4. Objective የባለሥልጣኑ ዓላማ ምግብ፣ መድሐኒት፣ የህክምና The objective of the Authority shall be to protect መሣሪያ፣ ደምና የደም ተዋጽዎ፣ ባሕላዊ፣ ተደጋጋፊ the public health by regulating food, medicine ወይም አማራጭ መድሐኒት፣ የውበት መጠበቂያ፣ and medical devices, blood and blood products, ትምባሆ፣ የጥራት አገልግሎት ሰጪ፣ ባዩኢኩቫለንስ traditional, complementary or alternative ማዕከል እና ባለሥልጣኑ ቁጥጥር እንዲያደርግ medicine, cosmetics, tobacco, quality control ሥልጣን የተሰጠውን ሌላ ምርት እና አገልግሎት service provider, bioequivalence centers and በመቆጣጠር የሕብረተሰቡን ጤና መጠበቅ ነው፡፡ other products and services entrusted to the Authority to regulate. ፭. ሥልጣንና ተግባር 5. Powers and Duties ባለስልጣኑ የሚከተሉት ሥልጣንና ተግባራት The Authority shall have the following powers ይኖሩታል፡፡ and duties. 1/ Initiate and submit to the ministry a policy, ፩/ ቁጥጥር የሚደረግበትን ምርት፣ የጥራት ቁጥጥር strategy and law ideas in regulatory አገልግሎት ሰጪ፣ ባዩኢኩቫለንስ ማዕከል እና perspective for Regulation of regulated ባለሥልጣኑ ቁጥጥር እንዲያደርግ ስልጣን product, quality control service provider, የተሰጠው ሌላ ምርት እና አገልግሎት በተመለከተ bioequivalence centers and other products ከቁጥጥር ዓላማ አንጻር የፖሊሲ፣ እስትራቴጂ እና and services entrusted to the Authority; enforce ያስፈጽማል፤ የብሔራዊ ደረጃ ሀሳብ ያመነጫል፣ Ethiopian mandatory standards; initiate national standards and implement same upon ሲጸድቅ ተግባራዊ ያደርጋል፤ approval; ፬/ ቁጥጥር የሚደረግበት ምርት አስመጪ፤ ላኪ፤ የጥራት 4/ Issue certificate of competency or special ቁጥጥር አገልግሎት ሰጪ ተቋም፤ ባዩኢኩቫለንስ regulatory license to importer, exporter, for cross regional purpose manufacturer or ማዕከል፤ ምርትን ከአንድ ክልል በላይ ለሚያቀርብ wholesaler of regulated products, quality አምራች እና አከፋፋይ የብቃት ማረጋገጫ ምስክር control service provider and bioequivalence ወረቀት ወይም ልዩ የቁጥጥር ፈቃድ ይሰጣል፤ centers; ፭/ በባለሥልጣኑ እውቅና ገበያ ውስጥ እንዲገባ የተደረገን 5/ Inspect, investigate, including retail, any ወይም ህገ ወጥ የሆነ ቁጥጥር የሚደረግበት ምርት place or establishment in regions and collect በተመለከተ የችርቻሮ ተቋምን ጨምሮ በክልል ባለ sample of regulated products that entered በማንኛውም ቦታ ወይም ተቋም ውስጥ ገብቶ into the market with authorization of the ምርቱን በሚመለከት የቁጥጥር ምርመራ ያደርጋል፣ Authority or illicit product; የጤና ማስጠንቀቂያ፣ ገላጭ ጽሑፍ፣ ማስታወቂያና ተያያዥ ጉዳዮችን ቁጥጥር ያደርጋል፤ ፲፬ሺ፮፻፸፭ gA Ød‰L ነU¶T Uz¤È qÜ_R ፲፭ የካቲት ፳፬ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 15, 3rd March, 2023 …page 14675 ፱/ የተመዘገበ ወይም ዕውቅና ያለው ወይም ህገ-ወጥ 9/ Notify and create awareness, as appropriate, ምርት፣ ተቋም፣ የተወሰደ አስተዳደራዊ እርምጃና to the public and stakeholders about የባለሥልጣኑን ተግባር በተመለከተ እንደአግባብነቱ registered or authorized or illicit products, ለህዝብና ባለድርሻ አካላት ያሳውቃል፤ የግንዛቤ establishments, administrative measures ማስጨበጥ ሥራ ይሰራል፤ taken and the Authority`s regulatory functions; ፲/ ቁጥጥር በሚደረግበት ምርት የደረሰ ድንገተኛ አደጋ 10/ Establish response system, perspective to ከቁጥጥር አንጻር ምላሽ ለመስጠት የሚያስችል regulatory, to emergency caused by a ሥርዓት እንዲሁም ቁጥጥር የሚደረግበት ምርት regulated product; establish a system that ለድንገተኛ አደጋ ምላሽ ስለሚውልበት አግባብ enables utilization of regulated product for ሥርዓት ይዘረጋል፤ ከሚመለከታቸው አካላት ጋር emergency response; work in collaboration በትብብር ይሰራል፤ with concerned bodies; ፲፩/ መሠረታዊ መድሐኒቶች፣ በድንገተኛ አደጋ ጊዜ 11/ Issue, revise essential medicine list, list of ጥቅም ላይ መዋል ስለሚችሉ መድሐኒቶች፣ እና ያለ medicine to be utilized for emergency; ማዘዣ ጥቅም ላይ ስለሚውሉ መድሐኒቶች ዝርዝር and over counter medicine list; ያወጣል፣ ይከልሳል፤ ፲፪/ የምግብ ጭማሪ ዝርዝር ያወጣል፤ ብሔራዊ 12/ Issue food additive list; issue national የመድኃኒት ቀመር ያወጣል፤ መድሐኒቶችን medicine formulary; categorize medicines በተለያዩ መደቦች ይከፍላል፣ ይከልሳል፤ into different categories; ፲፫/ በመድሐኒት ችርቻሮ ተቋማት ደረጃቸውን መሰረት 13/ Issue list or categorize medicines to be በማድረግ መያዝ የሚገባቸውን መድሐኒቶች መደብ possessed by retail medicine ወይም ዝርዝር ያወጣል፤ establishment in their respective level; ፲፬/ የመድሐኒት እና የህክምና መሣሪያን አግባባዊ 14/ Work with concerned bodies on the አጠቃቀም ተግባራዊ እንዲሆን ከሚመለከታቸው implementation of rational use of አካላት ጋር በትብብር ይሰራል፤ medicine and medical device; ፲፭/ የናርኮቲክ መድሐኒት፣ የሳይኮትሮፒክ ንጥረ ነገር 15/ Regulate manufacturing, importing, እና የፕሪከርሰር ኬሚካልን አመራረት፣ ወደ ሀገር exporting, wholesaling, distributing, ውስጥ ማስገባት፣ ወደ ውጭ አገር መላክ፣ ማከፋፈል፣ prescribing, dispensing, using, recording, ስርጭት፣ አስተዛዘዝ፣ እደላ፣ አጠቃቀም፣ መረጃ reporting and disposal of narcotic drug, psychotropic substance and precursor አያያዝ፣ ሪፖርት አደራረግ እና አወጋገድ ላይ chemical, and prevent their abuse; ቁጥጥር ያደርጋል፤ አላግባብ ሥራ ላይ እንዳይውሉ ይከላከላል፤ gA ፲፬ሺ፮፻፸፮ Ød‰L ነU¶T Uz¤È qÜ_R ፲፭ የካቲት ፳፬ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 15, 3rd March, 2023 …page 14676 ፲፮/ የሕክምና ሙከራ ጥያቄዎችን በመገምገም ይፈቅዳል፣ 16/ Evaluate clinical trial request and ሙከራው በተፈቀደለት አግባብና በመልካም authorize; monitor and inspect to ensure የሕክምና ሙከራ ሥርዓት መሠረት መካሄዱን the trail performed in accordance with the authorization and good clinical trial ይቆጣጠራል፤ ውጤቱን በመገምገም ለኅብረተሰቡ practice; evaluate and authorize the use of ጥቅም በሚኖረው መልኩ ሥራ ላይ እንዲውል the result in such a way it benefits the ይፈቅዳል፤ አስፈላጊ ሲሆን በማንኛውም ጊዜ public; when necessary, order at any time, የሕክምና ሙከራው እንዲታገድ ወይም እንዲቋረጥ the clinical trial to be suspended or ትእዛዝ ይሰጣል፤ terminated; ፲፯/ የድህረ-ገበያ ቅኝት ያካሂዳል ወይም እንዲካሄድ 17/ Undertake or order post market ያዛል፤ በቅኝቱ ውጤት መሠረት አግባብ ያለውን surveillances; take appropriate measures እርምጃ ይወስዳል፤ based on the result of the surveillance; ፲፰/ በዓለም ጤና ድርጅት፣ ጥብቅ የቁጥጥር ሥርዓት 18/ Adopt and implement, as appropriate, ባለው ተቋም፣ ኢትዮጵያ ባደረገችው የሁለትዮሽ criteria, standard, methods, ወይም የጋር ስምምነት፣ ባለሥልጣኑ ባደረገው pharmacopeia, manufacturer`s in house የትብብር መግባቢያ ማዕቀፍ ወይም ሌላ ዓለም method or criteria adopted or activity undertaken by the World Health አቀፍ ተቋም አማካኝነት የወጣ መስፈርት፣ ደረጃ፣ Organization, stringent regulatory ዘዴ፣ መፅሐፈ መድሐኒት፣ የአምራች የምርመራ ዘዴ authority, mutual or multi-lateral ወይም መስፈርት ወይም የተከናወነ የቁጥጥር ተግባር agreement entered by Ethiopia or other እንዳግባብነቱ ይቀበላል፤ ይተገብራል፤ ‹ International Organization relevant to its ፲፱/ ቁጥጥር የሚደረግበት ምርት ደህንነት ክትትል regulatory works; 19/ Conduct safety monitor of regulated ያደርጋል፣ መረጃ ያሰባስባል፤ በዓለም አቀፍ ደረጃ products, collect information; follow-up ክትትል የሚደረግበት ምርት ላይ ያሉ የመድሐኒት evidence of existing and new adverse ነባር እና አዲስ ጎጂ ክስተቶች እና መረጃዎችን events and information about globally ይከታተላል፤ ጥቅም ላይ መዋል የማይገባው ምርት monitored products; notify the public ሲኖር ሕብረተሰቡ እንዳይጠቀም ያሳውቃል፤ where there is product not to be used, አግባብነት ያለውን እርምጃ ይወስዳል፤ take the appropriate measure; ፳/ ክልል ተሻጋሪ በሆነ የማስታወቂያ መንገድ የሚተላለፍ 20/ Regulate cross regional advertisement of ቁጥጥር የሚደረግበት ምርትን የሚመለከት regulated products in cooperation with ማስታወቂያን አግባብ ካለው አካል ጋር በመሆን the concerned body; regulate promotion ይቆጣጠራል፤መድሐኒትና የሕክምና መሳሪያ of medicine and medical device with በፕሮሞሽናል ቁስ እና በባለሙያ ስለሚተዋወቅበት promotional materials and professionals; አግባብ ይቆጣጠራል፤ gA ፲፬ሺ፮፻፸፯ Ød‰L ነU¶T Uz¤È qÜ_R ፲፭ የካቲት ፳፬ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 15, 3rd March, 2023 …page 14677 ፳፩/ ለትምባሆ ምርት ንግድ ስራ ልዩ የቁጥጥር ፈቃድ 21/ Issue tobacco product special regulatory ይሰጣል፣ የትምባሆ ምርት ይዘት፣ መረጃን ይፋ license; regulate the content and product ማድረግ፣ አመራረት፣ አስተሻሸግ፣ ገላጭ ጽሁፍ፣ ወደ disclosure, manufacturing, packaging, labeling, design, import, storage, ሀገር ውስጥ ማስገባት፣ ጅምላ መሸጥ፣ ማከፋፈል፤ distribution, advertisement, promotion የማስተዋወቅ፣ ፕሮሞት የማድረግ እና ስፖንሰርሺፕ and sponsorship, report, and related ክልከላ፣ ሪፖርት እና ተያያዥ የትምባሆ ምርት aspects of tobacco products in line with ቁጥጥር ጉዳዮችን በአዋጁና አዋጁን ለማስፈጸም the World Health Organization በሚወጡ ሕጎች፣ በዓለም የጤና ድርጅት የትምባሆ Framework Convention on Tobacco ቁጥጥር ማዕቀፍ ኮንቬንሽን እና የኮንቬንሽኑን Control and its implementing guideline; ማስፈጸሚያ ጋይድላይን መሠረት ይቆጣጠራል፤ ሕገ- ወጥ ምርት ከሚመለከታቸው አካላት ጋር በመሆን ይከላከላል፤ ተገቢውን እርምጃ ይወስዳል፤ ፳፪/ በትምባሆ ቁጥጥር ላይ የወጣውን የዓለም ጤና 22/ Coordinate the implementation of the ድርጅት የትምባሆ ቁጥጥር ማዕቀፍ ኮንቬንሽን እና World Health Organization Framework የኮንቬንሽኑን ማስፈጸሚያ ጋይድላይንና ፕሮቶኮል Convention on Tobacco Control and its አፈጻጸም ያስተባብራል፤ የትምባሆ ቁጥጥርን implementing guideline; establish ውጤታማነት የሚከታተል አስተባባሪ አካል national coordinating mechanism to follow-up effective implementation of እንዲመሠረት ያደርጋል፤ tobacco control; ፳፫/ ቁጥጥር ከሚደረግበት ምርት ጋር በተያያዘ አግባብነት 23/ Concerning regulated products, search ባለው ሕግ መሠረት በፍርድ ቤት ወይም ያለፍርድ any establishment, place, vehicles, ቤት ትዕዛዝ ማንኛውንም ተቋም፣ ቦታ፣ ተሸከርካሪ፣ premises or other places and things with ግቢ ወይም ሌላ ነገር እና ቦታ ይፈትሻል፤ አግባብነት or without court order as provided by the ያለውን እርምጃ ይወስዳል፤ relevant law; serve as a regulatory information center; ፳፮/ የቁጥጥር ተግባሩን ለማከናወን አስፈላጊ የሆኑ 26/ Organize laboratories necessary for the ላቦራቶሪዎችን ያደራጃል፤ execution of its regulatory function; ፳፯/ ለሚያከናውናቸው ሥራዎች ዕውቅና ባለው አገራዊ 27/ Accept, as it deemed necessary, quality assurance report, inspection report, ወይም ዓለም አቀፍ ተቋም የተከናወነ የሦስተኛ ወገን declaration and laboratory result conducted የጥራት ሪፖርት፣ የኢንስፔክሽን ሪፖርት፣ መግለጫ by accredited National or International እና የላብራቶሪ ምርመራ ውጤት እንዳስፈላጊነቱ organization for activities it undertakes; ይቀበላል፤ 28/ Where the Authority suspect that a regulated ፳፰/ ቁጥጥር የሚደረግበት ምርት በሕግ የሚጠየቅን product is non-compliant to the criteria or መስፈርት ወይም ደረጃ ያላሟላ ወይም ህገ-ወጥ ምርት standard or it is illicit product; seize, collect ስለመሆኑ ሲጠረጥር እንዳግባብነቱ ምርቱን ይይዛል፣ sample, investigate; order for recall or return ናሙና ይወስዳል፤ ምርቱ ከገበያ እንዲሰበሰብ፣ ወደ to the country imported from, the product to መጣበት አገር እንዲመለስ፣ ተለይቶ እንዲቀመጥ be kept separately; ‹‹ gA ፲፬ሺ፮፻፸፱ Ød‰L ነU¶T Uz¤È qÜ_R ፲፭ የካቲት ፳፬ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 15, 3rd March, 2023 …page 14679 ፴፫/ የቁጥጥር ሕግ ጥሰት ለፈጸመ ሰው የጽሑፍ 33/ Issue warning letter, suspend or revoke ማስጠንቀቂያ ይሰጣል፤ የብቃት ማረጋገጫ፣ ልዩ certificate of competency, special license or ፈቃድ ወይም ባለሥልጣኑ የሰጠው ሌላ ፈቃድን other license issued by the Authority, enlist into black list person engaged into illicit ያግዳል፤ በሕገ ወጥ ንግድ ላይ የተሳተፈ ሰውን trade, order recall, disposal; ፴፮/ የባለሥልጣኑ ሠራተኛ ወይም ባለሥልጣኑ ሥራ ላይ 36/ Establish working procedures of code of የሚሳተፍ ባለሙያ ሥነ-ምግባር፤ አለባበስ፣ conduct, dressing code, participation in የመልካም አመራረት ሥርዓት ምርመራ እና የጥራት good manufacturing practices and ምርመራ ተሳትፎና ተያያዥ ተግባራትን በተመለከተ laboratories and other related activities of የአሰራር ሥርዓት ይዘረጋል፤ the employee of the Authority or professionals engaged in the Authority`s task; Organization of the Authority ባለሥልጣኑ፡- The Authority shall have: ፩/ አማካሪ ቦርድ (ከዚህ በኋላ “ቦርድ” እየተባለ 1/ Advisory Board (hereinafter the `Board`), የሚጠራ)፣ 2/ A Director General and as necessary, Deputy ፪/ በመንግስት የሚሾም ዋና ዳይሬክተር እና Director Generals to be appointed by the እንዳስፈላጊነቱ ምክትል ዋና ዳይሬክተሮች፣ እና Prime Minister, and ፫/ አስፈላጊ የሆኑ ሠራተኞች ይኖሩታል፡፡ 3/ 3/ The necessary staff. ፯. ስለአማካሪ ቦርዱ አባላትና ተጠሪነት 7. 8. 10. Powers and Functions of Deputy Director Generals ምክትል ዋና ዳይሬክተር፡- The Deputy Director Generals shall: ፩/የዘርፉን ተግባራት በማቀድ፣ በማደራጀት፣ 1/ Assist the Director General in planning, በመምራት እና በማስተባበር ዋና ዳይሬክተሩን organizing, directing and coordinating the ያግዛል ፤ activities of the Authority; ፪/ በዋና ዳይሬክተሩ ተለይተው የሚሰጠውን ሥራ 2/ Perform other activities specifically assigned ያከናውናል፤ to him by the Director General, ፫/ ዋና ዳይሬክተሩ በማይኖርበት ጊዜ ተክቶ ይሰራል፤ 3 Perform duties of Director General in his absence, ፬/ ዋና ዳይሬክተሩ በተለይ ካልወከለ በሹመት 4/ A Deputy Director General with the longest ቅድሚያ ያለው ምክትል ዋና ዳይሬክተር ዋና tenure shall act in place of the Director ዳይሬክተሩን ወክሎ ይሰራል፡፡ General in the absence of explicit delegation by Director General. ፲. በጀት

13. Budget የባለሥልጣኑ በጀት በመንግሥት የሚመደብ ይሆናል። The budget of the Authority shall be allocated by the Government. ፲፩. የገቢ ምንጭ 14. Revenue Source የባለሥልጣኑ የገቢ ምንጭ፦ Revenue source of the Authority shall be; 1/ Grant from Domestic or Abroad, and ፩/ ከአገር ውስጥም ሆነ ከውጭ አገር የሚገኝ ድጋፍ፣ እና 2/ Source generated through service it ፪/በሚያከናውናቸው አገልግሎቶች የሚሰበስበው provides. ገንዘብ፤ይሆናል። ፲፪. ስለ ሒሣብ መዛግብት 15. Transfer of Rights and Obligations በሚኒስትሮች ምክር ቤት ደንብ ቁጥር ፩፻፹፱/፪ሺ፪ The rights and obligations of the Ethiopian ተቋቁሞ የነበረው የኢትዮጵያ የምግብ፣ የመድሐኒት Food, Medicine and Healthcare Administration and Control Authority established under the እና የጤና ክብካቤ አስተዳደርና ቁጥጥር ባለሥልጣን Council of Ministers Regulation No. 189/2010 ያገኘው መብትንና የገባው ግዴታ በዚህ ደንብ shall be transferred to the Authority by this ለባለሥልጣኑ ተላልፈዋል፡፡ Regulation. ፲፬. ስለ ተሻረ ሕጎች

17. Repealed Law የኢትዮጵያ የምግብ፣ የመድሐኒት እና የጤና ክብካቤ The Ethiopian Food, Medicine and Healthcare አስተዳደርና እና ቁጥጥር ባለሥልጣን ማቋቋሚያ Administration and Control Authority የሚኒስትሮች ምክር ቤት ደንብ ቁጥር ፩፻፹፱/፪ሺ፪ Establishment Council of Ministers Regulation በዚህ ደንብ ተሽሯል፡፡ No. 189/2010 is hereby repealed. ፲፭.ተፈጻሚነታቸው ስለሚቀጥሉ ሕጎች 18. Laws Continued in Effect Directives, manuals and working procedures በኢትዮጵያ የምግብ፣ የመድሐኒት እና የጤና ክብካቤ issued by the Ethiopian Food, Medicine and አስተዳደርና ቁጥጥር ባለሥልጣን ወጥተው ሥራ ላይ Healthcare Administration and Control Authority ያሉ መመሪያዎች፣ ማኑዋሎች እና አሰራሮች shall be considered as issued by the Authority and እስካልተቀየሩ ድረስ በባለሥልጣኑ እንደወጡ ተቆጠሮ continue to have effect until replaced. ተፈጻሚነታቸው የሚቀጥል ይሆናል፡፡ ፲፮.ደንቡ የሚፀናበት ጊዜ 19.
