A-9.2 Loi sur l’aquaculture 2 Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol lows: Sa Majesté, sur l’avis et du consentement de l’Assem blée législative du Nouveau-Brunswick, décrète : 1(1) In this Act 1(1) Dans la présente loi “aquacultural produce” means aquatic plants and ani mals raised or being raised by aquaculture; “aquaculture” means the cultivation of aquatic plants and animals, but does not include the cultivation of aquatic plants and animals in a laboratory for experimental pur poses or in an aquarium; “aquaculture lease” means a lease issued under sec tion 25; “aquaculture licence” means an aquaculture licence is sued under section 6, and includes a renewal or an amend ment of such a licence; “aquaculture occupation permit” means an aquaculture occupation permit issued under section 26; “aquaculture site” means a site, specified in an aqua culture licence, at which aquaculture is to be carried on, is carried on or was carried on; “aquatic plants and animals” means plants and animals that have water as their natural habitats at all stages of their life cycles; “designated aquaculture land” means land under the administration and control of the Minister that has been designated by the Minister under section 24 as aquaculture land; “fallow period” means a period of time during which aquacultural produce shall not be present and aquaculture shall not be carried on at an aquaculture site; “inspector” means a person appointed as an inspector under section 40; “land” includes land covered by water and the water column superjacent to land; “lessee” means the holder of an aquaculture lease; “licensee” means the holder of an aquaculture licence; « aquaculture » désigne la culture des plantes et ani maux aquatiques mais ne s’entend pas de la culture des plantes et animaux aquatiques dans un laboratoire pour fins expérimentales ou dans un aquarium; « autorisation d’occupation aquacole » désigne une au torisation d’occupation aquacole délivrée en vertu de l’ar ticle 26; « bail aquacole » désigne un bail délivré en vertu de l’article 25; « eau » s’entend également de l’eau douce, de l’eau saumâtre et de l’eau de mer provenant des marées ou non; « inspecteur » désigne une personne nommée au poste d’inspecteur en vertu de l’article 40; « Ministre » désigne le ministre de l’Agriculture, de l’Aquaculture et des Pêches et s’entend également de ses représentants qu’il désigne; « mise en jachère » désigne une période durant laquelle l’aquaculture n’est pas pratiquée à un site aquacole et qu’aucun produit aquacole n’y est présent; « permis d’aquaculture » désigne un permis d’aquacul ture délivré en vertu de l’article 6 et s’entend également d’un renouvellement ou d’une modification de ce permis; « personne » s’entend également d’une association coo pérative constituée en corporation en vertu de ou assujettie à la Loi sur les associations coopératives; « plantes et animaux aquatiques » désigne des plantes et des animaux qui ont l’eau comme leurs habitats naturels durant toutes les phases de leurs cycles de vie; « preneur à bail » désigne le détenteur d’un bail aqua cole; « prescrit » désigne prescrit par règlements; « produit aquacole » désigne les plantes et animaux aquatiques élevés ou étant élevés en aquaculture; Aquaculture Act Chap.
