Short Title ይህ አዋጅ “በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ This Proclamation may be cited as the “Definition ሪፐብሊክ የፌደራል አስፈፃሚ አካላትን ሥልጣንና of Powers and Duties of the Executive Organs of ተግባር መወሰኛ አዋጅ ቁጥር ፩ሺ፺፯/፪ሺ፲፩” the Federal Democratic Republic of Ethiopia ተብሎ ሊጠቀስ ይችላል። Proclamation No. 1097/2018 ” ፪. ትርጓሜ 2. Definition In this Proclamation, unless the context በዚህ አዋጅ ውስጥ የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር፦ otherwise requires: ፩. “ሕገ-መንግሥት” ማለት የኢትዮጵያ ፌደራላዊ 1. “Constitution” means the Constitution of the ዲሞክራሲያዊ ሪፐብሊክ ሕገ-መንግሥት ነው። Federal Democratic Republic of Ethiopia. ፪. “ክልል” ማለት በኢትዮጵያ ፌደራላዊ 2. “Regional State” means any state referred to ዲሞከራሲያዊ ሪፐብሊክ ሕገ-መንግሥት አንቀፅ under Article 47 of the Constitution of the ፵፯ የተመለከተው ማንኛውም ክልል ሲሆን የአዲስ Federal Democratic Republic of Ethiopia አበባና ድሬዳዋ ከተሞች አስተዳደሮችንም and includes the Addis Ababa and Dire ይጨምራል። Dawa City Administrations. ፫. “ምክር ቤት” ማለት የሚኒስትሮች ምክር ቤት 3. “Council” means the Council of Ministers; ነው። ፬. ማንኛውም በወንድ ፆታ የተገለጸው አነጋገር 4. Powers and Duties of the Prime Minister የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ The powers and duties of the Prime Minister of ጠቅላይ ሚኒስትር ሥልጣንና ተግባር በሕገ- the Federal Democratic Republic of Ethiopia are መንግሥቱ አንቀፅ ፸፬ የተመለከተው ነው። those defined under Article 74 of the Constitution.

፬. የምክትል ጠቅላይ ሚኒስትሩ ሥልጣንና ተግባር 4. Powers and Duties of the Deputy Prime Minister የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ The powers and duties of the Deputy Prime ምክትል ጠቅላይ ሚኒስትር ሥልጣንና ተግባር Minister of the Federal Democratic Republic of በሕገ-መንግሥቱ አንቀፅ ፸፭ የተመለከተው ነው። Ethiopia are those defined under Article 75 of the Constitution. ፭. የሚኒስትሮች ምክር ቤት ሥልጣንና ተግባር 5. Powers and Duties of the Council of Ministers The powers and duties of the Council of የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ Ministers of the Federal Democratic Republic of የሚኒስትሮች ምክር ቤት ሥልጣንና ተግባር በሕገ- መንግሥቱ አንቀፅ ፸፯ የተመለከተው ነው። Ethiopia are those defined under Article 77 of the Constitution. gA ፲ሺ፮፻፴፮ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10636 ፮. የሚኒስትሮች ምክር ቤት አባላት 6. Members of the Council of Ministers ፩. የሚኒስትሮች ምክር ቤት የሚከተሉት አባላት 1. The Council of Ministers shall have the ይኖሩታል:- following members: ሀ) ጠቅላይ ሚኒስትር፣ a. the Prime Minister; b. the Deputy Prime Minister; ለ) ምክትል ጠቅላይ ሚኒስትር፣ ሐ) በዚህ አዋጅ አንቀፅ፱ የተመለከቱትን ሚኒስቴር c. Ministers heading the Ministries specified መሥሪያ ቤቶች የሚመሩ ሚኒስትሮች፣ እና under Article 9 of this Proclamation; and መ) በጠቅላይ ሚኒስትሩ የሚሰየሙ ሌሎች d. other Officials to be designated by the ባለስልጣኖች። Prime Minister. ፪. በዚህ አንቀፅ ንዑስ አንቀፅ ፩ (ሐ) የተመለከተው 2. Meeting Procedure of the Council of Ministers ፩. የሚኒስትሮች ምክር ቤት፡- 1. The Council of Ministers shall:

ሀ) ሥራውን በአግባቡ ለማካሄድ አስፈላጊው a. have its own internal procedural rules for የውስጥ ደንብ ይኖረዋል፤ a proper conduct of its activities; ለ) በውስጥ ደንቡ በሚወሰነው መሠረት መደበኛ b. conduct ordinary and extraordinary እና አስቸኳይ ስብሰባዎችን ያካሂዳል፤ meetings in accordance with its procedural rules; ሐ) ስብሰባ ላይ ከአባላቱ ከግማሽ በላይ ሲገኙ c. have a quorum where more than half of its ምልዓተ-ጉባኤ ይኖራል፤ members are present; d. pass decisions by consensus, or failing መ) የሚያስተላልፈው ውሳኔ በተባበረ ድምፅ ይሆናል፣ በተባበረ ድምፅ መወሰን ካልተቻለ that, by majority vote; where the Council በአብልጫ ድምፅ ይወሰናል፤ የተሰጠው has given an equal number of votes for ድምፅ እኩል ከሆነ ጠቅላይ ሚኒስትሩ ወሳኝ and against a decision, the Prime Minister ድምፅ ይኖረዋል። shall have the casting vote. ፪. ጠቅላይ ሚኒስትሩ፡- 2. The Prime Minister shall: a. without prejudice to the rights of the ሀ) የሚኒስትሮች ምክር ቤት አባላት አጀንዳ የማስያዝ መብታቸው እንደተጠበቀ ሆኖ members of the Council of Ministers to ለምክር ቤቱ በአጀንዳ የሚቀርቡ ጉዳዮችን propose agenda items, determine the ይወስናል፤ agenda of the Council; ለ) የምክር ቤቱን ስብሰባ ይመራል፤ b. preside over the meetings of the Council; ሐ) ለምክር ቤቱ በአጀንዳ የቀረበ ጉዳይ c. adjourn the meetings of the Council under በሚመለከተው የምክር ቤቱ ኮሚቴ መታየት circumstances where he finds it necessary የሚያስፈልገው ሆኖ ካገኘው ስብሰባውን ለሌላ to refer a matter included in the Council’s ጊዜ ያስተላልፋል። agenda to the relevant Committee of the Council. gA ፲ሺ፮፻፴፯ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10637 ፫. ጠቅላይ ሚኒስትሩ በማይኖርበት ጊዜ ምክትል 3. In the absence of the Prime Minister, the ጠቅላይ ሚኒስትሩ የምክር ቤቱን ስብሰባ Deputy Prime Minister shall preside over the ይመራል። meetings of the Council. ፰. የሚኒስትሮች ምክር ቤት ቋሚ ኮሚቴዎች 8. Standing Committees of the Council of Ministers ፩. የሚኒስትሮች ምክር ቤት ሥልጣንና ተግባሩን 1. The Council of Ministers may, with a view to ለመወጣት ይረዳው ዘንድ የምክር ቤቱ አባላት facilitating its functions, establish various የሚገኙባቸው ልዩ ልዩ ቋሚ ኮሚቴዎች ሊያቋቁም standing committees comprising of its ይችላል። members; ፪. የቋሚ ኮሚቴዎች ሥልጣንና ተግባር በምክር 2. Establishment of Ministries በዚህ አዋጅ የሚከተሉት ሚኒስቴሮች ተቋቁመዋል፡- The following ministries are established by this Proclamation: ፩/ የሰላም ሚኒስቴር 1. the Ministry of Peace; ፪/ የአገር መከላከያ ሚኒስቴር 2. the Ministry of National Defense; ፫/ የውጭ ጉዳይ ሚኒስቴር 3. the Ministry of Foreign Affairs;

፬/ የገንዘብ ሚኒስቴር 4. the Ministry of Finance; ፭/ ጠቅላይ ዓቃቤ ሕግ 5. the Attorney General; ፮/ የግብርና ሚኒስቴር 6. the Ministry of Agriculture; ፯/ የንግድና ኢንዱስትሪ ሚኒስቴር 7. the Ministry of Trade and Industry; ፰/ የኢኖቬሽንና ቴክኖሎጂ ሚኒስቴር 8. the Ministry of Innovation and Technology; ፱/ የትራንስፖርት ሚኒስቴር 9. the Ministry of Transport; ፲/ የከተማ ልማትና ኮንስትራክሽን ሚኒስቴር 10. the Ministry of Urban Development and Construction; ፲፩/ የውሃ፣ መስኖና ኤነርጂ ሚኒስቴር 11. the Ministry of Water, Irrigation and Energy; ፲፪/ የማዕድንና ነዳጅ ሚኒስቴር 12. the Ministry of Mines and Petroleum; ፲፫/ የትምህርት ሚኒስቴር 13. the Ministry of Education; ፲፬/ የሳይንስና ከፍተኛ ትምህርት ሚኒስቴር 14. the Ministry of Science and Higher Education; ፲፭/ የጤና ሚኒስቴር 15. the Ministry of Health; ፲፮/ የሴቶች፣ ሕፃናትና ወጣቶች ሚኒስቴር 16. the Ministry of Women, Children and Youth; ፲፯/ የሠራተኛና ማኅበራዊ ጉዳይ ሚኒስቴር 17. the Ministry of Labor and Social Affairs; ፲፰/ የባህልና ቱሪዝም ሚኒስቴር 18. the Ministry of Culture and Tourism; ፲፱/ የገቢዎች ሚኒስቴር 19. the Ministry of Revenues. ፲. የሚኒስቴሮች የወል ሥልጣንና ተግባር 10. Common Powers and Duties of Ministries እያንዳንዱ ሚኒስቴር፡- Each ministry shall have the power and duties to: gA ፲ሺ፮፻፴፰ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10638 ፩/ በሥራው መስክ፡- 1. In its area of jurisdiction: ሀ) የጥናትና ምርምር ተግባራትን ያከናውናል፣ a. undertake research and studies; gather, በዘርፉ መረጃዎችን ይሰበስባል፣ ያቀነባብራል፣ synthesize, and disseminate information; ያሰራጫል፤ ለ) በጥናት ላይ የተመሠረቱ ፖሊሲዎችን b. formulate evidence-based policies; ያመነጫል፤ ሐ) የፌደራል መንግሥት ሕጎችን ያመነጫል፣ c. initiate federal laws, and implement the ያስፈጽማል፤ same; መ) የፌደራል መንግሥቱን ፖሊሲ በሥራ ላይ d. work in coordination with other ministries ለማዋል ከሌሎች ሚኒስቴር መሥሪያ ቤቶች to implement policies of the Federal ጋር አስፈላጊውን ቅንጅት በመመሥረት Government; ይሠራል፤ ሠ) ዕቅድና በጀት ያዘጋጃል፣ ሲፈቀድም በሥራ e. prepare plans and budgets, and implement ላይ ያውላል፤ same upon approval; ረ) የአቅም ግንባታ ሥራዎችን ያከናውናል፣ f. undertake capacity building activities; የለውጥና የመልካም አስተዳደር ሥራዎችን implement, cause the implementation, and ይፈጽማል፣ ያስፈጽማል፣ ዉጤታማነታቸውን ensure the effectiveness of reform and ያረጋግጣል፤ good governance activities; ሰ) ለክልሎች እንዳስፈላጊነቱ ድጋፍና ምክር g. provide, as necessary, assistance and advice ይሰጣል፤ ልዩ ድጋፍ ለሚሹ ክልሎች በሰላም to Regional States; and provide coordinated ሚኒስቴር አስተባባሪነት የተቀናጀ ድጋፍ support to Regional States eligible for ያደርጋል፤ affirmative support as coordinated by the Ministry of Peace; ሸ) ለአርብቶ አደርና ከፊል አርብቶ አደር h. provide proper support to the develop አካባቢዎች ልማት ተገቢውን ድጋፍ ያደርጋል፤ ment of pastoral and semi-pastoral areas; ቀ) በሕግ መሠረት ውሎችንና ዓለም አቀፍ i. enter into contracts and international ስምምነቶችን ይፈራረማል፤ agreements in accordance with law;

፪. በማቋቋሚያ ሕጎቻቸው ወይም በዚህ አዋጅ 2. Direct and coordinate the performances of the አንቀጽ ፴፫ ተጠሪ የተደረጉለትን አስፈጻሚ executive organs made accountable to it under አካላት አፈጻጸም በበላይነት ይመራል፣ the laws establishing them or under Article 33 ያስተባብራል ፤ አደረጃጀቶቻቸውን እንዲሁም of this Proclamation; review their የሥራ ፕሮግራሞቻቸውንና በጀቶቻቸውን organizational structures as well as their work መርምሮ ለሚመለከተው የመንግሥት አካል programs and budgets, and submit same to the እንዲቀርቡ ይወስናል፤ appropriate government organs for approval; ፫. በሚያዘጋጃቸው ፖሊሲዎች፣ ሕጎች፣ የልማት 3. Exercise the powers and duties given to it ሥልጣንና ተግባራት በሥራ ላይ ያውላል፤ under this Proclamation and other laws; ፮. አስፈላጊ ሆኖ ሲገኝ ከሥልጣንና ተግባሩ በከፊል 6. Submit periodic performance reports to the ለሚኒስትሮች ምክር ቤት፣ እና ለሚመለከታቸው Prime Minister, Council of Ministers, and ሌሎች አካላት ሪፖርት ያቀርባል፤ other relevant bodies. ፲፩. የሚኒስትሮች ተጠሪነትና ኃላፊነት 11. The Ministry of Peace shall have powers and ተግባራት ይኖሩታል፡- duties to: ሀ) ሰላምን ለማስጠበቅ አግባብ ካላቸው a. work in cooperation with concerned Federal የፌደራልና የክልል መንግሥታት አካላት ጋር and Regional State government organs to በመተባበር ይሰራል፤ የአገርና ሕዝብ ሰላም፣ ensure the maintenance of public order; ደህንነትና ነፃነት እንዲከበሩ የሚያስችል ስልት develop strategies, and undertake awareness ይነድፋል፤ የግንዛቤና የንቅናቄ ሥራዎችን creation and sensitization activities to ያከናውናል፤ ensure the peace, security and freedom of the country and its people; ለ) ከሚመለከታቸው የክልል አካላት ጋር b. in collaboration with relevant Regional በመተባበር በየትኛውም የአገሪቱ ክፍል Organs, facilitate the provision of proper የሚኖሩ ዜጎች ተገቢውን ጥበቃ እንዲያገኙ protection to citizens living in any part of ያደርጋል፤ the country; ሐ) በተለያዩ ኃይማኖቶችና እምነቶች ተከታዮች፣ c. work in cooperation with relevant እንዲሁም በተለያዩ ብሔር፣ ብሔረሰቦችና government organs, cultural and religious ሕዝቦች መካከል ሰላምና መከባበር እንዲሰፍን organizations, and other pertinent bodies ለማድረግ አግባብ ካላቸው የመንግሥት አካላት፣ to ensure peace and mutual respect among የባህልና የኃይማኖት ተቋማት፣ እንዲሁም followers of different religions and ከሌሎች አግባብነት ካላቸው አካላት ጋር beliefs, as well as nations, nationalities በመተባበር ይሠራል፤ and peoples;

gA ፲ሺ፮፻፵ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10640 መ) በወሳኝ አገራዊ ጉዳዮች ዙሪያ ብሔራዊ d. in cooperation with the relevant actors, መግባባት እንዲፈጠር አግባብ ያላቸውን work towards the creation of national አካላት ያስተባብራል፤ የመፍትሄ ሃሳቦችን consensus on critical national issues; ለመንግሥት ያቀርባል፤ ሲወሰንም አፈጻጸሙን propose recommendations to the ይከታተላል፤ government, and upon approval, follow up their implementation; ሠ) ከሚመለከታቸው አካላት ጋር በመተባበር e. in cooperation with concerned bodies, አገራዊ አንድነትና መግባባትን የሚያጎለብት promote the enhancement of cultural የባህል ልውውጥ፣ የስነ-ዜጋ ትምህርት እና exchange, civic education, and artistic ኪነ-ጥበብ የሚስፋፋበትን ሁኔታ ያመቻቻል፤ works that build national unity and consensus; ረ) በግለሰቦችና በቡድኖች መካከል የሰላም፣ f. develop awareness creation and የመከባበርና የመቻቻል ባህል እንዲዳብር sensitization strategies to foster a culture የግንዛቤና ንቅናቄ ስልቶችን ይቀይሳል፣ of respect and tolerance among አተገባበሩን ይከታተላል፤ individuals and groups, and follow up their implementation; ሰ) ለአካባቢያዊ ግጭቶች መንስኤ የሆኑ g. identify factors serving as causes of ጉዳዮችን በጥናት ይለያል፤ ኅብረተሰቡ ወደ conflicts among communities; submit a ግጭትና አለመረጋጋት እንዳያመራ የመፍትሄ study proposing recommendations to keep አቅጣጫዎችን የሚያመለክት ጥናትያቀርባል፣ communities away from conflicts and ሲወሰንም ተግባራዊ ያደርጋል፤ instability, and implement same upon approval; ሸ) የሃይማኖት ድርጅቶችንና ማኀበራትን h. register religious organizations and ይመዘግባል፤ associations; ቀ) የብሔራዊ መረጃና ደኅንነት፣ የኢንፎርሜሽን i. oversee and follow up national መረብ ደኅንነትና የፋይናንስ ደኅንነት intelligence and security, as well as ሥራዎችን በበላይነት ይመራል፣ ይከታተላል፤ information network and financial security functions; በ) የፌደራል ፖሊስ ሥራዎች በአግባቡ j. supervise andfollow up the proper መከናወናቸውን ይከታተላል፣ ይቆጣጠራል፤ execution of functions relating to Federal Police

ተ) የዜግነት፣ የብሔራዊ መታወቂያ፣ ኢሜግሬሽንና k. lead and follow up citizenship, national ፓስፖርት፣ የወሳኝ ኩነቶች ምዝገባ ሥራዎችን identification card, immigration, passport ይመራል፤ and vital events registration or issuance functions; ቸ) የስደተኞች፣ የፖለቲካ ጥገኞችና ወደ አገር l. lead and follow up the affairs of ተመላሾችን ጉዳዮች ይመራል፤ immigrants, political asylum seekers and returnees; ኀ) ለተፈጥሮና ሰው ሰራሽ አደጋዎች ተገቢውን m. make appropriate preparations for natural ቅድመ ዝግጅት ያደርጋል፤ የብሔራዊ አደጋ and man-made disasters; lead and follow ስጋት ሥራ አመራርን በበላይነት ይመራል፣ up national disaster risk management; ይከታተላል፤ ነ) የጦር መሣሪያ፣ የተኩስ መሣሪያ ወይም ፈንጂ n. determine conditions for the utilization of ጥቅም ላይ ሊውሉ የሚችሉበትን ሁኔታዎች arms, firearms, or explosives; determine ይወስናል፤ እነዚህን መሣሪያዎች ለመያዝ፣ requirements to carry, use and sell these ለመጠቀም እንዲሁም ለመሸጥ የሚያስፈልገውን weapons; ቅድመ-ሁኔታ ይወስናል፤ gA ፲ሺ፮፻፵፩ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10641 ኘ) በፌደራል መንግሥትና በክልሎች መካከል o. serve as a focal point of the federal- በመግባባትና በአጋርነት ላይ የተመሠረተ regional relationship to strengthen the መልካም ግንኙነትና ትብብር እንዲኖር federal system by cultivating good በማድረግ የፌደራል ሥርዓቱ እንዲጠናከር relationship and cooperation between the የግንኙነቱ ማዕከል ሆኖ ያገለግላል፤ Federal Government and Regional States based on mutual understanding and partnership; አ) የሕገ-መንግሥቱ አንቀጽ ፵፰ እና ፷፪ (፮) p. with out prejudice to the provisions of እንዲሁም ሌሎች አግባብ ያላቸው ድንጋጌዎች Article 48 and Article 62(6) of the እንደተጠበቁ ሆነው፣ በክልሎች መካከል የሚነሱ Constitution and other relevant አለመግባባቶች የሚፈቱባቸውን ሁኔታዎች provisions, facilitate the resolution of disputes arising between Regional States; ያመቻቻል፤ ከ) አግባብ ያላቸው ሕጎች እንደተጠበቁ ሆነው፣ q. with out prejudice to the provisions of the ከክልሎች ጥያቄ ሲቀርብ በክልሎች ውስጥ relevant laws and upon the request of የሚፈጠሩ አለመግባባቶችና ግጭቶች Regional States, devise and implement በዘላቂነት የሚፈቱበትን መፍትሔ ይቀይሳል፣ sustainable solutions to disputes and ተግባራዊ ያደርጋል፤ conflicts that may arise within Regional States; ኸ) ፌደራል መንግሥቱ በክልሎች ጉዳይ ጣልቃ r. coordinate the implementation of እንዲገባ ሲወሰን አፈጻጸሙን ያስተባብራል፤ decisions authorizing the intervention of the Federal Government in the affairs of Regional States; ወ) ለክልሎች በተለይም ልዩ ድጋፍ ለሚሹ s. provide assistance to Regional States ክልሎች ትኩረት በመስጠት ድጋፍ ያደርጋል፤ particularly to those that need special ሌሎች የፌደራል መንግሥት አካላት ለአርብቶ support; coordinate, integrate and follow አደርና ከፊል አርብቶ አደር አካባቢ እንዲሁም up supports given by other federal organs ልዩ ድጋፍ ለሚሹ ክልሎች የሚያደርጓቸውን to pastoralists, semi-pastoralists and ድጋፎች ያስተባብራል፣ ያቀናጃል፣ አፈጻጸሙን Regional States that need special support; ይከታተላል፤ ዐ) አርብቶ አደሮችና ከፊል አርብቶ አደሮች t. in collaboration with concerned organs የማኅበራዊና ኢኮኖሚያዊ ልማት ተጠቃሚ coordinate activities that enable ለማድረግ የሚያስችሉ ተግባራትን pastoralists and semi-pastoralists to ከሚመለከታቸው አካላት ጋር በመሆን become beneficiaries of social and ያስተባብራል። economic developments. ፪. በሥራ ላይ ባሉ ሌሎች ሕጎችና ድንጋጌዎች 2. Ministry of National Defense የአገር መከላከያ ሚኒስቴር የሚከተሉት ሥልጣንና The Ministry of National Defense shall have the ተግባራት ይኖሩታል:- powers and duties to:

፩. የአገሪቱን የግዛት ሉዓላዊነት ያስከብራል፤ ሕገ- 1. defend the territorial integrity of the country; መንግሥታዊ ሥርዓቱን ከአደጋና ጥቃት protect and defend the Constitutional order ይከላከላል፤ form threats and attacks; ፪. አገር መከላከልን በሚመለከት አግባብ ያላቸውን 2. work by coordinating federal and regional የፌደራልና የክልል አካላት በማስተባበር ይሠራል፤ organs relevant in defending the country; gA ፲ሺ፮፻፵፪ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10642 ፫. በአስቸኳይ ጊዜ አዋጅ የሚሰጡትን ተግባሮች 3. undertake responsibilities assigned to it under ያከናውናል፤ state of emergency proclamations; ፬. መከላከያ ሠራዊት ያቋቁማል፣ ያስታጥቃል፣ 4. establish, equip and supervise defense forces, ይቆጣጠራል፣ የውጊያ ብቃቱን ያረጋግጣል፤ and ensure their combat capabilities; ፭. የመከላከያ ሠራዊት ማሠልጠኛ ተቋማት 5. cause to the organization of defense forces እንዲደራጁ ያደርጋል፤ training centers; ፮. የጦር ሠፈሮችንና ለሠራዊቱ የሚያስፈልጉትን 6. construct and cause the construction of የመኖሪያ ሠፈሮች ይሠራል፣ ያሠራል፤ military camps and residential quarters required for the defense forces; ፯. የአገሪቱ የመከላከያ ሠራዊት የብሔሮች፣ 7. ensure that the composition of the National የብሔረሰቦችና የሕዝቦችን ሚዛናዊ ተዋጽዖ Defense Forces reflect equitable representation ያካተተ መሆኑን ያረጋግጣል፤ of nations, nationalities and peoples; ፰. ተግባሩን ለሕገ-መንግሥቱ ተገዢ እና ከፖለቲካ 8. ensure that it carries out its functions in ድርጅት ወገናዊነት ነፃ በሆነ አኳኋን ማከናወኑን accordance with the Constitution and free of ያረጋግጣል፤ any partisanship to any political organization; ፱. ከክልል አቅም በላይ የሆነ የፀጥታ መደፍረስ 9. enforce security measures upon request by ሲያጋጥም በክልሉ መስተዳድር ጥያቄ መሠረት Regional States where security situations that ሰላምና መረጋጋትን ያሰፍናል፤ are beyond their control occur; ፲. ማንኛውም ክልል ሕገ-መንግሥቱን በመጣስ ሕገ- 10. when commanded in accordance with the መንግሥታዊ ሥርዓቱን አደጋ ላይ ሲጥልና Constitution, enforce security and በሕገ-መንግሥቱ በተደነገገው መሠረት ሲታዘዝ constitutional order where any Regional State ፀጥታንና ሕገ-መንግሥታዊ ሥርዓቱን ያስከብራል፤ violates the Constitution and endangers the constitutional order; ፲፩. የክተት አዋጅ በሚታወጅበት ጊዜ በአገር 11. in the event of declaration of national ውስጥ የሚገኝ ሀብት በተቀናጀ ሁኔታ ጥቅም ላይ mobilization, prepare plans and get የሚውልበትን ዘዴ እያጠና ያስወስናል፤ ኀብረተሰቡ authorizations for the coordinated utilization of resources in the country; prepare schemes ከጠላት ጥቃት ራሱን የሚከላከልበትን ዕቅድ whereby the public can defend or guard itself ያወጣል፣ ሲፈቀድም ከሚመለከታቸው አካላት against enemy threats, and, upon authorization, ጋር በመተባበር ሥራ ላይ እንዲውል ያደርጋል፤ implement same in cooperation with concerned organs; ፲፪. በጦርነት ወይም በአስቸኳይ ጊዜ አዋጅ 12. recruit, train and organize a national reserve የመከላከያ ሠራዊትን የሚቀላቀል፣ እንዲሁም force that shall join the armed forces in time ሰው ሠራሽም ሆነ የተፈጥሮ አደጋዎች ሲከሰቱ of war or state of emergency and that shall ዕገዛ የሚያደርግ ብሔራዊ ተጠባባቂ ኃይል provide assistance in the event of man-made ይመለምላል፣ ያሰለጥናል፣ ያደራጃል፤ or natural disasters; ፲፫. አገሪቱ የሚቀርብላትን ዓለም አቀፍ የሰላም 13. organize and deploy competent peace ማስከበር ጥሪ በአግባቡ ለመወጣት የሚያስችል keeping forces where the country is required የሰላም አስከባሪ ኃይል ያደራጃል፣ ያሰማራል፤ to participate in international peace keeping missions፤ ፲፬. የሠራዊቱ አባላት በሰላም ጊዜ በአገሪቱ የልማት 14. ensure that the defense forces participate in ሥራዎች እንዲሳተፉ ያደርጋል፤ the country's development activities in times of peace; ፲፭. ከሚከተሉት ምንጮች የሚገኘውን ገቢ 15. retain and utilize income derived from the የሚኒስትሮች ምክር ቤትን እያስፈቀደ ለአገር following sources for national defense መከላከያ አቅም ግንባታ እንዲውል ያደርጋል፡- capacity building upon obtaining the approval of the Council of Ministers:

gA ፲ሺ፮፻፵፫ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10643 ሀ) የመከላከያ ተቋማት በሰላም ጊዜ የሚኖራቸውን a. revenue generated by employing idle የማምረትና አገልግሎት የመስጠት ትርፍ facilities of defense institutions in times አቅም ለገቢ ማስገኛ ተግባር እንዲውል of peace in income generating activities; በማድረግ የሚገኘውን ገቢ፤ ለ) ለመከላከያ ጠቀሜታ የማያስፈልጉ ንብረቶችን b. the proceeds of disposal of properties በማስወገድ የሚገኘውን ገቢ፤ እና which are no more required for defense purposes; and ሐ) በተቆጣጣሪ ባለሥልጣንነት ከሚመራቸው c. dividends from enterprises put underits ድርጅቶች የሚገኘውን የትርፍ ድርሻ፤ supervision ፲፮. በዚህ አንቀጽ ንዑስ አንቀጽ ፲፭ የተመለከተው 16. ensure that the administration of the fund ገንዘብ አስተዳደር በፋይናንስ አስተዳደር አዋጅ referred to in sub-article 15 of this Article is ቁጥር ፮፻፵፰/፪ሺ፩ እና በአዋጁ መሠረት በወጡ carried out according to the procedures and ደንቦችና መመሪያዎች የተደነገጉትን ሥርዓቶችና standards embodied in the Financial መመዘኛዎች ተከትሎ መፈጸሙን ያረጋግጣል፣ Administration Proclamation No. 648/2009 and, regulations and directives issued በዋናው ኦዲተርም እንዲመረመር ያደርጋል። pursuant to the proclamation, and submit same for auditing by the Auditor General. ፲፭. የውጭ ጉዳይ ሚኒስቴር 15. Ministry of Foreign Affairs የውጭ ጉዳይ ሚኒስቴር የሚከተሉት ሥልጣንና The Ministry of Foreign Affairs shall have the ተግባራት ይኖሩታል፡- powers and duties to: ፩. የኢትዮጵያን ሕዝቦች ጥቅም የሚያስጠብቅ፣ 1. formulate foreign policy based on the የአገሪቱን ሉዓላዊነት የሚያስከብር፣ በጋራ principle of mutual respect and equality that ጥቅምና እኩልነት ላይ የተመሰረተ የውጭ protects the interests of the people of ግንኙነት ፖሊሲ ይቀርጻል፣ በሚመለከተው አካል Ethiopia and safeguard its sovereignty, and ሲፀድቅም በሥራ ላይ ያውላል፤ implement same upon approval; ፪. አገሪቱ ባላት የውጭ ግንኙነት ጥቅሟና መብቷ 2. safe guard the interests and rights of the እንዲጠበቅና በሌሎች መንግሥታት እንዲከበር country in connection with its foreign ያደርጋል፤ አገሪቱ ከጎረቤት አገሮች ጋር ያላት relations and ensure that they are respected መልካም ጉርብትና እንዲጠናከር ያደርጋል፤ by foreign states; ensure that the country’s good relations with neighboring countries are strengthened; ፫. ሥልጣኑ በተለይ ለሌላ አካል በሕግ ካልተሰጠ 3. except in so far as such power is specifically በስተቀር፣ ኢትዮጵያ ከሌሎች መንግሥታትና given by law to other organs, in consultation ዓለም ዓቀፍ ድርጅቶች ጋር የምታደርጋቸውን with relevant organs, negotiate and sign, በመንግሥት የተፈቀዱ ዓለም አቀፍ ውሎች upon approval by the government, treaties ጉዳዩ ከሚመለከታቸው አካላት ጋር በመመካከር that Ethiopia enters into with other states and ይደራደራል፣ ይፈርማል፤ እንዲሁም ዓለም አቀፍ international organizations; and effect all ውሎች እንዲፀድቁ ለማድረግ የሚያስፈልጉትን formalities of ratification of treaties; ፎርማሊቲዎች ሁሉ ያከናውናል፤ ፬. ሌሎች የመንግሥት አካላት ከውጭ አገር 4. coordinate all relations of other government መንግሥታትና ከዓለም አቀፍ ድርጅቶች organs with foreign states and international ጋር የሚያደርጓቸውን ሁሉንም ግንኙነቶች organizations; ያስተባብራል፤ ፭. ሥልጣኑ በተለይ ለሌላ አካል ካልተሰጠ 5. ensure the enforcement of rights and በስተቀር፣ የኢትዮጵያ መንግሥት የፈረማቸው obligations arising from treaties signed by ዓለም አቀፍ ውሎች የሚያስከትሏቸው መብቶችና the Governmentof Ethiopia except in so far ግዴታዎች መከበራቸውን ያረጋግጣል፤ as specific power has legally been entrusted to other organs;

gA ፲ሺ፮፻፵፬ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10644 ፮. ኢትዮጵያ ከሌሎች መንግሥታትና ዓለም አቀፍ 6. register and keep all authentic copies of treaties ድርጅቶች ጋር የምታደርጋቸውን ዓለም አቀፍ concluded between Ethiopia and other states ውሎች ሁሉንም የተመሰከረላቸውን ዋናዎቹን and international organizations; ቅጂዎች መዝግቦ ይጠብቃል፤ ፯. የኢትዮጵያ መንግሥት በብዙ መንግሥታት 7. perform the functions of a depository of መካከል የሚደረጉ ዓለም አቀፍ ውሎችን multi lateral treaties when the Government አስቀማጭ በሚሆንበት ጊዜ ይኸው ባለአደራነት of Ethiopia is adepository of such treaties; የሚጠይቀውን ተግባር ያከናውናል፤ ፰. በኢትዮጵያ ከሚገኙ የውጭ ሃገራት 8. maintain contacts, as may be necessary,with መንግሥታት እንደራሴዎች፣ ቆንስሎችና የዓለም foreign diplomatic and consular አቀፍ ድርጅቶች ወኪሎች ጋር እንደአስፈላጊነቱ representatives in Ethiopia as well as with በመገናኘት የጋራ ጥቅሞች የሚጠበቁበትን representatives of international organizations ሁኔታ ያመቻቻል፤ with a view to facilitating the protection of mutual interests; ፱. በዓለም አቀፍ ሕግና ኢትዮጵያ በተቀበለቻቸው 9. ensure that privileges and immunities ዓለም አቀፍ ውሎች ለውጭ አገር መንግሥታት accorded to foreign diplomatic missions and እንደራሴዎችና ለዓለም አቀፍ ድርጅቶች representatives of international organizations ወኪሎች የተሰጡ መብቶች እንዲከበሩ under international law and treaties to which ያደርጋል፤ Ethiopia is aparty are respected; ፲. በውጭ አገር የኢትዮጵያ የዲፕሎማቲክና 10. coordinate andsupervisetheactivities of የቆንስላ ሚስዮኖችን እንዲሁም በዓለም አቀፍ Ethiopia’s diplomatic and consular missions ድርጅቶች የኢትዮጵያ ቋሚ መልእክተኞች abroad and permanent missions offices in ጽሕፈት ቤቶችን ተግባራት ያስተባብራል፣ international organizations; ሥራቸውንም ይቆጣጠራል፤ ፲፩. አግባብ ባለው ሕግ መሠረት የዲፕሎማቲክና 11. issue diplomatic and service passports ሰርቪስ ፓስፖርቶች እና የዲፕሎማቲክና and diplomatic and service entry visas in ሰርቪስ መግቢያ ቪዛዎች ይሰጣል፤ accordance with the relevant laws; 12. provide support to relevant organs by ፲፪. የኢኮኖሚ ዲፕሎማሲ በማካሄድ:- pursuing economic diplomacy to: ሀ) የአገሪቱን የውጭ ንግድና ቱሪዝም a. promote the country's foreign trade and ለማስፋፋት፣ tourism; ለ) የውጭ ኢንቨስተሮችን ለመለየትና ለመሳብ፣ b. identify and attract foreign investors;

The powers and duties given to the Ministry ለገንዘብና ኢኮኖሚ ትብብር ሚኒስቴር of Finance and Economic Cooperation by the ተሰጥተው የነበሩ ሥልጣንና ተግባራት በዚህ provisions of other laws currently in force አዋጅ ለገንዘብ ሚኒስቴር ተሰጥተዋል። are hereby vested in the Ministry of Finance.

፲፯. ጠቅላይ ዓቃቤ ሕግ 17. gA ፲ሺ፮፻፵፯ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10647 ሠ) በገጠር የምግብ ዋስትና እና የሥራ ዕድል e. coordinate activities relating to food ፈጠራን የሚመለከቱ ተግባራትን ያስተባብራል፤ security and job creation schemes; ረ) በአርብቶ አደር አካባቢዎች ለእንስሳት ሀብት f. follow up the expansion of basin ልማት አስፈላጊ የሆኑ የውሃ ተፋሰስ developments, infrastructure and fodder ሥራዎች፣ መሠረተ ልማትና የመኖ ባንኮች banks necessary for livestock develop መስፋፋታቸውን ይከታተላል፤ ment; ሰ) ከሚመለከታቸው አካላት ጋር በመተባበር g. in collaboration with the relevant organs, የከተማ ግብርናን ውጤታማ ለማድረግ formulate techniques for a successful የሚያስችል ስልት ይነድፋል፣ የአተገባበር urban agriculture, and a procedure for ሥርዓት ይዘረጋል፤ their implementation; ሸ) የሰብል፣ እንስሳትና የዓሣ ምርትና h. promote the expansion of effective ምርታማነትን ለማሻሻል፣ የምርት ጥራት technologies, agricultural extension, ለማሳደግና ብክነትን ለመቀነስ የሚያስችሉ trainings, and capacity building services ውጤታማ ቴክኖሎጂዎች፣ የግብርና that help to improve production and ኤክስቴንሽን፣ የሥልጠና፣ የአቅም ግንባታ productivity and quality of crops, አገልግሎቶች እንዲስፋፉ ያደርጋል፤ livestock and fishery, and reduce wastages; ቀ) ብሔራዊ የእንስሳት ርቢ ፖሊሲ፣ ስትራቴጂና i. formulate national livestock breeding ፕሮግራም ይቀይሳል፤ policy, strategy and program; በ) የእንስሳትና ዓሣ ጤና አገልግሎትን ጥራትና j. establish a system that ensures access to ተደራሽነት ለማሻሻል፣ በሽታን ለመከላከልና quality veterinary services to improve the ወቅታዊ እርምጃ ለመውሰድ የሚያስችሉ prevention and timely control of animal ሥርዓቶችን ይዘረጋል፤ በአገር ውስጥ and fish diseases; cause the building of የእንስሳት ጤና ላቦራቶሪዎች እንዲገነቡ animal health laboratories in the country ያደርጋል፣ አቅማቸውን ይገነባል፤ and build their capacity; ተ) በሰብል ምርት፣ በእንስሳትና ዓሣ ሀብት k. establish early warning system in respect ልማት ላይ ተፅዕኖ ለሚያስከትሉ ወቅታዊ of current situations that affect crop ሁኔታዎች የቅድሚያ ማስጠንቀቂያ ሥርዓት production, and livestock and fishery ይዘረጋል፣ development; ቸ) የሰብል ምርት፣ የእንስሳትና ዓሣ ግብዓት l. build capacity for supplying, distributing, አቅርቦት፣ ሥርጭትና ግብይት አቅምን and marketing of inputs for crop በመገንባት አስተማማኝ አቅርቦትን ያረጋግጣል፤ production, livestock and fishery የጥራት ቁጥጥር ሥርዓት ይዘረጋል፣ development in order to ensure reliable supply of produce; establish and follow up ተግባራዊነቱን ይከታተላል፤ የገበያ ትስስር the implementation of a quality control በመፍጠር አቅርቦትን ለማሻሻል የቴክኒክ system; provide technical support to ድጋፎችን ይሰጣል፤ improve supply of products through the creation of market linkage; ኀ) ከሚመለከታቸው አካላት ጋር በመተባበር m. establish a system to ensure that all crop, ለገበያ የሚቀርብ ማንኛውም የሰብል ምርት፣ livestock, fish, livestock and fish products እንስሳ፣ ዓሣ፣ የእንስሳትና ዓሣ ምርትና ተዋጽዖ marketed maintain the required quality; የጥራት ደረጃውን የጠበቀ እንዲሆን የሚያስችል follow up the implementation of such ሥርዓት ይዘረጋል፣ ተግባራዊነቱን ይከታተላል፤ system; provide technical support to ዘመናዊ አመራረት እንዲጎለብትና የገበያ create modern production systems and ትስስር እንዲፈጠር የቴክኒክ ድጋፎችን market linkages; ይሰጣል፣

The Ministry of Trade and Industry ፩. የንግድና ኢንዱስትሪ ሚኒስቴር የሚከተሉት 1. gA ፲ሺ፮፻፶ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10650 በ) የዋጋ ቁጥጥር ሊደረግባቸው የሚገቡ መሠረታዊ j) undertake and submit to the Council of የንግድ ዕቃዎችንና አገልግሎቶችን ዋጋ እያጠና Ministers studies relating to prices of basic ለሚኒስትሮች ምክር ቤት ያቀርባል፣ ሲፈቀድም commodities and services that require price ተግባራዊነታቸውን ይከታተላል፤ control; oversee implementation of same upon approval; k) encourage the establishment of chambers ተ) የንግድና የዘርፍ ማኅበራት፣ የሸማቾች of commerce and sectoral associations, ማኅበራት፣ የኢንዱስትሪ፣ የዘርፍና የሙያ consumers’associations, industry, sectoral ማኅበራት እንዲቋቋሙ ያበረታታል፣የተቋቋሙ and professional associations, and ትንም እንዲጠናከሩ ያደርጋል፤ strengthen those which are already operational; ቸ) የአገሪቱን ሕጋዊ ሥነ-ልክ ሥርዓት l) coordinate the concerned enforcement ለመተግበር እንዲቻል አስፈጻሚ አካላትን bodies for the implementation of the legal ያስተባብራል፤ metrological system of the country; ኀ) አስገዳጅ የኢትዮጵያ ደረጃ ያላቸው የንግድ m) control the compliance of goods with the ዕቃዎችና አገልግሎቶች የደረጃውን መስፈርት requirements of mandatory Ethiopian ማሟላታቸውን ይቆጣጠራል፣ በሌሎች standards, and take measure against those አስፈጻሚ መሥሪያ ቤቶች የሚሠራባቸው found to be below the standards set for አስገዳጅ ደረጃዎች በተቀናጀ መልኩ them; cause the coordinated enforcement እንዲተገበሩ ያደርጋል፣ of standards applied by other enforcement bodies; ነ) የኢንዱስትሪ ልማትን ለማፋጠን የሚረዱ n) design policies, strategies and plans that ፖሊሲዎች፣ ስትራቴጂዎችንና መርሃ ግብሮችን help in fast-tracking industrial ያዘጋጃል፣ በሚመለከተው አካል ሲፀድቁም development; implement same upon ተግባራዊ ያደርጋል፤ approval by the concerned body; ኘ) ከሚመለከታቸው አካላት ጋር በመተባበር o) conduct studies and researches to ስትራቴጂካዊ ትኩረት በሚሰጣቸው ዘርፎች facilitate the realization of plans that የአገሪቱን ምርቶች ለውጭ ገበያ በማቅረብ enhance export in industries having ረገድ የታቀደውን ዕድገት ለማምጣት strategic importance; and implement የሚያስፈልጉ ጥናትና ምርምሮች ያካሂዳል፣ same in collaboration with the relevant ይተገብራል፤ agencies;

አ) በኢንቨስትመንት አዋጁ መሠረት የአገር ውስጥ p) in accordance with investment laws, ባለሃብቶች በኢንዱስትሪ ኢንቨስትመንት create conducive environment for the የሚሳተፉበትን ሁኔታዎች ያመቻቻል፤ በሥሩ participation of domestic investors in ያሉ ተጠሪ ተቋማት በዋናነት ለአገር ውስጥ industrial development and establish ባለሀብቶች ድጋፍ እንዲሰጡ ለማድረግ system for the provision of appropriate ተገቢውን ሥርዓት ይዘረጋል፣ ያስፈጽማል፤ support; establish systems to enable the institutions accountable to it to support domestic investors; and implement the same; ከ) የኢንዱስትሪ ዘርፍ ልማትን ለማሳደግ q) facilitate the selection, adoption and የሚያስችል የቴክኖሎጂ መረጣ፣ ማላመድና inculcation of technology that accelerates ማስረጽ ተግባራትን፤ የምርጥ ተሞክሮ industrial sector development; expedite the መቀመር፣ የቴክኖሎጂ ሽግግር፣ የክህሎት acquisition of best practices, technology ልማት እና አጠቃላይ የኢንዱስትሪ ልማት transfer and skills development and general አቅም ግንባታ ሥራዎችን ያመቻቻል፤ capacity building activities in industrial development; gA ፲ሺ፮፻፶፩ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10651 ኸ) የኢንዱስትሪ ዘርፍ ልማትና ምርታማነትን r) cause the provision of assistance ለማሳደግ ኢንዱስትሪዎች የኤክስቴሽን including industrial extension services, አገልግሎት፣ የቴክኖሎጂ፣ የግብዓትና የግብይት technology, inputs, marketing and እንዲሁም በአመራረት ረገድ ድጋፍ እንዲያገኙ manufacturing methods and thereby ያደርጋል፤ ውጤታማነታቸውንም ያረጋግጣል፤ ensure growth and productivity of the industrial sector; and monitor the effectiveness thereof; ወ) የኢንዱስትሪ ምርቶች የጥራት ደረጃቸውን s) establish systems of capacity building, የጠበቁ፣ በዓለም አቀፍ ተወዳዳሪ እንዲሆኑ research and inculcation to maintain የአቅም ግንባታ፣ የምርምርና ስርጸት quality standards and competitiveness of ሥራዎች እንዲከናወኑ ሥርዓት ይዘረጋል፣ industrial products in international ተግባራዊነቱን ይከታተላል፤ markets; oversee implementation of the same; ዐ) ከሚመለከታቸው አካላት ጋር በመቀናጀት t) design mechanisms to meet human ለኢንዱስትሪ ዘርፍ አስፈላጊ የሆነው የሰው resources and sustainable input provisions ኃይል ፍላጎት እና አስተማማኝ ግብዓት required in the industrial sector; ለማሟላት የሚያስችልበትን ስልት ይቀይሳል፤ ዘ) ከሚመለከታቸው አካላት ጋር በመሥራት u) work in cooperation with concerned የግብዓት አቅርቦት ትስስር ሥርዓት bodies to create conditions necessary for እንዲዘረጋ ሁኔታዎች ያመቻቻል፤ ተግባራዊ the establishment of system for industrial ያደርጋል፤ input provision linkages, and implement the same; ዠ) ስትራቴጂያዊ ጠቀሜታቸው ጉልህ የሆኑ ገቢ v) extend support to substitute import goods ምርቶችን በአገር ውስጥ ምርቶች እንዲተኩ having strategic importance with local ድጋፍ ያደርጋል፤ ገበያው ሊያቀርባቸው production; create necessary conditions ያልቻለው ወይም እጥረት በሚታይባቸው for government provision of goods and ምርቶችና አገልግሎቶች ዘርፍ መንግስት services which are not supplied by the የሚያቀርብበትን ሁኔታ ያመቻቻል፤ market system or are in short provisions; የ) በአነስተኛ፣በመካከለኛና በከፍተኛ ኢንዱስትሪ w) develop working mechanisms to create ዎች መካከል የተቀናጀ ትስስር እንዲፈጠርና linkage between small, medium and large- ስኬታማ ሽግግሮች እንዲከናወኑ የሚያስችሉ scale industries and facilitate effective የአሠራር ሥርዓቶችን ይዘረጋል፤ transformation;

ገ) ኢንዱስትሪዎች በአካባቢ ጥበቃ የተቀመጡ x) provide support to industries so as to መስፈርቶችን እንዲያሟሉ ድጋፍ ያደርጋል፤ ensure compliance with environmental protection requirements; ደ) የአገሪቱን የንግድና ኢንዱስትሪ መረጃዎች y) coordinate the collection, organization አሰባሰብ፣ አደረጃጀትና አጠቃቀምን and utilization of national trade and ያስተባብራል፣ የተቀናጀ መረጃ ያደራጃል፤ industry data; maintain organized ለሚመለከታቸው አካላት ያሰራጫል፤ information system; and disseminate same to pertinent bodies; ፪. በሥራ ላይ ባሉ ሌሎች ሕጎችና ድንጋጌዎች 2. The powers and duties given to the Ministry ለንግድ ሚኒስቴር እና ለኢንዱስትሪ ሚኒስቴር of Trade and the Ministry of Industry by ተሰጥተው የነበሩ ሥልጣንና ተግባራት በዚህ provisions of other laws currently in force are አዋጅ ለንግድና ኢንዱስትሪ ሚኒስቴር hereby vested in the Ministry of Trade and ተሰጥተዋል። Industry. ፳. የኢኖቬሽንና ቴክኖሎጂ ሚኒስቴር 20. The Ministry of Innovation and Technology ፩. የኢኖቬሽንና ቴክኖሎጂ ሚኒስቴር የሚከተሉት 1. The Ministry of Innovation and Technology ሥልጣንና ተግባራት ይኖሩታል፡- shall have the powers and duties to: gA ፲ሺ፮፻፶፪ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10652 ሀ) የአገሪቱን የልማት አቅጣጫ መሠረት ያደረገ a) prepare national innovation and አገራዊ የኢኖቬሽንና ቴክኖሎጂ ምርምርና technology research and development ልማት ፕሮግራሞችን ያዘጋጃል፣ ያስፈጽማል፤ programs based on the country’s በብቃት ለማስፈጸም የሚያስችል ተቋማዊ development priorities; plan institutional አቅም እና የሰው ኃይል ልማት ያቅዳል፣ capacity and human resources ተግባራዊነቱንም ይከታተላል፤ development for effective implementation of the programs; and follow up the same; ለ) ለክልሎች ኢኖቬሽንና ቴክኖሎጂ ተቋማት b) provide professional and technical support አቅም ግንባታ አስፈላጊውን የሙያና ቴክኒክ to regions’ innovation and technology ድጋፍ ይሰጣል፤ institutions; ሐ) ከሚመለከታቸው አካላት ጋር በመተባበር c) in collaboration with relevant bodies, set የኢንፎርሜሽን ቴክኖሎጂ አገልግሎቶች standards to ensure the provision of quality, reliable and secure information ጥራታቸው፣ ደህንነታቸውና አስተማማኝነታቸው technology services, and oversee የተጠበቀ እንዲሆን የሚያስችሉ ደረጃዎችን implementation thereof ; ይወስናል፣ተግባራዊመደረጋቸውን ይቆጣጠራል፤ መ) በኢኖቬሽንና ቴክኖሎጂ እንቅስቃሴ ውስጥ d) support capacity building of institutions ተሳታፊ የሆኑ ተቋማትና ባለሙያዎች አቅም and professionals involved in innovation ግንባታን ይደግፋል፤ የሙያ ማኀበራትንና and technology activities; support and አካዳሚዎችን ይደግፋል፣ ያበረታታል፤ encourage professional associations and academies; ሠ) የአገሪቱ ሥርዓተ-ትምህርት ከኢኖቬሽንና e) collaborate with pertinent bodies to ቴክኖሎጂ ልማት አንፃር መቃኘቱን ensure that the country’s educational ለማረጋገጥ ከሚመለከታቸው አካላት ጋር curricula are designed in tune with ይተባበራል፤ innovation and technology development; ረ) የቴክኖሎጂ ፍላጎት ለመዳሰስ፣ ተገቢ f) prepare and oversee the implementation ቴክኖሎጂዎችን ለማፈላለግና በሥራ ላይ of system for the identification, ለማዋል የሚያስችል ሥርዓት ከሚመለከታቸው exploration and application of appropriate አካላት ጋር በመተባበር ይዘረጋል፣ አፈፃፀሙን technologies in collaboration with the pertinent bodies; ይከታተላል፤ g) identify new innovation and technology ሰ) ለአገሪቱ ዕድገት አስፈላጊ የሆኑ አዳዲስ የኢኖቬሽንና ቴክኖሎጂ የጥናትና ምርምር studies and research areas pertinent to the መስኮችን ይለያል፤ አገራዊ የምርምር country’s development; coordinate ፕሮግራሞችን ያስተባብራል፤ national research programs on the same; ሸ) አገር-በቀል ቴክኖሎጂዎችን ለማሻሻል፣ h) support studies, researches and ለማሳደግና ለገበያ ለማቅረብ የሚደረጉ dissemination works for the enhancement, ጥናቶችን፣ የምርምርና ስርጸት ሥራዎችን development and marketing of indigenous ያበረታታል፣ ወደተግባር እንዲሸጋገሩ technologies; assist such works to አስፈላጊውን ድጋፍ ያደርጋል፤ ለኢኖቬሽንና advance their practical application; ቴክኖሎጂ መዳበር የበለጠ አስተዋጽዖ encourage and support individuals, ሊያደርጉ የሚችሉ ግለሰቦችን፣ የሙያ professional associations and academies ማኀበራትንና አካዳሚዎችን ያበረታታል፣ particularly involved in strengthening ይደግፋል፤ innovations and technologies;

ቀ) ለኢኖቬሽንና ቴክኖሎጂ ልማትና ለፈጠራ i) establish and implement system for the ሥራዎች ዕድገት አስተዋጽዖ ላበረከቱ grant of awards and incentives to ግለሰቦችና ተቋማት ሽልማትና ማበረታቻ individuals and institutions contributing to የሚሰጥበትን ሥርዓት ይዘረጋል፣ ተግባራዊም the advancement of innovation and ያደርጋል፤ technological development works; gA ፲ሺ፮፻፶፫ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10653 በ) በየዘርፉ በሽግግር የሚመጡ ቴክኖሎጂዎችን j) coordinate the registration, codification መረጃ ይመዘግባል፣ ኮዲፋይ የማድረግና and conservation of technologies attained የማቀብ ሥራዎችን ያስተባብራል፣ ለቀጣዩ acquired through transfers across sectors; ሥራ እንቅስቃሴም እንዲውሉ ያደርጋል፤ and ensure their subsequent utilization; ተ) ለሕዝብ አገልግሎት በመስጠት ላይ ያተኮሩ k) ensure that mission critical systems and መሠረታዊ ሲስተሞችና አገልግሎቶች services in public sector are supported by በቴክኖሎጂ የተደገፉ እንዲሆኑና ለተጠቃሚዎች appropriate technology and positioned to የተሻለ አገልግሎት ሊሰጡ በሚችሉበት ሁኔታ better provide services to the public; መመቻቸታቸውን ያረጋግጣል፤ ቸ) የምርምር ሥራዎችን ለማስተባበር የሚያግዙ l) establish, coordinate and support councils ምክር ቤቶችን ያቋቁማል፣ ያስተባብራል፣ that facilitate the coordination of research ይደግፋል፤ works; ኀ) የኢኖቬሽንና ቴክኖሎጂ መረጃ ቋት m) organize innovation and technology data ያደራጃል፣ መረጃዎችን ያጠናቅራል፤ አገራዊ base, compile information, set national የመረጃ አያያዝ ደረጃ ያወጣል፤ standards for information management; ነ) ከሚመለከታቸው አካላት ጋር በመተባበር n) in collaboration with relevant bodies, የፌደራልና የክልል መንግሥታዊ ተቋማት support the development, deployment and የመረጃ ሥርዓትን ይገነባል፣ ያቀናጃል፤ coordination of secure information ደህንነቱ የተጠበቀ የኢንፎርሜሽን መረብ network within federal and regional የመዘርጋት ሥራን ይደግፋል፤ government institutions; ኘ) የአገሪቱን ከፍተኛ ደረጃ መለያ ዶሜይን o) coordinate pertinent stakeholders for the ስም አገራዊ የአስተዳደር ሥርዓት creation and proper utilization of country እንዲፈጠርና በአግባቡ ጥቅም ላይ እንዲውል code top level domain system; facilitate የሚመለከታቸውን ያስተባብራል፣ ይከተታተላል፤ and oversee proper implementation of the same; assign and monitor government በመንግሥታዊ ተቋማት የመረጃ ሥርዓትን domain names and register addresses to ለመገንባትና ለማቀናጀት የዶሜይን ስም develop and coordinate government ይደለድላል፣ አድራሻ ይመዘግባል፣ይቆጣጠራል፤ institutions’ information system; አ) የጨረራና ጨረር አመንጪ ቁሶች p) prepare and implement system for አጠቃቀምና አወጋገድ ቁጥጥር ሥርዓት regulating the utilization and disposal of ተግባራዊ መደረጉን ይከታተላል፤ radiation and radiation producing items;

ከ) ብሔራዊ የቴሌኮሙኒኬሽን ቁጥር ፕላን q) establish national telecommunication numbering plan, assign and administer ያወጣል፣ ቁጥሮችን ይመድባል፣ ያስተዳድራል፣ numbers, and supervise the efficient አጠቃቀማቸውን ይቆጣጠራል፤ utilization thereof; ኸ) የቴሌኮሙኒኬሽንና የፖስታ አገልግሎቶች r) provide licenses and regulate በመስጠት ሥራ ላይ ለሚሰማሩ ፈቃድ telecommunication and postal service ይሰጣል፣ ይቆጣጠራል፤ የቴሌኮሙኒኬሽን operators; ensure the technical quality of መሣሪያዎችን የቴክኒክ ብቃት ያረጋግጣል፤ telecommunication equipment; ወ) ለኢትዮጵያ የተመደበውን የሬዲዮ ፍሪኩዌንሲ s) authorize and supervise the utilization of አጠቃቀም ይፈቅዳል፣ ይቆጣጠራል። radio frequencies allotted to Ethiopia; ፪. በሥራ ላይ ባሉ ሌሎች ሕጎችና ድንጋጌዎች 2. The powers and duties given by provisions of ኢንፎርሜሽን ቴክኖሎጂን በተመለከተ other laws currently in force to the Ministry ለመገናኛና ኢንፎርሜሽን ቴክኖሎጂ ሚኒስቴር of Communications and Information ተሰጥተው የነበሩ ሥልጣንና ተግባራት፤ Technology in relation to matters pertaining ቴክኖሎጂን በተመለከተ ለሳይንስና ቴክኖሎጂ to information technology and to the Ministry ሚኒስቴር ተሰጥተው የነበሩ ሥልጣንና ተግባራት of Science and Technology in relation to gA ፲ሺ፮፻፶፬ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10654 በዚህ አዋጅ ለኢኖቬሽንና ቴክኖሎጂ ሚኒስቴር matters pertaining to technology are hereby ተሰጥተዋል። vested in the Ministry of Innovation and Technology. ፳፩. የትራንስፖርት ሚኒስቴር 21. The Ministry of Transport የትራንስፖርት ሚኒስቴር የሚከተሉት ሥልጣንና The Ministry of Transport shall have the powers ተግባራት ይኖሩታል፡- and duties to: ፩. የአገሪቱን የልማት ስትራቴጂዎች ተግባራዊ 1) ensure the integration, efficiency and ለማድረግ፣ የልማት ማዕከላትንና የዕድገት accessibility of land, air and sea ኮሪደሮችን የትራንስፖርት ፍላጐት ለማሟላት transportation services, and thereby realize የየብስ፣ የአየርና የባህር ትራንስፖርት the country’s development strategies and አገልግሎቶች የተቀናጁ፣ ቀልጣፋና ተደራሽ meet the transport service requirements of መሆናቸውን ያረጋግጣል፤ development hubs and corridors; ፪. የትራንስፖርት መሠረተ ልማቶችን በተመለከተ 2) prepare national plans pertaining to the አገራዊ ዕቅዶች ያወጣል፤ አስተማማኝና development of transport infrastructure; ደህንነታቸው የተረጋገጠ እንዲሆኑ የሚያስችሉ ensure the establishment and implementation የቁጥጥር ሥርዓቶችን እንዲዘረጉና ሥራ ላይ of regulatory frameworks to guarantee the እንዲውሉ ያደርጋል፤ provision of reliable and safe transport services; ፫. የትራንስፖርት መሠረተ ልማቶች መዘርጋታቸውን፣ 3) ensure that transport infrastructure are መስፋፋታቸውንና መጠገናቸውን ያረጋግጣል፤ constructed, upgraded and maintained; set የአጠቃቀም፣ የአያያዝና የአስተዳደር ደረጃዎችና standards and systems to determine the ሥርዓቶችን ይወስናል፤ ተግባራዊነታቸውንም usage, maintenance and administration of ያረጋግጣል፤ transport infrastructure; and ensure their implementation; ፬. በትራንስፖርት ዘርፉ አዳዲስ ቴክኖሎጂዎችና 4) ensure the utilization, expansion and አሠራሮች በአገር ውስጥ ጥቅም ላይ እንዲውሉ፣ strengthening of advanced technologies and እንዲስፋፉና እንዲዳብሩ ያደርጋል፤ practices in the country’s transport sector; ፭. የትራንስፖርት መሠረተ-ልማቶችና አገልግሎቶች 5) identify and implement measures that በአካባቢና አየር ንብረት የሚኖራቸውን ተፅዕኖ mitigate the impact of transport infrastructure ለመቀነስ የሚያስችሉ ስልቶችን በመለየት ሥራ and services on the environment and the ላይ መዋላቸውን ያረጋግጣል፤ climate; ፮. ሁለት ወይም ከሁለት በላይ ክልሎችን 6) expand, administer and control highways that የሚያገናኙ አውራ መንገዶችን የማስፋፋትና connect two or more Regional States; የማስተዳደር ሥራን ያስተባብራል፤ ፯. የትራንስፖርት ማኔጅመንት ሥርዓቱን 7) undertake studies on transport management ለማሻሻልና የመንገድ ትራፊክ ደህንነት ችግርን system aiming at improving and በመሰረታዊነት ለመፍታት የሚያስችሉ ጥናቶችን fundamentally addressing road traffic safety ያከናውናል፣ ይተገብራል፣ issues, and implement same; ፰. የአውሮፕላን ትራንስፖርት አደጋ ምርመራ 8) ensure that investigation of aircraft accidents ተቀባይነት ባለው ደረጃ መሠረት መከናወኑን are carried out in accordance with acceptable ያረጋግጣል፤ standards;

፱. የወጪና ገቢ ዕቃዎችን የተመለከቱ የትራንዚት 9) regulate transit services related to import and ሥራዎችን ይቆጣጠራል፤ የአገሪቷ የሎጂስቲክስ export of goods; and ensure that the national ሥርዓት ቀልጣፋና ተወዳዳሪ መሆኑን ያረጋግጣል፤ logistic system is efficient and competitive; gA ፲ሺ፮፻፶፭ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10655 ፲. የኢትዮጵያና ጅቡቲ ምድር ባቡር ድርጅትን 10) follow up the operations of the Ethio- የሥራ እንቅስቃሴዎች በሁለቱ አገሮች መካከል Djibouti Railways in accordance with the በተደረገው ስምምነት መሠረት ይከታተላል፤ agreement concluded between the two countries; ፲፩. ለአገሪቱ ጠቀሜታ ያላቸውን አማራጭ የወደብ 11) initiate and submit to the government አገልግሎቶች እያጠና ለመንግስት ያቀርባል፣ studies on alternative port services and ሲፈቀድም አፈጻጸሙን ይከታተላል፤ ከወደብ oversee their implementation when approved; አገልግሎት ጋር በተያያዘ ከሌሎች ሀገራት ጋር conclude port service agreements with other የስምምነት ሰነዶችን ይፈራረማል፣ ተግባራዊነቱንም countries and follow up their implementation; ይከታተላል፤ ፲፪.የአገሪቷን የትራንስፖርት መረጃዎች ያደራጃል፤ 12) organize transport related data of the ለሚመለከታቸው አካላት ያሰራጫል። country, and disseminate same to concerned bodies; ፳፪. የከተማ ልማትና ኮንስትራክሽን ሚኒስቴር 22. The Ministry of Urban Development and Construction ፩. የከተማ ልማትና ኮንስትራክሽን ሚኒስቴር 1. The Ministry of Urban Development and የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፡- Construction shall have the powers and duties to: ሀ) የከተማ ልማትንና ኮንስትራክሽንን a) design and upon approval implement የሚመለከቱ ፖሊሲዎችና ስትራቴጂዎችን ፣ policies, strategies, development packages የልማት ፓኬጆችን እና ፕሮግራሞችን and programs relating to urban ይቀርጻል ፣ ሲፀድቅም ተግባራዊ ያደርጋል፣ development and construction; ለ) አከታተምን በሚመለከት ጥናት ያካሂዳል፣ b) undertake studies relating to urbanization, ከሚመለከታቸው አካላት ጋር በመቀናጀትና in coordination with other relevant bodies አገራዊ ስፓሻል ፕላን እንዲሰራ በማድረግ establish system for integrated urban የተቀናጀ የአከታተም ሥርዓት ይዘረጋል፣ development and preparation of national አፈጻጸሙን ይከታተላል፤ spatial plan; follow up implementation of same; ሐ) ከተሞች ከአገር አቀፍና ከክልል አቀፍ c) outline directions that ensure compliance የልማት ዕቅዶችና ከተቀናጀ የከተሞች ፕላን of urban centers with regional and ጋር ተጣጥመው የሚመሩበትን አቅጣጫ national development schemes and ይነድፋል፤ integrated urbanization plans; መ) ከክልሎች ጋር በመተባበር የከተሞች ልማት d) undertake studies for the integration of ከገጠር ልማት ጋር በተቀናጀ መንገድ urban and rural development activities in የሚከናወንበትን ሁኔታ በሚመለከት ጥናቶችን collaboration with regional states; follow- ያደርጋል፣ አፈፃፀማቸውንም ይከታተላል፤ up implementation of same; provide to ከተሞች የአካባቢያቸው የልማት ማዕከል urban centers all-round and coordinated እንዲሆኑ ሁለገብና የተቀናጀ ድጋፍ ይሰጣል፤ support so as to make them development hubs of their surroundings; ሠ) የተመጣጠነ የከተሞች ዕድገትና የህዝብ e) design strategies that ensure balanced አሰፋፈር እንዲኖር ለማድረግ የሚያስችሉ development and population settlement in ስልቶችን ይነድፋል፤ ከሚመለከታቸው urban centers; implement same in የፌደራልና የክልል መንግሥታት አካላት ጋር collaboration with the pertinent federal በመቀናጀት ይተገብራል፤ and regional government bodies; ረ) የከተሞችን መሬት በቁጠባ መጠቀም f) put in place new procedures for economic የሚያስችል ዘመናዊ የአሰራር ስልት use of urban land; follow up ይነድፋል ፣ አፈጻጸሙን ይከታተላል፣ implementation of same;

gA ፲ሺ፮፻፶፮ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10656 ሰ) የከተሞችን ፈርጅ እና ሚና መወሰኛ g) set standards relating to categorization መመዘኛ ያወጣል፤ የከተሞችን ፅዳት፣ and role definition of urban centers; ውበትና አረንጓዴ ልማት ስታንዳርድ establish criteria for urban sanitation, ያወጣል፣ ድጋፍና ክትትል ያደርጋል፤ beautification and greenery development; support and follow up implementation of same; ሸ) ከተሞች የአገልግሎት አሰጣጣቸውን h) provide capacity building support to እንዲያሻሽሉ እና መልካም አስተዳደር regions to improve service delivery and እንዲያሰፍኑ ለክልሎች የአቅም ግንባታ እገዛ ensure good governance in urban centers; ያደርጋል፤ የመሠረተ ልማት አቅርቦትና facilitate the integration of infrastructure አገልግሎት አሰጣጥ የተቀናጀ እንዲሆን and services provision; ያደርጋል፤ ቀ) የከተማ ልማት ሥራ ከድህነት ቅነሳ ጋር i) undertake studies for integration of urban የተቀናጀ እንዲሆን ጥናቶችን ያካሂዳል፤ development with poverty reduction; ለተግባራዊነታቸውም ድጋፍ ይሰጣል፤ support the implementation thereof; and የከተማ የምግብ ዋስትና እና የሥራ ዕድል ensure food security and job creation in ፈጠራ እንዲረጋገጥ ያደርጋል፤ the urban settings; በ) የአዲስ አበባና የድሬዳዋ የከተማ አስተዳደሮችን j) follow up the activities of Addis Ababa የከተማ ልማትና ኮንስትራክሽን ሥራ and Dire Dawa city administrations in እንቅስቃሴዎች ይከታተላል፤ relation to urban development and construction; ተ) የነፃ ገበያ ሥርዓት ለማረጋገጥ የሚያስችል፣ k) build cadaster and immovable property ግልፅነትና ተጠያቂነት የሚያሰፍን የካዳስተር market systems that ensure transparency እና የማይንቀሳቀስ ንብረት ግብይት ሥርዓት and accountability and enhance free እንዲገነባ ያደርጋል፤ በከተሞች ፍላጎትን market economy; provide support to መሠረት ያደረገ የለማ መሬት አቅርቦት ensure supply of developed urban land in ለማረጋገጥ ድጋፍ ይሠጣል፤ accordance with demands in urban centers; ቸ) የከተሞች ልማት ፋይናንስ ማጠናከሪያ l) undertake study to establish urban ሥርዓት ያጠናል፣ በሚመለከተው አካል development finance improvement እንዲጸድቅ ያደርጋል፣ ፈንድ ያሰባስባል፣ system; cause its approval by the ለአፈጻጸሙም ተቋማዊ አቅም እንዲፈጠር concerned organ; collect rising fund; ድጋፍና ክትትል ያደርጋል፤ provide support and follow-up to ensure institutional capacity building for implementation; m) without prejudice to powers given by law to any other government organ, ensure the proper administration of houses owned by the Federal Government;

ኀ) ለዜጎች የመኖሪያ ቤቶች አቅርቦት ለማሟላት n) undertake studies on the provision of የሚያስችሉ ጥናቶችን ያካሂዳል፤ በሚመለከታ residential housing to citizens; and support implementation of same once ቸው አካላት ሲፀድቁም ተግባራዊነታቸውን approved by the concerned organs; ይደግፋል፤ gA ፲ሺ፮፻፶፯ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10657 ነ) የኮንስትራክሽን ዘርፉን በአግባቡ ለመምራት o) design long term strategic plans that የሚያስችል የረጅም ጊዜ ስትራቴጂ enhance proper management of the ይነድፋል፣ ይተገብራል፤ ለዘርፉ ዕድገት construction sector; implement same; አስፈላጊ የሆኑ ጥናቶችን ከሚመለከታቸው execute studies on the development of the አካላት ጋር ቅንጅት በመፍጠር ይተገብራል፤ sector in coordination with pertinent bodies; ኘ) በዓለም አቀፍ ደረጃ የተወዳዳሪነት ብቃት p) create conducive environment for the ያለው የኮንስትራክሽን ኢንዱስትሪ development of internationally competitive ለመገንባት የሚያስችሉ የተመቻቹ ሁኔታዎች construction industry; establish transparent እንዲፈጠሩ ያደርጋል፤ በዲዛይን፣ በጨረታና፣ and accountable system for the management በኮንትራት ይዘት ላይ ግልጽነትና ተጠያቂነት of design, bidding and contract contents; ያለበት ሥርዓት ይዘረጋል፣ አፈጻጸሙን and follow up enforcement of same; ይከታተላል፤ አ) በማንኛውም ዘርፍ የሚደረጉ የኮንስትራክሽን q) regulate construction works in all sectors; ሥራዎች ላይ ተገቢውን ቁጥጥር ያደርጋል፤ determine construction work standards; የኮንስትራክሽን ሥራዎችን ደረጃ ያወጣል፣ and follow up compliance with standards; መከበራቸውን ይከታተላል፤ ከ) በፌደራል መንግሥት በጀት ለሚሠሩ r) extend support in the preparation of ሕንፃዎች ዲዛይኖችና የግንባታ ውሎች designs, construction contracts and እንዲዘጋጁ በማድረግና የግንባታ ሥራዎችን supervision of construction works በመቆጣጠር ረገድ አስፈላጊውን ድጋፍ involving buildings financed by federal ይሰጣል፤ budget; ኸ) የሕንፃ ኮድና ስታንዳርዶች በከተሞች s) support the development of appropriate ተፈጻሚ እንዲሆኑ ተገቢው አደረጃጀት፣ organizational set-up, systems and human አሠራርና የሰው ሃይል አቅም እንዲፈጠር resource required for implementation of ድጋፍ ያደርጋል፤ building codes and standards in cities;

ወ) አገር በቀል የኮንስትራክሽን ድርጅቶችን t) design strategy to enhance the capacity ብቃትና ቀጣይነት ለማረጋገጥ የሚያስችል and sustainability of local construction ስትራቴጂ ይቀይሳል፤ አፈጻጸሙን ይከታተላል፤ enterprises; follow up implementation of same; ዐ) በኮንስትራክሽን ዘርፍ የሚሰማሩ u) register engineers and architects engaged መሐንዲሶችና አርክቴክቶችን ይመዘግባል፣ in the construction sector; issue የሙያ ብቃት ማረጋገጫ የምስክር ወረቀት certificates of professional competence; ይሰጣል፤የሥራ ተቋራጮችንና የአማካሪዎችን determine the grades of contractors and ደረጃ ይወስናል፤ ከአንድ በላይ በሆኑ ክልሎች consultants; issue certificates of ውስጥመሥራት ለሚችሉ የሥራ ተቋራጮችና competence to contractors and consultants አማካሪዎች የብቃት ማረጋገጫ የምስክር operating in more than one regional ወረቀት ይሰጣል። states; v) undertake research to improve the types and qualities of local construction materials; ፪. በሥራ ላይ ባሉ ሌሎች ሕጎችና ድንጋጌዎች 2. The powers and duties given by provisions of ለከተማ ልማትና ቤቶች ሚኒስቴር እና other laws currently in force to the Ministry ለኮንስትራክሽን ሚኒስቴር ተሰጥተው የነበሩ of Urban Development and Housing and the ሥልጣንና ተግባራት በዚህ አዋጅ ለከተማ Ministry of Construction are hereby vested in ልማትና ኮንስትራክሽን ሚኒስቴር ተሰጥተዋል። the Ministry of Urban Development and Construction. gA ፲ሺ፮፻፶፰ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10658 ፳፫. የውሃ፣ መስኖና ኤነርጂ ሚኒስቴር 23. The Ministry of Water, Irrigation and Energy ፩. የውሃ፣ መስኖና ኤነርጂ ሚኒስቴር የሚከተሉት 1. The Ministry of Water, Irrigation and Energy ሥልጣንና ተግባራት ይኖሩታል:- shall have the powers and duties to: ሀ) የውሃ ሀብትና የመስኖ ልማት እንዲስፋፋ a) design policies and legal frameworks for ያደርጋል፤ ለዘርፉ ዕድገት የሚያስፈልጉ the development of water resources and የፓሊሲና የሕግ ማዕቀፍ ይቀርጻል፣ irrigation; upon approval follow up the ሲፀድቅም አፈጻጸሙን ይከታተላል፣ implementation thereof; ለ) የተፋሰስ ጥናት በማካሄድ የአገሪቱን የከርሰ b) undertake basin studies and verify the ምድርና ገጸ ምድር የውሃ ሀብት በመጠንና country’s ground and surface water በጥራት ይለያል፣ ጥቅም ላይ የሚውልበትን resource potentials in volumetric and ሁኔታ ያመቻቻል፤ quality terms, and facilitate utilization of same; ሐ) ፍትሃዊ የውሃ አጠቃቀምን ለማስፈን c) establish sustainable and integrated የሚያግዝ ዘላቂ እና የተቀናጀ የውሃ ሀብት administration system facilitating the አስተዳደር ሥርዓት እንዲፈጠር ያደርጋል፤ equitable utilization of water resources; መ) በፌደራል መንግሥት በጀት የተገነቡ d) administer dams and water infrastructure ግድቦችንና የውሃ ውቅሮችን ያስተዳድራል፤ financed by federal budget; ሠ) የአገሪቱ የኤሌክትሪክ ኃይል አቅርቦት e) ensure the development of electric power እንዲያድግና ስርጭቱም እንዲስፋፋ ያደርጋል፤ provisions and enhance distribution of የኤሌክትሪክ ኃይል እጥረትን ለማስወገድ ከውሃ same; generate, stock and distribute ኃይል፣ ከንፋስ ኃይል እና ከሌሎች አማራጭ energy produced from water, wind and የታዳሽ ኃይል ምንጮች ኤሌክትሪክ other alternative renewable energy የማመንጨት ሥራን ይደግፋል፣ ይመራል፤ sources and alleviate shortfalls in electric power provision; ረ) ከአንድ በላይ የሆኑ ክልሎችን አቋርጦ f) determine conditions for optimum and የሚፈስ ወይም የሚያዋስን ውሃ በልዩ ልዩ equitable allocation and utilization of የአገልግሎት ዓይነቶችና በክልሎች መካከል water bodies that traverse across or lie ሚዛናዊ በሆነ መንገድ የሚከፋፈልበትንና between more than one regional states ጥቅም ላይ የሚውልበትን ሁኔታ ይወስናል፤ among various uses and regional states; ሰ) አገራዊ ወሰን ተሻጋሪ የውሃ አካላት g) undertake studies pertaining to utilization አጠቃቀም ላይ ጥናት ያካሂዳል፣ አለም አቀፍ of national and transboundary water ውሎችን ይደራደራል፣ አፈጻጸማቸውን resources; negotiate international treaties; ይከታተላል፤ follow up implementation of same;

ሸ) ለልዩ ልዩ አገልግሎቶች የሚውል ውሃ h) determine quality standards of water used ሊኖረው የሚገባውን የጥራት ደረጃ ይወስናል፤ for various purposes; undertake የውሃ ብክለትን እንዳይኖር ክትትል monitoring works to avert water ያደርጋል፤ pollution; ቀ) የንፁህ መጠጥ ውሃ አቅርቦትና የሳኒቴሽን i) establish system that facilitates the መሠረተ ልማት ሽፋን እንዲያድግ እገዛ expansion of potable water supplies and የሚያደርግ የአሠራር ሥርዓት ይዘረጋል፤ coverage of sanitation infrastructure; ተግባራዊነቱን ይከታተላል፤ follow up implementation of same; በ) የመካከለኛና የከፍተኛ መስኖ ልማት j) cause the carrying out of study, design ሥራዎችን ለማስፋፋት የሚያስችሉ የጥናት፣ and construction works to promote the የዲዛይንና የግንባታ ሥራዎች እንዲካሄዱ expansion of medium and large irrigation ያደርጋል፤ development schemes; gA ፲ሺ፮፻፶፱ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10659 ተ) በዚህ ንዑስ አንቀጽ ፊደል ተራ (ረ) እና (ሰ) k) issue permits and regulate the በተጠቀሱት የውሃ አካሎች ላይ የውሃ construction and operation of water works ሥራዎች ለመሥራትና በጥቅም ላይ ለማዋል relating to water bodies referred to in ፈቃድ ይሰጣል፣ይቆጣጠራል፤ paragraphs (f) and (g) of this sub-article; ቸ) የሜቲዎሮሎጂ አገልግሎት እንዲስፋፋ l) provide support to promote expansion ድጋፍ ያደርጋል፣ ከዘርፉ የሚገኘውን meteorological services; enhance capacity መረጃዎች የመጠቀም አቅምን ያሳድጋል፤ to utilize data obtained from the sector; ኀ) የውሃ ሀብት መረጃና ኢንፎርሜሽን ሥርዓትን m) put in place water resources data and ይዘረጋል። information system; ፪. በሥራ ላይ ባሉ ሌሎች ሕጎች ድንጋጌዎች 2. The Ministry of Mines and Petroleum

፩. የማዕድንና ነዳጅ ሚኒስቴር የሚከተሉት 1. The Ministry of Mines and Petroleum shall ሥልጣንና ተግባራት ይኖሩታል:- have the powers and duties to: ሀ) የማዕድን፣ የነዳጅና የተፈጥሮ ጋዝ ልማትን a) design policies and legal frameworks pertaining to the development of minerals, የሚመለከቱ የፓሊሲና የሕግ ማዕቀፍ ይቀርጻል፣ petroleum and natural gas; when approved ሲፀድቅም አፈጻጸሙን ይከታተላል፤ follow up implementation thereof; ለ) የማዕድን፣ የነዳጅና የተፈጥሮ ጋዝ ልማትን b) organize research and training institutions ለማፋጠን የሚረዱ የምርምርና የማሠልጠኛ that accelerate the development of ተቋሞችን እንዳስፈላጊነቱ ያደራጃል፤ minerals, petroleum and natural gases, as may be necessary; ሐ) በማዕድን፣ በነዳጅና የተፈጥሮ ጋዝ ልማት c) work in partnership with educational መስክ በየደረጃው የሚፈለገውን የሰው ሀብት institutions and other pertinent bodies to ለማልማት ከትምህርት ተቋማትና ከሌሎች produce variously trained manpower የሚመለከታቸው አካላት ጋር በቅንጅት required in the development of minerals, ይሰራል፤ petroleum and natural gases; መ) የማዕድን፣ የነዳጅና የተፈጥሮ ጋዝ የስነ d) ensure the quality and accessibility of ምድር ካርታ ሽፋን ጥራትን ያሳድጋል፣ geophysical map and data on minerals, የመረጃዎችን ተደራሽነት ያረጋግጣል፤ petroleum and natural gas; ሠ) ከሚመለከታቸው ጋር በመተባበር በባህላዊና e) put in place, in cooperation with concerned በአነስተኛ ደረጃ የሚመረቱ የከበሩና የጌጣጌጥ bodies, system that enhances the efficiency ማዕድናት ግብይት ውጤታማና ቀልጣፋ and effectiveness of marketing in precious እንዲሆን ሥርዓት ይዘረጋል፤ በመስኩ and ornamental minerals produced in small ለሚሰማሩ አልሚዎች አበረታች ፖሊሲ scales; design and implement policy that ይቀርጻል፣ በሚመለከተው አካል ሲፀድቅም encourages small-scale mining operations ያስፈጽማል፣ ድጋፍ ያደርጋል፤ once approved by the concerned body; ረ) በባህላዊ መንገድ ማዕድን ማምረት ሥራ ላይ f) organize and build the capacity of የተሰማሩ ግለሰቦችን ያደራጃል፣ አቅማቸውን individuals engaged in traditional mining ይገነባል፤ operation; ሰ) ኢንቨስትመንትን በማበረታታት የማዕድን፣ g) promote investment by creating favorable ነዳጅ፣ የተፈጥሮ ጋዝ ፍለጋና ልማት conditions for the expansion of exploration እንዲስፋፋ ያደርጋል፣ ተጨማሪ ዕሴት and mining operations; encourage value ያላቸው ምርቶችን ያበረታታል፤ added products;

gA ፲ሺ፮፻፷ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10660 ሸ) የነዳጅና ተፈጥሮ ጋዝ ምርት ፍለጋን h) lead and oversee the exploration of በበላይነት ይመራል፣ ምርቱን ወደ ገበያ petroleum and natural gas; organize ለማሸጋገር የሚያስችል ዘመናዊ አሠራሮችንና modern system and institutional set up for አደረጃጀቶችን ይፈጥራል፤ the supply of products to markets; ቀ) በማዕድን፣በነዳጅና በተፈጥሮ ጋዝ ፍለጋና i) issue licenses to private investors engaged ልማት ለሚሠማሩ የግል ባለሃብቶች ፈቃድ in mining and exploration of petroleum ይሰጣል፣ ተገቢውን ድጋፍ ያደርጋል፤ በገቡት and natural gas; provide appropriate ውል መሠረትም ሥራቸውን ማካሄዳቸውንና support; and ensure that such investors የክፍያ ግዴታቸውን መፈጸማቸውን operate in accordance with the ይቆጣጠራል፤ agreements concluded and meet their financial obligations; በ) የነዳጅና የተፈጥሮ ጋዝ ልማት j) create conditions for the employment of በሚካሄድባቸው አካባቢዎች ለነዋሪዎች የሥራ local communities in areas where mining ዕድል የሚፈጠርበትን ሁኔታ ያመቻቻል፤ operations and explorations of petroleum ከመሠረተ ልማቱ ተጠቃሚ የሚሆኑበትን and natural gas are pursued; put in place ምቹ ሁኔታ ይፈጥራል፤ conducive environment to ensure that local communities benefit from such infrastructure developments; ተ) የተፈጥሮ ጋዝና የነዳጅ ምርቶችን የጥራት k) ensure quality standards of petroleum and ደረጃ ያረጋግጣል፣ የማከማቻና ማከፋፈያ natural gas products; set standards for ተቋሞችን ደረጃ ይወስናል፣ ተፈጻሚነቱን petroleum storage and distribution ይከታተላል፤ facilities; follow up enforcement of same; ቸ) አግባብ ካላቸው አካላት ጋር በመተባበር l) determine, in cooperation with the የነዳጅና መጠባበቂያ ክምችትን መጠን appropriate organs, the volume of ይወስናል፣ ክምችቱ እንዲኖር መደረጉን petroleum reserve and ensure that such ያረጋግጣል፤ reserve is maintained; ኀ) ከማዕድን፣ ከነዳጅና የተፈጥሮ ጋዝ ጋር m) negotiate and sign international treaties በተያያዙ ጉዳዮች ዓለም አቀፋዊ ስምምነቶችን pertaining to mining, petroleum and ይደራደራል፣ ይፈርማል፤ natural gas; ነ) የማዕድን፣ ነዳጅና የተፈጥሮ ጋዝን n) ensure that information relating to mining, የተመለከቱ መረጃዎች በአግባቡ እንዲሰበሰቡ፣ petroleum and natural gas is collected, እንዲጠበቁና ለተጠቃሚዎች እንዲቀርቡ maintained and availed for utilization by ያደርጋል። users;

The Ministry of Education የትምህርት ሚኒስቴር የሚከተሉት ሥልጣንና The Ministry of Education shall have the powers ተግባራት ይኖሩታል:- and duties to: ፩. የትምህርትና ሥልጠና ስታንዳርድ ያወጣል፤ 1. set education and training standards; ensure በሥራ ላይ መዋሉንም ያረጋግጣል፤ implementation of same; ፪. የዚህ አንቀጽ ንዑስ አንቀጽ (፩) አጠቃላይ 2. without prejudice to the generality of sub- አነጋገር እንደተጠበቀ ሆኖ፡- article (1) of this Article: ሀ) አገራዊ የብቃት ማዕቀፍ ያዘጋጃል፤ a) formulate a national qualification framework; gA ፲ሺ፮፻፷፩ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10661 ለ) አጠቃላይ የሥርዓተ-ትምህርት ማዕቀፍ b) formulate a general framework of ያዘጋጃል፤ education curricula; ሐ) የመምህራን የትምህርት ብቃት መለኪያ c) set minimum educational qualification ያወጣል፤ requirements for school teachers; መ) የትምህርትና ሥልጠና ተቋማት ሊያሟሉ d) set minimum standards for education and የሚገባቸውን ደረጃ ያወጣል፤ training institutions; ፫. የከፍተኛ ትምህርትና የቴክኒክና ሙያ ተቋማትን 3. ensure that quality and relevant education and ሳይጨምር በየደረጃው ባሉ የትምህርትና training are offered at all levels of the ሥልጠና ተቋማት ጥራትና አግባብነት ያለው education and training centers excluding ትምህርትና ሥልጠና መሰጠቱን ያረጋግጣል፤ higher education and technic and vocational institutes; ፬. የአገሪቱን የትምህርትና ሥልጠና ፖሊሲና 4. prepare and administer national examinations ሥርዓተ-ትምህርት መሠረት ያደረጉ አገር አቀፍ based on the country’s education and training ፈተናዎች ዝግጅት፣ ሪከርድ መያዝና የምስክር policy and curricula; lead the functions of ወረቀት የመስጠት ሂደቶችን በበላይነት maintaining records and issuing certificates; ይመራል፤ ፭. ትምህርትና ሥልጠናን በተመለከተ አገራዊ 5. publicize national performance in education የአህዝቦት ተግባራትን ያከናውናል። and training. ፳፮. የሳይንስና ከፍተኛ ትምህርት ሚኒስቴር 26. The Ministry of Science and Higher Education ፩. የሳይንስና ከፍተኛ ትምህርት ሚኒስቴር 1. The Ministry of Science and Higher የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፦ Education shall have the powers and duties to: ሀ) የከፍተኛ ትምህርት እንዲስፋፋ ያደርጋል፣ a) ensure the expansion of higher education; በበላይነት ይመራል፤ oversee the sector; ለ) የከፍተኛ ትምህርት ከአገሪቱ አጠቃላይ b) undertake and implement strategies that የልማት ፖሊሲና ከዘርፎች ዕድገት ጋር seek to synchronize higher education with አብሮ ለማስኬድ የሚያስችል ስትራቴጂ the country’s overall developmental policies ይነድፋል፣ በሥራ ላይ ያውላል፤ and sectoral specific developments;

The powers and duties given by provisions of ከፍተኛ ትምህርት እና ቴክኒክና ሙያን other laws currently in force to the Ministry በሚመለከት ለትምህርት ሚኒስቴር ተሰጥተው of Education in relation to matters pertaining የነበሩ ሥልጣንና ተግባራት፤ ሳይንስን to higher education and technical and በሚመለከት ለሳይንስና ቴክኖሎጂ ሚኒስቴር vocational education; and to Ministry of ተሰጥተው የነበሩ ሥልጣንና ተግባራት በዚህ Science and Technology pertaining to science አዋጅ ለሳይንስና ከፍተኛ ትምህርት ሚኒስቴር are hereby vested in the Ministry of Science ተሰጥተዋል። and Higher Education. ፳፯. የጤና ሚኒስቴር 27. Ministry of Health

የጤና ሚኒስቴር የሚከተሉት ሥልጣንና ተግባራት The Ministry of Health shall have the powers ይኖሩታል:- and duties to: ፩. የጤናውን ዘርፍ ልማት አገራዊ ፕሮግራም 1. formulate the country's health sector ይነድፋል፣ አፈጻጸሙን ይከታተላል፤ development program; follow up and evaluate the implementation of same; ፪. የጤና ሥርዓቱን ካርታ ያዘጋጃል፣ የጤና 2. prepare the country's health services መሠረተ ልማቶች እንዲስፋፉ ድጋፍ ያደርጋል፤ coverage map; provide support for the expansion of health infrastructure; ፫. የጤና አገልግሎት ሽፋን እንዲያድግ እገዛ 3. support the expansion of health services ያደርጋል፤ የጤና ፕሮግራሞችን አፈጻጸም coverage; follow up and coordinate the ይከታተላል፣ ያስተባብራል፤ implementation of health programs; ፬. የአገሪቱን የጤና ችግር ለመፍታትና የጤና 4. provide appropriate support to promote አገልግሎት አሰጣጥን ለማሻሻል የሚረዱ research activities intended to provide ምርምሮች እንዲካሄዱ ተገቢውን ድጋፍ solutions for the country's health problems ይሰጣል፤ and for improving health service delivery; ፭. አገራዊ የአመጋገብ ሥርዓት ስትራቴጂ 5. follow up and coordinate the implementation አፈጻጸምን ይከታተላል፣ ያስተባብራል፤ of national nutrition strategies; ፮. ወረርሽኝና ተላላፊ በሽታዎችን ለመከላከል 6. devise and follow up the implementation of የሚያስችሉ ስልቶችን ይቀይሳል፣ተግባራዊነታቸውን strategies for the prevention of epidemic and ይከታተላል፤ communicable diseases; ፯. የኅብረተሰቡን ጤና ሊጎዱ የሚችሉ ሁኔታዎችን 7. take preventive measures against events that የመከላከል እርምጃ ይወስዳል፣ ድንገተኛ threaten the public health; in the events of an ሁኔታዎች ሲፈጠሩ የሌሎች አካላት ሥራዎችን emergency situation coordinate measures of በማስተባበር ለችግሩ አፋጣኝና ውጤታማ other stakeholders to expeditiously and መፍትሄ ይሰጣል፤ effectively tackle the problem; gA ፲ሺ፮፻፷፫ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10663 ፰. አግባብነት ያላቸውን የተለያዩ ዘዴዎች 8. expand health education through various በመጠቀም የጤና አጠባበቅ ትምህርት appropriate means; እንዲስፋፋ ያደርጋል፤ ፱. በአገሪቱ ውስጥ የአስፈላጊ መድሃኒቶችና 9. ensure adequate supply and proper utilization የሕክምና መሣሪዎች በቂ አቅርቦት መኖሩንና of essential drugs and medical equipment in በአግባቡ ጥቅም ላይ መዋላቸውን ያረጋግጣል፤ the country; ፲. የፌደራል ሆስፒታሎችን አስተዳደር በበላይነት 10.supervise the administration of federal ይቆጣጠራል፤ የፌደራል ዩኒቨርሲቲዎች hospitals; collaborate on the capacity ሆስፒታሎችን አቅም በማጎልበት ረገድ ተባብሮ building activities of the federal university ይሠራል፤ hospitals; ፲፩. በአገሪቱ ውስጥ የሚሰጠው የጤና ባለሙያዎች 11.collaborate with the appropriate bodies in ሥልጠና ጥራትና አግባብነት ባለው ሁኔታ providing quality and relevant health እንዲካሄድ ከሚመለከታቸው አካላት ጋር professional trainings within the country; ይተባበራል፤ ፲፪. የምግብ፣የመድኃኒትና ጤና እንክብካቤ 12.ensure the proper execution of food, አስተዳደርና ቁጥጥር ሥራዎች በአግባቡ medicine and health care administration and መፈፀማቸውን ያረጋግጣል፤ regulatory functions;

፲፫. አገራዊ የጤና መድህን ሥርዓቱን ይመራል፤ 13.lead the national social health insurance አፈፃፀሙንም ይቆጣጠራል፤ system and oversee its implementation; ፲፬. አገራዊ የጤና መረጃ ሥርዓቱን ይመራል፣ 14.direct, coordinate and follow up ያስተባብራል፣ አፈፃፀሙን ይከታተላል። implementation of the country's health information system. ፳፰. የሴቶች፣ ሕፃናትና ወጣቶች ሚኒስቴር 28. Ministry of Women, Children and Youth ፩. የሴቶች፣ ሕፃናትና ወጣቶች ሚኒስቴር 1. gA ፲ሺ፮፻፷፭ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10665 አ) በተለያዩ ምክንያቶች ለችግር የተጋለጡና o) design strategies to ensure local options ወላጆቻቸውን ያጡ ሕፃናት ጉዲፈቻን ጨምሮ of care and support, including adoption, በአገር ውስጥ ባሉ አማራጭ ድጋፍና for orphaned children and children እንክብካቤ ዘዴዎች ተጠቃሚ የሚሆኑበትን exposed to risk due to various reasons; ስልት ይቀይሳል፣ ተግባራዊ ያደርጋል፤ implement same upon approval; follow up በዓለም አቀፍ ጉዲፈቻ ከአገር የወጡ care taking of children adopted abroad; ኢትዮጵያዊ ሕፃናት በእንክብካቤ እንደተያዙ ለማረጋገጥ ጉዳያቸውን ይከታተላል፤ ከ) ሕፃናትን ከአገሪቱ ልማት ተጠቃሚ እንዲሆኑ p) design strategies to ensure that ለማድረግ የመንግሥትና የግሉ ዘርፍ የልማት government and private actors carry out ተቋማት ማኅበራዊ ሃላፊነታቸውን እንዲወጡ their obligations to guarantee that children ስልት ይቀይሳል፣ አፈጻጸሙንም ይከታተላል፤ are beneficiaries of the development of the country; follow up implementation of same; ኸ) ቤተሰብ እንደኅብረተሰብ ዋና መሠረት q) in collaboration with the relevant regional የተሰጠውን ሕገ-መንግሥታዊ ጥበቃ በተግባር government organs and other relevant ለማዋል የሚያስፈልጉ ስልቶችን ከሚመለከታ bodies, design techniques necessary to ቸው ክልላዊ መንግሥት አካላትና ሌሎች implement the constitutional protection given to the family as the fundamental ባለድርሻ አካላት ጋር በትብብር ይነድፋል፤ unit of society; follow up implementation ተግባራዊነቱን ይከተላል፤ of same; ወ) በፌደራል መንግሥት አካላት የሚዘጋጁ r) design strategies to follow up and regulate ፖሊሲዎች፣ ሕጎች፣ የልማት ፕሮግራሞችና that the preparation of policies, ፕሮጀክቶች የሴቶች፣ ሕፃናትና ወጣቶች legislations, development programs and ጉዳይ እንዲያካትቱ ስልት ይነድፋል፣ projects by Federal Government organs ይገመግማል፣ ተገቢውን ክትትልና ቁጥጥር give due considerations to the issues of ያደርጋል፤ women, children and the youth; አ) ሴቶችና ሕፃናትን የሚመለከቱ ዓለም አቀፍ s) conclude international treaties relating to ውሎችን በሕግ መሠረት ይዋዋላል፤ women and children in accordance with አፈጻጸማቸውን ይከታተላል፤ ለሚመለከታቸው law and, follow up the implementation of አካላትም ሪፖርት ያቀርባል፤ same and submit reports to the concerned bodies; ዘ) የሴቶች፣ የሕፃናትና የወጣቶችን ሁኔታ t) collect, compile and disseminate to የሚያመለክቱ ዝርዝር መረጃዎች ይሰበስባል፣ relevant stakeholders information on the ያደራጃል፣ በሚመለከታቸው ሁሉ እንዲታወቁ objective realities of women, children and ያደርጋል። the youth. ፪. በሥራ ላይ ባሉ ሌሎች ሕጎችና ድንጋጌዎች 2/ The powers and duties given to the Ministry ለሴቶችና ሕፃናት ሚኒስቴር ተሰጥተው የነበሩ of Women and Children Affairs by the ሥልጣንና ተግባራት ፣ወጣቶችን በሚመለከት provisions of other laws, currently in force, ለወጣቶችና ስፖርት ሚኒስቴር ተሰጥተው የነበሩ with respect to women and children and to ሥልጣንና ተግባራት በዚህ አዋጅ ለሴቶች፣ the Ministry of Youth and Sports with respect ሕፃናትና ወጣቶች ሚኒስቴር ተሰጥተዋል። to the youth are hereby vested in the Ministry of Women, Children and Youth. ፳፱. የሠራተኛና ማኅበራዊ ጉዳይ ሚኒስቴር 29. Ministry of Labor and Social Affairs የሠራተኛና ማኅበራዊ ጉዳይ ሚኒስቴር የሚከተሉት The Ministry of Labor and Social Affairs shall ሥልጣንና ተግባራት ይኖሩታል:- have the powers and duties to: ፩. የአሠሪና ሠራተኛ ጉዳይ ሕጎች፣ የሠራተኞች 1. ensure and follow up the proper enforcement አስተዳደር ሕጎች በትክክል ሥራ ላይ of labor laws and administrative rules; መዋላቸውን ይከታተላል፣ ይቆጣጠራል፤

፲ሺ፮፻፷፮ gA Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10666 ፪. ተቀማጭነታቸው ከአንድ ክልል በላይ የሆኑ 2. follow up and support the labor relation of ድርጅቶችን የአሠሪና ሠራተኛ ጉዳይ enterprises situated in more than one ይከታተላል፣ ድጋፍ ይሰጣል፤ Regional State; ፫. በሥራ ላይ የሚከሠቱ አደጋዎችና በሥራ 3. establish a system to prevent occupational ምክንያት የሚመጡ በሽታዎችን ለመከላከል accidents and occupational diseases; issue የሚያስችል የአሠራር ሥርዓት ይዘረጋል፤ የሙያ occupational health and safety standards and ጤንነትና ደኅንነት ደረጃዎች ያወጣል፣ ሥራ ላይ supervise their implementation; መዋላቸውን ይቆጣጠራል፤ ፬. የኢንዱስትሪ ሠላም ለማስጠበቅ የሚያስችል 4. set up a system to ensure industrial peace and ሥርዓት ይዘረጋል ፣ ተግባራዊነቱንም ያረጋግጣል፤ ensure its proper implementation; ፭. አሠሪዎችና ሠራተኞች በማኀበር የመደራጀትና 5. encourage and support employers and የሕብረት ድርድር የማድረግ መብቶቻቸውን workers to form organizations and thereby እንዲጠቀሙ ያበረታታል፣ ይደግፋል፤ exercise their rights of collective bargaining; ፮. በአሠሪዎችና በሠራተኞች መካከል የሁለትዮሽ፣ 6. encourage the practice of bipartite forums እንዲሁም የመንግሥት ወገንን ጨምሮ between workers and employers and tripartite የሶስትዮሽ የውይይት መድረኮች እንዲደረጉ forums involving the Government; ድጋፍ ያደርጋል፤ ፯. በአገር አቀፍ ደረጃ የሚደራጁትን የሠራተኛና 7. register employers’ association and trade የአሠሪ ማኀበራት ይመዘግባል፤ unions established at national level; ፰. በአዲስ አበባና ድሬዳዋ ከተሞች ውስጥ የሚገኙ 8. register trade unions and collective የፌደራል መንግሥት የልማት ድርጅቶችን agreements relating to Federal Public የሚመለከቱ የሠራተኛ ማኀበራትንና የሕብረት Enterprises situated inAddis Ababa and Dire ስምምነቶችን ይመዘግባል፤ በእነዚሁ ድርጅቶች Dawa cities; carry out labor inspection ውስጥ የሥራ ሁኔታ ቁጥጥር አገልግሎት services in such enterprises; provide ተግባሮችን ያከናውናል፤ በአሠሪዎችና በሠራተኞች conciliation services to amicably settle labor መካከል የሚነሱ የሥራ ክርክሮችን በስምምነት disputes arising between employers and ለመጨረስ የማስማማት አገልግሎት ይሰጣል፤ employees; ፱. የሥራ ክርክሮችን ክስተት ለመቀነስ የሚያስችሉ 9. set a mechanism to minimize occurrence of ስልቶችን ይቀይሳል፤ ሲከሰቱም መፍትሄ labor disputes and establish efficient system የሚያገኙበት የተቀላጠፈ የአሠራር ሥርዓት for settlement of same; ይዘረጋል፣ ያስፈጽማል፤ ፲. የአሠሪና ሠራተኛ ብሔራዊ የመረጃ ሥርዓት 10.establish national labor sector information ይዘረጋል፣ አገራዊ የሥራ ገበያ መረጃ ሥርዓት system and realize its implementation; ይዘረጋል፣ ተግባራዊ ያደርጋል፤ establish and put into operation a national labor market information system; ፲፩. የማኀበራዊ ጥበቃ ሥርዓትን በማጠናከር 11.work in collaboration with the concerned የዜጎች ማኀበራዊና ኢኮኖሚያዊ ደኅንነት እና bodies to strengthen the social protection ዋስትና የሚሻሻሉባቸውና የሚጠበቁባቸው system to improve and ensure the social and ዘዴዎችን በሚመለከት በተለይም፡- economic wellbeing of citizens and, in particular to:

ሀ) የአካል ጉዳተኞች እኩል ዕድል ተጠቃሚና a) enable persons with disabilities benefit from ሙሉ ተሳታፊ እንዲሆኑ፣ equal opportunities and full participation; ለ) አረጋዊያን እንክብካቤና ድጋፍ እንዲያገኙና b) enable the elderly to get care and support ተሳትፏቸው እንዲጎለብት፣ and enhance their participation; gA ፲ሺ፮፻፷፯ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10667 ሐ) የማኀበራዊና ኢኮኖሚያዊ ችግሮችን c) prevent social and economic problems and ለመከላከልና በችግሩ ውስጥ የሚገኙ provide the necessary services to በተለይም አረጋውያንና የአካል ጉዳተኞች segments of the society under difficult አስፈላጊ የሆኑ አገልግሎቶችን እንዲያገኙ፣ circumstances particularly the elderly and ከሚመለከታቸው አካላት ጋር በመተባበር ይሰራል፤ people with disabilities; ፲፪. ከሚመለከታቸው አካላት ጋር በተመባበር 12. in cooperation with concerned bodies, መደበኛ ያልሆነውን የኢኮኖሚ ዘርፍ ወደ establish a labor administration system መደበኛ ኢኮኖሚ ለማሸጋገር የሚያስችል around the labor relation that enables the የአሠራር ሥርዓት በአሠሪና ሠራተኛ አስተዳዳር proper transition of the informal economy to ግንኙነት ዙሪያ ይዘረጋል፤ the formal economy; ፲፫. ቀልጣፋና ፍትሐዊ የሥራ ስምሪት 13. enhance the accessibility of efficient and አገልግሎቶች ተደራሽነት እንዲስፋፋ ያደርጋል፤ equitable employment services; ፲፬. ለውጭ አገር ዜጎች የሥራ ፈቃድ ይሰጣል፤ 14. issue work permits to foreign nationals and, ከሚመለከታቸው አካላት ጋር በመተባበር in cooperation with concerned bodies, አፈጻጸሙን ይቆጣጠራል፤ supervise the compliance therewith; ፲፭. ከሚመለከታቸው አካላት ጋር በመተባበር 15. in cooperation with concerned bodies, የኢትዮጵያውያን የውጭ አገር የሥራ ስምሪትን regulate the Ethiopians overseas employment; ይቆጣጠራል። ፴. የባህልና ቱሪዝም ሚኒስቴር 30. Ministry of Culture and Tourism የባህልና ቱሪዝም ሚኒስቴር የሚከተሉት ሥልጣንና The Ministry of Culture and Tourism shall have ተግባራት ይኖሩታል:- the powers and duties to: ፩. በኢትዮጵያ የሚገኙ ልዩ ልዩ ታሪካዊና ባህላዊ 1. cause the study and preservation of history, ቅርሶችና ዕሴቶች እንዲጠኑና እንዲጠበቁ cultural heritages and values of the various ያደርጋል፤ peoples in Ethiopia; ፪. በባህል ዘርፍ የሕዝቡን ተሳትፎ ተቋማዊ 2. expand cultural institutions to institutionalize መሠረት ለማስያዝ የባህል ተቋማት እንዲስፋፉ public participation in the development of ያደርጋል፤ culture; ፫. ማኀበራዊ እድገትን የሚያጓትቱ አመለካከቶችን፣ 3. undertake activities to bring about changes in እምነቶችንና ልማዳዊ አሰራሮችን የመለወጥ cultural attitudes, beliefs and practices ተግባሮች ያከናውናል፤ hindering social progress; ፬. የዕደ ጥበብ፣ ኪነ ጥበብና የሥነ-ጥበብ ሥራዎች 4. promote creativity in handicraft, artistic እንዲስፋፉ ያደርጋል፤ የአገሪቱ የፊልምና works and fine art; create conducive ተውኔት ጥበብ ሥራዎች የሚያድጉበትን አግባብ environment for the development of the ያመቻቻል፤ country’s film industry and theatrical arts; ፭. በዘርፉ ውጤታማ የፈጠራ ሥራዎችን ላበረከቱ 5. establish and enforce a working procedure ግለሰቦችና ተቋማት ሽልማትና ማበረታቻ for awarding and motivating those የሚሰጥበት ሥርዓት ይዘረጋል፣ ተግባራዊም individuals and institutions with outstanding ያደርጋል፤ achievements in creative industry; ፮. በኢትዮጵያ የሚገኙ ልዩ ልዩ ቋንቋዎች 6. cause the study of the various languages in እንዲጠኑ፣ ስነ-ጽሑፎቻቸው እንዲዳብሩና Ethiopia and the advancement and promotion እንዲስፋፉ ምቹ ሁኔታን ይፈጥራል፤ of their literatures; ፯. የትርጉም አገልግሎትና የአስተርጓሚነት ሙያ 7. undertake activities related to advancement ዕውቀት እንዲዳብርና እንዲስፋፋ የሚያደርጉ and promotion of translation services and ተግባሮችን ያከናውናል፤ ደረጃውን የጠበቀ የሥራ translation as a professional knowledge; ቋንቋ አጠቃቀም እና የትርጉም አገልግሎት assist and follow up standard usage of እንዲኖር ይደግፋል፣ ክትትል ያደርጋል፤ working language and translation services;

gA ፲ሺ፮፻፷፰ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10668 ፰. የቱሪዝም ዘርፍን ዕድገት ለመምራት 8. design and implement a strategy to enhance የሚያስችል ስትራቴጂካዊ ዕቅድ ይነድፋል፣ the growth of the tourism sector; ይተገብራል፤ ፱. ዓለም አቀፍና የአገር ውስጥ ቱሪዝም እንዲስፋፋ 9. create conducive environment for expansion ምቹ ሁኔታን ይፈጥራል፤ of international and domestic tourism; ፲. የአገሪቱ የተፈጥሮ ቅርሶች እንዲጠኑ፣ እንዲጠበቁና 10.facilitate the studying and preservation of the ለቱሪዝም አመቺ ሆነው እንዲለሙና ጥቅም ላይ country's natural heritages and the እንዲውሉ የሚደረጉበትን ሁኔታ ያመቻቻል፤ development and utilization of them as በፌደራል መንግስት እንዲተዳደሩ የተሰየሙ የዱር tourist attractions; support the work of እንስሳት ጥበቃ ቦታዎች አስተዳደር በአግባቡ concerned organs to ensure the proper እንዲመሩ ለሚመለከታቸው አካላት ድጋፍ management of wildlife conservation areas ያደርጋል፤ designated to be administered by the Federal Government; ፲፩. በሰው ኃይል ሥልጠናና በሙያ ምክር 11.build the capacity of the culture and tourism አገልግሎት አማካኝነት የባህልና የቱሪዝም Sector through the provision of human ሴክተርን የማስፈጸም አቅም ይገነባል፤ resource training and consultancy supports; ፲፪. የባህልና ቱሪዝም መረጃዎችን ያሰባስባል፣ 12.collect, compile and disseminate information ያጠናቅራል፣ ያሰራጫል። on culture and tourism. ፴፩. የገቢዎች ሚኒስቴር 31. Ministry of Revenues ፩. በሥራ ላይ ባሉ ሕጎች ለገቢዎችና ጉምሩክ 1. The powers and duties given to the Ethiopian ባለሥልጣን የተሰጡት ሥልጣንና ተግባሮች Revenues and Customs Authority by the በዚህ አዋጅ ለገቢዎች ሚኒስቴር ተሰጥተዋል። provisions of laws currently in force are hereby vested in the Ministry of Revenues. ፪. የጉምሩክ ኮሚሽን በዚህ አዋጅ ተቋቁሟል፤ 2. The Customs Commission is hereby ዝርዝር ሥልጣንና ተግባራቱ የሚኒስትሮች established. The powers and duties of the ምክር ቤት በሚያወጣው ደንብ ይወሰናል። Commission shall be specified through Regulation to be issues by the Council of Ministers. ፴፪. ስለሌሎች አስፈጻሚ አካላት 32. Other Federal Executive Organs

፩. የሲቪል ሰርቪስ ኮሚሽን በዚህ አዋጅ ተቋቁሟል 1. The Civil Service Commission is hereby ፤ኮሚሽኑ የሚከተሉት ሥልጣንና ተግባራት established. The Commission shall have the ይኖሩታል:- powers and duties to: ሀ) በአገር አቀፍ ደረጃ በመንግሥት መሥሪያ a) adopt strategies for continuous human ቤቶች የሰው ሀብት ልማት በቀጣይነት resource development and deployment የሚለማበትንና ጥቅም ላይ የሚውልበትን activities of executive organs of the ስልት ይቀይሳል፤ government; ለ) የመንግሥት ዘርፍ አገልግሎት አሰጣጥ b) adopt strategies for continuous በቀጣይነት የሚሻሻልበትን ስልት ይቀይሳል፤ improvement of service delivery in the ተግባራዊነቱንም ይከታተላል፣ ይገመግማል፤ public sector; coordinate public sector የመንግሥት ዘርፍ አቅም ግንባታ ሥራዎችን capacity building activities; monitor and ያስተባብራል፤ evaluate the implementation of same; ሐ) የፌደራል ሲቪል ሰርቪስ ሠራተኞች c) ensure that the recruitment and selection ምልመላና መረጣ በብቃት ላይ የተመሠረተ of the federal civil servants is primarily እንዲሆን ያደርጋል፤ based on merit; gA ፲ሺ፮፻፷፱ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10669 መ) ብቃት ያለውና ውጤታማ አመራርና ሲቪል d) adopt strategies for building competent ሰርቪስ እንዲገነባ ስልት ይቀይሳል፣ የብቃት and effective leadership and public ማረጋገጫ ሥርዓት ይዘረጋል፤ ተግባራዊነቱንም service; establish systems to ensure ይከታተላል፤ competence and follow up the implementation of same; ሠ) የሲቪል ሰርቪሱ በብቃትና በአፈጻጸም ላይ e) establish competence and performance- የተመሠረተ የክፍያና የማበረታቻ ሥርዓት based pay and reward system for the እንዲዘረጋ ያደርጋል፤ ውጤታማነቱን public service; evaluate its effectiveness ይገመግማል፣ አስፈላጊውን የማሻሻያ እርምጃ and make necessary adjustments; ይወስዳል፣ ረ) የፌደራል ሲቪል ሰርቪስ ሠራተኞች f) follow up and ensure the proper አስተዳደር ሕጎች በአግባቡ ሥራ ላይ enforcement of Federal public servants' መዋላቸውን ይከታተላል፣ የሠራተኞች ሥነ- administration laws; establish a system to ምግባር መከታተያ ሥርዓት እንዲዘረጋ monitor ethics of Federal public servants', ያደርጋል፣ ያረጋግጣል፤ and follow up the implementation of same; ሰ) የፌደራል መንግሥት መሥሪያ ቤቶችን g) review and decide on the appropriateness የውስጥ አደረጃጀት አግባብነት መርምሮ of the internal organizational structures of ውሳኔ ይሰጣል፤ በአደረጃጀት ማሻሻያ ጥናት Federal Government offices; provide ላይ አስፈላጊውን ድጋፍ ይሰጣል፤ የፌደራል necessary support in conducting reform መንግስት መሥሪያ ቤቶችን የሥልጣንና studies; conduct studies and make ተግባራት ወሰን፣ አወቃቀርና አደረጃጀትን recommendations to the Government on በተመለከተ ጥናት በማካሄድ ለመንግስት mandate, accountability and structure of የውሳኔ ሃሳብ ያቀርባል፤ Federal Government institutions; ሸ) በፌደራል መንግሥት መሥሪያ ቤቶች h) ensure that Federal Government offices የአገልግሎት አሰጣጥ ስታንዳርድ፣ የቅሬታ establish and implement service delivery አቀራረብና አፈታት ሥርዓት መዘርጋቱንና standards, complaint submission and ተግባራዊ መደረጉን ያረጋግጣል፤ handling procedures for customers; ቀ) የሲቪል ሰርቪሱ የሰው ሃብት አመራር i) ensure the development and መረጃዎች ሥርዓት በወጥነት እንዲዳብርና implementation of uniform information እንዲተገበር ያደርጋል፤ ማዕከላዊ የመረጃ system on human resource management ምንጭ ሆኖ ያገለግላል፤ of the public service and serve as a central information clearing house; በ) በሕግ መሠረት የፌደራል ሲቪል ሰርቪስ j) decide on requests for authorization of ሠራተኞችን ከጡረታ ዕድሜ ክልል በላይ retention of public servants in service በአገልግሎት ላይ ስለማቆየት በሚቀርቡ beyond retirement age as per the relevant ጥያቄዎች ላይ ውሳኔ ይሰጣል፤ laws; ተ) በመንግሥት ሠራተኞች ሕግ መሠረት k) give final decisions on the issue of fact on በፌደራል ሲቪል ሰርቪስ ሠራተኞች appeals of public service employees on በሚቀርብ ይግባኝ ላይ የፍሬ ነገር የመጨረሻ the basis of public service laws; ውሳኔ ይሰጣል፤ ቸ) በፌደራል ደረጃ የሚከናወኑ የካይዘን l) follow up and supervise the proper አመራር የለውጥ ሥራዎች በአግባቡ execution of Kaizen based reform መከናወናቸውን ይከታተላል፣ ይቆጣጠራል። activities conducted at the federal level.

፪. ቱሪዝም ኢትዮጵያ በዚህ አዋጅ ተቋቁሟል፤ 2. Tourism Ethiopia is hereby established; it የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል:- shall have the powers and duties to: gA ፲ሺ፮፻፸ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10670 ሀ) የተለያዩ የቱሪዝም ባለድርሻ አካላት a) promote the country’s tourism resources የሚያከናውኗቸውን የቱሪዝም ማርኬቲንግ and attractions domestically and abroad እንቅስቃሴዎች በማቀናጀትና በመምራት by organizing and coordinating tourism የአገሪቱን የቱሪዝም ሃብቶች፣ መስህቦችና marketing initiatives of the various መልካም ገፅታ በውጭ አገርና በአገር ውስጥ stakeholders; በስፋት ያስተዋውቃል፤ ለ) ሥልጣንና ተግባራቱን ለማስፈጸም b) establish and administer tourism fund to እንዲያስችለው የቱሪዝም ፈንድ ያቋቁማል፣ carry out its mandates; ያስተዳድራል፤ ሐ) የአገሪቱ የቱሪዝም መስህቦች ተለይተው c) design and implement a strategy to ensure እንዲታወቁ ፣ ለቱሪዝም አመቺ ሆነው that the country's tourist attractions are እንዲለሙና እንዲደራጁ ስልት ነድፎ identified, properly developed and ይተገብራል ፤ መስህቦችና የአገልግሎቶች organized; set up, coordinate and direct መረጃ ማዕከላትን በመግቢያ በሮችና በማዕከል gateways in country tourism attractions ያደራጃል፣ ያስተባብራል፣ ይመራል፤ and facilities information centers; መ) የአገሪቱ የቱሪስት መስህቦች በቅድመ d) improve conditions and work towards ሁኔታነት የተቀመጡ መስፈርቶችን በማሟላት fulfillment of preconditions of the በዓለም አቀፍ ቅርስነት የሚመዘገቡበትን nation’s tourist attractions for recognition ሁኔታ ያመቻቻል፣ as international heritages; ሠ) የአገሪቱን የቱሪዝም መስህቦች፣ ምርትና e) originate and put into effect tourism አገልግሎቶች መለያ በመቅረጽና በየጊዜው attraction, product and service brands and በማሻሻል በሥራ ላይ እንዲውል ያደርጋል፤ update them timely ረ) የማርኬቲንግ ተግባራትን ለማከናወን የሚረዱ f) identify, collect, analyze, organize and መረጃዎችንና የጥናት ዓይነቶችን ይለያል፣ communicate data and study types ያሰባስባል፣ ይተነትናል፣ ያደራጃል፣ያሰራጫል፤ suitable for conducting marketing operations; ሰ) የቱሪስት አገልግሎት ሰጪ ተቋማትን ደረጃዎች g) set tourist service provider institution ይወስናል፣ ተፈጻሚነቱን ይቆጣጠራል፤ standards and supervise same;

ሸ) የቱሪስት አገልግሎት ሰጪ ድርጅቶች h) ensure that tourist services are expanded እንዲስፋፉ፣ የየአካባቢው ማኀበረሰብም and that local communities share the ከቱሪዝም ጥቅሞች ተካፋይ እንዲሆን benefits derived from tourism; የሚደረግበትን አግባብ ያመቻቻል፤ ቀ) የቱሪዝም ልማትና ማርኬቲንግ የአገልግሎት i) facilitate the addressing of training needs ክፍተት በመለየት የሥልጠና ፍላጎቶች by assessing tourism development and የሚሟሉበትን ሁኔታ ያመቻቻል፤ marketing service gap; በ) ከቱሪዝም ተዋናዮች ጋር አጋርነትና ትብብር j) establish collaboration and partnership ይፈጥራል፤ with various actors in the tourism sector; ተ) የቱሪዝም ዘርፉን ዕድገት ለማረጋገጥ k) conduct studies and research to ensure አስፈላጊ የሆኑ ጥናቶችን ያከናውናል፣ growth of the tourism sector; implement በሚመለከተው አካል ሲጸድቅ ይተገብራል፤ same when it is approved by the relevant organ; ቸ) ነባርና አዳዲስ የቱሪስት መዳረሻዎችን l) identify existing and new tourist የልማት ክፍተት በጥናት በመለየት destinations development gaps and የሚለሙበትን ሁኔታ ያመቻቻል፣ የግል facilitate their development, and promote ባለሀብቶችም በልማቱ እንዲሳተፉ ያበረታታል፤ the participation of the private sector in the development of same; gA ፲ሺ፮፻፸፩ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10671 ኀ) የሰመረ የቱሪዝም አገልግሎት እንዲኖር m) work in cooperation with relevant actors ከሚመለከታቸው አካላት ጋር በቅንጅት to ensure coordinated tourism services; ይሠራል፣ የመንግሥትና የግል ዘርፍ አካላትን coordinate the actions of government and ያስተባብራል፣ ከክልል የቱሪዝም አካላት ጋር private entities; formulate and implement በጋራ የሚሰራበትን ማዕቀፍ በማዘጋጀት frameworks to forge cooperation among በሥራ ላይ ያውላል፤ ጥራት ያለው የቱሪዝም regional tourism organs; serve as a focal አገልግሎትና የቱሪስቶችን ደህንነት ለማረጋገጥ point for forums established to facilitate ያሉትን ዘርፈ-ብዙ ጥረቶች ለማስተባበር the coordination of multi-sectoral efforts በቱሪዝም ዙሪያ ለሚፈጠሩ የጋራ መድረኮች required for the provision of quality በማዕከልነት ያገለግላል፤ tourist services and for ensuring the wellbeing of tourists; ነ) በውጭ አገር ከሚገኙ አቻ ተቋማት ጋር n) establish alliance with overseas similar ትብብራዊ ግንኙነት ይመሰርታል። institutions.

፫. የአካባቢ፣ ደንና የአየር ንብረት ለውጥ ኮሚሽን 3. The Environment, Forest and Climate በዚህ አዋጅ ተቋቁሟል፤ ኮሚሽኑ የሚከተሉት Change Commission is hereby established. ሥልጣንና ተግባራት ይኖሩታል:- The Commission shall have the powers and duties to: ሀ) በሕገ መንግሥቱ የተደነገጉት የአካባቢ a) coordinate activities to ensure that the ደህንነት ዓላማዎችና በአገሪቱ የአካባቢ environmental objectives provided under ፖሊሲ የተመለከቱት መሠረታዊ መርሆዎች the Constitution and the basic principles ከግብ መድረሳቸውን ለማረጋገጥ የሚያስችሉ set out in the Environmental Policy of the ተግባራትን ያስተባብራል; Country are realized; ለ) በመንግሥትም ሆነ በግል የሚወጠኑ b) establish a system that enables ማህበራዊና ኢኮኖሚያዊ የልማት ፖሊሲዎች፣ undertaking environmental impact ሥልቶች፣ ሕጎች መርሐ ግብሮች እና assessment or strategic environmental ፕሮጀክቶች ላይ የአካባቢ ተጽእኖ ግምገማ assessment of social and economic ወይም ስልታዊ የአካባቢ ግምገማ ለማካሄድ development polices, strategies, laws, የሚያስችል ሥርዓት ይዘረጋል፤ ሥርዓቱ program and projects set by the በተግባር ላይ መዋሉንም ይከታተላል፤ government or private entities, and fololow up the implementation of same; ሐ) ማህበራዊ፣ ኢኮኖሚያዊና አካባቢያዊ ፍትህን c) prepare a mechanism that promotes በሚያራምድና ከሚገኘው ጥቅም ትልቁን social, economic and environmental ድርሻ በእርምጃው ለሚነኩ ማህበረሰቦች justice and channel the major part of the በሚያስገኝ አካሄድ ከደን ምንጣሮና ጉስቁልና benefit derived thereof to the affected ሊከተል ይችል የነበረውን የሙቀት አማቂ communities to reduce emissions of ጋዞች ልቀት የመቀነሻ ሥርዓት ያዘጋጃል፤ greenhouse gases that would otherwise have resulted from deforestation and forest degradation; መ) ለአየር ንብረት የማይበገር አረንጓዴ d) coordinate actions on soliciting the ኢኮኖሚን በየዘርፉና በየክልሉ ለመገንቢያ resources required for building a climate የሚውል ሃብት የሚያስገኙ ተግባራት resilient green economy in all sectors and ዝግጅትን ያስተባብራል፤ የአቅም ግንባታ at all Regional levels; provide capacity ድጋፍንና የምክር አገልግሎትን ይሰጣል፤ building support and advisory services on same;

ሠ) በአካባቢ ተፅዕኖ ግምገማ አዋጅ መሠረት e) establish a system for evaluating and ለልማት ፕሮጀክት እና ፕሮግራም የይሁንታ deciding on the impacts of implementing ፈቃድ ከመሰጠቱ በፊት የፕሮጀክቱ እና investment programs and projects on the ፕሮግራሙ ትግበራ በአካባቢ ላይ የሚያስከተለው environment, in accordance with the gA ፲ሺ፮፻፸፪ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10672 ፪ አሉታዊ ተፅዕኖ በሚመለከተው የዘርፍ የፈቃድ Environmental Impact Assessment ሰጪ አካል ወይም በሚመለከተው የክልል አካል Proclamation, prior to approvals of their ተገምግሞ ውሣኔ የሚሰጥበትን ሥርዓት implementation by the concerned sectoral ይዘረጋል፣ ትግበራውንም ያረጋግጣል፤ licensing organ or the concerned Regional organ; ረ) ኢትዮጵያ ከተፈጥሮ ሃብቶች መሠረት፣ f) prepare programs and directives for the ከበረሀማነት፣ ከደን፣ ከአደገኛ ኬሚካሎች፣ synergistic implementation and follow up ከኢንዱስትሪ ቆሻሻዎች እና ከሰው ሰራሽ of environmental agreements ratified by የአካባቢ አደገኛ ንጥረ ነገሮች ጋር በተያያዘ Ethiopia pertaining to the natural ያፀደቀቻቸው አህጉራዊና ዓለም አቀፋዊ resources base, desertification, forests, የአካባቢ ስምምነቶችን በየዘርፉና በየአስተዳደር hazardous chemicals, industrial wastes እርከኑ በመተግበር ወቅት የድግግሞሽ፣ የሃብት and anthropogenic environmental hazards ብክነትንና ክፍተትን ለማስቀረት የሚያስችሉ with the objective of avoiding overlaps, መርሐግብሮችን እና መመሪያዎችን ያዘጋጃል፤ wastage of resources and gaps during መተግበራቸውንም ይከታተላል፤ their implementation in all sectors and at all governance levels; follow up implementation of same; ሰ) በዓለም አቀፍ የአካባቢ እና የአየር ንብረት g) take part in the negotiations of ለውጥ ስምምነቶች ድርድር ላይ ይሳተፋል፣ international environmental and climate በዘርፉ አገራዊ ምላሽን በማስተባበሩ በኩል change agreements and, as appropriate, ቁልፍ ሚና ይጫወታል፣ እንደአግባቡ initiate the process for their ratification; ስምምነቶቹ እንዲፀድቁ ሃሳብ ያቀርባል፤ play a key role in coordinating the nationwide responses to the agreements; ሸ) ኢትዮጵያ አባል የሆነችባቸውን፣ ዓለም አቀፍ h) formulate or initiate and coordinate the የአካባቢ ውሎች ለመተግበር ተፈላጊ የሆኑ formulation of policies, strategies, laws, ፖሊሲዎችን፣ ስልቶችን፣ ሕጎችንና መርሐ guidelines and programs to implement ግብሮችን እንደሁኔታው ያዘጋጃል፣ ወይም international environmental agreements to እንዲዘጋጁ ሃሳብ ያመነጫል፣ አዘገጃጀታቸውን which Ethiopia is a party; and upon ያስተባብራል፤ ሲፈቀዱም በሥራ ላይ approval, ensure their implementation; መዋላቸውን ያረጋግጣል፤ ቀ) አደገኛ ንጥረ ነገሮችን ወይም ዝቃጮችን i) formulate environmental safety policies and ማምረትን፣ ወደ ሀገር ማስገባትን፣ አያያዝንና laws on the production, importation, አጠቃቀምን፣ እንዲሁም ሕያዋንን በዘረመል management and utilization of hazardous ምሕንድስና መለወጥን፣ ልውጥ ወይም ባዕድ substances or wastes, as well as on the ሕያዋንን ወደ አገር ማስገባትን፣ አያያዝንና development of genetically modified አጠቃቀምን የሚመለከቱ የአካባቢ ደህንነት organisms and the importation, handling and ፖሊሲዎችንና ሕጎችን ያዘጋጃል፣ በሥራ ላይ utilization of genetically modified መዋላቸውን ያረጋግጣል፤ organisms or alien species, and ensure their implementation; በ) በልማት ዕቅዶችና በኢንቨስትመንት መርሐ j) prepare or cause the preparation of ግብሮች ውስጥ የሚካተቱ የአካባቢ የአዋጪነት environmental cost benefit analysis and ማስሊያ ቀመሮችንና የስሌት ሥርዓቶችን formulate an accounting system to be ያዘጋጃል ወይም እንዲዘጋጁ ያደርጋል፤ በጥቅም integrated in development plans and ላይ የመዋላቸውን ሂደት ይከታተላል፤ investment programs, as the case may be, monitor their application; ተ) ዘላቂነት የጎደለው የተፈጥሮ ሀብቶች አጠቃቀም k) propose disincentives to discourage ልምድን፣ የአካባቢ ጉስቁልናን ወይም ብክለትን practices that may hamper the sustainable ለመከላከል በሚያስችሉ የመግቻ እርምጃዎች use of natural resources or incentives to ወይም የማበረታቻ ዘዴዎች መጠቀምን encourage prevention of environmental በተመለከተ ሃሣብ ያቀርባል፤ degradation or pollution;

gA ፲ሺ፮፻፸፫ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10673 ፫ ቸ) የአካባቢ መረጃ አሰባሰብን፣ አደረጃጀትን እና l) establish an environmental information አጠቃቀምን የሚያቀላጥፍ የአካባቢ መረጃ system that promotes efficiency in ሥርዓትን ይዘረጋል፤ environmental data collection, management and use; ኀ) የአካባቢና የደን አያያዝን፣ በጥቅም ማዋልንና m) coordinate, and as may be appropriate, carry ፍትሃዊ የጥቅም ተጋሪነትን የሚያራምድ out research and technology transfer እንዲሁም አረንጓዴ የሥራ ዕድልን የሚፈጥር activities that promotes the sustainability of ምርምርንና የቴክኖሎጂ ሽግግርንያስተባብራል the environment and the conservation and ፣እንደአስፈላጊነቱ ራሱ ያካሂዳል፤ use of forest as well as the equitable sharing of benefits accruing from them while creating opportunities for green jobs; ነ) አግባብነት ባላቸው የሕግ ድንጋጌዎች n) in accordance with the provisions of the መሠረት የአካባቢና የደን ጥበቃ ግዴታዎች relevant laws, enter any land, premises or መከበራቸውን ለማረጋገጥ በፌደራሉ ሥልጣን any other place that falls under the ሥር ወደሚገኝ ማንኛውም መሬት፣ ቅጥር Federal jurisdiction, inspect anything and ግቢ ወይም ሌላ ቦታ በመግባት ኃላፊነቱን take samples as deemed necessary with a ለመወጣት ተገቢ ሆኖ ያገኘውን ማንኛውንም view to discharging its duty and ነገር ይፈትሻል፣ ናሙናዎችን ይወስዳል፤ ascertaining compliance with the requirements of environmental protection and conservation of forest; ኘ) የአገሪቱን የአካባቢና የደን እንዲሁም ለአየር o) prepare and disseminate a periodic report ንብረት የማይበገር አረንጓዴ ኢኮኖሚን on the state of the country’s environment በሚመለከት ዘገባን በየወቅቱ እያዘጋጀ and forest as well as climate resilient ያሰራጫል፤ green economy; አ) መደበኛ ያልሆኑ የአካባቢ ትምህርት መርሃ p) promote and provide non-formal ግብሮችን ያስፋፋል፣ ትምህርቱን ይሰጣል፤ environmental education programs, and አካባቢያዊ ጉዳዮችን በመደበኛ ትምህርት cooperate with the competent organs with ሥርዓተ ትምህርት ውስጥ ለማካተት አግባብ a view to integrating environmental ካላቸው መሥሪያ ቤቶች ጋር ትብብር concerns in the regular educational ያደርጋል፤ curricula; ከ) አነስተኛና ሰፋፊ የደን ልማት፣ ቀርከሀን q) establish a system for development and ጨምሮ በግል፣ በወል ይዞታ እና በተፋሰስ utilization of small and large-scale forest ውስጥ እንዲለማና ጥቅም ላይ እንዲዉል including bamboo on private, communal ሥርዓት ይዘረጋል፣ትግበራውንም ያረጋግጣል፤ and watershed areas, and ensure implementation of same; ኸ) የሀገሪቱ የተፈጥሮ ደን እንዲጠበቅና r) establish a system for protection and, as እንደአስፈላጊነቱ ዘላቂ ጥቅም ላይ እንዲዉል the case may be, for sustainable ሥርዓት ይዘረጋል፣ትግበራውንም ያረጋግጣል፤ utilization of the natural forest resources of the country; and ensure its implementation; ወ) የተጎዱና የተራቆቱ የደን መሬቶች s) establish a system to rehabilitate degraded እንዲያገግሙና የአካባቢያዊና ኢኮኖሚያዊ forest lands and ensure its implementation ጠቀሜታቸው እንዲሻሻል ሥርዓት ይዘረጋል፣ to enhance their environmental and ትግበራውንም ያረጋግጣል። economic benefits. ፬. የስፖርት ኮሚሽን በዚህ አዋጅ ተቋቁሟል፤ 4. The Sport Commission is hereby established. ኮሚሽኑ የሚከተሉት ሥልጣንና ተግባራት The Commission shall have the powers and ይኖሩታል:- duties to: a) enable the public to participate in and ሀ) ሕዝቡን በስፖርት ለሁሉምና ባህላዊ ስፖርት benefit from sports-for-all and traditional ተሳታፊና ተጠቃሚ ያደርጋል፤ sports;

The powers and duties given to the ኢንቨስትመንትን በተመለከተ ለሆርቲካልቸርና Horticulture and Agriculture Investment ግብርና ኢንቨስትመንት ባለሥልጣን የተሰጡ Authority by the provision of other laws ሥልጣንና ተግባራት በዚህ አዋጅ ለግብርና currently in force pertaining to agricultural ሚኒስቴር ተሰጥተዋል፤ የሆርቲካልቸር ዘርፉን investment are hereby vested in the Ministry ልማት በተመለከተ ለባለሥልጣን መሥሪያ ቤቱ of Agriculture; those powers and duties የተሰጡ ሥልጣንና ተግባራት በዚህ አዋጅ pertaining to development of horticulture ለኢትዮጵያ ኢንቨስትመንት ኮሚሽን ተሰጥተዋል። sector are hereby vested in the Ethiopian Investment Commission.

gA ፲ሺ፮፻፸፮ Ød‰L ነU¶T Uz¤È qÜ_R ፰ ሕዳር ፳ qN ፪ሺ፲፩ ›.M Federal Negarit Gazette No. 8, 29th November, 2018 ....page 10676 ፰. የቴክኖሎጂና ኢኖቬሽን ኢንስቲትዩት በዚህ 8. The Technology and Innovation Institute is አዋጅ ተቋቁሟል። በሚኒስትሮች ምክር ቤት hereby established. The powers and duties ደንብ ቁጥር ፪፻፶፯/፪ሺ፬ ዓ.ም ለሳይንስና given to the Science and Technology ቴክኖሎጂ ኢንፎርሜሽን ማዕከል ተሰጥተው Information Center under Council of የነበሩ ሥልጣንና ተግባራት ሁሉ በዚህ አዋጅ Ministers Regulations Number 247/2011 is hereby vested in the Institute. ለቴክኖሎጂና ኢኖቬሽን ኢንስቲቲዩት ተሰጥተዋል። ፱. የጂኦስፓሻል ኢንፎርሜሽን ኢንስቲቲዩት በዚህ 9. The Geospatial Information Institute is አዋጅ ተቋቁሟል። በኢትዮጵያ ጂኦስፓሻል hereby established. The powers and duties ኢንፎርሜሽን ኤጀንሲ እንደገና ማቋቋሚያ given to the Geospatial Information Agency አዋጅ ቁጥር ፩ሺ፸፱/፪ሺ፲ ዓ.ም ለጂኦስፓሻል under its establishment Proclamation Number ኢንፎርሜሽን ኤጀንሲ፣ እንዲሁም ጂኦስፓሻል 1079/2018 and powers and duties given to ዳታና መረጃን በተመለከተ በኢንፎርሜሽን the Information Network Security Agency መረብ ደህንነት ኤጀንሲ እንደገና ማቋቋሚያ under Proclamation Number 808/2013 are አዋጅ ቁጥር ፰፻፰//፪ሺ፮ ዓ.ም ለኢንፎርሜሽን hereby vested in the Institute. መረብ ደህንነት ኤጀንሲ ተሰጥተው የነበሩ ሥልጣንና ተግባራት ለጂኦስፓሻል ኢንፎርሜሽን ኢንስቲቲዩት ተሰጥተዋል። ፲. የገቢዎች ሚኒስቴር በዚህ አዋጅ ተቋቁሟል። 10. The Ministry of Revenues is hereby በኢትዮጵያ ገቢዎችና ጉምሩክ ባለሥልጣን established.
