[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In these Regulations, Act means The Natural Products Marketing Act, 1972 of Saskatchewan; (Loi) assembly yard means premises to which producers may deliver their hogs; (parc de groupage) assembly yard operator means the owner or operator of an assembly yard; (exploitant d’un parc de grou page) Commission means the Saskatchewan Hog Marketing Commission established pursuant to the Act and the Plan; (Commission) hog means any member of the species Sus Scrofa L. (do mestic pig) produced in Saskatchewan; (porc) order buyer means any person buying sows at a public auction in an assembly yard for the purpose of reselling to, or on behalf of another person; (courtier en truies) Plan means the Saskatchewan Hog Marketing Plan es tablished and amended from time to time pursuant to the Act; (Plan) 2 Dans le présent règlement, acheteur désigne une personne qui achète du porc dans la province, autre qu'un producteur, un transformateur, un consommateur ou un négociant en bétail titulaire d'un permis délivré en Saskatchewan, y compris un courtier en truies; (purchaser) camionneur désigne une personne qui s'adonne ordinai rement au commerce du transport du porc à l'aide d'un véhicule quelconque; (trucker) Commission désigne l'organisme dit Saskatchewan Hog Marketing Commission créé en vertu de la Loi et du Plan; (Commission) courtier en truies désigne une personne achetant des truies aux enchères publiques dans un parc de groupage pour les revendre à une autre personne ou en son nom; (order buyer) exploitant d'un parc de groupage désigne le proprié taire ou l'exploitant d'un parc de groupage; (assembly yard operator) Saskatchewan Hog Licensing (Interprovincial and Export) Regulations Règlement sur la délivrance de permis pour la commercialisation du porc de la Saskatchewan (marché interprovincial et commerce d’exportation) Interpretation Interprétation Sections 2-5 Articles 2-5 Current to November 21, 2016 2 À jour au 21 novembre 2016 processor means any person engaged in the business of processing hogs or using hogs in manufacturing; (trans formateur) producer means (a) any person engaged in producing or feeding hogs and making them available for slaughter and includes the employer of any such person, (b) any person who, under any lease or agreement is entitled to a share of the hogs produced or fed by a person referred to in paragraph (a), and (c) any person who takes possession of any hogs from any person under any form of security for a debt; (pro ducteur) purchaser means any person purchasing hogs in the province, other than a producer, a processor, a consumer or a livestock dealer licensed in Saskatchewan and in cludes an order buyer; (acheteur) trucker means a person who operates a vehicle for the transport of hogs on a continued commercial basis. (processor) Application Application 3 These Regulations apply only to the marketing of hogs in interprovincial and export trade and to persons and property situated in the Province of Saskatchewan. 3 Le présent règlement ne vise qu'à réglementer la com mercialisation du porc sur le marché interprovincial et dans le commerce d'exportation et ne s'applique qu'aux personnes et aux biens qui se trouvent dans la province de la Saskatchewan. Licensing Délivrance de permis 4 (1) No person shall act as a purchaser, a processor, an assembly yard operator or a trucker unless he holds a li cence issued by the Commission authorizing such an ac tion. 4 (1) Nul ne peut agir comme acheteur, transformateur, exploitant d'un parc de groupage ou camionneur à moins d'être titulaire d'un permis à cet effet délivré par la Com mission. (2) A licence referred to in subsection (1) shall expire on December 31st next following the day of issue. Requirements for Assembly Yards Exigences pour les parcs de groupage 7 No licence shall be issued to an assembly yard opera tor unless each assembly yard that he proposes to oper ate provides the following: (a) adequate protection from wind and sun; (b) a concrete floor; (c) bedding; (d) water readily available; (e) adequate pens; (f) adequate loading facilities during all weather con ditions; and (g) tattooing equipment capable of producing tattoos that are clearly legible. 7 L'exploitant d'un parc de groupage n'obtiendra de per mis que si le parc qu'il se propose d'exploiter répond aux exigences suivantes : a) bonne protection contre le vent et le soleil; b) plancher de ciment; c) litière; d) abreuvoirs accessibles aux porcs; e) cages convenables; f) installation permettant un chargement facile des animaux par toute température; et g) équipement de tatouage produisant une marque fa cilement lisible.
