Box ማውጫ ደንብ ቁጥር 49/1999 ዓ.ም በአማራ ብሔራዊ ክልላዊ መንግስት የሊዝ ስርዓት ተግባራዊ የሚሆንባቸው ተጨማሪ ከተሞች መወሰኛ ክልል ምክር ቤት ደንብ CONTENTS Regulation No.49/2007 The Amhara National Regional State Lease System to be operative in Additional Cities Determination, Council of Regional Government Regulation. ደንብ ቁጥር 49/1999 ዓ.ም በአማራ ብሔራዊ ክልላዊ መንግስት የሊዝ ስርዓት ተግባራዊ የሚሆንባቸውን ተጨማሪ ከተሞች ለመወሰን የወጣ ክልል ምክር ቤት ደንብ REGULATION NO.49/2007 A COUNCIL OF REGIONAL GOVERNMENT REGULATION ISSUED TO PROVIDE FOR THE DETERMINATION OF THE LEASE SYSTEM TO BE OPERATIVE IN ADDITIONAL CITIES IN THE AMHARA NATIONAL REGIONAL STATE. የከተማ ቦታ የመንግስትና የህዝብ ንብረት ሆኖ የይዞታና የመጠቀም መብቶችን ለተጠቃሚዎች WHEREAS, it has been enacted that Urban land is the property of the State and the public and that lease has been to be operated as cardinal land holding-system to ባህር ዳር ጥር 25 ቀን 1999 ዓ.ም Bahir Dar 2 nd February, 2007 12ኛ ዓመት ቁጥር 10 12th Year No 10 www.abyssinialaw.com gI 2 ZKr -HG Uz¤È qÜ R 10# R 25 qN 1999 ›.M Ziker Hig Gazette No 10 2nd February, 2007, page 2 በማስተላፍ ረገድ የሊዝ ስርዓት ዋነኛ የመሬት ስሪት ሆኖ እንዲሠራበት አስቀድሞ በህግ የተወሰነ በመሆኑ፤ transfer rights of land holding and its use to users; መሬት ነክ ንብረቶች ሊኖራቸው የሚገባውን የይዞታ ዘመንና የልማት ሥራ ወጭ መመለሻ የጊዜ ወሰን በዝርዝር ህግ በመደንገግ በተጨማሪ አካባቢዎች የከተማ ቦታ በሊዝ የሚተላለፍበትንና አጠቃቀሙ ልማት ተኮር የሚሆንበትን አመቺ ሁኔታ መፍጠር በማስፈለጉ፤ WHEREAS, it has been necessary to create favorable conditions that Urban land is to be transferred by lease and to make its utilization productive in additional localities by providing, in specific law, the period of holding that landed properties may have and the period it requires to recover investment cost; የአማራ ክልል መስተዳድር ምክር ቤት በተሻሻለው የብሔራዊ ክልሉ ህገ-መንግስት አንቀጽ 58 ንዑስ አንቀጽ 7፣ የከተማ ቦታን በሊዝ ስለመያዝ ተሻሽሎ በወጣው የፌዴራሉ መንግስት አዋጅ ቁጥር 272/1994 ዓ.ም አንቀጽ 3 ንዑስ አንቀጽ 2 ፊደል ተራ ቁጥር ለ እና ይህንኑ ለማስፈፀም በወጣው የክልል ምክር ቤት ደንብ ቁጥር 6/1994 ዓ.ም አንቀጽ 3 ንዑስ አንቀጽ 2 ድንጋጌዎች ስር በተሰጠው ስልጣን መሠረት ይህንን ደንብ አውጥቷል። NOW, THEREFORE, the Council of the Amhara National Regional Government, in accordance with the powers vested in it under the provisions of Art.58, Sub. Art. 7 of the Revised Regional constitution and sub. Art. 2(B) of Art.3 of the Urban Lands Lease Holding of the Revised Federal Proclamation No.272/2004 and Sub. Art.2 of Art.3 of the Amhara National Regional Council Regulation No.6/2004 issued for executing this proclamation, hereby issues this regulation. 1. አጭር ርዕስ 1. Short Title ይህ ደንብ “የሊዝ ስርዓት ተግባራዊ የሚሆንባቸው ተጨማሪ ከተሞች መወሰኛ ክልል መስተዳድር ምክር ቤት ደንብ ቁጥር 49/1999 ዓ.ም” ተብሎ ሊጠቀስ ይችላል። This regulation may be cited as “The Lease System Operative Additional Cities Determination, Council of Regional Government Regulation No.49/2007.” 2. ወደ ሊዝ ስርዓት የሚገቡ ተጨማሪ ከተሞችን ስለመወሰን 2. Determination of Additional Cities to be included to Lease System www.abyssinialaw.com gI 3 ZKr -HG Uz¤È qÜ R 10# R 25 qN 1999 ›.M Ziker Hig Gazette No 10 2nd February, 2007, page 3 1. በብሔራዊ ክልሉ ውስጥ ከዚህ በታች በተመለከቱት ከተሞች ይህ ደንብ ከፀናበት ጀምሮ የሊዝ ስርዓት ተግባራዊ እንዲሆን ተወስኗል። ሀ/ የደብረ ብርሃን ከተማ አስተዳደር ለ/ የደብረ ማርቆስ ከተማ አስተዳደር ሐ/ የወልዲያ ከተማ አስተዳደር መ/ የቻግኒ ከተማ አስተዳደር ሠ/ የላሊበላ ከተማ አስተዳደር 1. It has been determined that lease system is to be operative on the following cities in the National Region on the date of coming into force of this regulation. A. Debre Birhan City Administration; B. Debere Markos City Administration; C. Woldia City Administration; D. Chagni City Administration; E. Lalibela City Administration. 2. በዚህ አንቀጽ ንዑስ አንቀጽ 1 ስር የሰፈረው ድንጋጌ ቢኖርም ይህ ደንብ ከመጽናቱ በፊት በተጠቀሱት ከተሞች ውስጥ በህጋዊ መንገድ ተይዘው የቆዩ የቦታ ይዞታዎች በነባር ይዞታ ማስተዳደሪያ ደንብ መሠረት መተዳደራቸውን ይቀጥላሉ፤ 2. Notwithstanding to provision of sub.Art.1 of this Article, landholdings legally (lawfully) held in the indicated cities before the coming into force of this regulation shall continue to be administered in accordance with formerly held administrative regulation. 3. በዚህ አንቀጽ ንዑስ አንቀጽ 2 ስር የተደነገገው እንደተጠበቀ ሆኖ በሚከተሉት ሁኔታዎች ውስጥ የሚገኙ የከተማ ቦታ ይዞታዎች በዚህ ደንብ መሠረት ወደ ሊዝ ስርዓት እንዲሸጋገሩ ይደረጋል፦ 3. Without prejudice to the provision of Sub.Art.2 of this Article, urban landholdings which are under the following circumstances shall be transferred into lease system, pursuant to this regulation hereof; ሀ/ በማናቸውም ሁኔታ በነባር ይዞታ ላይ የሚደረግ የመጠን ለውጥ የተጨማሪ ቦታ ግዥ ወይም የካዳስተር ቦታ ጭማሪ፣ A. Any change of dimensions made on formerly occupied holdings, procurement of supplementary lands or supplementary of cadastre land; ለ/ በማናቸውም መንገድ የሚፈፀም የቦታ ይዞታ ማስተላለፍ። B. Grading the Status of Cities and Status of Land Site ለሊዝ ስርዓት ተግባራዊነት የተመቻቸ ሁኔታን ለመፍጠር ይቻል ዘንድ ከዚህ በላይ በተመለከቱት ከተሞች ውስጥ የከተማ ደረጃን፣ የቦታ ደረጃንና የሊዝ መነሻ ዋጋን አስመልክቶ የክልሉ መስተዳድር ምክር ቤት ያወጣው መመሪያ ቁጥር 23/1998 ዓ.ም ተፈፃሚ ይሆናል። Directive No.23/2006 issued by the Council of Regional Government shall be applicable concerning status of cities, grades of the land sites and minimum lease price of the cities indicated here in above with the view to creating favorable conditions for the lease system effectiveness. 4. ደንቡ የሚፀናበት ጊዜ 4. Effective Date ይህ ደንብ በክልሉ መንግስት ዝክረ-ህግ ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የፀና ይሆናል። This regulation shall come into force as of the date of its publication in the Zikre-Hig Gazette of the Regional State ባህር ዳር ጥር 25 ቀን 1999 ዓ.ም አያሌው ጐበዜ የአማራ ብሔራዊ ክልላዊ መንግስት ርዕሰ መስተዳድር Done at Bahir Dar This 2 nd day of February, 2007 Ayalew Gobezie Head of Government of the Amhara National Regional State www.abyssinialaw.com
