[...] Inconsistencies in regulations (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subse quent amendment as registered by the Clerk of the Privy Council under the Statutory Instruments Act, the original regulation or amendment prevails to the extent of the inconsistency. This Order may be cited as the Prince Edward Is land Tobacco Order. 1. Le présent décret peut être cité sous le titre : Décret relatif au tabac de l’Île-du-Prince-Édouard. INTERPRETATION INTERPRÉTATION 2. In this Order, “Act” means the Prince Edward Island Natural Prod ucts Marketing Act; (Loi) “Board” means the Prince Edward Island Marketing Board; (Régie) “Commodity Board” means the Prince Edward Island Tobacco Commodity Marketing Board established pur suant to the Act; (Office de commercialisation) “Plan” means the Prince Edward Island Tobacco Com modity Marketing Plan established and amended from time to time pursuant to the Act and any regulations made pursuant to the Act to give effect to the Plan; (Plan) “tobacco” means unmanufactured flue-cured tobacco produced in the Province of Prince Edward Island. The Board and the Commodity Board are each au thorized to regulate the marketing of tobacco in inter provincial and export trade and for such purposes may, with respect to persons and property situated within the Province of Prince Edward Island, exercise all or any powers like the powers exercisable by each of them in 3. LEVIES CONTRIBUTIONS 4. The Commodity Board is authorized, (a) [Revoked, SOR/80-90] (b) in relation to the powers granted to it by section 3 with respect to the marketing of tobacco in inter provincial and export trade, to make orders fixing, imposing and collecting levies or charges from persons situated within the Province of Prince Edward Island engaged in the production or mar keting of tobacco and for such purpose classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in differ ent amounts, and to use such levies or charges for its purposes, including the creation of reserves, and the pay ment of expenses and losses resulting from the sale or disposal of tobacco, and the equalization or adjustment among producers of tobacco of moneys realized from the sale thereof during such period or periods of time as the Commodity Board may determine.
