[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In these Regulations, Act means the Pesticide Residue Compensation Act; (Loi) applicant means a farmer who makes an application de scribed in section 3. (Act) Certificate of Designation of Inspector Certificat de nomination d’un inspecteur 2.1 The certificate of designation furnished to an inspec tor shall be signed by the Deputy Minister of Agriculture, shall certify that the person named therein is an inspec tor for the purposes of the Act and shall show (a) his name; (b) the date of his designation; and (c) his signature and photograph. Application for Compensation Demande d’indemnité 3 Every application for compensation for loss occa sioned by reason of a pesticide residue shall contain 3 Toute demande d’indemnité pour perte occasionnée par des résidus de pesticide doit indiquer a) les nom et adresse de la personne qui la présente; Pesticide Residue Compensation Regulations Règlement sur l’indemnisation pour dommages causés par les pesticides Application for Compensation Demande d’indemnité Sections 3-5 Articles 3-5 Current to November 21, 2016 2 À jour au 21 novembre 2016 (a) the name and address of the person making the application; (b) the date of application; (c) the name of the agricultural product in respect of which the application is made; (d) the place where that agricultural product is usually sold; (e) the place where that agricultural product was pro duced; (f) the date and identification of the notice that the sale of that agricultural product would be contrary to the Food and Drugs Act or any regulations made thereunder; (g) the kind, quantity and stage of production or mar keting of that agricultural product; (h) the steps, if any, taken by the applicant to reduce the loss for which the compensation is claimed; (i) the steps, if any, taken to pursue any action in law against the manufacturer of the pesticide or against any person whose act or omission resulted in or con tributed to the presence of the pesticide residue in or upon that agricultural product; and (j) such other information as the Minister may re quire. b) la date de la demande; c) le nom du produit agricole qui fait l’objet de la de mande; d) le lieu où se trouve le marché habituel de ce pro duit agricole; e) le lieu de production de ce produit agricole; f) la date et la référence que porte l’avis indiquant que la vente de ce produit agricole serait contraire aux dis positions de la Loi des aliments et drogues ou de son règlement d’application; g) la nature, la quantité et le stade de production ou de commercialisation du produit agricole; h) les mesures que le demandeur a prises, s’il en est, en vue de réduire la perte qui fait l’objet de sa de mande d’indemnité; i) les mesures prises, s’il en est, en vue de poursuivre en justice le fabricant du pesticide ou toute personne dont l’action ou l’omission a entraîné ou contribué à entraîner la présence de résidus de pesticide dans ou sur le produit agricole; et j) tout autre renseignement que peut demander le mi nistre. Compensation Indemnisation 4 Where an application has been filed with the Minister, the Minister may pay compensation to the applicant to a maximum of 80 per cent of the monetary value of the agricultural product in respect of which the application is made, which value shall be determined in accordance with section 5. 4 Lorsqu’une demande a été déposée auprès du mi nistre, ce dernier peut payer au demandeur une indemni té maximale de 80 pour cent de la valeur monétaire du produit agricole qui fait l’objet de la demande, cette va leur devant être déterminée conformément à l’article 5. 5 (1) For the purposes of section 4, where the agricultur al product in respect of which an application is made is ready for sale at the place where it is usually sold by the applicant, the monetary value of the agricultural product shall be deemed to be the market value that the product would have had if it had been sold at the place where it is usually sold on the date of the notice referred to in para graph 3(f). 5 (1) Aux fins de l’application de l’article 4, lorsque le produit agricole qui fait l’objet d’une demande est prêt pour la vente sur le marché où le demandeur le vend ha bituellement, la valeur monétaire du produit agricole est censée être la valeur marchande que le produit aurait eue s’il avait été vendu sur le marché où il se vend habituelle ment, à la date de l’avis mentionné à l’alinéa 3f). Reduction of Loss Réduction du chiffre de la perte 7 The Minister shall not undertake any course of action to reduce loss occasioned by pesticide residue if, in his opinion, the expenditure for such action together with the compensation payable to the applicant would be greater than the compensation payable under section 4 if no course of action to reduce loss were undertaken. 7 Le ministre ne prendra aucune mesure pour réduire le chiffre d’une perte occasionnée par des résidus de pesti cide si, à son avis, le montant que représente le coût de cette mesure ajouté à l’indemnité à verser au demandeur est supérieur à l’indemnité payable en vertu de l’article 4 si aucune mesure n’était prise.
