የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ፌደራል ነጋሪት ጋዜጣ FEDERAL NEGARIT GAZETTE OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA 23rd Year No.78 ሃያ ሦስተኛ ዓመት ቁጥር ፸፰ አዲስ አበባ ነሐሴ ፩ ቀን ፪ሺ፱ ዓ.ም በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ADDIS ABABA, 7th August, 2017 የሕዝብ ተወካዮች ምክር ቤት ጠባቂነት የወጣ ማውጫ CONTENT አዋጅ ቁጥር ፩ሺ፶/፪ሺ፱ ዓ.ም PROCLAMATION No. 1050/2017 የኢትዮጵያ ምርት ገበያ ማቋቋሚያ (ማሻሻያ) አዋጅ Ethiopia Commodity Exchange Establishment (Amendment) ……………………………………………ገጽ ፱ሺ፰፻፳፬ Proclamation …………………………………….page 9824 አዋጅ ቁጥር ፩ሺ፶/፪ሺ፱ Proclamation No. 1050/2017 የኢትዮጵያ ምርት ገበያ ማቋቋሚያ አዋጅን ለማሻሻል የወጣ A PROCLAMATION TO PROVIDE FOR THE AMENDMENT አዋጅ OF THE ETHIOPIA COMMODITY EXCHANGE ESTABLISHMENT PROCLAMATION የኢትዮጵያ ምርት ገበያ የተቋቋመበትን ዓላማ ለማሳካት WHER AS, it is found necessary to satisfy the customer የምርት ገበያውን ተደራሽነት የበለጠ በማስፋት demand and increase the small scale farmers participation in የግብይት ተዋናዮችን ፍላጎትና አነስተኛ አምርቾች the exchange by develop procedures and by enhance the በገበያው ያላተቸውን ተሳትፎ ማሳደግ የሚያስችል accessibility of Ethiopia commodity exchange to achieve their objectives ; አሰራር መዘርጋት አስፈላጊ በመሆኑ፣ የግብርና ምርቶች በዓይነት በመጠንም ሆነ በጥራት ወጪ WHERE AS, it is found necessary to re-amend the ቆጣቢ በሆነ ሁኔታ ወደ ምርት ገበያው የሚቀርቡበትን Ethiopia Commodity Exchange Establishment proclamation አመቺ ሁኔታ በመፍጠር በዓለም ገበያ ተወዳዳሪ no.550/2007 in a way it receives the agricultural product in እንዲሆኑ በማድረግ የአገሪቱን የውጭ ንግድ በማጠናከር their type ,quality , amount and in a cost effective manner and make them competitive to foreign market there by enhance የምርት ገበያውን ማቋቋሚያ አዋጅ ቁጥር the country foreign trade; ፭፻፶/፲፱፻፺፱ን እንደገና ማሻሻል አስፈላጊ ሆኖ በመገኘቱ፤ በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ NOW, THEREFORE, in accordance with sub-article መንግስት አንቀጽ ፶፭ (፩) መሰረት እንደሚከተለው (1) of Article 55 of the Constitution of the Federal Democratic ታውጇል;- Republic of Ethiopia, it is hereby proclaimed as follows:

Short Title This Proclamation may be cited as the “Ethiopia ይህ አዋጅ “የኢትዮጵያ ምርት ገበያ ማቋቋሚያ Commodity Exchange Establishment (Amendment) (ማሻሻያ) አዋጅ ቁጥር ፩ሺ፶/፪ሺ፱” ተብሎ ሊጠቀስ Proclamation No. 1050 /2017”. ይችላል፡፡ ፪. ማሻሻያ 2. Amendment የኢትዮጵያ ምርት ገበያ ማቋቋሚያ አዋጅ ቁጥር The Ethiopia Commodity Exchange Establishment ፭፻፶/፲፱፻፺፱ (እንደተሻሻለው) እንደሚከተለው Proclamation No.550/2007 (as amended) is here by re- እንደገና ተሻሽሏል;- amended as follows: ፩/ የአዋጁ አንቀጽ ፪ (፮) ተሰርዞ በሚከተለው አዲስ 1/ Sub-article (6) of Article 2 of the Proclamation is ንዑስ አንቀጽ (፮) ተተክቷል፦ deleted and replaced by the following new sub- article (6): “፮/ ‘ውል’ ማለት ለምርት ገበያ ግብይት ሲባል “6/ ‘contract’ means a standardized agreement አንድን ምርት ለመግዛት ወይም ለመሸጥ prepared to buy or sell a specified commodity ወጥ ሆኖ የተዘጋጀና የምርቱን መጠን፣ ዋጋ፣ containing details such as amount, grade, ደረጃ፣ መነሻ ቦታ፣ ተፈጻሚ የሚሆንበትንና price and origin of the commodity and the የምርቱ ርክክብ የሚፈጸምበትን ቀን date on which the contact will mature and በዝርዝር የሚያካትት ስምምነት ነው፤” become deliverable for purposes of trading on the Exchange;” 2/ Sub-article (13) of Article 2 of the Proclamation is ፪/ የአዋጁ አንቀጽ ፪ (፲፫) ተሰርዞ በሚከተለው deleted and replaced by the following new sub- አዲስ ንዑስ አንቀጽ (፲፫) ተተክቷል፦ article (13): “13/ ‘Ministry’ means the Ministry of Trade of “፲፫/ ‘ሚኒስቴር’ ማለት የኢትዮጵያ ፌደራላዊ the Federal Democratic Republic of ዲሞክራሲያዊ ሪፐብሊክ የንግድ ሚኒስቴር Ethiopia;” ነው፤” ፫/ ከአዋጁ አንቀጽ ፪ (፲፭) ቀጥሎ የሚከተለው 3/ The following new sub-article (16) is added after

አዲስ ንዑስ አንቀጽ (፲፮) ተጨምሯል፦ sub-article (15) of Article 2 of the Proclamation: “፲፮/ ‘ጥብቅ የማቆያ ሥፍራ’ ማለት በምርት “16/ ‘bonded yard’ means fenced secured yard ገበያው ግብይት የሚካሄድበትን ምርት constructed for parking trucks loaded with የያዙ የጭነት ተሽከርካሪዎች ጭነቱ commodity to be traded in the Exchange ተሽከርካሪው ላይ እንዳለ ተሽጦ ወደገዥ until the consignment is sold on truck and እስከሚተላለፍበት ወይም በምርት ማከማቻ picked up by the buyer within the መጋዘን እስከሚራገፍበት ድረስ ባለው ጊዜ maximum pick up period or deposited to የሚቆሙበት የተከለለና ደህንነቱ የተጠበቀ warehouse;” ቦታ ነው፡፡” gA ፱ሺ፰፻፳፮ ØdE‰L ነU¶T Uz¤È qÜ_R ፸፰ ነሐሴ ፩ qN ፪ሺ፱ ›.M Federal Negarit Gazette No.78, August 7th, 2017………………page 9826 ፬/ የአዋጁ አንቀጽ ፬ ተሰርዞ በሚከተለው አዲስ 4/ Article 4 of the Proclamation is deleted and replaced by the following new Article 4: አንቀጽ ፬ ተተክቷል፦ “፬. ተቆጣጣሪ ባለሥልጣን “4. Supervising Authority The Ministry of Trade shall be the የንግድ ሚኒስቴር የምርት ገበያው supervising authority of the Exchange.” ተቆጣጣሪ ባለሥልጣን ይሆናል፡፡” ፭/ ከአዋጁ አንቀጽ ፮ (፲) ቀጥሎ የሚከተለው አዲስ 5/ The following new sub-articles (11) and (12) are ንዑስ አንቀጽ (፲፩) እና (፲፪) ተጨምረዋል፦ added after sub-article (10) of Article 6 the Proclamation: “፲፩/ ስትራተጂያዊ በሆኑ የአገሪቱ አካባቢዎች “11/ to construct and manage modern and ዘመናዊና በቴክኖሎጂ የተደገፉ የምርት technology based commodity warehouses ማከማቻ መጋዘኖችን እና ጥብቅ የማቆያ and bonded yards in strategic locations of ሥፍራዎችን መገንባትና ማስተዳደር፤ the country; ፲፪/ በምርት ገበያው ግብይት የሚደረግባቸው 12/ define mandatory criteria for condition of ምርቶች የሚጓጓዙበትን ሁኔታ በተመለከተ transport of exchange traded commodities and follow up its implementation, as may be እንደአስፈላጊነቱ አግባብነት ካለው delegated by appropriate government የመንግሥት አካል በሚሰጠው ውክልና authority.” መሠረት አስገዳጅ መስፈርት ማውጣት፤ ተፈጻሚነቱን የማረጋገጥ እና ተገቢውን እርምጃ የመውሰድ፡፡”

፮/ የአዋጁ አንቀጽ ፯ ተሰርዞ በሚከተለው አዲስ 6/ Article 7 of the Proclamation is deleted and replaced by the following new Article 7: አንቀጽ ፯ ተተክቷል፦ “፯. ካፒታል “7. Capital The authorized capital of the Exchange የምርት ገበያው የተፈቀደ ካፒታል ፩ is Birr 1,250,000,000 (One Billion, Two ቢሊዮን ፪፻፶ ሚሊዮን (አንድ ቢሊዮን ሁለት Hundred Fifty Million) of which Birr መቶ ሃምሣ ሚሊዮን) ብር ሲሆን ከዚህ 725, 000,000 (Seven Hundred Twenty- ውስጥ ብር ፯፻፳፭ ሚሊዮን (ሰባት መቶ ሃያ Five Million) is paid in cash and in አምስት ሚሊዮን ብር) በዓይነትና በጥሬ kind.” ገንዘብ ተከፍሏል፡፡” ፯/ ከአዋጁ አንቀጽ ፰ (፮) ቀጥሎ የሚከተለው 7/ The following new sub-article (7) is added after sub-article (6) of Article 8 of the Proclamation: አዲስ ንዑስ አንቀጽ (፯) ተጨምሯል፦ “፯/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪) እና በዚህ “7/ Notwithstanding sub-article (2) of this Article and sub-article (1) of Article 20 of አዋጅ አንቀጽ ፳ (፩) የተደነገገው ቢኖርም the Proclamation, detail conditions under በምርት ገበያው የአባልነት መቀመጫ gA ፱ሺ፰፻፳፯ ØdE‰L ነU¶T Uz¤È qÜ_R ፸፰ ነሐሴ ፩ qN ፪ሺ፱ ›.M Federal Negarit Gazette No.78, August 7th, 2017………………page 9827 ሳይኖራቸው ያለአገናኝ በምርት ገበያው which non-members of the Exchange may በራሳቸው መገበያየት የሚችሉ ምርት buy or sell their own commodities at the ሻጮች ወይም ገዥዎች የሚስተናገዱበት Exchange plat without intermediary shall be determined in the rules of the ዝርዝር ሁኔታ በምርት ገበያው የውስጥ Exchange.” ደንብ ይወሰናል፡፡” ፰/ የአዋጁ አንቀጽ ፲፩ (፩) ተሰርዞ በሚከተለው 8/ Sub-article (1) of Article 11 of the Proclamation is deleted and replaced by the following new sub- አዲስ ንዑስ አንቀጽ (፩) ተተክቷል፦ article (1): “፩/ የዳይሬክተሮች ቦርድ አስራ አንድ አባላት “1/ The Board of Directors shall consist of eleven የሚኖሩት ሲሆን ሰብሳቢውን ጨምሮ members, of whom six, including the ስድስቱ በሚኒስቴሩ ይሰየማሉ፤ አምስቱ chairperson, are assigned by the Ministry and በምርት ገበያው የውስጥ ደንብ መሰረት five are elected from Members or Members’ ከአባላት ወይም ከአባል ማህበራት Associations in accordance with the rules of ይመረጣሉ፡፡” the Exchange.” ፱/ ከአዋጁ አንቀጽ ፲፭ (፱) ቀጥሎ የሚከተለው 9/ The following new sub-article (10) is added after አዲስ ንዑስ አንቀጽ (፲) ተጨምሯል፦ sub-article (9) of Article 15 of the Proclamation:

“፲/ የምርት ገበያውን አደረጃጀትና መዋቅር “10/ Approve the organizational structure of the ያጸድቃል፡፡” Exchange.” ፲/ የአዋጁ አንቀጽ ፳ (፪) ተሰርዞ በሚከተለው አዲስ 10/ Sub-article (2) Article 20 of the Proclamation is ንዑስ አንቀጽ (፪) ተተክቷል፦ deleted and replaced by the following new sub- article (2): “፪/ ስለምርቱ ጥራት ወይም ደረጃ ከምርት “2/ It shall be prohibited to trade a commodity ገበያው የምርት የምስክር ወረቀት ሳያገኝ on the Exchange without the issuance of an እንዲሁም ስለምርቱ መጠን፣ መነሻ ቦታ Exchange product certificate as to the ሁኔታና የማከማቻ መጋዘኑ ወይም ጥብቅ product quality or grade and of an Exchange ማቆያው የሚገኝበትን ቦታ የሚገልጽ warehouse receipt as to the product origin, የመጋዘን ማከማቻ ደረሰኝ ሳይኖረው quantity, condition, and location of ምርቱን በምርት ገበያው ለግብይት warehouse or bonded yard.” ማቅረብ የተከለከለ ነው፡፡” ፲፩/ የአዋጁ አንቀጽ ፳፪ (፩) ተሰርዞ በሚከተለው 11/ Sub-article (1) of Article 22 of the Proclamation አዲስ ንዑስ አንቀጽ (፩) ተተክቷል፦ is deleted and replaced by the following new sub-article (1): “፩/ የምርት ገበያው ከግብርና ምርቶች ጋር “1/ The Exchange shall operate with spot or በተያያዘ ወዲያውኑ የሚፈጸም ወይም future contracts or forward contracts in ርክብክባቸው ወደፊት የሚፈጸም ወይም agricultural commodities.” ወደፊት በሚፈጸሙ ውሎች ላይ ተመስርቶ ይሰራል፡፡” 12/ The following new sub-articles (3) and (4) are gA ፱ሺ፰፻፳፷ ØdE‰L ነU¶T Uz¤È qÜ_R ፸፰ ነሐሴ ፩ qN ፪ሺ፱ ›.M Federal Negarit Gazette No.78, August 7th, 2017………………page 9828 ፲፪/ ከአዋጁ አንቀጽ ፳፪ (፪) ቀጥሎ የሚከተለው added after sub-article (2) of Article 22 of the አዲስ ንዑስ አንቀጽ (፫) እና (፬) ተጨምረዋል፦ Proclamation: “3/ The conditions under which future contracts “፫/ በምርት ገበያው ግብይት የሚደረግባቸው or forward contracts in agricultural ርክክባቸው ወደፊት የሚፈጸም እና ወደ ፊት commodities traded at the exchange shall be የሚፈጸሙ ውሎችን በተመለከተ ዝርዝሩ provided in the directive to be issued by the

ባለሥልጣኑ በሚያወጣው መመሪያና በምርት Authority and the rules of the exchange. ገበያው የውስጥ ደንብ ይወሰናል፡፡ 4/ Notwithstanding the provisions of sub-article ፬/ በዚህ አንቀጽ ንኡስ አንቀጽ (፩) የተደነገገው (1) of this Article, the Exchange may, after ቢኖርም በሚኒስቴሩ ወይም አግባብነት ባለው conducting a study, trade in other contracts የመንግሥት አካል መጽደቁ እንደተጠበቀ outside contracts in agricultural commodities ሆኖ የምርት ገበያው ከግብርና ምርቶች ውጭ subject to the prior approval of the Ministry or other pertinent government authority.” ያሉ ውሎችን በማጥናት ሊያገበያይ ይችላል፡፡” 13/ Sub-article (3) of Article 23 of the Proclamation ፲፫/ የአዋጁ አንቀጽ ፳፫ ንዑስ አንቀጽ (፫) ተሰርዞ is deleted and replaced by the following new በሚከተለው አዲስ ንዑስ አንቀጽ (፫) sub-article (3): ተተክቷል፦ “3/ Without prejudice to the Ethiopian “፫/ የኢትዮጵያ ደረጃዎችን አጽድቆ ለማውጣት Standards Agency approved to given በህግ ሥልጣን የተሰጠው አካል እንደተጠበቀ authorized body the Exchange shall carry ሆኖ ምርት ገበያው በዚህ አንቀጽ የተሰጡትን out its duties under this Article.” ተግባራት ያከናውናል፡፡” 14/ The following new Article 30 is added after ፲፬/ ከአዋጁ አንቀጽ ፳፱ ቀጥሎ የሚከተለው አዲስ Article 29 of the Proclamation and the existing አንቀጽ ፴ ተጨምሮ ነባሮቹ አንቀጾች ከ፴ Articles 30 to 33 are respectively renumbered እስከ ፴፫ የሚገኙት እንደቅደም ተከተላቸው as Article,31, 32,33 and 34: አንቀጽ ፴፩፣ ፴፪፣ ፴፫ እና ፴፬ ሆነው ተሸጋሽገዋል፦ “30. Identity preserved and Traceable “፴. ባለቤትነትን እና የምርት ዱካን ባስጠበቀ Commodities ሁኔታ ስለሚደረግ ግብይት 1/ Notwithstanding sub-article (4) of ፩/ በዚህ አዋጅ አንቀጽ ፪ (፬) ስለምርት Article 2 of this Proclamation regarding ተተካኪነት የተደነገገው ቢኖርም የምርት interchangeability of commodities, the ገበያው የምርቱን ባለቤት ማንነት እና Exchange may establish a trading system that ensures the identity of the owner or የምርቱን ዱካ ያረጋገጠ የግብይት supplier and traceability of commodities. ሥርዓት ሊዘረጋ ይችላል፡፡

gA ፱ሺ፰፻፳፱ ØdE‰L ነU¶T Uz¤È qÜ_R ፸፰ ነሐሴ ፩ qN ፪ሺ፱ ›.M Federal Negarit Gazette No.78, August 7th, 2017………………page 9829 ፪/ ባለቤትነትን እና የምርት ዱካን ባስጠበቀ 2/ The kind of commodity to be included to trade in the Exchange by ሁኔታ በሚደረግ ግብይት መካተት ያለባቸው maintaining identity of owner or ምርቶች ዝርዝር ሚኒስቴሩ በየጊዜው preserving identity may be decided by the Ministry by revising from time to እየከለሰ ሊወስን ይችላል፡፡ time. ፫/ በዚህ ሥርዓት ግብይት የሚፈጸምባቸው 3/ Staking, inventory and delivery of ምርቶች የመጋዘን ውስጥ የምርት አቀማመጥ፤ commodities at the Exchange`s አስተዳደርና ርክክብም የምርቱንና የባለቤቱን warehouse through such trading ወይም አቅራቢውን ማንነት የሚያረጋግጡ system shall also be done by ensuring መሆን ይኖርባቸዋል፡፡ identity of the commodity and that of its owner/supplier. ፬/ በዚህ ሥርዓት ግብይት የሚደረግበትን ምርት 4/ Detail rules governing on truck trading እንደጫኑ በምርት ገበያው ጥብቅ ማቆያ of identity preserved commodities at ሥፍራ ግብይት የሚካሔድባቸውን the Exchange`s Bonded Yard, ተሽከርካሪዎችና ጭነቶች አቀባበል፤ ናሙና handling of arrivals, sampling, አወሳሰድ፤ ደረጃ አወሳሰን፤ የክብደት ምዘና፤ grading, weighing, trading, and risk ግብይት፤ ርክክብና የአደጋ ቁጥጥር management shall be determined in አሠራሮችን የተመለከቱ ዝርዝር የአሠራር the Rules of the Exchange.” ሥርዓት በምርት ገበያው ደንብ ይወሰናል፡፡” ፫. አዋጁ የሚጸናበት ጊዜ 3.
