Authorizations Autorisations Required information and documents Renseignements et documents à fournir 2 (1) The Minister may, on application, issue the autho rization referred to in paragraph 34.4(2)(b) or 35(2)(b) of the Act. The application must be made to the Minister in writing and include (a) the information and documents set out in Sched ule 1; and (b) an irrevocable letter of credit issued by a recog nized Canadian financial institution, or another equiv alent financial guarantee, including a performance bond, to cover the costs of implementing the plan re ferred to in section 16 of Schedule 1. 2 (1) Le ministre peut, sur demande, délivrer l’autorisa tion visée aux alinéas 34.4(2)b) ou 35(2)b) de la Loi. Confirmation of receipt Accusé de réception (2) The Minister must, on receipt of an application, send to the applicant a confirmation of receipt that indicates the date of receipt. The request must be submit ted to the Minister in writing and include (a) the file numbers indicated on the original autho rization; (b) the requested cancellation date; (c) the reason for requesting the cancellation; and (d) a detailed description of the likely effects of the cancellation on fish and fish habitat. 7 Le titulaire de toute autorisation peut demander au ministre de la révoquer. Amendment, suspension or cancellation by Minister Modification, suspension ou révocation par le ministre 9 (1) The Minister may, on the Minister’s own initiative, amend or suspend, in whole or in part, or cancel any au thorization if (a) the Minister has reasonable grounds to believe that the conditions established by the Minister in the authorization have not been or will not be met; (b) the Minister has reasonable grounds to believe that the authorization was obtained by fraudulent or improper means or by the misrepresentation of a ma terial fact; (c) the Minister becomes aware of new information that demonstrates that the death of fish or the harmful alteration, disruption or destruction of fish habitat is or will be significantly greater than anticipated by the Minister at the time of issuance of the authorization; or (d) the authorization holder has not paid a fine im posed on them under the Act. 9 (1) Le ministre peut, de son propre chef, modifier ou suspendre, en tout ou en partie, ou révoquer toute autori sation dans les cas suivants : a) il a des motifs raisonnables de croire que les condi tions qu’il a fixées dans l’autorisation ne sont pas ou ne seront pas respectées; b) il a des motifs raisonnables de croire que l’autori sation a été obtenue de façon frauduleuse ou irrégu lière ou par suite d’une fausse déclaration sur un fait important; c) il a pris connaissance de nouveaux renseignements démontrant que la mort du poisson ou la détériora tion, la destruction ou la perturbation de son habitat est ou sera significativement plus importante qu’envi sagé par le ministre au moment de la délivrance de l’autorisation; d) le titulaire n’a pas payé l’amende qui lui a été impo sée en application de la Loi. Suspension in urgent situations Suspension en cas d’urgence (3) Despite subsection (2), the Minister may suspend an authorization, in whole or in part, without giving the au thorization holder an opportunity to make written repre sentations if the suspension is required to prevent the imminent death of fish or the imminent harmful alter ation, disruption or destruction of fish habitat. Notice of amendment, suspension or cancellation Avis de modification, suspension ou révocation (4) If the authorization is amended or suspended, in whole or in part, or cancelled by the Minister, the Minis ter must notify the authorization holder in writing of the amendment, suspension or cancellation, its effective date and, in the case of a suspension, the duration. Reinstatement of authorization Rétablissement d’une autorisation (5) The Minister may reinstate the authorization at the expiry of the period indicated in the notice of suspension or, on written request, at any time during the suspension if the matter that gave rise to the suspension has been re solved or corrected. The Minister may require the autho rization holder to submit a request for amendment in or der to reinstate the authorization.
