre-Hig Gazette No. 12 8th Day of June 2012, Page -3 ድንጋጌዎች ሥር በተሰጠው ስልጣን መሰረት ይህንን ደንብ አውጥቷል፡፡ Proclamation No. 176/2010, hereby issues this Regulation as follows. 1. አጭር ርዕስ 1. Short Title ይህ ደንብ “የመንዝ-ጓሳ ማህበረሰብ ጥብቅ ቦታ ዳር ድንበር አከላለልና አስተዳደር መወሰኛ ክልል መስተዳድር ምክር ቤት ደንብ ቁጥር 97/2004 ዓ.ም” ተብሎ ሊጠቀስ ይችላል፡፡ This regulation may be cited as “The Menz Guassa Community Conservation Area Boundary Demarcation and Administrative Determination, Council of Regional Government Regulation No. 97/2012.” 2. ትርጓሜ 2. Definitions የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር በዚህ ደንብ ውስጥ፡ Unless the context requires otherwise, in this Regulation: 1. “የማህበረሰብ ጥብቅ ቦታ” ማለት የዱር እንስሳት፣ እፅዋትና የአዕዋፍ ክምችት ያለበት፣ የተፈጥሮ መጠለያ በመሆን የሚታወቀው፣ በተፈቀደ ህግ መሰረት የአካባቢው ህብረተሰብ በዘላቂነት የሚጠቀምበትና በዚህ ደንብ መሰረት ልዩ ጥበቃ እንዲደረግለት ወሰኑ ተለይቶ የተከለለው የመንዝ-ጓሳ የማህበረሰብ ጥብቅ ስፍራ ነው፣ 1. “Community Conservation Area” shall mean the Menz Guassa community conservation area recognized as embracing the distinct natural habitat for the diversity of wild animals, plants and flock of birds, sustainably utilized by the surrounding community based on the permitting laws and with its boundaries being identified and demarcated pursuant to this Regulation, and thereby given special care thereof; 2. “ጉልት” ማለት ከድንጋይ፣ ከኮንክሪት፣ ከብረት ወይም ከሌላ ቋሚ ከሆነ ነገር ተሰርቶ በመሬት ላይ የተተከለ የወሰን መለያ ምልክት ነው፣ 2. “Beacon” shall mean a landmark which is made up of stone, concrete, metal or any other object fixed on the ground; 3. “የዱር እንስሳት” ማለት ለማዳ ያልሆኑና በየብስም ሆነ በውኃ ውስጥ የሚኖሩ ልዩ ልዩ ዝርያ ያላቸው በተፈጥሮ የሚገኙ በምድር የሚሄዱና በአየር ላይ የሚበሩ እንስሳትን የሚያጠቃልልና የመኖሪያ፣ የመጠለያ፣ የመራቢያና የመመገቢያ አካባቢዎችን ጭምር ያካተተን ሥነ-ህይወታዊ ሀብት ይገልፃል፣ 3. “Wildlife” shall include a host of various untamed, territorial and aquatic species of animals found in nature move on land and fly in the air, also encompassing their respective habitats, sanctuaries, breeding and feeding areas capable of expressing the diversity of biological resources; www.abyssinialaw.com ገጽ-4-ዝክረ-ህግ ጋዜጣ ቁጥር 12 ሰኔ 1 ቀን 2004 ዓ.ም Zikre-Hig Gazette No. 12 8th Day of June 2012, Page -4 4. “ቢሮ” ማለት በአማራ ብሔራዊ ክልላዊ መንግስት የባህል፣ ቱሪዝምና ፓርኮች ልማት ቢሮ ማለት ነው፣ 4. “Bureau” shall mean the Amhara National Regional State Culture, Tourism and Parks’ Development Bureau; 5. “ጓሳ” ማለት አፍሮ አልፓይን በሆነ ሥርዓተ ምህዳር ውስጥ በከፍተኛ ቦታዎች ላይ የሚገኝ የሣር ዓይነት ሲሆን በውስጡ የተለያዩ የዱር እንስሳት፣ የአዕዋፋትና የእፅዋት ዝርያዎችን አካቶ የያዘ አካባቢ ነው፣ 5. “Guassa” shall mean a type of the grass species found on the high grounds of the afro - alpine ecosystem, which shall also include a variety of wild animals, birds and plant species contained therein; 6. “ውስጠ-ደንብ” ማለት የጓሣ ተጠቃሚ የሆነ ህብረተሰብ ጓሣውን ለመጠበቅ፣ ለማልማትና ለመንከባከብ በመንግስት የወጡትን ህጐችና መመሪያዎች ሳይቃረን የሚያወጣውን ከባቢያዊ የመተዳደሪያ ህግ ነው፡፡ 6. “By-law” shall mean a local statute of the guassa user community to be issued for the purpose of conserving, developing and sustainably caring for same with no contravention to the laws enacted by the government. 3. ስለ ማህበረሰብ ጥብቅ ስፍራው ስያሜ፣ አከላለልና ወሰኖች፣ 3. Designation, Demarcation and Boundaries of the Community Conservation Area 1. በዚህ ደንብ መሠረት የተቋቋመው የማህበረሰብ ጥብቅ ስፍራ “የመንዝ ጓሣ የማህበረሰብ ጥብቅ ቦታ” ተብሎ ተሰይሟል፡፡ 1. The Community Conservation Area established pursuant to this regulation, is hereby designated as “the Menz-Guassa Community Conservation Area”. 2. በዚህ አንቀጽ ንዑስ አንቀጽ /1/ መሠረት የተሰየመው የማህበረሰብ ጥብቅ ስፍራ በሰሜን ሸዋ ዞን በመንዝ ጌራ ምድር ወረዳ የሚገኝና በጠቅላላው 7800 ሄ/ር ስፋት የሚሸፍን ሆኖ በምሥራቅ በኩል በኤፍራታ ግድም ወረዳ ከሉልጌ-ሠረትና መስቀል በር ቀበሌዎች እንዲሁም በምዕራብ፣ በሰሜንና በደቡብ በኩል በመንዝ ጌራ ምድር ወረዳ ከ05, 06, 016‚ 017 እና 020 ቀበሌዎች ጋር ይዋሰናል፡፡ 2. The community conservation area, so designated pursuant to Sub Art. /1/ of this Article hereof, shall, having been located in the Menz Gera Meder Woreda of the North Shoa Zone and covering a total area of 7800 hectares of land, share boundaries with the Lulgie-Seret and Meskel Ber Kebeles of the Efrata Gedem woreda to the Eastern as well as the 05, 06, 016, 017 and 020 kebeles of the Menz Gera Meder Woreda to the Western, to the Northern and to the Southern directions. www.abyssinialaw.com ገጽ-5-ዝክረ-ህግ ጋዜጣ ቁጥር 12 ሰኔ 1 ቀን 2004 ዓ.ም Zikre-Hig Gazette No. 12 8th Day of June 2012, Page -5 3. የማህበረሰብ ጥብቅ ቦታውን አከላለልና አዋሳኝ ሥፍራዎች በኬክሮስ /ላቲቲዩድ/ እና በኬንትሮስ /ሎንግቲዩድ/ ነጥቦች የሚያሳየው ዝርዝር መግለጫ ከዚህ በታች ተመልክቷል፡ 3. The detailed description showing the demarcation of the community conservation area and its adjoining places on the latitudinal and longitudinal points are indicated here below: ሀ/ የመንዝ ጓሣን የማህበረሰብ ጥብቅ ቦታ በደቡብ አቅጣጫ ከሚያዋስነው ጎሬ ከተባለው ቦታ ላይ 10 ዲግሪ፣ 16 ደቂቃ፣ 14.3 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 35.3 ሰኮንድ ምሥራቅ ጉልት ቁጥር አንድን መነሻ በማድረግ፣ a. Commencing at the place called Gore which borders the community conservation area to the Southern direction 10 degrees , 16 minutes, 14.3 seconds North and 39 degrees, 46 minutes, 35.3 seconds East (Beacon No. 1 as a starting point); ለ/ ከዚያም ወደ ሰሜን ምዕራብ አቅጣጫ ታጥፎ በመሄድ አስፋትራ ወንዝ ላይ 1ዐ ዲግሪ 16 ደቂቃ 28.6 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 34.5 ሰኮንድ ምሥራቅ ጉልት ቁጥር ሁለት፣ b. Thence, turning to the North-Western direction at the Asfatra River 10 degrees, 16 minutes, 28.6 seconds North and 39 degrees, 46 minutes, 34.5 seconds East (Beacon No. 2); ሐ/ ከዚያም ወደ ሰሜን ምዕራብ አቅጣጫ ታጥፎ በመሄድ ወይራ ባዶ ከተባለው ቦታ ላይ 1ዐ ዲግሪ 17 ደቂቃ 22.3 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 03.1 ሰኮንድ ምስራቅ ጉልት ቁጥር ሶስት፣ c. Thence, turning to the North-Western direction at the place called Woira Bado 10 degrees, 17 minutes, 22.3 seconds North and 39 degrees, 46 minutes, 03.1 seconds East (Beacon No. 3); መ/ ከዚያም ወደ ሰሜን ምሥራቅ አቅጣጫ ታጥፎ በመሄድ መሻገሪያ ወንዝ ላይ 1ዐ ዲግሪ 18 ደቂቃ 00.9 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 19.4 ሰኮንድ ምሥራቅ ጉልት ቁጥር አራት፣ d. Thence, turning to the North-Eastern direction at the Meshageria River 10 degrees, 18 minutes, 00.9 seconds North and 39 degrees, 46 minutes, 19.4 seconds East (Beacon No. 4); ሠ/ ከዚያም ወደ ሰሜን ምሥራቅ አቅጣጫ በመቀጠል የሀጣ ጨንቻ ላይ 10 ዲግሪ 18 ደቂቃ 29.6 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 44.2 ሰኮንድ ምስራቅ ጉልት ቁጥር አምስት፣ e. Thence, extending to the North-Eastern direction at Yehata Chencha 10 degrees, 18 minutes, 29.6 seconds North and 39 degrees, 46 minutes, 44.2 seconds East (Beacon No.5); www.abyssinialaw.com ገጽ-6-ዝክረ-ህግ ጋዜጣ ቁጥር 12 ሰኔ 1 ቀን 2004 ዓ.ም Zikre-Hig Gazette No. 12 8th Day of June 2012, Page -6 ረ/ በዚሁ አቅጣጫ በመቀጠል ቃሉ ምድር ላይ 10 ዲግሪ 19 ደቂቃ 38 ሰኮንድ ሰሜንና 39 ዲግሪ 47 ደቂቃ 08.9 ሰኮንድ ምሥራቅ ጉልት ቁጥር ስድስት፣ f. Continuing in the same direction at Kalu Midir 10 degrees, 19 minutes, 38 seconds North and 39 degrees, 47 minutes, 08.9 seconds East (Beacon No. 6); ሰ/ ከዚያም ወደ ሰሜን ምዕራብ በመታጠፍ አመሃ በረት ላይ 10 ዲግሪ 2ዐ ደቂቃ 31.3 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 41.5 ሰኮንድ ምስራቅ ጉልት ቁጥር ሰባት፣ g. Thence, turning to the North-western direction at Ameha Beret 10 degrees, 20 minutes, 31.3 seconds North and 39 degrees, 46 minutes 41.5 seconds East (Beacon No. 7); ሸ/ በዚሁ አቅጣጫ በመቀጠል ጥቁር ምድር ላይ 1ዐ ዲግሪ 2ዐ ደቂቃ 49.4 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 29.4 ሰኮንድ ምሥራቅ ጉልት ቁጥር ስምንት፣ h. Continuing in the same direction at Tikur Midir 10 degrees, 20 minutes, 49.4 seconds North and 39 degrees, 46 minuets, 29.4 seconds East (Beacon No. 8); ቀ/ ከዚያም ወደ ሰሜን አቅጣጫ በመታጠፍ የገብስ ላይ 1ዐ ዲግሪ 21 ደቂቃ 19.2 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 29.3 ሰኮንድ ምሥራቅ ጉልት ቁጥር ዘጠኝ፣ i. Thence, turning to the Northern direction at Yegebs 10 degrees, 21 minutes, 19.2 seconds North and 39 degrees, 46 minutes, 29.3 seconds East (Beacon No. 9); በ/ ከዚያም ወደ ሰሜን ምሥራቅ አቅጣጫ በመታጠፍ ሸለቆው ላይ 1ዐ ዲግሪ 21 ደቂቃ 29 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 22.8 ሰኮንድ ምሥራቅ ጉልት ቁጥር አስር፣ j. Thence, turning to the North-Eastern direction at the valley 10 degrees, 21 minutes, 29 seconds North and 39 degrees, 46 minutes, 22.8 seconds East (Beacon No. 10); ተ/ ከዚያም ወደ ሰሜን አቅጣጫ በመሄድ በሀ በረት ላይ 1ዐ ዲግሪ 21 ደቂቃ 57 ሰኮንድ ሰሜንና 39 ዲግሪ 46 ደቂቃ 12.9 ሰኮንድ ምሥራቅ ጉልት ቁጥር አስራ አንድ፣ k. Objective የጥብቅ ቦታው ክለላ ዋና ዓላማ በክልላችን የሚገኙ ብርቅና ድንቅ የዱር እንስሳትን በዘላቂነት መንከባከብ፣ናየአካባቢውን ማህበረሰብ ባህላዊ የተፈጥሮ ጥበቃ ማጠናከርና በውስጡ የያዘውን የብዝሃ ህይወት ሃብት በህዝቡ ቀጥተኛ ተሳትፎ ከጥፋት በመታደግ ለመጭው ትውልድ በቅርስነት የሚተላለፍባቸዉን ምቹ ሁኔታዎች መፍጠር ነው፡፡ The main objective of the delimitation of the Conservation Area is to sustainably preserve those endemic species of wild animals found in the Region, to strengthen the indeginious protection of nature used by the local community as well as to create favorable conditions in which the bio diversity resource of the area shall be transferred to the succeeding generation in the form of a heritage by protecting and preserving same from distruction through the direct participation of the community. 5. ስለማህበረሰብ ጥብቅ ቦታው አደረጃጀት፣ አስተዳደርና ተጠሪነት 5. Organization, Administration and Accountability of the Community Conservation Area 1. የመንዝ ጓሳ የማህበረሰብ ጥብቅ ቦታ ከዚህ በታች የተመለከተው አደረጃጀት ይኖረዋል፡ 1. The Menz Guassa Community Conservation Area shall have the organizational structure as indicated here below: ሀ/ የጓሳ ልማትና ጥበቃ ምክር ቤት፣ a. The Guassa Development & Conservation Council; and ለ/ የእለት ተእለት ስራውን ለማከናወን የሚያስችል ጽ/ቤት b. The office specified under Sub Art. 1/b/ of this Article hereof shall be organized pursuant to Art. 24 Sub Art. 9 of the Proclamation No. 176/2010 and be accountable to the Guassa Development and Conservation Council and to the Bureau, as appropriate. 6. ስለ ጽ/ቤቱ መደበኛ አድራሻ 6. Principal Residence of the Office የማህበረሰብ ጥብቅ ቦታው ጽ/ቤቱ መደበኛ አድራሻ በመንዝ ጌራ ምድር ወረዳ አስተዳደር በመንዝ ጓሳ አካባቢ ይሆናል፡፡ The Office of the Community Conservation Area shall have its principal residence in the Menz Guassa locality of the Menz Gera Meder Woreda Administration. 7. ስለ ምክርቤቱ ተግባርና ኃላፊነት 7. Duties and Responsibilities of the Council የመንዝ ጓሳ ልማትና ጥበቃ ምክር ቤት በዚህ ደንብ መሰረት የሚከተሉት ዝርዝር ተግባርና ኃላፊነቶች ይኖሩታል፡ The Menz Guassa Development & Conservation Council shall, pursuant to this Regulation, have the following specific duties and responsibilities: 1. የጓሣ ልማትና ጥበቃ ሥራዎችን በበላይነት ይመራል፣ 1. Direct over the guassa development and conservation activities; 2. የጓሳውን አካባቢ መዘጊያና መከፈቻ ጊዜ ይወስናል፣ 2. Determine the closing and opening time of the guassa area; 3. ከጎብኝዎች አገልግሎትና ከሌሎች ምንጮች የሚገኙ ልዩ ልዩ ገቢዎች የሚሰበሰቡበትንና ለጓሳውና ለአካባቢው ሕብረተሰብ ልማት በአግባቡ የሚውሉበትን ሁኔታ ይከታተላል፣ 3. Follow up the conditions in which the various revenues to be acquired from the service delivered for visitors and other sources are collected and the due implementation of such collectibles are utilized for the development of the guassa and the local community thereof; 4. የአካባቢውን ህብረተሰብ በማስተባበር የማህበረሰብ ጥብቅ ስፍራው ጥበቃና ልማት ሥራ እንዲከናወን ያደርጋል፣ 4. Create favourable conditions in which those sections of the community inhabiting around the conservation area may be made aware of their lasting benefits and develop sense of ownership in connection thereto; 6. ጉዳዩ የሚመለከታቸው አካላት በቅንጅትና በተናጠል የሚጠበቅባቸውን ኃላፊነት በአግባቡ ሊወጡ የሚችሉበትን የአሠራር ስርዓት ይዘረጋል፣ አፈፃፀሙን ይከታተላል፣ ይቆጣጠራል 6. Put in place a working procedure in which those concerned bodies might be able to properly discharge their anticipated responsibilities, either individually or collectively as well as follow up and supervise its implementation thereof; 7. በጥብቅ ስፍራው ልማትና ጥበቃ ሥራዎች ዙሪያ ለሚከሰቱ ችግሮች መፍትሄዎችን ያፈላልጋል፣ 7. Seek remedies for those problems which might be encountered with regard to the protection and development of the conservation area; 8. የጽ/ቤቱን የአጭር፣ የመካከለኛና የረጅም ጊዜ እቅዶችና ሪፖርቶች መርምሮ ያጸድቃል፣ 8. Examine and approve the short, medium and long term plans and reports of the office. 8. ስለ ጽ/ቤቱ ተግባርና ኃላፊነት 8. Duties and Responsibilities of the Office የማህበረሰብ ጥብቅ ስፍራው ጽ/ቤት በዚህ ደንብ መሠረት የሚከተሉት ዝርዝር ተግባርና ኃላፊነቶች ይኖሩታል፡ The office of the community conservation area shall, pursuant to this Regulation, have the following specific duties and responsibilities: 1. የጥብቅ ስፍራውን የጥበቃ ቦታዎች ከአካባቢው ህብረተሰብ ጋር በመሆን ይለያል፣ ጠባቂዎችን ያሰማራል፣ ይቆጣጠራል፣ 1. Identify the guarding posts of the conservation area in collaboration with the local community, assign guards and supervise same; 2. ከጉብኝት የሚመነጩ የአገልግሎት ክፍያዎችን ይሰበስባል፣ ለአካባቢው ህብረተሰብ ልማት እንዲውል ያደርጋል፣ 2. Collect service charges to be generated from visits as well as cause the utilization of same for the development of the local community thereof; 3. በምክር ቤቱ የተወሰነውን የጓሳ መዘጊያና መከፈቻ ጊዜ ያስከብራል፣ ይቆጣጠራል፣ 3. Carry out the protection and supervision activities with respect to the biodiversity resources within the conservation area as well as control diseases that may be transmitted from the domestic to the wild animals; 5. ጥብቅ ስፍራውን በተመለከተ የአካባቢውን ማህበረሰብ በማስተባበር ውስጠ-ደንቡን ያሻሽላል፣ የስራ እቅድ ያዘጋጃል፣ የልማትና የጥበቃ ስራዎች እንዲከናወኑ ያደርጋል፣ የትምህርትና ቅስቀሳ ፕሮግራሞችን ያካሂዳል፣ 5. Revise bylaws pertaining to the conservation area by coordinating the local community, prepare work plan, cause the carrying out of development and protection activities as well as undertake education and agitational programs thereof; 6. በጥብቅ ስፍራው ውስጥ የተከለከሉ ተግባራትንና ሌሎች ህገ-ወጥ ድርጊቶችን የሚፈጽሙ ግለሰቦችን ለሕግ በማቅረብ እርምጃ እንዲወሰድባቸው ያደርጋል፣ 6. Cause the taking of legal measures against those individuals who commit prohibited and other illegal acts in the conservation area, by presenting them before the law; 7. ወርሃዊና የስራ እንቅስቃሴና የፋይናንስ ክንውን ሪፖርቶችን አግባብ ላላቸው አካላት ያቀርባል፡፡ 7. Submit periodic activity and financial performance reports to the pertinent bodies. 9. ስለተከለከሉ ተግባራት 9. Prohibited Activities በማህበረሰብ ጥብቅ ቦታው ውስጥ እንዲከናወኑ ከተፈቀዱት ተግባራትና ከሚመለከታቸው አካላትም ሆነ ተሣታፊዎች ውጭ የሚከተሉትን ተግባራት መፈፀም በዚህ ደንብ የተከለከለ ነው፡ With the exception of those permitted to be practiced and the concerned bodies as well as participants, it is prohibited by this Regulation to commit the following activities in the community conservation area: 1. በጥብቅ ቦታው ውስጥ ሁከት መፍጠር ወይም ባለድምጽ መሣሪያዎችን ከመጠን አሳልፎ መጠቀም፣ 1. Creating nuisance or using sound instruments in excess of limit in the conservation area; 2. የዱር እንስሳትን ማደን፣ ማስፈራራት ወይም ማስበርገግ፣ 2. Cutting, gathering or transporting the guassa during the season where the area is closed for harvesting same; 5. የዱር እንስሳትን እንቁላል፣ ጫጩትና ግልገል መውሰድ፣ 5. Taking away eggs, hatchlings or cubs of wild animals; 6. ከጥብቅ ቦታው ላይ ተፈጥሯዊ ወይም ሰው ሰራሽ ቁሶችን ማንሳት፣ መውሰድ፣ ማጐሳቆል ወይም ማበላሸት፣ 6. Picking up, taking away, damaging or ruining natural or man made items at the conservation area; 7. የቤት እንስሳትን በዝግ ወቅት ለግጦሽ ማሠማራት፣ 7. Letting domestic animals in the area for grazing during closed seasons; 8. በጥብቅ ቦታው ውስጥ ውሻ አስከትሎ መንቀሳቀስ፣ 8. Moving about in the conservation area accompanied by dogs; 9. የማዕድን ፍለጋ ወይም የቁፋሮ ሥራዎችን ማካሄድ፣ 9. Carrying out mining exploration or digging activities; 10. ለቱሪስቶች ማረፊያ እንዲሆኑ ተለይተው ከተወሰኑት ሥፍሪዎች ውጭ እሳት ማንደድ፣ 10. Making fire, with the exception of those places specifically reserved for the purpose of tourist lodges; 11. መርዛማ ንጥረ ነገሮችን ይዞ መገኘት፣ 11. Moving about with the possession of poisonous substances; 12. ጐብኝዎች ለምግብ መያዣና ለመሣሰሉት የተጠቀሙባቸውን ሰው ሰራሽ ቁሶች በዘፈቀደ መጣል፣ 12. Establishing dwelling houses, planting grinding mills or construction of other similar institutions in the conservation area; 14. በህግ ከተወሰነው ፍጥነት ውጭ ተሽከርካሪ መንዳት ወይም ከጥዋቱ 12 ሰዓት በፊትና ከምሽቱ 12 ሰዓት በኋላ በጥብቅ ቦታው ውስጥ ማሽከርከር፣ 14. Riding motor vehicles beyond the legally prescribed speed limit or doing so before 6:00 a.m in the morning and after 6:00 p.m in the evening; 15. የእንስሳት ማጥመጃ መሣሪያ ይዞ ወይም አጥምዶ መገኘት፣ 15. Kebeles Benefitting from the Conservation Area ጥብቅ ስፍራውን በማልማትና በመጠበቅ ሥራ ላይ በቀጥታ የሚሣተፉና እስካሁን ሲጠቀሙ የቆዩ ቀበሌዎች በዚህ ደንብ መሰረት የጓሳው ተጠቃሚዎች ናቸው፡፡ Those kebeles participating in the development and protection activities pertaining to the conservation area and which might have so far benefitted therefrom shall have the same entitlement thereto as per this Regulation. 11. ስለጥብቅ ስፍራው የአጠባበቅ ሁኔታ 11. Condition of Protecting the Conservation Area የጥበቃ ስራው በጓሳ ተጠቃሚ ቀበሌዎች በኩል በተመረጡ የጓሳ ጠባቂ ስካውቶችና በአካባቢው ህብረተሰብ ትብብር ይከናወናል፡፡ The protection activity shall be carried out by the guassa protection scouts to be selected on the part of the Guassa user kebeles and with the cooperation of the local community. 12. ጓሳው ለአገልግሎት ክፍት ስለሚሆንበት ጊዜ 12. Time for the Opening of the Guassa for Utilization 1. ይህ ደንብ በስራ ላይ ከዋለበት ጊዜ ጀምሮ ጓሳው ለሁለት ተከታታይ ዓመታት ዝግ ሆኖ በሶስተኛው ዓመት በግንቦት ወር ለህብረተሰቡ አገልግሎት ክፍት ይሆናል፣ 1. The Guassa shall, having been closed for the two consecutive years from the effective date of this Regulation, be opened for the service of the community as of the month of Ginbot in the third year. 2. የጓሳውን አለቃቀቅ በተመለከተ የጥብቅ ስፍራው ጽ/ቤትና የጓሳ ልማትና ጥበቃ ምክርቤቱ በጋራ በመሆን ለአጠቃቀም የሚለቀቅበትን ጊዜ ለጓሳ ተጠቃሚ ቀበሌዎች ያሳውቃሉ፣ 2. The office of the conservation area and the Gussa conservation and protection council shall, regarding the publicity of the guassa, jointly announce the opening time of the area to the kebeles benefitting therefrom. 3. ጓሳው ለተጠቃሚዎች ከተከፈተ ከ 3 ወር በኋላ ከሃምሌ ወር የመጀመሪያ ሳምንት ጀምሮ ለተከታታይ ሁለት አመት ከአስር ወር ዝግ ይሆናል፡፡ 3. Right of the Local Community to Use the Conservation Area 1. ከጥብቅ ስፍራው የሚገኘው የቱሪዝም ገቢ ለአካባቢው ህብረተሰብ ልማት ይውላል። 1. The tourism income to be generated from the conservation area shall be expended for the development of the local community. 2. ከአካባቢው ኢኮ-ቱሪዝም የሚገኘውን ገቢ ለመጠቀም እንዲያመች በአካባቢው ህብረተሰብ ፈቃደኝነትና ተሣትፎ የተለያዩ የኢኮቱሪዝም ማህበራት ይቋቋማሉ። 2. There shall, through the will and participation of the local community, be established various eco-tourism cooperatives with a view to benefittig from the income to be generated from the activities thereof. 3. ጥብቅ ስፍራው ለአጠቃቀም ክፍት በሚሆንበት ወቅት ብቻ የመጠቀም መብት ያላቸው ቀበሌዎች ነዋሪ ህዝብ የጓሳ ሣር አጭዶ መጠቀም ይችላል፡፡ 3. The resident public of the kebeles entitled to use may be able to collect the guassa by cutting same only during the period when the conservetion area remains open for utilization. 4. ጥብቅ ስፍራው ለአጠቃቀም ክፍት በሚሆንበት ወቅት ለግጦሽ በተፈቀዱ አካባቢዎች ብቻ የቤት እንስሳትን ማስጋጥ ይቻላል፡፡ 4. It shall be allowed to deploy grazing animals only in those sites permited for same in the time when the conservation area remains open for use. 14. ስለ ቅጣት 14. Penalties 1. በዚህ ደንብ በአንቀጽ 9 ስር የተዘረዘሩትን ክልከላዎች የተላለፈ ማንኛውም ሰው በኢፊዲሪ የወንጀል ህግና አግባብ ባላቸው ሌሎች ህጎች መሠረት ይቀጣል፡፡ 1. Who so ever breaches the prohibitions specified under Art. 9 of this Regulation shall be punished in accordance with the criminal code of the FDRE and other relevant laws; 2. ፍርድ ቤት ተገቢውን ቅጣት ሲወስን ወንጀል የተሰራባቸው መሣሪያዎች ውርስ እንዲሆኑ ያደርጋል። 2. Where the court has decided appropriate penalties, it shall order that the weapons used for the commission of criminal acts be confiscated therewith. 15. የመተባበር ግዴታ 15. Power to Issue Directives ቢሮው ለዚህ ደንብ ሙሉ ተፈፃሚነት የሚያስፈልጉትን ዝርዝር መመሪያዎች ሊያወጣ ይችላል፡፡ The Bureau may issue specific directives necessary for the full implementation of this Regulation. 17. ደንቡ የሚፀናበት ጊዜ 17.
