Η Υφυπουργός Ναυτιλίας πάρα τω Προέδρω, ασκώντας τις εξουσίες που της παρέχονται δυνάμει του άρθρου 17(2) του περί της Διεθνούς Σύμβασης του Χονγκ Κονγκ για την Ασφαλή και Φιλική προς το Περιβάλλον Ανακύκλωση των Πλοίων και περί Συναφών Θεμάτων (Κυρωτικού) Νόμου του 2025, εκδίδει την ακόλουθη γνωστοποίηση: Συνοπτικός τίτλος. 1. Η παρούσα Γνωστοποίηση θα αναφέρεται ως η περί της Διεθνούς Σύμβασης του Χονγκ Κονγκ για την Ασφαλή και Φιλική προς το Περιβάλλον Ανακύκλωση των Πλοίων (Αρχική Έκδοση Διεθνούς Πιστοποιητικού Κατάστασης Απογραφής Επιβλαβών Υλικών) Γνωστοποίηση του 2026. Ερμηνεία. 2.-(1) Στην παρούσα Γνωστοποίηση: «Κανονισμός (ΕΕ) αριθ. 1257/2013» σημαίνει την πράξη της Ευρωπαϊκής Ένωσης με τίτλο «Κανονισμός (ΕΕ) αριθ. 1257/2013 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 20ής Νοεμβρίου 2013 για την ανακύκλωση πλοίων και την τροποποίηση του κανονισμού (ΕΚ) αριθ. 1013/2006 και της οδηγίας 2009/16/ΕΚ» όπως εκάστοτε τροποποιείται· «Νόμος» σημαίνει τον περί της Διεθνούς Σύμβασης του Χονγκ Κονγκ για την Ασφαλή και Φιλική προς το Περιβάλλον Ανακύκλωση των Πλοίων και περί Συναφών Θεμάτων (Κυρωτικό) Νόμο του 2025. «Πιστοποιητικό ΕΕ» σημαίνει το Πιστοποιητικό Καταλόγου Επικίνδυνων Υλικών που προβλέπεται στο άρθρο 9 του Κανονισμού (ΕΕ) αριθ. 1257/2013· «Πιστοποιητικό HKC» σημαίνει το Διεθνές Πιστοποιητικό Κατάστασης Απογραφής Επιβλαβών Υλικών που προβλέπεται από τον Κανονισμό 11 του Παραρτήματος της Διεθνούς Σύμβασης του Χονγκ Κονγκ για την Ασφαλή και Φιλική προς το Περιβάλλον Ανακύκλωση των Πλοίων· (2) Οποιοιδήποτε άλλοι όροι που περιέχονται στην παρούσα Γνωστοποίηση και δεν ορίζονται διαφορετικά, έχουν την έννοια που τους αποδίδει ο Νόμος. Αρχική έκδοση Διεθνούς Πιστοποιητικού Κατάστασης Απογραφής Επιβλαβών Υλικών χωρίς νέα επιθεώρηση. 3.-(1) Σύμφωνα με τις διατάξεις του εδαφίου (2) του άρθρου 17 του Νόμου, δύναται να εκδοθεί αρχικό Πιστοποιητικό HKC σε κυπριακό πλοίο που ήδη συμμορφώνεται με τον Κανονισμό (ΕΕ) αριθ. 1257/2013, χωρίς νέα επιθεώρηση, υπό την προϋπόθεση ότι πληρούνται οι ακόλουθες απαιτήσεις: (α) Το Πιστοποιητικό HKC θα εκδοθεί από τον Αναγνωρισμένο Οργανισμό που έχει διενεργήσει την επιθεώρηση του πλοίου και έχει εκδώσει το Πιστοποιητικό EE∙ (β) Πριν από την έκδοση του Πιστοποιητικού HKC, ο πλοιοκτήτης οφείλει να υποβάλει γραπτή δήλωση, υπογεγραμμένη από τον ίδιο ή εξουσιοδοτημένο εκπρόσωπό του, προς τον Αναγνωρισμένο Οργανισμό, στην οποία να επιβεβαιώνεται ότι: «Δεν έχει επέλθει οποιαδήποτε αλλαγή που να επηρεάζει την εγκυρότητα του Πιστοποιητικού EE, όπως καθορίζεται από το στοιχείο α) της παραγράφου 2 του άρθρου 10 του Κανονισμού (ΕΕ) αριθ. 1257/2013.» (2) Εφόσον ικανοποιηθούν οι απαιτήσεις της υποπαραγράφου (1) της παρούσας παραγράφου, ο Αναγνωρισμένος Οργανισμός εκδίδει Πιστοποιητικό HKC, το οποίο: (i) Φέρει την ίδια ημερομηνία λήξης με το Πιστοποιητικό ΕΕ, η οποία όμως δεν θα είναι μεταγενέστερη της ημερομηνίας που πρέπει να διεξαχθούν οι επόμενες εναρμονισμένες επιθεωρήσεις του πλοίου. (ii) Αναγράφει την ίδια ημερομηνία ολοκλήρωσης της επιθεώρησης που αναφέρεται στο Πιστοποιητικό ΕΕ. (iii) Εκδίδεται με τον μορφότυπο που καθορίζεται στο Παράρτημα. Έγινε στις 19 Ιανουαρίου 2026.
