Exemptions Exemptions Yogurt Yogourt 2 (1) Yogurt — except drinkable yogurt — that is made from dairy products is exempt from the application of paragraphs 4(1)(a) and (d) of the Food and Drugs Act and section D.03.002 of the Food and Drug Regulations, in respect of the vitamin D that is present in the food, if the applicable condition in subsection (2) is met. 2 (1) Le yogourt — sauf le yogourt à boire — fait de pro duits laitiers est soustrait à l’application des alinéas 4(1)a) et d) de la Loi sur les aliments et drogues et de l’article D.03.002 du Règlement sur les aliments et drogues en ce qui concerne la vitamine D présente dans cet aliment, si la condition applicable prévue au para graphe (2) est respectée. Condition Condition (2) The food must contain the following amount of vita min D: (a) in the case of plain yogurt, 5 μg of vitamin D per 100 g; or (b) in the case of fruit or flavoured yogurt, not less than 3.8 μg and not more than 5 μg of vitamin D per 100 g. (2) L’aliment contient la quantité de vitamine D sui vante : a) s’agissant de yogourt nature, 5 μg de vitamine D par 100 g; b) s’agissant de yogourt aux fruits ou aromatisé, au moins 3,8 μg et au plus 5 μg de vitamine D par 100 g. Marketing Authorization for Vitamin D in Yogurt and Kefir Autorisation de mise en marché de la vitamine D dans le yogourt et le kéfir Exemptions Exemptions Sections 4-5 Articles 4-5 Current to June 19, 2024 2 À jour au 19 juin 2024 Kefir Kéfir 4 (1) Kefir that is made from dairy products is exempt from the application of paragraphs 4(1)(a) and (d) of the Food and Drugs Act and section D.03.002 of the Food and Drug Regulations, in respect of the vitamin D that is present in the food, if the applicable condition set out in subsection (2) is met. 4 (1) Le kéfir fait de produits laitiers est soustrait à l’ap plication des alinéas 4(1)a) et d) de la Loi sur les aliments et drogues et de l’article D.03.002 du Règlement sur les aliments et drogues en ce qui concerne la vitamine D présente dans cet aliment, si la condition applicable pré vue au paragraphe (2) est respectée. Condition Condition (2) The food must contain the following amount of vita min D: (a) in the case of plain kefir, 2.7 μg of vitamin D per 100 mL; or (b) in the case of fruit or flavoured kefir, not less than 2.3 μg and not more than 2.7 μg of vitamin D per 100 mL. (2) L’aliment contient la quantité de vitamine D sui vante : a) s’agissant de kéfir nature, 2,7 μg de vitamine D par 100 mL; b) s’agissant de kéfir aux fruits ou aromatisé, au moins 2,3 μg et au plus 2,7 μg de vitamine D par 100 mL. Coming into Force Entrée en vigueur Registration Enregistrement 5 This Marketing Authorization comes into force on the day on which it is registered. 5 La présente autorisation entre en vigueur à la date de son enregistrement.
