Definitions Définitions 2 The following definitions apply in this Regulation. 2 Les définitions qui suivent s’appliquent au présent règlement. “Act” means the Agricultural Producers Registration and Farm Organizations Funding Act. (Loi) “appeal board” means the appeal board established under subsection 16(4) of the Act. (Act) Application for registration and renewal of registration of farm businesses Demande d’enregistrement d’entreprises agricoles et renouvellement 3(1) An application to register a farming operation as a farm business or to renew the registration of a farming operation as a farm business shall contain the following information: 3(1) La demande d’enregistrement d’une exploitation agricole en tant qu’entreprise agricole ou de renouvelle‐ ment d’enregistrement d’une exploitation agricole en tant qu’entreprise agricole comprend les renseignements suivants : (a) the name, address, telephone number, fax num‐ ber and e-mail address of the farming operation; a) le nom, l’adresse, le numéro de téléphone, le nu‐ méro de télécopieur et l’adresse de courrier électroni‐ que de l’exploitation agricole; (b) the form of business organization that is used in carrying on the farming operation; b) la forme d’organisation commerciale de l’exploi‐ tation agricole; (c) if an individual carries on a farming operation, the name, address, telephone number, fax number and e-mail address of the individual; c) dans le cas où l’exploitant agricole est un particu‐ lier, son nom, son adresse, son numéro de téléphone, son numéro de télécopieur et son adresse de courrier électronique; (d) if a partnership carries on a farming operation, the name, address, telephone number, fax number and e-mail address of the partner acting as the partner‐ ship’s representative for the filing of the application; d) dans le cas où l’exploitant agricole est une socié‐ té en nom collectif, le nom, l’adresse, le numéro de té‐ léphone, le numéro de télécopieur et l’adresse de courrier électronique de l’associé agissant à titre de représentant de la société pour le dépôt de la de‐ mande; 2007-70 Loi sur l’enregistrement des producteurs agricoles et le financement des organismes agricoles 2011, ch. 108 2 (e) if a corporation carries on a farming operation, the name, address, telephone number, fax number and e-mail address of the officer acting as the corpora‐ tion’s representative for the filing of the application; e) dans le cas où l’exploitant agricole est une corpo‐ ration, le nom, l’adresse, le numéro de téléphone, le numéro de télécopieur et l’adresse de courrier électro‐ nique du dirigeant agissant à titre de représentant de la corporation pour le dépôt de la demande; (f) the type of farming activity performed by the farming operation; f) les activités agricoles exercées par l’exploitation agricole; (g) the approximate annual gross income of the farming operation with reference to the income ranges specified in the form provided by the Registrar; g) le revenu brut annuel approximatif de l’exploita‐ tion agricole d’après les tranches de revenus indiquées dans la formule fournie par le registraire; (h) the method of payment of fees referred to in subsection (2); h) le mode de paiement des droits visés au paragra‐ phe (2); (i) the option for the person who carries on a farm‐ ing operation to seek membership in an accredited farm organization; i) l’option pour l’exploitant agricole de devenir membre ou non d’un organisme agricole agréé; (j) the list of accredited farm organizations with whom the person who carries on a farming operation may seek membership; and j) la liste des organismes agricoles agréés avec les‐ quels l’exploitant agricole peut devenir membre; (k) a statement by the person who carries on a farm‐ ing operation or the representative of the farming op‐ eration certifying the following: k) une déclaration dans laquelle l’exploitant agri‐ cole ou son représentant atteste ce qui suit : (i) the information contained in the application is complete and accurate; and (i) les renseignements figurant dans la demande sont complets et exacts; (ii) the person who carries on a farming operation or the representative of the farming operation un‐ derstands that it is an offence to make a false state‐ ment in the application. Organization deemed to be accredited farm organization Organisme réputé être un organisme agricole agréé 8 The company incorporated under the corporate name of The Agricultural Alliance of New Brunswick/L’Alli‐ ance agricole du Nouveau-Brunswick Inc. is deemed to be an accredited farm organization for the purposes of section 12 of the Act. 8 La compagnie constituée en corporation sous la rai‐ son sociale de The Agricultural Alliance of New Brunswick/ L’Alliance agricole du Nouveau-Brunswick Inc. est réputée être un organisme agricole agréé aux fins d’application de l’article 12 de la Loi.
