[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In these Regulations, appointed shipper means a shipper in possession of a valid and subsisting certificate of appointment issued by the Commodity Board pursuant to the Ontario Green house Vegetable Appointed Shippers’ Procedures (Inter provincial and Export) Regulations; (expéditeur dési gné) Commodity Board means The Ontario Greenhouse Veg etable Producers’ Marketing Board; (Office de commer cialisation) greenhouse vegetables means tomatoes, cucumbers and lettuce produced in the Province of Ontario in a greenhouse or any other enclosure under glass, plastic or other material used for the purpose of controlling tem perature and providing protection for growing plants; (légumes de serre) producer means a person engaged in the production of greenhouse vegetables; (producteur) product means any quantity of greenhouse vegetables; (produit) 2 Dans le présent règlement, détaillant désigne toute personne qui vend ou offre de vendre un produit directement à un consommateur et comprend l’exploitant d’un étalage routier; (retailer) expéditeur désigne toute personne qui offre de vendre, vend, reçoit, groupe, emballe, expédie pour la vente ou transporte un produit mais ne comprend pas a) une personne qui conduit, à titre d’employé, un vé hicule appartenant à un producteur ou à un expédi teur désigné, b) une société ferroviaire, ou c) une personne qui transporte le produit par véhicule automobile à titre d’agent du producteur; (shipper) expéditeur désigné désigne un expéditeur titulaire d’un certificat de désignation valide délivré par l’Office de commercialisation en vertu du Règlement sur les procé dures relatives aux expéditeurs de légumes de serre de l’Ontario (marché interprovincial et commerce d’expor tation); (appointed shipper) Ontario Greenhouse Vegetable Marketing (Interprovincial and Export) Regulations Règlement sur la commercialisation des légumes de serre de l’Ontario (marché inter provincial et commerce d’exportation) Interpretation Interprétation Sections 2-5 Articles 2-5 Current to November 21, 2016 2 À jour au 21 novembre 2016 retailer means any person who sells or offers to sell a product directly to the consumer and includes the opera tor of a roadside stand; (détaillant) shipper means any person who offers for sale, sells, re ceives, assembles, packs, ships for sale or transports a product but does not include (a) a servant employed by and driving a vehicle owned by a producer or an appointed shipper, (b) a railway company, or (c) a person who transports the product by motor ve hicle as agent of the producer; (expéditeur) wholesaler means a person who buys a product through the Commodity Board and who offers for sale or sells the product to a retailer. (product) Application Application 3 These Regulations apply only to (a) the marketing of a product in interprovincial and export trade; (b) persons and property situated in the Province of Ontario; and (c) a product produced in the Counties of Essex, Kent and Lambton in the Province of Ontario. 3 Le présent règlement ne s’applique a) qu’à la commercialisation d’un produit sur le mar ché interprovincial et dans le commerce d’exportation; b) qu’aux personnes et aux biens situés dans la pro vince d’Ontario; et c) qu’aux légumes de serre produits dans les comtés d’Essex, de Kent et de Lambton dans la province d’On tario. (2) A licence issued pursuant to subsection (1) shall ex pire on December 31st of the year for which the licence is issued.
