Current to April 21, 2020 iii À jour au 21 avril 2020 TABLE OF PROVISIONS TABLE ANALYTIQUE An Act respecting the Caughnawaga Indian Reserve and to amend the Indian Act Loi concernant la réserve de Caughnawaga et modifiant la Loi des Indiens 1 Acts and proceedings validated 1 Validation d’actes et procédures Current to April 21, 2020 1 À jour au 21 avril 2020 S.C. 1934, c. 29 S.C. 1934, ch. 29 An Act respecting the Caughnawaga Indian Reserve and to amend the Indian Act Loi concernant la réserve de Caughnawaga et modifiant la Loi des Indiens [Assented to 28th June 1934] [Sanctionnée le 28 juin 1934] Preamble R.S., 1886, c. 44; R.S., 1927, c. 98 R.S., 1886, c. 43 Préambule S.R., 1886, ch. 44; S.R., 1927, ch. 98 S.R., 1886, ch. 43 WHEREAS by Order in Council of the fifth March, 1889 (P.C. 466), the provisions of The Indian Ad vancement Act, being chapter forty-four of the Re vised Statutes of Canada, 1886, were applied to the Iroquois Indians of Caughnawaga in the province of Quebec, and, for the purpose of giving effect to the application of the said Act, the reserve at Caugh nawaga was designated the Caughnawaga Indian Re serve, and was divided into six sections, as therein set out; and whereas by Order in Council of the 12th July, 1906 (P.C. 1419), in the purported exercise of the powers conferred by section four of The Indian Advancement Act, as enacted by section one of chap ter thirty of the statutes of 1890, it was provided that the division of the Caughnawaga Indian Reserve into sections be done away with, and that the said reserve be comprised in one section; and whereas it appears that there was no provision of The Indian Act or of any other statute authorizing the making of the last mentioned Order in Council, and that the same was and is, therefore, void and of no effect; and whereas it is expedient that anything duly done or suffered pursuant to the provisions of the said last mentioned Order in Council be validated, and that provision be made for again dividing the reserve into six sections: Therefore His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows: CONSIDÉRANT que, par arrêté en conseil du cin quième jour de mars 1889 (C.P. 466), les dispositions de l'Acte de l’avancement des Sauvages, chapitre quarante-quatre des Statuts revisés du Canada, 1886, ont été appliquées aux Indiens iroquois de Caughna waga, province de Québec, et que, pour donner effet à l’application dudit Acte, la réserve de Caughnawa ga a reçu la désignation de Réserve indienne de Caughnawaga et été divisée en six arrondissements y indiqués; considérant que, par arrêté en conseil du douzième jour de juillet 1906 (C.P. 1419), dans l’exer‐ cice voulu des pouvoirs conférés par l’article quatre de l'Acte de l’avancement des Sauvages, tel qu’édicté par l’article premier du chapitre trente du Statut de 1890, il a été prescrit d’abolir la division de la Réserve indienne de Caughnawaga en arrondissements et de renfermer ladite réserve en un seul arrondissement; considérant qu’il ne semble avoir existé aucune dis position de l'Acte des Sauvages ou de quelque autre statut autorisant l’établissement de l’arrêté en conseil en dernier lieu mentionné et que celui-ci est, en conséquence, nul et sans effet; et considérant qu’il est opportun que soit validée toute chose régulière ment accomplie ou subie conformément aux disposi tions de l’arrêté en conseil en dernier lieu mentionné et qu’il soit de nouveau pourvu à la division de la ré serve en six arrondissements : À ces causes, Sa Ma‐ jesté, sur l’avis et du consentement du Sénat et de la Chambre des communes du Canada, décrète : Caughnawaga Indian Reserve Réserve de Caughnawaga Sections 1-2 Articles 1-2 Current to April 21, 2020 2 À jour au 21 avril 2020 Acts and proceedings validated Validation d’actes et procédures 1 All acts committed, proceedings taken or things done or suffered under or pursuant to the provisions of the said Order in Council of the 12th July, 1906 (P.C. 1419), are hereby declared to have been valid and effective to all intents and purposes as if the said Order in Council had been lawfully made. 1 Tous actes commis, toutes procédures prises ou choses accomplies ou subies sous le régime ou en conformité des dispositions dudit arrêté en conseil du douzième jour de juillet 1906 (C.P. 1419) sont, par les présentes, déclarés avoir été valides et exécutoires, à tous égards, comme si cet arrêté en conseil eût été légalement édicté. 2 [Amendment to another Act] 2 [Modification à une autre loi]
