2021 FORESTRY AND WILDLIFE ACT 4 (AMENDMENT) COMMONWEALTH OF DOMINICA ACT NO. 4 OF 2021. I assent CHARLES A. SAVARIN President 30th April, 2021 ACT TO AMEND THE FORESTRY AND WILDLIFE ACT CHAP. 60:02. (Gazetted 4th May, 2021.) BE IT ENACTED by the Parliament of the Commonwealth of Dominica as follows: 1. This Act may be cited as the FORESTRY AND WILDLIFE (AMENDMENT) ACT, 2021. Short title. 13 LS 2021 FORESTRY AND WILDLIFE ACT 4 (AMENDMENT) 14 Interpretation. Ch. 60:02. Amendment of section 2 of the Act. 2. In this Act the Forestry and Wildlife Act is referred to as “the Act”. 3. Section 2 of the Act is amended by inserting the following new definition immediately after the definition of “director”: ““export” means (a) to take or cause to be taken outside the territorial waters of Dominica; (b) to load or cause to be loaded on a vessel or an aircraft;”. 4. Section 32 of the Act is repealed and replaced as follows: 32. No person shall export any live or dead wildlife or parts thereof cooked, frozen or processed, except with a permit issued by the Director in Form 5, and in accordance with conditions specified in the permit.”. 5. The Act is amended by inserting the following new section 60A immediately after section 60: 60A. A person who contravenes – (a) section 32 is liable on summary conviction to a fine of five thousand dollars; (b) section 33 is liable on summary conviction to a fine of two thousand five hundred dollars; (c) regulation 2(c) of the Ninth Schedule is liable on summary conviction to a fine of seven thousand five hundred dollars.”. Repeal and replacement of section 32 of the Act. “Exporting of wildlife. “Penalties for contravening sections 32, 33 and the Ninth Schedule. Insertion of new section 60A. 2021 FORESTRY AND WILDLIFE ACT 4 (AMENDMENT) 15 6. Section 63 of the Act is repealed and replaced by the following: 63. A person who contravenes – (a) section 62 (a) is liable on summary conviction to a fine of ten thousand dollars; (b) section 62 (b) is liable on summary conviction to a fine of twenty-five thousand dollars; (c) section 62 (c) or (d) is liable on summary conviction to a fine of five thousand dollars, and to imprisonment for three years.”. 7.
