this Act, Les définitions qui suivent s’appliquent à la présente loi. “applicant” means an individual or corporation who has made an application; « demandeur » “application” means an application to purchase or lease Yukon lands or to obtain a right-of-way or easement with respect to those lands; « demande » “corporation” means a corporation incorporated or registered in the Yukon and includes a society incorporated under the Societies Act; « personne morale » “disposition” means a sale or lease of Yukon lands or a grant of right-of-way or easement with respect to those lands; « aliénation » “notification” means a direction issued to a registrar of land titles directing them to issue a certificate of title to a person named in the direction in respect of Yukon lands described therein; « notification » “reserved lands” means Yukon lands that have been withdrawn from disposition; « terres réservées » “Yukon lands” means properties to which this Act applies. « terres du Yukon » « Application of the Act 2 Champ d’application de la Loi (1) This Act applies with respect to all properties in the Yukon that are vested in His Majesty in right of Canada but the right to the beneficial use or to the proceeds of which is appropriated to the Government of the Yukon and is subject to the control of the Legislature, other than (1) La présente loi s’applique à tous les biens (2) Nothing in this Act shall be construed as limiting the operation of the Yukon Quartz Mining Act (Canada), the Yukon Placer Mining Act (Canada) or the Dominion Water Power Act (Canada) and every disposition of Yukon lands is subject to the provisions of sections 9, 12 to 16, and paragraph 23(j) of the Territorial Lands Act (Canada). (4) If an interest has already been granted in the lands and still subsists when the order is made under subsection (3), that interest continues unaffected by the order and shall be respected and administered as if the order had not been made. [S.Y. 2002, c. 132, s. 5] [L.Y. 2002, ch. 132, art. 5] 6 Requirement for execution of documents (Exigences applicables à la passat ion des documents) 6 Requirement for execution of documents 6 Exigences applicables à la passation des documents (1) Subject to subsection (2), no person may acquire any interest in or with respect to any Yukon lands until the transfer, notification, lease, or grant of right-of-way or easement in respect of the lands is executed by the person and in the manner prescribed, and no person seeking a disposition of Yukon lands has any cause of action with respect to any negotiations, arrangements, or agreements carried on or entered into by the Minister or on the Minister’s behalf with respect to Yukon lands before that execution. (2) If a person has entered into an agreement for sale with the Minister with respect to Yukon lands and has complied with the terms and conditions of the agreement and with the provisions of this Act and the regulations, the person is entitled to a transfer of those lands. (2) Every application made pursuant to subsection (1) shall be accompanied by any evidence that is prescribed to show that the applicant is eligible to obtain a disposition of Yukon lands and, when a survey of those lands exists, by a copy of that survey.
