Establishment Council of Ministers Regulation………….. …..……………………………..……………….ገጽ ፷ሺ፯፻፳ ……………………………...…………….……page 8720 የሚኒስትሮች ምክር ቤት ዯንብ ቁጥር ፫፻፷፰/፪ሺ፰ COUNCIL OF MINISTER REGULATION No. 368/2015 COUNCIL OF MINISTER REGULATION TO የኢትዮጵያ የግብርና ሥራዎች ኮርፖሬሽንን ሇማቋቋም ESTABLISH THE ETHIOPIAN AGRICULTURAL የወጣ የሚኒስትሮች ምክር ቤት ዯንብ BUSINESSES CORPORATION የሚኒስትሮች ምክር ቤት የኢትዮጵያ ፌዳራሊዊ This Regulation is issued by the Council of Ministers ዱሞክራሲያዊ ሪፐብሉክ አስፈፃሚ አካሊትን ሥሌጣንና pursuant to Article 5 of the Definition of Powers and ተግባር ሇመወሰን በወጣው አዋጅ ቁጥር ፱፻፲፮/፪ሺ፰ Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 916/2015 and አንቀጽ ፭ እና በመንግስት የሌማት ዴርጅቶች አዋጅ ቁጥር Article 47(1) of the Public Enterprises Proclamation No. ፳፭/፲፱፻፹፬ አንቀጽ ፵፯(፩) መሠረት ይህን ዯንብ 25/1992. አውጥቷሌ። 1. Short Title ፩. አጭር ርዕስ This Regulation may be cited as the “Ethiopian ይህ ዯንብ “የኢትዮጵያ የግብርና ሥራዎች ኮርፖሬሽን Agricultural Businesses Corporation Establishment ማቋቋሚያ የሚኒስትሮች ምክር ቤት ዯንብ ቁጥር Council of Ministers Regulation No. 368/2015”. ፫፻፷፰/፪ሺ፰” ተብል ሉጠቀስ ይችሊሌ፡፡ 2. Establishment ፪. መቋቋም 1/ The Ethiopian Agricultural Businesses Corporation ፩/ የግብርና ሥራዎች ኮርፖሬሽን (ከዚህ በኋሊ (hereinafter the “corporation”) is hereby established “ኮርፖሬሽን” እየተባሇ የሚጠራ) የፌዳራሌ as a Federal Government public Enterprise. መንግሥት የሌማት ዴርጀት ሆኖ በዚህ ዯንብ ተቋቁሟሌ፡፡ 2/ The Corporation shall be governed by the Public ፪/ ኮርፖሬሽኑ በመንግሥት የሌማት ዴርጅቶች አዋጅ Enterprises Proclamation No. 25/1992. ቁጥር ፳፭/፲፱፻፹፬ መሠረት ይተዲዯራሌ፡፡

Supervising Authority የመንግሥት የሌማት ዴርጅቶች ሚኒስቴር የኮርፖሬሽኑ The Ministry of Public Enterprises shall be the ተቆጣጣሪ ባሇሥሌጣን ይሆናሌ፡፡ supervising authority of the Corporation. ፬. ዋና መሥሪያ ቤት 4. Head Office የኮርፖሬሽኑ ዋና መሥሪያ ቤት በአዱስ አበባ ሆኖ The Corporation shall have its head office in Addis እንዯአስፈሊጊነቱ በላልች የአገሪቱ ክፍልች ቅርንጫፍ Ababa and may have branches elsewhere in other parts of the country, as may be necessary. ሉኖረው ይችሊሌ፡፡ ፭. ዓሊማ 5. Purposes ኮርፖሬሽኑ የተቋቋመባቸው ዓሊማዎች የሚከተለት The purpose for which the Corporation is established ናቸው፦ are: 1/ to buy from domestic and international markets ፩/ የግብርና ምርት ማሳዯጊያዎችን ከሀገር ውስጥና and supply agricultural inputs, process same; ከውጭ አገር ገዝቶ ሇገበያ ማቅረብ፣ ማዘጋጀት፤ undertake agricultural inputs market price የግብርና ምርት ማሳዯጊያዎችን የገበያ ዋጋ stabilization activities; የማረጋጋት ተግባራትን ማከናወን፤ 2/ to render agricultural mechanization services, ፪/ የግብርና ሜካናይዜሽን አገሌግልት፣ የእርሻና agricultural and construction equipment repair የኮንስትራክሽን መሣሪያዎችን የጥገና አገሌግልት፣ services and provide rental services of agricultural የእርሻ መሣሪያዎችንና የትራንስፖርት ተሽከርካሪ machineries and transport vehicles; ዎችን የኪራይ አገሌግልት በክፍያ መስጠት፤ ፫/ የእርሻ መሣሪያዎችንና መሇዋወጫዎችን፣ የኮንስት 3/ to buy from domestic and international markets and supply agricultural machineries and spare ራክሽን መሣሪያዎችን እና አግሮ ኬሚካልችን parts, construction equipment and agro- ከሀገር ውስጥና ከውጭ አገር ገዝቶ ሇሽያጭ chemicals; ማቅረብ፤ ፬/ ዘመናዊ የእርሻ መሣሪያዎች አጠቃቀም እንዱሇመዴ 4/ to provide necessary education for the promotion

አስፈሊጊውን ትምህርት መስጠት፤ ስሇእርሻ of the use of modern agricultural machineries; መሣሪያዎች አያያዝና አጠቃቀም የምክር provide consultancy service in handling and use of agricultural machineries and provide on the job አገሌግልት መስጠት፤ የቴክኒክ ሙያ ማሻሻያ ሥራ technical trainings; ሊይ ሥሌጠና መስጠት፤ ፭/ የተፈጥሮ ሙጫ ምርት መሰብሰብ፣ መግዛት፣ እሴት 5/ to harvest, buy, value add to and process natural መጨመር፣ ማዘጋጀት፤ ላልች ከዯን ውጤቶች gum, produce other forest products, and supply to የሚመረቱ ምርቶችን ማምረት፣ ሇሀገር ውስጥና domestic and international markets; ሇውጪ ገበያዎች ማቅረብ፤ gA ፷ሺ፯፻፳፪ ØdE‰L ነU¶T Uz¤È ቁጥር ፳ታህሣሥ ፲፪ ቀን ፪ሺ፰ዓ.ም Federal Negarit Gazette No.-20 , 22nd December , 2015 ….page 8722 ፮/ የእርሻ መሬት ሌማት ጥናትና ዱዛይን፣ የእርሻ 6/ to undertake agricultural land development studies መሬት ቅየሳ፣ ምንጣሮና ማስተካከሌ፣ የውኃ and preparation of designs, agricultural land ተፋሰስና የመስኖ ሥራ እንዱሁም ከእርሻ መሬት surveying, clearing, leveling, drainage and irrigation activities as well as other activities ሌማት ጋር የተዛመደ ሥራዎችን ማከናወን፤ related to agricultural land development; ፯/ የአዲዱስና ማስፋፊያ ፕሮጀክቶችን አዋጪነት ጥናት፣ 7/ to cause undertaking of feasibility studies, design የዱዛይን ዝግጅት፣ የቴክኖልጂ መረጣና ዴርዴር፣ preparation, technology selection and negotiation, የተከሊና የኮሚሽኒንግ እንዱሁም የምርምር erection and commissioning of new and expansion projects as well as for research ሥራዎች እንዱካሄደ ማዴረግ፤ activities; ፰/ አቅሙ ካሊቸው የአገር ውስጥ እና የውጪ ኩባንያዎች 8/ to cause the local designing and manufacturing of ጋር በመተባበር የግብርና የማምረቻ መሣሪያዎችና agricultural machineries and spare parts in መሇዋወጫዎች ዱዛይንና የማምረት ሥራዎች partnership with capable local and foreign በአገር ውስጥ እንዱከናወኑ ማዴረግ፤ companies; ፱/ ሇመስኩ የሚፈሇገውን የሰሇጠነ የሰው ኃይሌ 9/ to work in cooperation with the concerned በሚፈሇገው ዓይነት፣ መጠንና ጥራት ሇማፍራት educational research and training institutions in እንዱቻሌ ከሚመሇከታቸው የትምህርት የምርምርና producing trained manpower in such fields, የሥሌጠና ተቋማት ጋር በመተባበር መሥራት፤ numbers and quality as required by the sector;

፲/ በመንግስት የሌማት ዴርጅቶች ሚኒስቴር በሚሰጠው 10/ to undertake studies, based on direction given to አቅጣጫ ሊይ በመመሥረት በሀገር ውስጥና በውጭ it by the Ministry of Public Enterprises, for the ሀገራት ተወዲዲሪና አትራፊ ሆኖ እንዱንቀሳቀስ acquisition of financial, technological and modern እገዛ የሚያዯርጉሇትን የፋይናንስ፣ የቴክኖልጂና governance inputs (including attracting የዘመናዊ አስተዲዯር ግብዓቶችን ሇማግኘት investments or participating in investments) that የሚያስችሇውን (ኢንቨስትመንት መሳብንም ሆነ can help it to become competitive, both locally and globally, and profitable and implement same በኢንቨስትመንት መሳተፍን ጨምሮ) ጥናት upon approval; በማካሄዴ ሲፈቀዴ ተግባራዊ ማዴረግ፤ ፲፩/ የተሇያዩ የአዝዕርት፣ የአትክሌት፣ የፍራፍሬና 11/ to multiply, clean and process pre-basic, basic and የመሳሰለት ቅዴመ መሥራች፣ መሥራችና certified seeds of various crops, vegetables and የተመሠከረሇት ዘር ማባዛት፣ ማበጠርና ማዘጋጀት፣ fruits; where necessary import pre-basic seeds and እንዯአስፈሊጊነቱም ቅዴመ መሥራች ዘሮችን cause their production or sale them; to sell ከውጭ አገር በማስመጣት ማስመረት ወይም መሸጥ፣ byproducts; ተረፈ ምርቶችን ሇገበያ ማቅረብ፤ gA ፷ሺ፯፻፳፫ ØdE‰L ነU¶T Uz¤È ቁጥር ፳ታህሣሥ ፲፪ ቀን ፪ሺ፰ዓ.ም Federal Negarit Gazette No.-20 , 22nd December , 2015 ….page 8723 ፲፪/ በግብርና ግብዓት አቅርቦት፣ በእርሻ መሣሪያዎች 12/ to undertake research and implement አቅርቦት፣ በእርሻ መሣሪያዎች ጥገና፣ በተፈጥሮ improvements with respect to the supply of ሙጫ ምርትና ገበያ በሜካናይዜሽን አገሌግልትና agricultural inputs, agricultural machineries repair, the production and marketing of natural በተዛማጅ ሥራዎች ዙሪያ ምርምር በማካሄዴ gum, mechanization services and related matters የተሻሻለትን ተግባራዊ ማዴረግ፣ በውጤቱም and thereby ensure its competitiveness; ተወዲዲሪነትን ማረጋገጥ፤ ፲፫/ የገንዘብና ኢኮኖሚ ትብብር ሚኒስቴር በሚያወጣው 13/ to sell bonds, collateralize, negotiate and sign መመሪያና የመንግሥት ሌማት ዴርጅቶች loan agreements with local and foreign sources in accordance with directives issued by the Ministry ሚኒስቴር በሚሠጠው አቅጣጫ መሠረት ቦንዴ of Finance and Economic Corporation and on the መሸጥ፣ ዋስትና ማስያዝ፣ ከሀገር ውስጥና ከውጪ basis of the guidance of Ministry of Public የገንዘብ ምንጮች የብዴር ውሌ መዯራዯርና Enterprise; ሲፈቀዴ መፈራረም፤ 14/ to engage in other related activities for the ፲፬/ ዓሊማውን ከግብ ሇማዴረስ የሚረደ ላልች ተዛማጅ attainment of its purposes. ሥራዎችን መሥራት፡፡ ፮.ካፒታሌ 6. Capital የኮርፖሬሽኑ የተፈቀዯ ካፒታሌ ብር ፪ ቢሉዮን ፬፻፵ The authorized capital of the Corporation is Birr

ሚሉዮን (ሁሇት ቢሉዮን አራት መቶ አርባ ሚሉዮን) 2,440,000,000 Billion (Two Billion Four Hundred Forty Million) of which Birr 610,000,000 (Six ሲሆን ከዚህ ውስጥ ብር ፮፻፲ ሚሉዮን (ስዴስት መቶ Hundred Ten Million) is paid up in cash and in kind. አስር ሚሉዮን) በጥሬ ገንዘብና በዓይነት ተከፍሎሌ፡፡ ፯.ኃሊፊነት 7. Liability ኮርፖሬሽኑ ካሇው ጠቅሊሊ ንብረት በሊይ በዕዲ ተጠያቂ The Corporation shall not be held liable beyond its አይሆንም፡፡ total assets. 8. Duration ፰.ኮርፖሬሽኑ የሚቆይበት ጊዜ The Corporation is established for an in definite ኮርፖሬሽኑ ሊሌተወሰነ ጊዜ ይቆያሌ፡፡ duration. ፱.የተሻሩ ዯንቦች 9. Repealed Regulations የሚከተለት ዯንቦች በዚህ ዯንብ ተሽረዋሌ፡‐ The following regulations are hereby repealed: ፩/ የኢትዮጵያ ምርጥ ዘር ዴርጅት ማቋቋሚያ 1/ the Ethiopian Seeds Enterprise Establishment የሚኒስትሮች ምክር ቤት ዯንብ ቁጥር Council of Ministers Regulations No. 154/1993; ፩፻፶፬/፲፱፻፹፮፤ 2/ the Natural Gum Processing and Marketing ፪/ የተፈጥሮ ሙጫ ምርትና ገበያ ዴርጅት ማቋቋሚያ Enterprise Establishment Council of Ministers የሚኒስትሮች ምክር ቤት ዯንብ ቁጥር Regulations No. 179/1994; ፩፻፸፱/፲፱፻፹፮፤ 3/ the Agricultural Inputs Supply Enterprise ፫/ የግብርና ምርት ማሳዯጊያዎች አቅራቢ ዴርጅት Establishment Council of Ministers Regulations ማቋቋሚያ የሚኒስትሮች ምክር ቤት ዯንብ ቁጥር No. 177/1994; ፩፻፸፯/፲፱፻፹፮፤ gA ፷ሺ፯፻፳፬ ØdE‰L ነU¶T Uz¤È ቁጥር ፳ታህሣሥ ፲፪ ቀን ፪ሺ፰ዓ.ም Federal Negarit Gazette No.-20 , 22nd December , 2015 ….page 8724 ፬/ የግብርና ሜካናይዜሽን አገሌግልት ዴርጅት 4/ the Agricultural Mechanization Services Enterprise ማቋቋሚያ ሚኒስትሮች ምክር ቤት ዯንብ ቁጥር Establishment Council of Ministers Regulations ፺፯/፲፱፻፹፮፤ No. 97/1994. ፲. የመብትና ግዳታዎች መተሊሇፍ 10. Transfer of Rights and Liabilities The rights and liabilities of the following public የሚከተለት የመንግስት የሌማት ዴርጅቶች መብትና enterprises are hereby transferred to the Corporation: ግዳታዎች በዚህ ዯንብ ሇግብርና ሥራዎች ኮርፖሬሽን ተሊሌፈዋሌ፦ ፩/ በሚኒስትሮች ምክር ቤት ዯንብ ቁጥር 1/ the Ethiopian Seeds Enterprise Established under ፩፻፶፬/፲፱፻፹፮፤ ተቋቁሞ የነበረው የኢትዮጵያ the Council of Ministers Regulations No.

ምርጥ ዘር ዴርጅት፤ 154/1993; ፪/ በሚኒስትሮች ምክር ቤት ዯንብ ቁጥር 2/ the Natural Gum Processing and Marketing ፩፻፸፱/፲፱፻፹፮ ተቋቁሞ የነበረው የተፈጥሮ ሙጫ Enterprise Established under the Council of Ministers Regulations No. 179/1994; ምርት ገበያ ዴርጅት፤ ፫/ በሚኒስትሮች ምክር ቤት ዯንብ ቁጥር 3/ the Agricultural Inputs Supply Enterprise ፩፻፸፯/፲፱፻፹፮ ተቋቁሞ የነበረው የግብርና ምርት Established under the Council of Ministers ማሳዯጊያዎች አቅራቢ ዴርጅት፤ Regulations No. 177/1994; ፬/ በሚኒስትሮች ምክር ቤት ዯንብ ተቋቁሞ 4/ the Agricultural Equipment and Technical በመቀጠሌም በአዋጅ ቁጥር ፩፻፵፮/፲፱፻፺፩ አንቀጽ Services Enterprise Established under the Council of Ministers Regulation and subsequently ፭ መሠረት ጥር ፩/፱፻፺፬ እንዯ አዱስ ወዯ አክሲዮን converted into a share company as of January 10, ማህበርነት ተሇውጦ የነበረው የእርሻ መሣሪያዎችና 2002 by the Proclamation No. 146/1998 Article 5; የቴክኒክ አገሌግልት አክሲዮን ማህበር፤ ፭/ በሚኒስትሮች ምክር ቤት ዯንብ ቁጥር ፺፯/፲፱፻፹፮ 5/ the Agricultural Mechanization Services ተቋቁሞ የነበረው የግብርና ሜካናይዜሽን Enterprise Established under the Council of አገሌግልት ዴርጅት፡፡ Ministers Regulations No. 97/1994. ፲፩.ዯንቡ የሚፀናበት ጊዜ 11.
