"community consent" means the prior informed c,onsent given by local communities> in accordance with Article 7(1 ) (a) of the Proclamation, to allow access to their community knowledge; 7. ' 'Institute" means the [nstitute of Biodiversity Conservarion establ ished by Proclamatitm No, l.20/ 1998 (as amended); 8. " International Treaty" means· the International Treaty on Plant Genetic Resources for Food and /1\griculture which was adopted on the 3' d day of November 2001 at the Thirty-First Conference of the rood and Agriculture Organization of the IUnited Nations, and which Ethiopia ratified by Proclamation No. 330/2003, 9. ";multilateral syste1n of access•· means the system established in accordance with Artic le 10 of the lntemadonal Treaty in order to facil itatc the access to, and a fair and equitable sharing of the be11elits arising from the utilization of , plant genet1c resources for food aud agriculture; I 0. "Proclamation·· means the Access to Genetic Resources and Community Knowledge, and Community Rights Proclamation No. 482/2006; l 1. "relevant regional body" means an organ of a regional state having the po,\ler and responsibility to administer genetic resources and/or commllllity knowledge in the region; 1.1. PROCEDURE OF ACCESS SECTION ONE PROCEDURE FOR COMMERCIAL ACCESS 3. Submission of Access Application· The access application to be submitted pursuant to Article 14 (' 1) of the Proclamation to access genetic resources and/or community knowledge shall be presented in accordance with the form specified in Annex-I of this Regulation. 4. Admission of Access Application Upon submission of an access application, the '°·'I Institute shall: 1. admit the access application and register it. in the access register, if it ascertains that the access application contains all the information required in Annex-I of this Regulation; or 2. return the access application to the applicant to be ,t·.. completed, stating the information missing, i( it /. ascertains that the access application does not contain all the information required in Annex-I of this Regulation. 5. Examination of Access Application I. The Institute shall, based on the provisions of the Proclamation and access agreements concluded hitherto, examine the access application admitted under Article -4 of this Regulation and determine whether it may be granted or should be denied. 2. Having examined the access application, the Institute shall : (a) if it ascertains that there is sufficient ground to deny the proposed access, deny the proposed access and communicate the same to the applicant in writing stating the reasons for the denial; or (b) if it ascertains that there is no ground sufficient to deny the intended access, give public notice of the access application. www.abyssinialaw.com .., 'I?, ?;'li.r.·ii l,,.,l' .. t-~ )?t·)· .?11.'' The public notice referred lo in sub-article (1) of this A1ticle shall contatn the following pa.rt·iculars: (a) the idenlity and other necessary particulars of the appllcant; (b) the description of the proposed genetic resl'>urce anti/or the communfty knowledge: and (c) the proposed use of lhc genetic resource and/or the community knowledge. J . Any· person may lodge objection against, or give comn1en1 on, the access application within 30 day:s From the date of its publication. 4. The Institute may, as appropriate. also ask for the opinion of relevant institutions on the access application. 7, P11blici1y of Acce.1,, Information Any iinformation communicated to the lastilUte in 1.hc course of access application or in the course of monitoring access shall be public and may be consulted by any interested person. 8. Ccmfidenltal Information I. Notwithstanding the provisions of Anicle 7 or Ibis Regulation, the Institute may, upon acceptable justificalion, grant confidential wreatment, for a period of nol more than I 0 years, to the infonnation which shall be c!ommunicatcd to ll in the course of access mpplication or monitoring access and which has not been divulged and could be used for disloyal commercial purposes by third parties. Confidential lnformation may not be communicated to third parties except upon court order, explry of the perio(i of confidenlialhy, or mutual agreement of lhe parties. 2. Notwlttistanding the provisions of sub-anicle (I) of this Article, the lnstitule may disclose confidenttal information to its employees or consultants for purpose of evaluation; provided however, tnat it shall make i1s employees and consultams aware of the confidcmialit)' of the information. 10. Act~ess Decision Upon the expiry of the time limit se1 for submission of objection and oplnion. and having examined the public objections and opinions submitted, if any, the Institute shall: (a) if 1t ascertains that there exists a suffi~ient ground to deny the pi;oposed access. • I(. • . Notwithstanding the provisions of sub-article (I) of this Article, where the Institute ascertains chat Ethiopian higber learning or research institution or an inter-governmental institution baJSCd in Ethiopia, can not undertake the research in Ethiopia, it may sta[e in [he access p(:rrnit that it can expon genetic resources out or Ethiopia.
