Fish Transportation Loadslip Regulation (Man. Reg.152/94)

Fish Transportation Loadslip Regulation Règlement sur la formule de transport du poisson Regulation 152/94 Registered August 3, 1994 Règlement 152/94 Date d'enregistrement : le 3 août 1994 Definition 1 In this regulation, "loadslip" means the fish transportation loadslip set out in the Schedule. Form of loadslip 2 For the purpose of this regulation, the minister shall issue to persons who transport fish in the province the loadslip form that is set out in the Schedule. Loadslip required 3(1) Subject to section 4, no person shall transport fish in the province unless the fish is accompanied by a loadslip that complies with the requirements of this section and contains all of the information indicated on the form. R.M. 111/2002 3(6) A person who uses a loadslip shall leave a copy of the loadslip with the person to whom the fish was delivered. R.M. 153/2003 Exceptions 4 A loadslip is not required for any of the following: (a) fish caught under the authority of a licence to fish for commercial purposes issued under the Fishing Licensing Regulation if the fish were transported by the commercial fisherman from the landing location specified on the licence (i) to an agency of the corporation, at the address specified on the licence, in a form acceptable to the agency, or (ii) to the licensed commercial fisherman's private packing shed, at the address specified on the licence; (b) fish lawfully purchased by a consumer from a retailer or a producer and accompanied by the appropriate receipt; (c) fish caught by recreational fishing under the authority of the Fishing Licensing Regulation in an amount not exceeding possession limits as specified by the Manitoba Fishery Regulations, 1987 (Canada); Exceptions 4 Les formules ne sont pas nécessaires dans les cas suivants : a) le poisson est pris en vertu d'un permis de pêche commerciale délivré en application du Règlement sur les permis de pêche, il a été débarqué à l'endroit indiqué sur le permis et il a été transporté par un pêcheur commercial depuis cet endroit : (i) jusqu'au plus proche organisme de l'Office dont l'adresse est indiquée sur le permis, en la forme que l'organisme estime acceptable, (ii) jusqu'au hangar d'emballage privé du pêcheur commercial titulaire du permis dont l'adresse est indiquée sur le permis; b) le poisson est acheté légalement d'un détaillant ou d'un producteur par un consommateur muni du reçu approprié; c) le poisson est pris en conformité avec les dispositions du Règlement sur les permis de pêche en ce qui a trait à la pêche récréative et la quantité de poisson n'excède pas les limites de possession que prévoit le Règlement de pêche du Manitoba de 1987 (Canada); PÊCHE F90 — R.M. 152/94 03/05 3 (d) fish caught under the authority of a general fishing permit issued under the Manitoba Fishery Regulations, 1987 (Canada) or the Fishing Licensing Regulation and transported from the place where the fish were landed directly to that person's residence at the address specified on the permit; (e) fish caught by a person who is an Indian as defined by the Indian Act (Canada) as food for personal or family consumption, and transported directly from the place where the fish were landed to that person's nearest residence; (f) fish transported under the authority of (i) a bill of lading, shipping advice or other similar document issued by the corporation, or (ii) a licence or permit issued under the Fisheries Act (Canada) or its regulations.
